Project Acceptance
DATE: December 26, 2019
Project Manager Steve Sampson Brown recommends City Council acceptance of the
public improvement contract for the Bee Branch East Blum Site Foundation and
Contaminated Soil Removal Project, as completed by Tschiggfrie Excavating Company,
in the final contract amount of $58,573.79.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Project Acceptance
INTRODUCTION
The enclosed resolution provides for the acceptance of the Public Improvement
Contract for the East Blum Site Foundation & Contaminated Soil Removal Project.
DISCUSSION
The East Blum Site Foundation & Contaminated Soil Removal Project was completed by
Tschiggfrie Excavating Co. of Dubuque, lowa in the final contract amount of$58,573.79.
There were two change orders for landfill fees and HMA street patching. This project
involved the removal of the foundation wall, concrete floor slab and contaminated soil.
BUDGET IMPACT:
The project cost will be paid for by the Bee Branch Flood Maintenance Facility
Improvement Project CIP 340-2609 4X0001.
RECOMMENDATIOf�
The City Council is requested to adopt the attached resolution to accept the East Blum
Site Foundation & Contaminated Soil Removal Project, and to authorize the final
retainage payment in the amount of$2,928.69 to Tschiggfrie Excavating Company of
Dubuque, lowa for East Blum Site Foundation & Contaminated S�il Removal Project.

RESOLUTION NO. 9-20
ACCEPTING THE BEE BRANCH EAST BLUM SITE FOUNDATION & AND
CONTAMINATED SOIL REMOVAL PROJECT AND AUTHORIZING THE PAYMENT
OF THE CONTRACT AMOUNT TO THE CONTRACTOR
WHEREAS, the Public Improvement Contract for the East Blum Site Foundation &
Contaminated Soil Removal Project (the Project) has been completed by the
Contractor, Tschiggfrie Excavating, Company of Dubuque, Iowa (Contractor), and the
City Engineer has examined the work and signed a certificate stating that the Project
has been completed according to the terms of the Public Improvement Contract and
that the City Engineer recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $58,573.79; and
WHEREAS, the Contractor has previously been paid $55,645.10, leaving a balance
of $2,928.69; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Bee Branch Flood Mitigation Maintenance Facility CIP appropriations for the contract
amount of $58,573.79 Tess any retained percentage provided for therein as provided in
Iowa Code.
Section 3. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $2,928.69 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
