SUBJECT: Amy Court Drainage Improvements Project

City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the Amy Court Drainage Improvements Project, as completed
by Drew Cook & Sons Excavating Company, Inc., in the final contract amount of
$80,075.67, which is a 6.6% decrease from the original contract amount of $85,749.50.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Amy Court Drainage Improvements Project
INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the Amy Court Drainage Improvements Project.
BACKGROUND
The Amy Court Drainage Improvements involved the extension of approximately 90 feet
of storm sewer, construction of two intakes, reconstructing the curb & gutter section and
impacted driveway approaches, and installation of drain tile in the cul-de-sac. Work also
included some minor re-grading. The final lift of asphalt paving of the cul-de-sac will be
done in the Spring of 2020 by the Public Works Department.
DISCUSSION
The Amy Court Drainage Improvements Project was completed by Drew Cook & Sons
Excavating Company, Inc. of Dubuque, IA in the final contract amount of $80,075.67,
which is a 6.6% decrease from the original contract amount of $85,749.50.
RECOMMENDATION
I recommend that the City Council accept the public improvements and authorize the
payment of the contract amount of $80,075.67 to Drew Cook & Sons Excavating
Company, Inc. of Dubuque, IA, for the Amy Court Drainage Improvements Project.

RESOLUTION NO. 435-19
ACCEPTING THE AMY COURT DRAINAGE IMPROVEMENTS PROJECT AND
AUTHORIZING THE FINAL PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Amy Court Drainage
Improvements Project (the Project) has been completed by the Contractor, Drew Cook
& Sons Excavating Company, Inc. of Dubuque, IA (Contractor), and the City Engineer
has examined the work and signed a certificate stating that the Project has been
completed according to the terms of the Public Improvement Contract and that the City
Engineer recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $80,075.67; and
WHEREAS, the Contractor has previously been paid $76,071.89, leaving a retainage
balance of $4,003.78; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
General Repairs CIP appropriations for the contract amount of $80,075.67 Tess any
retained percentage provided for therein as provided in Iowa Code.
Section 3. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $4,003.78 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
