Present —Mayor Kane, Councilmen McEvoy and Thompson, City Man- ager Evans. Absent — Councilmen Andelfinger and Schuckert. Meeting called by order of Mayor Kane and Councilman Thompson. Mayor Kane read the call and stated that service thereof had been duly made and that this meeting is called for the purpose of reconsider- ing the action of the City Council of the meeting of July 31st, 1933, in granting the application of Edward Lyons to transfer his beer permit from 630 Main street to 260 Iowa Street and acting on any other busi- ness as may properly come before a regular meeting of the City Council. Councilman McEvoy moved that the City Council reconsider their previous action of the Council meet- ing of July 31st, 1933, in granting the application of Edward Lyons re- questing a transfer of his beer per- mit from 630% Main Street to 260 Iowa Street. Seconded by Council- man Thompson. Carried by the fol- lowing vote: Yeas — Mayor Kane, Councilmen McEvoy and Thompson. Nays —None. Absent — Councilmen Andelfinger and Schuckert. Councilman Thompson moved that the application of Edward Lyons, requesting a transfer of his beer per- mit from 630 Main Street to 260 Iowa Street, be denied. Seconded by Councilman McEvoy. Communication of Frank Pierce, Secretary - Treasurer of League of Iowa Municipalities, requesting that the City of Dubuque be represented at the annual meeting of the League of Iowa Municipalities to be held at Decorah, Iowa, presented and read. Councilman Thompson moved that the members of the City Council, City Manager and City Solicitor be authorized to 'attend the annual meeting of the League of Iowa Mu- nicipalities to be held at Decorah, Iowa. Seconded by Councilman Mc- Evoy. Carried by the following vote: Yeas — Mayor Kane, Councilmen McEvoy and Thompson. Nays —None. Absent — Councilmen Andelfinger and Schuckert. Mayor Kane stated that this is the regular monthly meeting of the City Council for the transaction of any such business as may properly come before the meeting. Petition of Mrs. Betty Lee request- ing that the City Council authorize the fireproofing of the barbecue stand at 871 Central Avenue and when said improvement is made that the order to remove said structure be rescinded and annulled and that she be permitted to continue the business presented and read. Councilman Andelfinger moved to suspend the rules, for the purpose of allowing any one present in the Council Chamber, who wishes to do so, to address the Council. Second- ed by Councilman McEvoy. Whereas, the Council of the City of Dubuque caused to be prepared and published, as provided by law, Budget Estimate of Expenditures for the . fiscal year 1934, and the hearing upon said Budget Estimate was fixed for the 7th day of August, 1933, at 7:30 o'clock P. M. at the Council Chamber in the City Hall; and, Whereas, this being the time and place set for said hearing said Bud- get Estimate was taken up for final consideration by the Council and all tax payers have been given an op- portunity to be heard for or against said Budget Estimate: It Is Therefore Resolved by the City Council of the City of Dubuque: That the Budget Estimate of Ex- penditures for 1934 heretofore pre- pared and published be and the same is hereby finally approved and adopted and the Mayor and Clerk are directed to certify the same to the County Auditor of Dubuque County, Iowa, together with the ver- ified proof of publication and the notice of hearing upon said Budget Estimate. D. 193 ; or any time before that date at the option of the City, the sum of $100.00, with interest thereon at the rate of five per cent. per annum, payable on the presentation and sur- render of the interest coupons here- to attached, both interest and prin- cipal are payable at the office of the City Treasurer in the City of Du- buque in the State of Iowa. This bond is issued by the City of Dubuque pur- suant to and by virtue of Chapter 311 of the Code of Iowa, 1927, and in accordance with a resolution of the City Council of said City, duly passed on the 7th day of August, 1933. This bond is one of a series of two bonds, one for $100.00, num- bered 3332, and one for $6.60, num- bered 3333, all of like tenor and date, and issued for the purpose of the construction of a concrete side- walk along the east side of South Grandview Avenue abutting Lot 1 of Lot 1 of Mineral Lot 46, and de- scribed in said resolution; which cost is assessable to and levied along said improvement, and is made by law a lien on all abutting or adjacent prop- erty, and payable in ten annual in- stallments, with interest on all de- ferred payments at the rate of five per cent. per annum, and this bond is payable only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified 'and recited that all the acts and conditions and things required to be done precedent to and in the issuing of this series of bonds, have been clone, happened and performed in regular and due form as required by said law and resolution; and for the assessments, collections and payment hereon of said special tax, the faith and dili- gence of said City of Dubuque are herby irrevocably pledged. In Witness Whereof, the City of Dubuque by its City Council has caused this bond to be signed by its Mayor and countersigned by its City Clerk, with the seal of said City af- fixed this 7th day of August, 1933, and has authorized the use of their fac- simile signature to the interest coupons hereto attached. Be It Further Resolved, that as fast as funds allow, beginning with the second year after the payment of interest due, these bonds shall be called and retired in the same order as numbered. Nays —None. Resolution Providing for the Issu- ance of Public Improvement Bonds. CITY OF DUBUQUE, IOWA Resolution No. 78 -33. Whereas, the contract heretofore entered into by the City of Dubuque for the construction of a five (5) foot concrete sidewalk, hereinafter described, has been completed and said improvement has been accepted by the City Council of said City.and the City Engineer has computed the cost and expense thereof to be $106.60. And Whereas, public notice as pro- vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: Now, Therefore, Be It Resolved by the City Council of the City of Dubuque that to provide for the cost of the construction of a concrete sidewalk along the east side of South Grandview Avenue abutting Lot 1 of Lot 1 of Mineral Lot 46 there be issued Improvement bonds to the amount of $106.60, said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1927, which bear date as of the 7th day of August, 1933, shall be in de- nominations of $100.00, except that there shall be one bond to the amount of $6.60. They shall be num- bered from 3332 to 3333 inclusive and shall be divided into two series of which the bond numbered 3332 shall constitute the first series and shall be payable the 1st day of April, A. D. 1939, the bond numbered 3333 shall constitute the second series and shall be payable the first day of April, A. D. 1940, Said bonds shall bear interest at the rate of five per cent. per annum which interest shall be payable semi- annually, in accordance with the terms of the coupons thereto at- tached; and said bonds shall be pay- able out of the proceeds of the spe- cial assessment levied for said im- provement. Both principal and interest shall be payable at the office of the City Treasurer in the City of Dubuque. Gentlemen: In connection with our instructions of August 17th, a ques- tionaire • was sent to a number of Iowa cities on August 18th request- ing information on the closing hour, or hours, for the sale of beer and also the closing hour for dancing at beer parlors. Replies have been re- ceived to date from 18 cities. None of the 18 cities have any local or- dinance governing the closing hour for the sale of beer. Eleven of the 18 cities also have no regulation for the closing hour for dancing at beer parlors. The 11 cities last above mentioned are Ames, Burlington, Cedar Rapids, Council Bluffs, Daven- port, Grinnell, Fort Madison, Keo- kuk, Marion, Muscatine, and Ottumwa. In answer to the portion of the questionnaire regarding the closing hour for dancing at beer parlors, please be advised that the following cities make it compulsory that danc- ing stop at midnight, namely Cedar Falls, Fort Dodge, Marshalltown, Mason City, and Waterloo.
