INTRODUCTION
The purpose of this memo is to request City Council approval to initiate the bid process
for the Eagle Point Park Environmental Restoration Project - Phase 2) Bioretention
Basin Construction, Tree Removal, and Native Vegetation Establishment. Supporting
documentation, a resolution, and a notice of public hearing are enclosed.
BACKGROUND
The Eagle Point Park Environmental Restoration Management Plan, approved by the
City Council in January 2017, outlines the unique nature and value of this park and the
importance of making the site more resilient. The report focuses on the restoration of
native plants to improve the health of the ecosystem and enhance ecological functions
such as water purification, groundwater recharge and pollinator support. Another major
area of focus is the reduction of stormwater runoff and the use of stormwater best
practices to reduce soil erosion and improve water quality.
The City Council approved a $185,244 Contract with Emmons and Olivier Resources,
Inc. (EOR) in October 2018 for Project Design, Construction Management, and Grant
Administration Services. EOR is assisting the City with implementing best practices
outlined in the Environmental Restoration Management Plan as well as grant
administration and Section 106 historic preservation review. EOR was also awarded an
additional $16,466.08 for design and archaeological monitoring relating to the federal
review process. EOR's total budget is $201,710.08.
DISCUSSION
The City team for this project includes staff from Leisure Services, Engineering, and
Planning Services Departments. City Staff and the EOR team are receiving guidance
from the lowa Department of Natural Resources (IDNR) and the lowa Department of
Agriculture and Land Stewardship (IDALS) in developing of plans and specifications for
implementing best practices.
Eagle Point Park is listed in the National Register of Historic Places. The park has been
determined to possess historic, architectural, cultural, and archeological resources. The
commentary from the State Historic Preservation Office (SHPO) required additional
information from our consultants re: design aspects of bio-retention basins along the
park road and the question of removal of potential legacy trees in that specific basin
area. This in turn generated additional design work by EOR and archeological
monitoring by Bear Creek Archeology. The bio-retention basin work recently was
cleared by SHPO and the National Park Service.
Consequently, City staff have been working with EOR consultants and IDNR and IDALS
staff to move the project forward through two bidding packages. Phase 1) Turf
Conversion and Soil Quality Restoration (SQR) was initiated in July 2019. Phase 2)
Bioretention Basin Construction, Tree Removal, and Native Vegetation Establishment
was delayed until February 2020. Due to the different type of the work involved for these
phases, we expect to receive favorable bids by separating the construction work.
The general nature of the work involved with Phase 2 is: grading, drainage pipes and
structures, erosion and sediment control, native landscaping, vegetation establishment
and maintenance. EOR estimated Phase 2 will cost $290,665.65 as shown below.

BUDGETIMPACT
The IDNR is a major funding partner with $801,300 in state and federal pass-through
grants awarded for this project, leveraged by $79,597 from the Leisure Services
Department's FY14 Capital Improvement Project (CIP) #7202301 for Eagle Point Park.
The City has two Resource Enhancement and Protection (REAP) grants from IDNR, a
$175,000 Land and Water Conservation Fund (LWCF) federal pass-through grant from
the National Park Service (NPS) to the IDNR, and a State Revolving Fund (SRF)
Sponsored Project of$259,722 from the IDNR. Total project funding is $832,452.00 as
set forth below:

RECOMMENDATION
The staff recommendation is for City Council approval to give preliminary approval to
construction plans and specifications and establish March 2, 2020 as the date of the
public hearing and hereby authorize the City Clerk to advertise for bid proposal for the
Eagle Point Park Environmental Restoration Project - Phase 2) Bioretention Basin
Construction, Tree Removal, and Native Vegetation Establishment through the adoption
of the attached resolution.

BIORETENTION BASIN CONSTRUCTION, TREE REMOVAL, AND NATIVE
VEGETATION ESTABLISHMENT
PRELIMINARY APPROVAL OF PLANS, SPECIFICATIONS, FORM OF CONTRACT,
AND ESTIMATED COST; SETTING DATE OF PUBLIC HEARING ON PLANS,
SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED COST; AND ORDERING
THE ADVERTISEMENT FOR BIDS
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The proposed plans, specifications, form of contract and estimated cost for
the Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention Basin
Construction, Tree Removal, and Native Vegetation Establishment in the estimated amount
$290,665.65, are hereby preliminarily approved and ordered filed in the office of the City
Clerk for public inspection.
Section 2. A public hearing will be held on the 2nd day of March 2020, at 6:30 p.m. in the
Historic Federal Building Council Chambers (second floor) 350 W. 6th Street, Dubuque,
Iowa, at which time interested persons may appear and be heard for or against the
proposed plans and specifications, form of contract and estimated cost of said Project, and
the City Clerk be and is hereby directed to cause the attached notice of the time and place
of such hearing to be published in a newspaper having general circulation in the City of
Dubuque, Iowa, which notice shall be published not less than four days nor more than
twenty days prior to the date of such hearing. At the hearing, any interested person may
appear and file objections to the proposed plans, specifications, form of contract, or
estimated cost of the Project.
Section 3. Eagle Point Park Environmental Restoration Project: Phase 2) Bioretention
Basin Construction, Tree Removal, and Native Vegetation Establishment is hereby ordered
to be advertised for bids for construction. The amount of the security to accompany each
bid shall be in an amount which shall conform to the provisions of the Notice to Bidders
hereby approved.
Section 4. The City Engineer is hereby directed to advertise for bids for the construction
of the improvements herein provided, by publishing the attached Notice to Bidders to be
published in the Master Builders of Iowa Plan Room, The Construction Update Network
and posted on the City of Dubuque website at www.cityofdubuque.orq/bids. Publication will
occur not Tess than thirteen but not more than forty-five days before the date for filing bids
before 2:00 p.m. on the 9th day of March 2020. Sealed Bids must be filed before 2:00 p.m.
on March 9, 2020, in the Office of the City Clerk, City Hall - First Floor, 50 West 13th Street,
Dubuque, Iowa. Sealed proposals will be opened, and Bids tabulated at 2:00 p.m. on
March 9, 2020 at City Hall - Conference Room B, 50 West 13th Street, Dubuque, Iowa.
Bids shall be opened and read by the City Clerk at said time and will be submitted to the

Construction, Tree Removal, and Native Vegetation Establishment, in accordance with
the provisions of Chapter 26, Code of lowa, at 6:00 p.m., on the 2nd day of March, 2020,
in the Historic Federal Building Council Chambers (second floor), 350 West 6th Street,
Dubuque, lowa.
The scope of the Project is as follows:
The project is Phase 2) Bioretention Basin Construction, Tree Removal, and Native

Project.
Copies of supporting documents for the public hearing are on file in the City Clerk's Office,

120.1 Time and Place for Filinq Sealed Proposals
Sealed Bids for the work comprising each improvement as stated below must be filed
before 2:00 p.m. on March 9, 2020, in the Office of the City Clerk, City Hall - First Floor, 50
West 13t" Street, Dubuque, lowa.
120.2 Time and Placed Sealed Proposals Will be Opened and Considered
Sealed proposals will be opened and Bids tabulated at 2:00 p.m. on March 9, 2020, at City
Hall - Conference Room B, 50 West 13th Street, Dubuque, lowa, for consideration by the
City Council at its meeting on March 16, 2020. The City of Dubuque, lowa, reserves the
right to reject any and all Bids.
120.3 Time for Commencement and Completion of Work
Work on the Project must be commenced within ten (10) calendar days after the Notice to
Proceed has been issued and shall be fully completed by June 30, 2020.
120.4 Bid Securitv
Each Bidder must accompany its Bid with a Bid security as security that the successful
Bidder will enter into a contract for the work Bid upon and will furnish after the award of
contract a corporate surety Bond, acceptable to the governmental entity, for the faithful
performance of the contract, in an amount equal to one hundred percent of the amount of
the contract. The Bid security must be in the amount of ten percent (10%) of the amount of
the contract and must be in the form of a cashier's check or certified check drawn on a
state-chartered or federally chartered bank, or a certified share draft drawn on a state-
chartered or federally chartered credit union, or the Bidder may provide a Bid Bond with
corporate surety satisfactory to the governmental entity. The Bid Bond must contain no
conditions except as provided in this section.
120.5 Contract Documents
Copies of the Contract Documents may be obtained at the Engineering Department, City
Hall — Second Floor, 50 West 13t" Street, Dubuque, lowa 52001. The Contract Documents
will also be available on the City's website at www.cityofdubuque.orq/bids.aspx. No plan
deposit is required.
120.6 Preference for lowa Products and Labor
By virtue of statutory authority, preference will be given to products and provisions grown
and coal produced within the State of lowa, and to lowa domestic labor, to the extent
lawfully required under lowa statutes.
120.7 Sales Tax
The Bidder should not include State of lowa sales tax in its Bid. A sales tax exemption
certificate will be available for all material purchased in lowa for incorporation into the
Project.
