Chief of Police Mark Dalsing recommends City Council approval of the Fiscal Year
2019/2020 School Resource Officer Agreement with the Dubuque Community School
District and recommends acceptance of the School District's financial support of
$278,542, retroactive to the start of the 2019/2020 school year.

INTRODUCTION:
The purpose of this memorandum is to seek approval of the FY 2019/2020 School
Resource Officer agreement between the City of Dubuque Police Department and the
Dubuque Community School District.
BAC KG RO U N D:
The police department and the Dubuque Community Schools continue to work closely in
providing a strong relationship between the school and police through the Dubuque Police
School Resource Officer (SRO) program. Currently the police department dedicates four
full-time police officers to the Dubuque Community School District throughout the school
year.
DISCUSSION:
The purpose of the agreement is to define the role of the police department in providing
school resource officer services to the elementary, junior high and senior high schools.
Additionally the agreement outlines the financial support from the Dubuque Community
Schools to the City of Dubuque for SRO services. This year's contract reflects the
beginning of the SRO Expansion Project, which begins in the 2019-2020 school year. The
Dubuque Community School District provides financial support to the City for 50% of the
salary of four SRO officers, 45% of 50% of one Corporal, and 45% of 50%, less the school
districYs contribution for a DARE Officer, in the amount of$278,542. The contract review
process begins in late July or early August for the current school year. The City Legal
Department and the Police Department have reviewed the agreement and concur with the
requirements.
RECOMMEN DATION:
We recommend approval of the attached agreement between the City of Dubuque and
Dubuque Community Schools for the 2019/2020 school term, and accept the school
districYs financial support of$278,542, retroactive to the start of the 2019/2020 school year.

AGREEMENT

AND
DUBUQUE COMMUNITY SCHOOL DISTRICT
FOR
SCHOOL RESOURCE OFFICERS
FOR
SCHOOL YEAR 2019-2020
This Agreement, dated for reference purposes the 14th day of October, 2019, is
made and entered into by and between the City of Dubuque, through its Police
Department (City) and the Dubuque Community School District (School District).
WHEREAS, School District and City have a strong desire and commitment to
continue the services of the School Resource Officers (SRO); and
WHEREAS, it is necessary to define the roles of the parties in providing such
services to the elementary, middle, and senior high schools.
NOW, THEREFORE, it is agreed by and between the parties as foliows:
SECTION 1. ROLE OF SRO.
1.1 Five (5) SRO will be assigned by City to School District, SRO will, at he sole
direction of the Chief of Police:
(a) Act as liaison between the Iaw enforcement community and the School
District;
(b) Maintain campus awareness, identify imminent problems, and serve as
safety consultants for the School District;
(c) Visit classrooms;
(d) Make presentations and answer questions;
(e) Instruct DARE. (Drug Abuse Resistance Education Cooperative
Program) curriculum;
(f) Inform school officials and staff of current police involvement with students
and/or student's families;
(g) Investigate appropriate cases involving students as victims or suspects
except those cases handled by a specialized unit;

(h) Assist with prevention patrol for students en route to and from school;
(1) Take appropriate action with respect to on-site occurrences, including but
not limited to, fights, vandalism, theft, accidents', traffic violations, disorderly
conduct, narcotics offenses, weapons, unauthorized persons on school property,
and other occurrences as appropriate;
(J)
Assist with in -servicing other School District security staff;
(k) Interact with patrol and investigative divisions on matters of mutual
concern, including but not limited to, indecent exposure, gang activity, traffic
hazards, sex offenses, suspicious persons, and other matters as appropriate;
(I) Attend School District staff and faculty meetings and training sessions
when requested;
) Act as a resource person to School District staff;
(n) Attend School District sponsored extra -curricular activities when
requested;
(o) Interact with students to prote and reinforce basic life skills, self-control,
and accountability;
(p)
Maintain confidential records on student contacts;.
(q) Maintain working knowledge of Dubuque Community School Board
policies, School District Administrative Regulations and Student Handbooks; and
(r) Conduct other duties as approved or assigned by the Chief of Police.
1.2 The hours and work day of SRO will be determined by the Chief of Police based
on School District building schedules and extra -curricular activities. Uniforms will be
worn at the discretion of SRO and the Chief of Police.

Personnel and Support costs reflecta planned expansion of the School Resource
Officer 'program. SRO #6 and Initial Training funding is in support of the next SRO
position, which will be filled in fiscal year 2020. Beck and Fullmer are existing positions
which will eventually be funded at 50%. Position equipment is specific to the SRO
position, and support costs includes personal equipment and transportation costs.
Ongoing training funds supports training for all existing SRO positions.
School District will pay to City fifty percent (50%) of the salary of four (4) SRO's, forty-
five percent (45%) of fifty percent (50%) of the SRO Supervisor, forty-five percent (45%)
of fifty percent (50%) of the DARE SRO Officer, and fifty percent (50%) of Additional
Support costs, in the total amount of Two Hundred Seventy Eight Thousand, Five
Hundred Forty Two dollars ($278,542), payable as follows:
(a) City will invoice to School District by November 15, 2019.
School District payment to City by December 15, 2019.
Amount due is 50% of the Agreement ($139,271)
(b) City will invoice to School District by March 15, 2020.
School District payment to City by April 15, 2020.
Amount due is 50% of the Agreement ($139,271)
SECTION 3. TERMINATION. School District or City may cancel this Agreement by
giving the other party not less than thirty (30) days written notice of intent to cancel.
However, under emergency or exigent circumstances, either party may cancel this
Agreement by giving the other party not less than ten (10) days written notice.
SECTION 4, TERM. The term of this Agreement is from August 19, 2019, through
June 15, 2020.
SECTION 5, APPLICABLE LAWS. City and School District will not engage in
discriminatory hiring or any other employment practices that conflict with any local,
state, or federal laws.
SECTION 6. INSURANCE AND INDEMNIFICATION.
6.1 City must maintain its membership in the Iowa Communities Assurance Pool and
add School District as an Additional Member. If City discontinues its membership in
ICAP, City must provide proof of a policy of commercial general liability form coverage
in the amount of $2,000,000, naming School District as an additional insured on a
primary and non-contributory basis.
6.2 School District must provide proof of a policy of commercial general liability form
coverage in the amount of S2,000,000, naming City as an additional insured on a
primary and non-contributory basis.
6.3 City will indemnify and hold School District, its staff, and students harmless from
and against any and ail claims, liability, and causes of action arising from or related to
City's negligence in the performance of this agreement and the negligence by City
officers, agents, or employees.
6.4 School District will indemnify and hold City, its staff, employees, and agents
harmless from and against any and all claims, liability, and causes of action arising from
or related to School District's negligence in the performance of this Agreement and the
negligence by School District's officers, agents, students or employees.

review in the absence of textual change other than adjustment of dates and agreed
compensation.
