Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Assistant Planner Guy Hemenway reviewed the proposed amendment to the Unified
Development Code to permit Licensed Child Care Centers in Office, Commercial and
Industrial Zoning Districts. He explained that the Imagine Dubuque Comprehensive
Plan, the Consolidated Plan, and currently, as part of planning process for the Equitable
Poverty Prevention Plan, identified the lack of accessibility, affordability and abundance
of licensed child care facilities as barriers for individuals in poverty. He explained the
requirements for a licensed child care facilities and the conditional use permit
requirements for a licensed childcare center. He noted that the Department of Human
Services (DHS) monitors licensed child care centers. He explained by requiring these
child care centers to be conditional use permits creates a redundant review process,
increases the cost and time demands for approval.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the text amendment.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
Planning Services Staff is proposing to amend the office, commercial and industriai
district regulations to allow licensed child care facilities as permitted uses. This
amendment will encourage the provision of accessible and affordable day care for
children and will reduce the cost and time that may create barriers to the development
of child care facilities. These barriers can be reduced by eliminating the requirement
that all licensed child care facilities in office, commercial and industrial zoning districts
require a Conditional Use Permit (CUP).
DISCUSSION
Currently, all office, commercial and industrial zoning districts within the city require that
licensed child care facilities obtain a CUP prior to commencement. The CUP process
requires that the Zoning Board of Adjustment review the proposal regarding exterior
accommodations for drop-off/pick-up areas, employee parking and outdoor recreational
area. The CUP process can be costly depending on the number of adjacent properties
that must be notified and can delay projects for up to 2 months.
The CUP requirements for licensed child care faciiities are somewhat redundant
because the State of lowa Department of Human Services regulates both day care
homes and licensed child care facilities. Many of the regulations required for the CUP
are duplicated by the state DHS. In addition, the DHS conducts inspections of exterior
and interior day care spaces on a regular basis using trained inspectors to insure the
safety of the facility.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission move licensed child care
facilities from the list of conditional uses to the list of permitted uses in all office,
commercial and industrial districts. �

Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code Article 8-5.20 Conditional Uses are hereby amended as follows:
20. Licensed Child Care Center
A licensed child care center may be allowed in the R-1, R-2, R -2A, R-3, R-4, 9-R7
OS, OC, C-1, 0-2, C -2A, C-3, C-4, C-5, CS, CR, LI, HI, MHI, and RROD districts
in accordance with the following conditions:
A. Such facility shall supply loading and unloading spaces so as not to obstruct
public streets or create traffic or safety hazards;
B. All licenses have been issued or have been applied for and are awaiting the
outcome of the state's decision; and
C. When located within the R-1, R-2, R -2A, R-3, R-4, or RROD districts or in a
signage shall be limited to one non -illuminated, wall mounted sign not to exceed
four square feet in area.
