stated that service thereof had been
duly made and that this meeting is
called for the purpose of acting upon
proposals submitted on the following
public improvements: Paving of
Main Street and South Main Street
from the north property line of
Charter Street to the south property
line of West Seventeenth Street; In-
stalling boulevard lights on Main
Street from Jones Street to West
Thirteenth Street; Resurfacing West
Seventeenth Street from the west
property line of Central Avenue to
the east property line of West Lo-
cust Street; Paving of R oosevelt
Street from the westerly property
line of Rhomberg Avenue to the
north line of Lot 6, Peil's Subdivis-
ion; and acting on any other busi-
ness as may properly come before a
regular meeting of the City Council.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: At the special Council
meeting of August 28th the letter
from Mr. Herbert A. Kennison, dated
August 17th, addressed to the Coun-
cil was referred to the City Man-
ager for investigation and report
back to the Council.
The original request for Mt. Ver-
non Court was made May 5, 1933,
by Mr. Herbert Kennison. The re-
quest was that the Council approve
the laying out and to perform grad-
ing of the street shown on the plats
attached and indicated as "Mt. Ver-
non Court." It was mentioned that
the Zoning Board had given this pro-
position study and approval as a pre-
liminary measure until final appro-
val by the City Council. It was
also mentioned in the original appli-
cation that the final grades were to
be submitted and approved by the
City Engineer.
The City Council viewed this pro-
posed allotment June 6, 1933, and
discussed somewhat some of the fea-
tures with Mr. Kennison on the
ground. No actual decision of accept-
ance was made on this date.
Mr. Kennison's letter of August
17th asks that the letter of May 5th
be disregarded and he now asks that
the plan be approved, with no men-
tion of the City doing the grading
on said plan.
The City Engineer and the writer
have studied this plan and we have
the following criticisms and sugges-
tions to make thereon: —
In connection with the improve-
ment assessments for paving and
sanitary sewerage of Mt. Vernon
Court, the entire costs of said im-
provement are to be borne by the
lots owned by Mr. Kennison and be-
ing in the Mt. Vernon Court Addi-
tion. No improvement assessments
are to be levied on the Country Club
property, the lot immediately north
on the west side of Grandview Av6-
nue, or the lots in the Jones Addi-
tion in Overview Court. Mr. Kenni-
son agrees that his property shall
assume all improvement assess-
ments.
The question was discussed with
Mr. Kennison as to what authority
he had for showing a portion of Mt.
Vernon Court being platted on Coun-
try Club property at a point approx-
imately 145 feet west of the Grand-
view Avenue property line at the
intersection of the 15 -foot public al-
ley. This portion shown on Country
Club property is a triangle approx-
imately 10' x 23'. Mr. Kennison was
advised that it was up to him to try
to secure from the Country Club this
above mentioned triangle and if pro-
per arrangements could not be made
to secure this triangle, that the Mt.
Vernon Court south line would have
to be moved toward the south appo-
site this point at least 5 feet in order
to provide a court width of at least
25 feet.
On the original plat Mr. Kennison
had shown a new 15 -foot wide public
alley approximately 150 feet west of
Grandview Avenue and running in a
general direction parallel to Grand-
view Avenue, but said alley did not
extend to the rear of the Jones al-
lotment on Overview Court to the
extent of 4 feet. The City Council
discussed this question with Mr.
Kennison on the ground June 6th.
He then agreed, and has confirmed
his decision since, that the alley can
be shown platted clear to his south
property line or to the line of the
Jones allotment. At this time the
alley will not be a benefit to the
Jones allotment as it will end at a
rear line of one private lot, but the
purpose of the City Council in de-
manding that this alley extend clear
through this Kennison property was
to prevent some serious action in
the future.
On Lots 3 and 4 of the Mt. Vernon
Court Addition, designated "Ken
Sub," the 12 -foot easement for pri-
vate drive at the south end of these
two lots is questioned. The proposed
Zoning Ordinance requires that the
minimum for a single family lot shall
he 6000 sq. ft. Lot 4 is shown as 6175
sq. ft., but the 12 -foot easement at
the south end, which was originally
intended to remain in Mr. Kennison's
name, would decrease the size of this
area so that Lot 4 could not be used
for building purposes. It is suggest-
ed that rather than an easement be-
ing mentioned here and the property
remaining under Mr. Kennison's
name, that the easement be re-
moved, with the provision that "pri-
vate drive" be inserted and the en-
tire lot be sold to one person. Mr.
Kennison has consented to this.
In connection with the 4 -foot wide
easement around the south side of
Lots 5 and 6 and the west side of
Lots 6, 7 and 8 and the north side
of Lots 8, 9 and 10, we also ques-
tion the advisability of Mr. Kennison
retaining a 4 -foot strip between his
present property and the edges of
the lots to be sold in the future. Mr.
Kennison would be required to pay
taxes on this 4 -foot strip over an ex-
tent of some 700 or 800 feet, which
is not practical and it is strongly
recommended that the allotment
plan be not accepted with such ease-
ment complications. Mr. Kennison
has agreed to remove this 4 -foot
easement strip on all of the above
mentioned Lots 6 to 10 inclusive.
Another question that has been
raised is the right for Mr. Kennison
to designate an established building
line on the north side of Mt. Vernon
Court through property of the Du-
buque Golf Club.

Council, Dubuque, Iowa.
Gentlemen: In connection with
the letter of August 22nd from Jo-
seph C. Gehrig, insurance service, of
Dubuque, Iowa, to the City Council
of Dubuque and referred to the wri-
ter for investigation and report at
the special meeting of Council Au-
gust 28th, please be advised as
follows:
Mr. Gehrig desires that the City
Council of Dubuque authorize the
cancellation of the $2,000 surety
bond for a Class "B" permit to sell
beer issued to Mr. Milton Steiner of
165 West 4th Street, Dubuque, Iowa.
This location is on the north side
of West 4th Street 'underneath the
present street floor occupied by Sam
Swift's Barber Shop.
Chief Giellis and the writer inves-
tigated from several sources and we
find today that this beer parlor was
closed about August 15, 1933.
Mr. Steiner was asked to come to
this office today and gave the infor-
mation that he can no longer oper-
ate a Class •'B" beer parlor and de-
sires that Council do everything pos-
sible to relieve him of costs already
obligated, including the cancellation
of the bond and the permit fee for
sale of beer if possible. I assured
him that there was no rebate on the
yearly license for a Class "13"
parlor.

Gentlemen: Attached is a letter
from Mr. C. 'B. Jenkins, 11 East 26th
Street, requesting a new street light
at the intersection of White and 26th
Streets. Attached is also a sketch
showing the present layout of street
lights in this vicinity.
Many minor robberies have oc-
cured in this section in the past few
months. Inasmuch as these are long
blocks and White Street is inade-
quately lighted, particularly at this

Mr. H. C. Baumgartner, chairman
of Playground and Recreation Com-
mission and Syl McCauley, recrea-
tional director, addressed the Coun-
cil relative to the construction of a
proposed swimming pool.
Communication of Playground and
Recreation Commission stating that
the Commission has selected Mr. C.
I. Krajewski as architect for the pro-
posed swimming pool and asking the
City Council to approve of their se-
lection and also that the City So-
licitor be instructed to draw up and
execute, between the City of Du-
buque and the architect, a contract
embodying terms, payment, obliga-
tions, etc., presented and read.
Councilman Andelfinger moved
that the contract as drawn by the
City Solicitor covering the services
of Mr. C. I. Krajewski as architect
for the proposed swimming pool be
approved and the Mayor authorized
to execute the same on behalf of
the City of Dubuque. Seconded by
Councilman McEvoy. Carried by the

Communication of Playground and
Recreation Commission requesting
the approval of the City Council on
their selection of the site for the
proposed swimming pool namely that
part of City property south of Rail-
road Avenue, which includes Lot 29
of the Harbor Addition and such
other adjoining City property as may
be necessary for the construction of
said pool, presented and read.
Councilman McEvoy moved that
the site as selected by the Play-
ground and Recreation Commission
for the construction of the proposed
swimming pool be approved. Sec-
onded by Councilman Andelfinger.

the proposed estimate to be expend-

proposed swimming pool, presented
and read.

making of an application to the Fed-
eral Government for funds in an
amount not to exceed $60,000.00 for
the construction of the proposed
swimming pool and the return pay-
ment of said $60,000.00 to be paid

common labor at 50 cents per hour
and $1.20 per hour for skilled labor
and that a copy of said telegram ac-
company all plans and specifications
which may be applied for by con-
tractors. Seconded by Councilman

Dubuque, Iowa.
Gentlemen: Pursuant to law the
Zoning Commission, after its ap-
pointment, proceeded with due dili-
gence to prepare a preliminary re-
port embodying a proposed zoning
ordinance for the City of Dubuque
providing for various zoning districts
with regulations as to use, height
and areas of buildings and land, etc.,
as deemed proper by the commission
and best suited to carry out the pur-
poses of the statute providing for
municipal zoning. The commission
was ably assisted by John Nolen
and associates.
The City Manager and the Build-
ing Commissioner have examined
the proposed ordinance for accuracy
in detail in conjunction with the
commission. The City Solicitor has
very thoroughly studied the ordin-
ance from both the legal and the
practical standpoint and approved
the same.
Upon completion of said report and
ordinance the commission proceed-
ed to hold public hearings thereon
as contemplated by statute. Prior
to said public hearings, invitation
was given to certain groups who
might have special interest in the
matter.
Notice, by publication, was then
given of two public hearings to be
held August 24 and 31, 1933, respec-
tively and proof of publication of
such notice, together with an ex-
planatory article which was also
published, is attached hereto and
made a part hereof.
Said public hearings were ,held
pursuant to said notice and thereaf-
ter the commission adopted said pre-
liminary report and made it their
final report and it submits herewith
to your honorable body the same for
adoption into ordinance.

your instructions and our advertise-
ment, bids were received at 10:00
a. m. Wednesday, September 6, 1933,
for the resurfacing of West 17th
Street from Central Avenue to Lo-
cust Street.
At about the time of receipt of
bids, we were officially advised that
on all Public Works 30% Aid Pro-
jects, the contractors shall pay $.50-

$1.20 labor scales. This was un-
known to the contractors and City
officials prior to the receipt of bids.
Bids were unopened until a special
meeting of City Council with the con-
tractors September llth and at that
time the contractors who bid on said
17th Street agreed to abide by the
$.50-$1.20 labor rates.
Accordingly, the bid was opened
and attached is a tabulation showing
the bid received. Inasmuch as this
bid is below the Engineer's estimate
and the contractor agrees to abide
by the requirements of the $.50 -$1.20
labor rates, the City Manager recom-
mends that the contract for the re-
surfacing of West 17th Street be
awarded to the James F. Lee Paving
Company as it was the low bid and

Gentlemen: In connection with the
alternate proposals taken on the
Kaufmann Avenue Water Works Re-
servoir improvements which have
been held up since receipt of bids
for two days, please be advised that
no word has been received that the
requested 30% Federal Aid has been
granted. Inasmuch as the reservoir
work needs immediate attention and
can be finished this fall only in case
of start at the very earliest date, it
is the writer's recommendation that
the request for 30% Federal Aid for
the Kaufmann Avenue Reservoir and
the Eagle Point Smoke Stack, which
were both estimated at $13,000, be
cancelled: that Federal authorities
be advised that local funds can be
raised for this construction and the
work will be started at once, to be
paid for by this city.
Accordingly, it is my further
recommendation that the work for
the Kaufmann Avenue Reservoir be
awarded to the low bidder, namely
Wm. Yokom, on the basis of 40%
minimum common labor and that the
prevailing Dubuque wage scale shall
apply for skilled labor as outlined

to ride in an automobile in the par-

COUNCIL OF CITY OF DUBUQUE
'Whereas, information has been
received that, through the efforts of
U. S. Senator Louis Murphy, the pub-
lic works administration has con-
cluded to allocate sufficient funds
for the immediate construction of
dams in the Mississippi river in the
vicinity of the city of Dubuque, work
thereon to be begun within the near
future; and
"Whereas, all of the citizens and
residents of the city of Dubuque have
evidence intense interest in the de-
velopment of these public projects
in order that suffering and hard-
ships, due to a long period of un-
employment, may be alleviated; and
"Whereas, it is recognized that
immediate construction of these
projects will furnish employment to
a great number of our people who
would otherwise become or continue
to be in a destitute condition and
objects of public and private char-
ity; and
"Whereas, it is the purpose of the
council of the city of Dubuque, on
behalf of all of the people of such
city, to adopt this Resolution ex-
pressing herein to Senator Louis
Murphy its sincere appreciation of
his untiring efforts, interest and the
exercise of his great influence in se-
curing from the Public Works Ad-
ministration the allocation of suffi-
cient funds to construct the dams
in the immediate vicinity of Dubuque
in furtherance of the development
of the nine -foot channel for the Up-
per Mississippi River and to assure
him of its sincere belief that, with-
out his efforts, interest and influ-
ence these projects would have been
indefinitely deferred.
`Be it, therefore, resolved that a
certified copy of the expression of
appreciation herein contained be
transmitted to Senator Louis Mur-
