Councilman Andelfinger be appoint-
ed as Mayor Pro -tem of the meeting.

Mayor Pro Tem Andelfinger stated
that this is the regular monthly
meeting of the City Council for the
purpose of acting upon any business
that may properly come before the
meeting.
Proof of publication, certified to by
the publishers, of the notice of meet-
ing for issuance of Dock Bonds. The
City Council of the City of Dubuque,
Iowa, will meet on the 4th day of
January. 1932, at the Council Cham-
ber in the City Hall, Dubuque, Iowa,
at 7:30 o'clock P. M., for the purpose
of instituting proceedings and taking
'action for the issuance of Dock
Bonds of said City in the amount of
$150,000.00 for the purpose of con-
structing works . and improvements
for the harbor and water front in
said City and for the purchase of
property for said purpose. At any
time before the date of said meeting
five or more taxpayers may file a
petition in the office of the City
Clerk setting forth their objections
to the issuance of said bonds. By
order of the City Council, December
14th, 1931.

of the City of Dubuque.
Gentlemen: Pursuant to a notice
published by the Clerk of the City
of Dubuque of a public hearing to be
held on January 4, 1932, by your
Honorable Body for the purpose of
hearing objections to the proposed
action of the Council to issue addi-
tional Dock Bonds in the sum of
$150,000, you are adised that objec-
tions have been filed in my office by
taxpayers of the City of Dubuque in
sufficient number to warrant the sub-
mission of all matters to the Direct-
or of Budget of the State of Iowa.
Therefore, in accordance with the
provisions of Chapter 23 of the Code
of Iowa, 1931, I, as Clerk of the City
of Dubuque, am preparing a copy of
such objections together with other
pertinent information for submission
to the Director of Budget, which will
go forward to such Director as soon
as the same has been completed,
and I am advised by the Solicitor
that further proceedings with refer-
ence to the proposed issuance of
bonds must remain in abeyance until
all matters are finally determined
by such Director of Budget at a
hearing to be held by him for such
purpose.

tion of a coal terminal at present

mended by the Dock Commission
presented and read.

Mr. John Loftus, President of
Home Defense League, Mr. J. A.
Cunningham, Counsel for Home De-
fense League, et al addressed the
Council objecting to the entering
into a contract or building of a coal
terminal and requesting that this
matter be brought before the public
at the next spring election. Mr. J. A.
Kerper, Mr. W. W. Morse et al ad-
dressed the Council in support of the
project as to the building of the
coal terminal and entering into a
contract for same.
Petition of J. J. Nagle requesting
the City Council to designate the
amount the City will accept for the
issuance of a deed to him for the
purchase of Lot 1 of Min. Lot 82 and
also stating that the amount paid by
the City at date of tax sale was
$343.71 presented and read.
Councilman Schuckert moved to
refer the petition to the City Solic-
itor to arrange the execution of the
deed for the amount mentioned plus
6% interest. Seconded by Council-
man Jansen. Carried by the follow-
ing vote:

tute requesting the City Council to
consider the use of Iowa coal in the
fuel requirements of the City of Du-

Whereas, the Interstate Power
Company has caused to be filed in
the office of the Clerk of the City of
Dubuque a change in rates to be
effective as of January 1, 1932, for
residence, commercial, and street
lighting and such change is a reduc-
tion in the rates previously charged
for such purposes, and,
Whereas, this Council has exam-
ined the schedule proposing such
changes in rates and finds the same
to be satisfactory at this time:
Now Therefore, Be it Resolved by
the City Council of the City of Du-
buque, That the schedule containing
the change in rates effective January
1, 1932, as submitted by the Inter-
state Power Company be made a
matter of record and that the same
be approved.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: On November 30th Mr.
J. J. Nagle, owner of Lots 3 and 4,
Newman's Subdivision on Southern
Avenue, requested that he be per-
mitted to repurchase said lots, which
the City now owns on tax deeds, for
the amount of $35.23 for general
taxes and sewer assessment amount-
ing to $25.21. There is still an un-
paid balance for said sewer amount-
ing to $39.70, making the total
$100.14.
It was the unanimous opinion of
the entire City Council, Mr. Schuck-
ert being absent, that Mr. Nagle be
permitted to repurchase the deeds
for this property on the basis of the

payment of the principal, plus 6%
interest.

Illinois Central Railroad dated No-
vember 3, 1931, signed by Hurd,

neys, praying that the City of Du-
buque vacate Main Street south of
Railroad Street, was considered by
the Council at an informal session
Saturday, December 19th, all mem-
bers being present except Mr.
Schuckert.
It was unanimously decided that
the City should not vacate this prop-
erty.

Mrs. Margaret Bour, owner of Lot 1

northeast corner of Algona and
Dodge Streets, requested the City
Council to reduce the assessment for
the improvement of North and South
Algona Streets as assesssed against
Lot 1 of 59.
The Mayor and City Council, with
the exception of Mr. Schuckert, who

cember 19th and determined that no
reduction could be granted.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: At the informal meet-
ing of City Council held Saturday
afternoon, December 19th, the City
Manager presented requests from
the Dubuque Y. M. C. A., signed by
J. L. Daniels, President, requesting
Council to consider reduction in rate
for water used in the swimming pool
at the Y. M. C. A. The plea of the
Y. M. C. A. was the fact that certain
other Iowa cities make reductions in
water rates to similar institutions.
The City Manager reported that
investigation had shown the follow -
ing:—
The average monthly consumption
of water to the Dubuque Y. M. C. A.
from October 1, 1930 to September 1,
1931 was 42,500 cu. ft. or an average
monthly charge of $49.60.
Other statistics were presented to
Council showing that the same
amount of water for Y. M. C. A. pur-
pose in other Iowa cities would be
as follows: —
Waterloo, a city company, $11.37
cheaper.
Marshalltown, a city company,
$3.77 cheaper.
Burlingtonn, a private company,
$21.05 cheaper.
Fort Dodge, a city company, $14.56
cheaper.
Sioux City, a city company, $28.35
cheaper.
Iowa City, a private company,
$18.40 cheaper.
Council Bluffs, Davenport, Des
Moines, Keokuk, Clinton and Mason
City would be in excess of the pres-
ent charges of Dubuque.
It was felt by Council that some
reason for the reduction in Y. M.
C. A. water rates, other than the
fact that City firemen, City police-
men and City playgrounds used the
facilities, was necessary prior to the
lowering of rates. It was also felt
that if, from the standpoint of
health, the rates for swimming pools
were lowered, that the same should
apply to Clarke College and the Uni-
ersity of Dubuque.
Due to the fact that the Water
Works is faced with the possibility
of having to purchase the interests of
a number of Dubuque business firms
in the high pressure lines built years
ago in the business streets of Du-
buque and that the present trouble
with the well at the Water Works
and other features recommended by
the Underwriters, all of which would
require considerable cash from earn-
ings to consummate, that no reduc-
tion in rates should be considered at
this particular time.

Resolution No. 2 -32.
On January 4, 1932, Almighty God
called to his Eternal Reward„ Philip
J. Link.
For many years, Mr. Link has
been a loyal, conscientious and faith-
ful employee of the City of Dubuque.
His passing has been the occasion
of genuine sorrow. His pleasing dis-
position and fair treatment of those
under his immediate jurisdiction has
won for him countless friends and
his honesty and integrity and will-
ingness to perform the duties of his
office under all conditions and cir-
cumstances has gained for him full
appreciation by his superiors. The
members of the Council of the City
of Dubuque, both individually and as
the governing body of said City,
recognizing the great loss which has
been suffered due to his death desire
to join with sorrowing friends and
relatives in expressing, by the adop-
tion of this Resolution their heart-
felt sorrow and sympathy.
Now Therefore:
Be it Resolved by the Council of
the City of Dubuque:
That this Resolution be spread up-
on the permanent Council Records of
of said City and that a copy of the
same, duly certified to by the City

On January 10, 1932, John Stuber,
Clerk of the City of Dubuque for
nearly fourteen years, was sum-
moned by Almighty God from his
temporal home to His Eternal King-
dom. The news of his death has
shocked this entire community. He
was honored and esteemed by his
fellow men. He was a good citizen
and a christian gentleman. He was
endeared to all who knew him. As
a public official he won the respect
and admiration of not only the Coun-
cils, with which he was directly
associated, but also of all who had
occasion to consult him in his offi-
cial capacity. He was honest, faith-
ful and conscientious in the dmin-
istration of the affairs of his office.
His passing marks an occasion of
genuine sorrow.
This Council wishes to join with
sorrowing friends, associates and
relatives in giving expression to its
grief and sympathy and, to the end
that this expression may be perpet-
uated,
Resolved that this Resolution be
spread upon the permanent records
of the Council of the City and a copy
thereof, duly certified to by the Clerk

Resolution No. 5-32
WHEREAS, the contract hereto-
fore entered into by the City of Du-
buque for the Construction of a six
inch sanitary sewer in Klingenberg
Terrace and Rosaline Streets, here-
inafter described, has been com-
pleted and said improvement has
been accepted by the .City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $946.16,
AND WHEREAS, public notice as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Counucil to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and determined:
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque that to provide for
the cost of the construction of a six
(6) inch vitrified tile sanitary sewer,
manholes and Y branches in Klingen-
berg Terrace from the manhole in
Kleine Street westerly to Rosaline
Street and southerly in Rosaline
Street to the north line of Lots ele-
ven (11) and fifteen (15) C, A. Voel-
ker's Addition, there be issued Sewer
bonds to the amount of $946.16.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 11th. day of February, 1932;
shall be in denominations of $100.00
except that there shall be one bond
to the amount of $46.16. They shall
be numbered from 3255 to 3264 in-
clusive and shall be divided into ten
series of which the bond numbered
3255 shall constitute the first series
and shall be payable the 1st. day of
April, A. D. 1932; the bond numbered
3256 shall constitute the second ser-
ies and shall be payable the first day
of April, A. D. 1933; the bond num-
bered 3257 shall constitute the third
series and shall be payable the 1st,
day of April, A, D. 1934; the bond
numbered 3258 shall constitute the
fourth series and shall be payable
the 1st. day of April, A, D. 1935; the
bond numbered 3259 shall constitute
the fifth series and shall be payable
the 1st. day of April, A. D. 1936; the
bond numbered 3260 shall constitute
the sixth series and shall be payable
the first clay of April, A, D. 1937;
the bond numbered 3261 shall consti-
tute the seventh series and shall be
payable the let. day of April, A. D,

Said bonds shall bear interest at
the rate of five per cent. per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-
tached; and said bonds shall be pay-
able out of the proceeds of the spe-
cial assessment levied for said im-
provement.
Both principal and interest shall
be payable at the office of the City
Treasurer in the City of Dubuque.

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer hereof,

with interest thereon at the rate of
five per cent. per annum, payable on
the presentation and surrender of
the interest coupons hereto attached,
both interest and principal are pay-
able at the office of the City Trea-
surer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City

tion; which cost is assessable to and
levied along said improvement, and
is made by law a lien on all abutting
or adjacent property, and payable
in ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent. per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used for no other pur-
pose, And it is hereby certified and
recited that all the acts and condi-
tions and things required to be done
precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular
and due form as required by said law
and resolution; and for the assess-
ments, collections and payment here-
on of said special tax, the faith and
diligence of said City of Dubuque are
hereby irrevocably pledged.
In Witness Whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City affix-

Gentlemen: At the regular meet-
ing of December 7th Mr. Daniel
Courtney requested the Council to
cancel the assessment on the East
19.88 ft. of Lot 12, Ann O'Hare's Sub-
division on the southerly side of
Grace Street for the reason that the
said lot had been assessed in the
West Dubuque sewer program,
whereas no sewer had been erected
in front of said lot at that time as
sewer in front of this lot had been
built years ago.
City Council viewed this lot De-
cember 19th, with all members ex-
cept Mr. Schuckert present, with no
decision being made at that time.

This is to advise your Honorable
Body that the City Engineer in-
cluded this lot in the 1930 assess -
men of West Dubuque sewers at the
uniform rate of approximately $3.00
per foot frontage inasmuch as the
lot had not previously been assess-
ed for the sewer built on Grace
Street in front of the same.
Your decision as to the prayer of
the petition that this assessment
now be cancelled is desired at this
time.

Gentlemen:
The matter of the verbal sewer
assessment complaint filed by Mr.
Dan Courtney, which was referred to
the City Council and viewed on the
ground at the informal meeting held
December '19, 1931, was referred to
the City Engineer and City Manager
for further investigation.
Please be advised that we find on
investigation that Mr. Courtney has
not been doubly assessed for sani-
tary sewer facilities on his property.
The original assessment against the
East 30.12 ft. of the Grace Street
frontage was made about 1907. The
West 19.88 ft. was not assessed at
this time, although this sewer ex-
tends partially in front of this lot.
The 1930 West Dubuque Sewer as-
sessment did not include any further
assessment against the East 30.12 ft,
but did include an assessment
against the 19.88 ft. on Grace Street
frontage amounting to $31.37. This
is a narrow shaped lot which extends
for a distance of 19.88 ft. in width
from Grace to Bennett Streets, being
268 ft. in length. The Bennett Street
assessment for this West Dubuque
sewer included an assessment for
19.88 ft. and also the lot to the east
designated as the South 1 / 2 of the
West 31.12 ft. was assessed for
$47.54.
A recapitulation of these assess-
ments includes the following:
Grace Street -19.88 ft $31.37
Bennett Street -19.88 ft. 31.37
Benett Street -31.12 ft. 47.54
$110.28

Gentlemen:
The question of the repairs to the
sidewalk and the downspout drain of
the Y. M. C. A. under date of Decem-
ber 24th, which was referred to the
Council January 4th and referred to
the Manager for additional informa-
tion, please be advised that I dis-
cussed with Mr. Stirratt today the
plumbing and sidewalk repairs.
It is the Manager's recommenda-
tion that inasmuch as the City
moved the catchbasin, to which the
downspout was originally connected,
without notification to the Y. M.

C. A., that the City stand the cost
of this new connection, namely
$14.15; that inasmuch as the side-
walk repairs, originally invoiced at
108 feet at 15 cents per foot or
$16.20, included repairs to a consider-
able area at the intersection, I
agreed to recommend to Council that
the City stand one -half of the $16.20
bill or $8.10. I am therefore recom-
mending that 50/ of the sidewalk
bill to E. C. Kuehnle amounting to
$8.10 and the bill. of the Nesler and
Buechele Company for $14.15 be
assumed by the City of Dubuque due
to the fact that the former City em-
ployees did not provide the facilities
in the new catchbasin as had been
in the former catchbasin.

Gentlemen:
In connection with the three re-
quests for street lights referred to
the City Manager, I wish to advise
that in regard to the request for a
new light on Locust Street between
16th and 17th Streets, I find that this
stretch is not unusually long and
believe that by moving the 17th
Street light out about 15 feet on the
span across Locust Street that the
present facilities will be sufficient for
this block.
The request for a new light at
Gondolfo and Dodge Streets seems
unnecessary at this time as there
is at present a light at Dodge and
Algona about 200 feet from this
intersection and also a light near
the middle of Gondolfo Street be-
tween St. Joseph and Dodge Streets.
We have, however, ordered in a red
light reflector for the intersection of
Dodge and Gondolfo to protect traffic
going westwardly on Dodge Street.
Regarding the request of property
owners on Francis Street between
23rd and Kaufman, the writer would
respectfully recommend that no light
be installed on this street in the
middle of the block. The reason for
this is, while the block is rather long,
heavy trees occur on both sides of
the street and it would be impossible
to string wires without causing chop-
ping and trimming of said trees. I
would, however, recommend the mov•
ing of the present lights on Francis
Street as follows: Move the Kauf-
man Avenue light about 10 feet east -
wardly to be nearer the center line
of Francis Street; change the pre-
sent bracket light on West 23rd
Street to a new span type light and
move said location 15 feet east -
wardly to light up the middle of the
intersection of West 23rd and Fran-
cis Streets.

previous action of the City Council
in receiving and filing this petition
be rescinded and that the prayer of
the petitioners be granted and the
City Auditor be instructed to draw
a warrant in the sum of $50.00 in
favor of the Eagle Point Produce
Company to cover the amount of the

Iowa, a municipal corporation, the
receipt whereof is hereby acknow-

owner of East 1/2 of Lot 304 Wood -
lawn Park Addition in the City of
Dubuque, hereby grants and conveys
to said City of Dubuque, a perpetual
right of easement, in, over and
across said East 1 /2 of Lot 304 Wood -
lawn Park Addition for the purpose
of constructing a storm sewer with
the right to go upon said premises
at all reasonable times for the pur-
pose of inspecting and repairing the
same when installed; provided, how-
ever, that said City of Dubuque shall
