SUBJECT: DICW — McFadden Farm Grading Phase I DATE: November 12, 2019 INTRODUCTION The enclosed resolution provides for the acceptance of the construction contract for the DICW — McFadden Farm Grading Phase I. BACKGROUND In July of 2014, the City purchased 36.5 acres of property from McFadden properties, LLC (McFadden Farm). The McFadden farm is within the City's current industrial park along Chavenelle Road and is adjacent to existing developed industrial property that has City utilities available at its perimeter. Dubuque was one of multiple communities under consideration by a company reviewing locations for a corporate expansion. The company would have been a significant user of City water and sewer services. The company required approximately 40 acres for their proposed development. The City strengthened its bid for their selection by expediting the grading plan. Greater Dubuque Development Corporation recommended that the City begin the grading work as soon as possible to heighten its chance in the selection process. Greater Dubuque also agreed to f�and $37,000 of thP estimatPd $103,000 desgin costs for the si#e. DISCUSSION With the adoption of the FY2019 Capital Improvement Program Budget amendment, funding in the amount of$632,000 was made available for the development of the McFadden farm property, from existing balances in the Urban Renewal District and the Greater Dubuque Development Corporation contribution. Bids were received on September 4, 2018 and the project was awarded to Peterson Contractors Inc (PCI) on September 4, 2018. Grading began later that month and was completed in July of 2019. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the contract amount of$452,714.60 to Peterson Contractors Inc of Reinbeck, lowa for the DICW — McFadden Farm Grading Phase I project. This reflects the multiple preliminary design iterations during the early stages of development, along with planning and developing preliminary engineering plans for the remainder of the property. The future planning and engineering will allow staff to accurately define future site sizes, property acquisitions, infrastructure sizing for futur� site development. This additional effort also included construction estimates for future CIP site development budgets. FUNDING SOURCE The project funding summary is as follows: CIP Fundinq Source Amount 3601056 Dubuque Industrial Center West land sales $ 717,000.00 Total Project Cost $ 590,873.33 Remaining CIP Balance 126 126.67 Remaining funds will be used for continuing the development of the McFadden Farm, within the Dubuque Industrial Center West. ACTION TO BE TAKEN I recommend that the City Council adopt the attached resolution accepting the construction contract for the DICW — McFadden Farm Grading Phase I project to Peterson Contractors Inc of Reinbeck, lowa in the amount of$452,714.60. DICW - McFadden Farm Grading Phase l Project (the Project) has been completed by the Contractor, Peterson Contractors, Inc. of Reinbeck, Iowa (Contractor), and the City Engineer has examined the work and signed a certificate stating that the Project has been completed according to the terms of the Public Improvement Contract and that the City Engineer recommends that the Project be accepted; and WHEREAS, the final contract amount for the Project is $452,714.60; WHEREAS, the Contractor has previously been paid $430,078.87, leaving a balance of $22,635.73; and WHEREAS, the City Council finds that the recommendation of the City Engineer should be accepted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Dubuque Industrial Center West Land Sales CIP appropriations for the contract amount of $452,714.60 Tess any retained percentage provided for therein as provided in Iowa Code. Section 3. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $22,635.73 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
