City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Pristine Properties, LLC, has recently completed in Cedar Lake —
East Fifteenth Addition. Maintenance guarantees for said public improvements shall be
provided by the owners, Pristine Properties, LLC, for a period of two years from the date
of acceptance by City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements that the
developers, Pristine Properties, LLC, have recently completed in Cedar Lake — East Fifteenth
Addition.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 333-19, the developers of
Cedar Lake — East Fifteenth Addition were required to install certain public improvements
including sanitary sewer main and water main and to dedicate said improvements to the City
upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On February 18, 2020, the owners requested City's acceptance of the improvements in Cedar
Lake — East Fifteenth Addition. Upon inspection by the City, it has been determined that the
public improvements required by Resolution 333-19 have been completed in accordance with
plans approved by the City Council and in conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public sanitary sewer and water
main improvements as described above. Maintenance guarantees for said public improvements
shall be provided by the owners, Pristine Properties, LLC, for a period of two (2) years from the
date of acceptance by City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements in Cedar Lake — East Fifteenth Addition.

RESOLUTION NO. 66-20
ACCEPTING PUBLIC IMPROVEMENTS IN CEDAR LAKE — EAST FIFTEENTH
ADDITION, IN THE CITY OF DUBUQUE, IOWA
Whereas, pursuant to Resolution 333-19, certain public improvements including
sanitary sewer main and water main were installed by the developer of Cedar Lake —
East Fifteenth Addition in the City of Dubuque, Iowa; and
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements in Cedar Lake — East Fifteenth Addition be and the same
is hereby accepted.
Section 2. That a maintenance guarantee covering said public improvements
shall be provided by the owners, Pristine Properties, LLC, for a period of two (2) years
from the date of this resolution.

Hi Brittni (Pristine Properties),
I am attaching a copy of the City Council resolution accepting ownership of the newly installed water main and
sewer. At this time, the Letter of Credit with the City for $117,923.15 can be reduced to $26,800.75 (25% of original
construction estimate) – you can contact Fidelity Bank and Trust to ask them to revise the LOC. This letter of credit at
the reduced amount must continue until March 2, 2022 (2 year warranty period).
Please let me know if you have any questions on any of these topics.

Tom and Webbers, if someone can please send me a construction cost estimate
for the water and sewer goods, then I will compute the required letter of credit and
inspection fee amounts. After I receive the letter of credit and inspection fee
check I will give Kyle Kritz the green light to release the plat for recording.
It is also important for the project contractor to contact me with a schedule to
make sure we have an inspector onsite during construction.

there shouldn’t be any more meetings. However, you can’t start any
home construction until the Final Plat is recorded (Except the lot up
front that we previously discussed). The City is in possession of the Final
Plat, and will not release it to be recorded until they have everything
they need. I’ve added Nate Kieffer as a recipient because he can better
answer what the City still needs from you.
Nate, Can you let them know what you still need from them before
you’ll release the plat?
Once the City releases the Final Plat you will need to get the remaining
signature and the plat recorded. As I understand it, once the plat has
been recorded, I believe you can start on any of the homes. However
you can’t take occupancy on any of them until they have been
connected to Sanitary Sewer and Water Main, but you can’t start on the
Sanitary and Water until you hear back from the DNR.
Hopefully this make some sense.

Hi Tom,
After Monday night's city council meeting
are we now all set and approved for all 6 lots
to be built on? Dad was thinking we were
only set for 1 lot in the front portion and 1
lot in the back portion so I wanted to see if
we can get clarification on whether or not
we will have any additional city meetings or
approvals needed down the road to build
things out?
