The City of Dubuque and Cheryl A. Sheldon entered into a purchase agreement
whereby the City would acquire a portion of Lot 10 of F.D.R. Park View Heights,
Section 3, Township 88 North, Range 2 East of the 5t" Principal Meridian in Dubuque
County for additional right of way along North Cascade Road for a purchase price of
$500.
City Engineer Gus Psihoyos recommends City Council approval of the Acquisition Plat
and acceptance of the dedication of said lot for right of way purposes.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memo provides information regarding the platting and acceptance of additional
right of way for the North Cascade Road Reconstruction Project, from the bridge over
Catfish Creek to Edval Lane.
BACKGROUND
With the upcoming completion of the Southwest Arterial (US 52) and the location of the
Middle Interchange at North Cascade / English Mill Road, traffic volumes are expected
to increase on North Cascade Road. The existing roadway is narrow, substandard in
design and is inadequate to accommodate future traffic and development growth.
The Timber Hyrst residential subdivision is under development and connects
Creekwood Drive to North Cascade Road between Edval Lane and the Catfish Creek
bridge. The development agreement for this subdivision between the City of Dubuque
and North Cascade Road Developers, LLC. stipulates that the City will complete safety
related improvement to North Cascade Road.
The City is d�velopir�ig a project to reconstruct N�rlh Cascade R�ad between the bridge
over South Fork of the Catfish Creek to the future intersection of North Cascade Road
and the Southwest Arterial. The project will be developed into 2 phases; Phase 1 (2019)
- from C�tfish Creek bridc�e to Edval Lane; and Phase 2 (2021) - from Edval L�ne t�
Southwest Arterial.
The current 24-foot rural roadway will be widened to accommodate a 35-foot urban
"complete street" section with 5-foot paved shoulders / bike lanes on each side and
grading for future sidewalks on each side of the road. The existing curves on North
Cascade Road are substandard ancl will be realigned to improve safety and allow for
better sight distance.
Recently, the City of Dubuque and Cheryl A. Sheldon entered into a purchase
agreement whereby the City would acquire a portion of Lot 10 of F.D.R. Park View
Heights, Section 3, Township 88 North, Range 2 East of the 5t" Principal Meridian in
Dubuque County, lowa (shown as Project Parcel 7 on attached map) owned by Cheryl
A. Sheldon, needed for the for the North Cascade Road Reconstruction Project. As part
of that agreement, the City is responsible for the surveying and platting of the proposed
division of the property.
DISCUSSION
In accordance with a Purchase Agreement with the property owner, Cheryl A. Sheldon,
the additional right of way of North Cascade Road needs to be platted. The platting of
this additional area has been coordinated with the owner of the property and they have
signed and consented to the plat.
The City of Dubuque Engineering Department has prepared the acquisition plat to
provide the right of way areas. The area being platted will be dedicated to the public for
street and utility purposes.
BUDGET IMPACT
The anticipated project funding for the property acquisitions to accommodate the future
improvements for the North Cascade Road Reconstruction Project is summarized as
follows:

Per the executed Purchase Agreements with Cheryl A. Sheldon, the City has
compensated the owner in the amount of $500.00 for the property (Project Parcel 7)
needed as additional right of way along North Cascade Road.
RECOMMENDATION
I recommend that the City Council approve the Acquisition Plat of Lot 10A of F.D.R.
Park View Heights, Section 3, Township 88 North, Range 2 East of the 5th Principal
Meridiari ir� Dubuque County, lowa, which provides the additional right of way needed
for the for the North Cascade Road Reconstruction Project by the adoption of the
attached resolution.
ACTION TO BE TAKEN
I respectfully request approval of the Acquisition Plat of Lot 10A of F.D.R. Park View
Heights, Section 3, Township 88 North, Range 2 East of the 5t" Principal Meridian in
Dubuque County, lowa, and acceptance of the dedication of said lot for Right of Way
purposes, through the adoption of the enclosed resolutions.

HEIGHTS, SECTION 3, TOWNSHIP 88 NORTH, RANGE 2 EAST OF THE 5TH
PRINCIPAL MERIDIAN IN DUBUQUE COUNTY, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, an Acquisition Plat dated February 14, 2019 prepared by The
City of Dubuque Engineering Department describing Lot 10A of F.D.R. Park View
Heights, Section 3, Township 88 North, Range 2 East of the 5th Principal
Meridian in Dubuque County, Iowa; and
Whereas, Lot 10A of F.D.R. Park View Heights, Section 3, Township 88 North,
Range 2 East of the 5th Principal Meridian in Dubuque County, Iowa is
designated as Project Parcel 7 on said Acquisition Plat dated February 14, 2019
prepared by The City of Dubuque Engineering Department; and
Whereas, said plat conform to the laws and statutes pertaining thereto; and
Whereas, upon said plat appears Lot 10A, which Cheryl A. Sheldon, by said
plat has dedicated to the public forever; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

Section 1. That the plat dated February 14, 2019 prepared by The City of
Dubuque Engineering Department, relative to the real estate hereinabove
described be and the same are hereby approved, and the Mayor and City Clerk
be and they are hereby authorized and directed to execute said plat and on
behalf of the City of Dubuque, Iowa.
Section 2. That the dedication of Lot 10A of F.D.R. Park View Heights, Section
3, Township 88 North, Range 2 East of the 5th Principal Meridian in Dubuque
County, Iowa, for Right of Way purposes, as it appears on said Acquisition Plat,
be and the same is hereby accepted.

APPROVING THE ACQUISITION PLAT OF LOT 10A OF F.D.R. PARK VIEW
HEIGHTS, SECTION 3, TOWNSHIP 88 NORTH, RANGE 2 EAST OF THE 5TH
PRINCIPAL MERIDIAN IN DUBUQUE COUNTY, IOWA
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, an Acquisition Plat dated February 14, 2019 prepared by The
City of Dubuque Engineering Department describing Lot 10A of F.D.R. Park View
Heights, Section 3, Township 88 North, Range 2 East of the 5th Principal
Meridian in Dubuque County, Iowa; and
Whereas, Lot 10A of F.D.R. Park View Heights, Section 3, Township 88 North,
Range 2 East of the 5th Principal Meridian in Dubuque County, Iowa is
designated as Project Parcel 7 on said Acquisition Plat dated February 14, 2019
prepared by The City of Dubuque Engineering Department; and
Whereas, said plat conform to the laws and statutes pertaining thereto; and
Whereas, upon said plat appears Lot 10A, which Cheryl A. Sheldon, by said
plat has dedicated to the public forever; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated February 14, 2019 prepared by The City of
Dubuque Engineering Department, relative to the real estate hereinabove
described be and the same are hereby approved, and the Mayor and City Clerk
be and they are hereby authorized and directed to execute said plat and on
behalf of the City of Dubuque, Iowa.
Section 2. That the dedication of Lot 10A of F.D.R. Park View Heights, Section
3, Township 88 North, Range 2 East of the 5th Principal Meridian in Dubuque
County, Iowa, for Right of Way purposes, as it appears on said Acquisition Plat,
be and the same is hereby accepted.
Section 4. That the City Clerk be and is hereby authorized and directed to file
said plat and certified copy of this resolution in the office of the Recorder, in and
for Dubuque County, Iowa.
