Van Milligen, City Manager SUBJECT: Withdrawal Request from Residential Parking Permit District A DATE: November 24, 2019 City Engineer Gus Psihoyos recommends that a public hearing be set for December 16, 2019, on the University of Dubuque's request to withdraw Grace Street from North Algona to 270 feet east of McCormick Street from the Residential Parking Permit District "District A." Since the University of Dubuque owns all the property on this section of Grace Street, it exceeds 60% of the dwelling units required to amend the ordinance to withdraw this section of Grace Street from the Residential Parking Permit District "District A" as required under the ordinance. Van Milligen, City Manager �.�, FROM: Gus Psihoyos, City Engineer '�� �� '� . ��� DATE: November 22, 2019 RE: Withdrawal Request from Residential Parking Permit District A INTRODUCTION The purpose of this memorandum is to respond to an October 23, 2019 request to amend an ordinance of a Residential Parking Permit District (RPPD), "District A" by withdrawal of Grace Street from N. Algona to 270 feet east of McCormick Street. BACKGROUND In 1985, the City adopted ordinance 9-14-321.720 establishing Residential Parking Permit Districts. The purpose of such districts is to reduce traffic congestion resulting from the use of parking within residential districts by persons not residing within the district, to protect the residents of these districts from an unreasonable burden in gaining access to their residences, to preserve the character of such districts as residential districts, and other various purposes. A Residential Parking Permit District designati�n can be made only after a petition of residents representing 60 percent (60%) of the dwelling units in a proposed area is received, a parking study is conducted by the City Engineer, and a public hearing is held by the City Council. DISCUSSION RPPD, "District A" encompasses Grace Street from Ida Street to a point 270 feet east of McCormick Street. The establishment of Grace Street to RPPD "District A", was approved by City Council December 16, 1985. The University of Dubuque has just purchased the remaining property on Grace Street from N. Algona Street to McCormick Street. A request from the University of Dubuque was submitted on October 23, 2019 to remove the section of Grace Street from North Algona to McCormick Street. Since the University of Dubuque owns all the property on this section of Grace Street, it exceeds the 60 percent (60%) of the dwelling units required to amend the ordinance to withdraw this section of Grace Street from RPPD "District A" as required under the ordinance. RECOMMENDATION I am recommEnding the ordinance be amended to withdraw Grace Street from North Algona to 270 feet east of McCormick Street from RPPD "District A", and that a public hearing be set for December 16, 2019. ACTION TO BE TAKEN I respectfully request that a public hearing be set for December 16 for the request to amend RPPD "District A" ordinance through the adoption of the attached resolution. Code of Ordinances, has received a request that the area described as follows be excluded in Residential Parking Permit District A: Grace Street, from North Algona to 270 feet east of McCormick Street; and Whereas, the City Manager, in accordance with Ordinance 9-14-321.733 recommends that Residential Parking Permit District A be amended to exclude such area and that the City Council set a public hearing on the request to amend Residential Parking Permit District A. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Council finds and determines that the request from petitioner is valid for Grace Street, in Residential Parking Permit District A. Section. 2. That the City Clerk be authorized and directed to publish a notice of public hearing on amending Residential Parking Permit District A, to be held on December 16, 2019.
