The City of Dubuque Zoning Advisory Commission has reviewed the above-cited I,
request. The application, staff report and related materials are attached for your review.
Discussion
Eddie Severns spoke in favor of the request. He stated that he is the owner of RF2
Furniture and was speaking on behalf of Sanjay Mehta, owner of the property at 245
Railroad Avenue. He said his furniture business is currently located in the Historic
Millwork District. He would like to relocate to 245 Railroad Avenue so he can expand the
business. He said that it would give him an additional 2,000 square feet of retail space.
Staff reviewed the staff report noting the subject property's location and the types of
uses that exist on site and in the surrounding area. Staff said that the rezoning is an
expansion of the adjacentC-3 district. Staff also noted the existing business are
permitted uses in a C-3 zoning district, and therefore, will not create non-conforming
uses.
There were no public comments.
The Zoning Advisory Commission discussed the request noting that it represented an
expansion of an existing C-3 zoning district.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City
Council approve the request.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 245 RAILROAD AVENUE
FROM LI LIGHT INDUSTRIAL DISTRICT TO C-3 GENERAL COMMERCIAL
DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter—described
property from LI Light Industrial District to C-3 General Commercial District, to wit:
Blk A Industrial Sub, and to the centerline of the adjoining public right-of-way, all
in the City of Dubuque, Iowa.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication as provided
by law.

Property History: The property was zoned Heavy Industrial from 1934 until 1985. In
1985, the property was rezoned to LI Light Industrial. The site contains a multi-tenant
building that has been constructed over time. The original building was constructed in
1921 and is composed of brick; two concrete block additions were constructed in 1921
and 1940. Smaller modifications to the building were made in the 2000 — 2004.
Tandem Tire, Mountain Top Stonework and Becwar Tile & Marble currently occupy
three of the tenant spaces in the building.
Physical Characteristics: The subject property is bounded by Harrison Street, Camp
Street, Salina Street and Railroad Avenue. The subject property encompasses
approximately 2.73 acres and contains an approximate 75,000 sf multi-tenant concrete
block/brick masonry building and associated parking lot. The site is 100°/o impervious.
Concurrence with Comprehensive Plan: The 2017 Comprehensive Plan included the
following Land Use recommendations that supports the applicanYs request.
COMMERCIAL: Be responsive to market demands and the needs of residents by
providing key retail and employment centers. Ensure that such development does not
impact the quality of life in adjacent residential neighborhoods.

• Explore additional opportunities for limited commercial development within
neighborhoods to provide enhanced local access to day-to-day goods and
services like convenience goods, dry cleaning, etc. such uses are typically best
located at major intersections.
• Continue to concentrate commercial uses within a regional draw along major
transportation corridor, including downtown.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site. The proposed rezoning ,
would have no impact on existing utilities.
Traffic Patterns/Counts: There are no traffic counts for Harrison Street, Camp
Street, Salina Street or Railroad Avenue. These network of streets are accessed by
the following major streets.

Public Services: Existing public services are adequate to serve the property.
Environment: Staff does not anticipate any adverse impact to the environment as
the proposed rezoning does not change the erosion control and storm water
management requirements already applied to the site.
Adjacent Properties: Staff does not anticipate any significant impacts to adjacent
property. Most likely impact from rezoning the site to commercial would be an
increase in the number of vehicle trips into this area.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting to rezone the property at 245 Railroad
Avenue from LI Light Industrial District to C-3 General Commercial District. The subject
property is bounded by Harrison Street, Camp Street, Salina Street and Railroad
Avenue in downtown Dubuque. The subject building is a one-story brick/concrete block
structure that is highly visible from the surrounding elevated highways.

The applicant is requesting the change in zoning from LI Light Industrial to C-3 General
Commercial to facilitate the conversion of a portion of the building to retail sales and
service. According to City records, the subject property was zoned HI Heavy Industrial
until its rezoning in 1985 to LI Light Industrial. The surrounding area is currently a
mixture of C-3, CS, and LI zoned properties.
The subject multi-tenant building is approximately 75,000 sf and contain the businesses
of Tandem Tire (Vehicle service or repair use), Mountain Top Stonework and Becwar
Tile and Marble (Construction supply sales or service use). A portion of the building has
vacant space. The rezoning of the property from LI Light Industrial to C-3 General
Commercial will not make the existing businesses non-conforming. Both vehicle service
and repair and construction supply sales or service are permitted uses in a C-3 zoning
district.
The C-3 General Commercial District is intended to provide locations for commercial
uses which are designed to serve the motor public or uses requiring highway or arterial
location. The subject property is located in an island of commercial/industrial
development that is bound by US Hwy 151/61 on the south and east side, South Locust
Street to the west and US Hwy 20/Dodge Street to the north with primary access to the
site coming from either South Locust Street or US Hwy 151/61.
RECOMMENDATION: Planning staff recommends the Zoning Advisory Commission
review the criteria for rezoning requests found in Section 16-9-5(A) of the Unified
Development Code and make a recommendation to the City Council.
