SUBJECT: Amendment of Arts Commission Ordinance Regarding Meeting Schedule
DATE: December 11, 2019
Arts & Cultural Affairs Coordinator Jenni Petersen-Brant recommends City Council
approval of an amendment to the City of Dubuque Code of Ordinances Title 2 Boards
and Commissions, Chapter 8 Arts and Cultural Affairs Advisory Commission, Section
2-8-10 Meetings, providing that the Commission must meet monthly, but not a
designated date. The City Clerk's office brought it to the attention of the Commission
and staff that the current ordinance dictated that the Arts Commission regular meeting
must be held on the fourth Tuesday of each month. The City Clerk suggested that the
ordinance could be amended to provide more scheduling flexibility for future meetings in
keeping with current practices of other City Commissions.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The memorandum is to accompany an amendment to the City of Dubuque Code of
Ordinances Title 2 Boards and Commissions, Chapter 8 Arts and Cultural Affairs
Advisory Commission, Section 2-8-10 Meetings.
BACKGROUND
Section 2-8-10 Meetings of the City of Dubuque's Ordinance governing the Arts and
Cultural Affairs Advisory currently states that 'The commission must meet on the fourth
Tuesday of each month.'
DISCUSSION
Recently, the timing of mandatory new staff training presented a conflict with the regular
schedule of the Arts and Cultural Affairs Advisory Commission. As no other staff from
the Economic Development Department was available to provide staff support for that
meeting, the Commission sought to reschedule their October 2019 regular meeting for a
different day that month. The City Clerk's office brought it to the attention of the
Commission and Staff that the current ordinance dictated that the Arts Commission
regular meeting must be held on the fourth Tuesday of each month. The City Clerk
suggested that the ordinance could be amended to provide more scheduling flexibility
for future meetings in keeping with current practices of other City Commissions.
The topic was discussed at the Arts and Cultural Affairs Commission on October 22,
2019. The minutes from that meeting reflect that the Commission made and approved
the following motion:
"Motion made to change section 2-8-10 section of the Arts and Cultural Affairs Advisory
Commission ordinance to read that 'The commission must meet monthly.' by
Commissioner Daugherty, seconded by Commissioner Siegert. Commissioners Halder,
Riedel, Decker, Siegert, Daugherty, Neuhaus voted to approve motion; Motion passes."
The amendment has been prepared by City of Dubuque Attorney, Crenna Brumwell.
RECOMMENDATION/ ACTION STEP
Recommend the amendment for City Council approval.

AMENDING CITY OF DUBUQUE CODE OF ORDINANCES TITLE 2 BOARDS AND
COMMISSIONS, CHAPTER 8 ARTS AND CULTURAL AFFAIRS ADVISORY
COMMISSION, SECTION 2-8-10 MEETINGS
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 2-8-10 of the City of Dubuque Code of Ordinances is amended to
read as follows:
2-8-10: MEETINGS:
A. Regular Meetings: The commission must meet monthly.
B. Special Meetings: Special meetings may be called by the chairperson or at the
written request of a majority of the commissioners.
C. Open Meetings: All meetings must be called and held in conformance with the
Iowa open meetings law.
D. Attendance:
1.In the event a commissioner has been absent for three (3) or more consecutive
meetings of •the commission, without being excused by the chairperson, such
absence will be grounds for the commission to recommend to the city council that
the position be declared vacant and a replacement appointed.
2.Attendance must be entered upon the minutes of all meetings.
E. Minutes: A copy of the minutes of all regular and special meetings of the
commission must be filed with the city council within ten (10) working days after each
meeting, or by the next regularly scheduled city council meeting, whichever is later.
F. Quorum: Four (4) commissioners constitute a quorum for the transaction of
business. The affirmative vote of a majority of the commissioners present and voting
is necessary for the adoption of any motion or resolution.
Section 2. This ordinance shall take effect upon publication.
