Van Milligen, City Manager SUBJECT: Van Buren Street Energy Dissipator Project DATE: December 11, 2019 City Engineer Gus Psihoyos is recommending acceptance of the public improvement construction contract for the Van Buren Street Energy Dissipator Project, as completed by Drew Cook & Sons Excavating Company, Inc., in the final contract amount of $94,960.07, which is a 10.5% increase from the original contract amount of $85,681.50. The increase in cost was due to additional rock excavation, backfill, tree removal, and sidewalk replacement. BACKGROUND This Van Buren Street Energy Dissipator Project involved improvements to the outlet of the 72" diameter storm sewer south of Van Buren Street near Hickson Avenue. The existing storm outlets into a natural drainage ditch which has become unstable. The improvements will protect both the storm sewer and adjacent private property from deteriorating and undermining. DISCUSSION The Van Buren Street Energy Dissipator Project was completed by Drew Cook & Sons Excavating Company, Inc. of Dubuque, IA in the final contract $94,960.07. Which is 10.5% increase from the original contract amount of$85,681.50. The increase in cost was due to additional rock excavation, backfill, tree removal, and sidewalk replacement. RECOMMENDATION I recommend that the City Council accept the public improvements and authorize the payment of the contract amount of $94,960.07 to Drew Cook & Sons Excavating Company, Inc. of Dubuque, IA, for the Van Buren Street Energy Dissipator Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Van Buren Storm Outlet CIP appropriations for the contract amount of $94,690.07 Tess any retained percentage provided for therein as provided in Iowa Code. Section 3. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $4,734.51 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
