Regular Session, May 2nd, 1932.
Council met at 7:50 p. m.
Present —Mayor Andelfinger, Coun-
cilmen Kane, McEvoy, Schuckert,
Thompson, City Manager Evans.
Mayor Andelfinger stated that this
is the regular monthly meeting of
the City Council for the transaction
of such business as may properly
come before a regular meeting of the
City Council.
Communications of Dubuque Traf-
fic Association, The Adams Company
and The White House Biscuit Com-
pany objecting to the passage of the
proposed ordinance restricting the
maximum weight and length of trail-
ers and semi - trailers upon the streets
of the City of Dubuque; prohibiting
the use upon said streets of trailers
and semi - trailers exceeding such re-
stricted weight and length limita-
tions; repealing all ordinances or
parts of ordinances in conflict here-
with; declaring an emergency to
exist; and providing penalties for the
violation hereof presented and read.
Councilman McEvoy moved to re-
ceive and file the communications.
Seconded by Councilman Thompson.
Carried by the following vote:

Communication of Mississippi Val-
ley Shippers' Conference stating that
a meeting of the National Rivers and
Harbors Congress has been called to
meet in Chicago, Ill., on June 13th.
and 14th. for to formulate plans to
resist the organized efforts which
threaten to impair or cause the
abandonment of the entire national
system of waterways and requesting
the City Council to join in having
this meeting held in the early part of
May instead of the dates as sug-
gested presented and read.
Councilman McEvoy moved to re-
fer the communication to the City
Manager. Seconded by Councilman
Schuckert. Carried by the following
vote:

Petition of Rudolph Hansen re-
questing that the City accept the
sum of $17.74 as full payment of the
second assessment levied against his
property for the paving in front of

In connection with the authorized
settlement in reduction of assess-
ments for land owned by Dr. C. W.
Powers between Bennett and West
Third Streets, please be advised that
we attach hereto two copies of the
agreement which has been approved
by Dr. Powers and is in line with
the last instructions by Council and
meets with the City Solicitor's ap-
proval.
We suggest that the settlement be
spread on the Council minutes and
one copy be submitted to the Trea-
surer with instructions to revise the
special assessments accordingly.

It is understood that the City of
Dubuque assumes $375.88 of your
original total assessments and that
interest on the previous assessments
has been cancelled up to March 29,
1932. You are to pay interest at the
rate of five (5 %) per cent on the
adjusted amount of $400.00 from and
after March 29, 1932.
Your $400.00 adjusted total is to
be paid with interest by you in eight
(8) annual installments beginning
March 31, 1933 and ending March 31,
1940, which last date is the last day
for settlement of the West Dubuque
sanitary sewer system.
The above mentioned reduction of
assessments by Council is further
conditioned upon your previous ver-
bal offer to deed to the City of Du-
buque, without compensation, a strip
off the south end of Lot 25 twenty -
five (25) feet in width for the- approx-
imate distance of 137.94 feet, which
area is now within the lines of West
Third Street and needed for street
purposes by the City.

agreement is now acceptable to you
and if so, that you will return at

Acceptance
The adjustment of assessments
originally $775.88, reduced to $400.00
is satisfactory to me. I will deed to
the City of Dubuque, Iowa, a strip
25 feet wide off the south end of Lot
25, approximately 137.94 feet along
and entirely within the street lines
of West Third Street.

The Council viewed the property
of Mrs. Minnie Miller including Lots
68, 69, 70, 71 and 72 of McDaniels
Park Hill Addition on Burlington
Street in line with the request made

Gentlemen:
On April 4, 1932, a petition for
the paving of Kleine Street from
Kaufman Avenue to Klingenberg
Terrace was received by City Coun-
cil and referred to the Council to
view the ground. At the special
meeting of Council on April 26th the
petition was received and read for
the paving of Chappell Court. Chap-
pell Court starts from the west side
of Kleine Street and runs westward-
ly one block. This petition was also
referred to Council to view the
ground.
At a special meeting April 28th, at
which Councilmen Kane, McEvoy,
Schuckert and Thompson were pre-
sent, with Mayor Andelfinger absent,
the City Council viewed both Chap-
pell Court and Kleine Street, con-
sidered the petitioners for and
against the improvement, and unan-
imously decided to proceed with the
paving of both Kleine Street and
Chappell Court. Kleine Street is to
be paved 26 feet wide, allowing 2
feet greater parking space on both
sides than is in existence at the
present time with the stone curbs in
place, which are to be removed. The
width of paving on Chappell Court
is to be 18 feet.
We attach herewith the petition
and remonstrance on Kleine Street,
together with the petition on Chap-
pell Court.

Gentlemen:
Attached is a notice to bidders
for the purchase of a motor pickup
sweeper. This notice was run in the
Dubuque Telegraph- Herald April 14
and 15 in compliance with instruc-
tions at the meeting of April 11th.
This is to advise that today, in strict
compliance with the notice to bid-
ders, the following proposals were
received on a motor pickup sweeper:
The Elgin Corporation of Elgin,
Illinois quoted on one new Model
Elgin D Sweeper f. o. b. Dubuque,
$6,500.00, trade -in allowance on pre-
sent Elgin City Sweeper $300.00,
with an additional $130.00 allowance
for cash within thirty days, net price
$6,070.00. As the alternate plan (B)
Regular Session,
in our proposal, they offer to permit
the City of Dubuque to pay within
ten days from receipt of said ma-
chine in good condition $2,166.66,
with a deferred payment one year
from date of delivery $2,166.66 and
the second deferred payment two
years from date of delivery $2,166.66,
or a total price of $6,499.98. It is
further stipulated that the City of
Dubuque is permitted to keep the
present Elgin Sweeper as long as is
desired by the City. The further sti-
pulation offers to donate to the City
a new belt to replace the present
broken belt for the old Elgin free of
cost. The selling price of this belt
is $230.00. It is felt that this propo-
sition cannot be considered with the
bid of the Elgin Company inasmuch
as it was not requested in the notice
to bidders. It is further felt that to
try to repair and maintain the old
machine is useless.
The second bid was received from
the Austin-Western Road Machinery
Company of Chicago, Illinois. They
propose to deliver to the City one
new 1932 four wheel Austin Motor
Sweeper for $6,500.00. The trade -in
allowance on the present Elgin
Sweeper is $500.00, with a further
2% discount, amounting to $130.00 if
cash is paid for the entire trans-
action within thirty days, making a
net cash price of $5,870.00. On the
lease plan they offer to deliver to the
City said machine on the basis of
$2,130.00 payable within thirty days
from delivery and on April 10, 1933
a further payment of $2,130.00 and
on April 10, 1934 a further payment
of $2,130.00, making a total deferred
payment of $6,390.00. This bid also
includes the stipulation that the City
of Dubuque is permitted to keep pre-
sent Elgin Sweeper as long as is
desired by City.
You will note that the Austin Ma-
chine is $109.98 cheaper on the de-
ferred payment plan and is $200.00
cheaper on the cash plan. It is re-
commended that the deferred or
lease plan be adopted in the consid-
eration of purchase of either ma-
chine.
It is felt that both machines have
been improved since the time of the
use of each by the City of Dubuque.
The writer will be glad to go into
details of comparison prior to pur-
chase of this equipment, which is
badly needed, and it is hoped that
a decision can be reached this eve-
ning.

tract of lease be entered into by and
between the City of Dubuque and the
Austin - Western Road Machinery Co.
for one Motor Pick -up Street Sweep-
er in accordance with the form
thereof prepared by the City Soli-
citor for the sum of $6390.00. Be it
further resolved that this Resolution
and Contract of Lease remains on
file for public inspection together
with the specifications therefor, for
at least one week before final adop-
tion, approval and execution.

Contract of Lease
A contract of lease is hereby en-
tered into by and between the City
of Dubuque, owner of the Municipal
Athletic Field, hereinafter referred
to as the lessor, and Dubuque Base-
ball Fans Association, owner of the
Dubuque Baseball Club, hereinafter
referred to as the lessee under the
following terms and conditions:
In consideration of the mutual
promises and agreements herein con-
tained the parties hereto have and
do hereby agree among themselves
as follows:
1st. The lessor hereby grants to
the lessee the right to the use of the
Municipal Athletic Field during the
baseball playing season commencing
on May 14th and ending on Septem-
ber 15th. in each year for a period
of three years beginning with the
year 1932 and ending on September
15, 1935, and for such privilege said
lessee agrees as follows:
A. To cause to be made at its
own expense all improvements and
repairs upon the playing field.
B. To maintain at its own ex-
pense in good condition and repair
all electrical equipment, fixtures and
appurtenances, during the times pro-

charges for electrical current used
in connection therewith, it being un-
derstood that said lessee shall pay
all expenses for repairs, adjust-
ments etc. of such equipment as may
a 1st, apil September 16111. in
eac year.
P. The $upietting of said premises
during the periods herein provided
for shall be under the joint control
of the parties hereto so that, when-
eYer it is prgPPsed to sublet said
premises to others for the holding
and giving of exhibitions, attrac-
tions or events, the fees to by
charged therefore shall be mutually
agreed upon by the Manager of the
lessor, representing the City of Du-
buque, and the lessee herein. The
City shall receive, as its share of
the fees thus charged a sum equal
to twenty -five percent of the gross
fees thus exacted and the lessee shall
receive seventy -five per cent of such
fees. It is anticipated that, during
the term of this lease, the use of said
premises may be desired by civic,
.patriotic, and similar organizations
for the holding of exhibitions and
events at times when the baseball
club of the lessee is not playing
scheduled or exhibition games. As
to such organizations the lessor re-
serves the right to grant to them the
use of said premises free of charge,
except always that all expenses inci-
dent to such use, including the re-
storation of the premises in a good
condition as when received, shall be
paid by such parties to whom this
privilege may be extended.
D. It shall permit other baseball
clubs of the City (i.e. clubs playing
with regulation hard baseballs) to
use said premises in the daytime
without charge therefore, if no ad-
p)ission fee is charged by such clubs
for such games. If such games are
to be played at night, then the lessee
shall exact such a fee in advance as
vigil cover all expenses incident
thereto. Should such clubs, how
ever, e xact an admission fee to such
games then the lessee shall have the
right to demand not to exceel ten
per pent of the gross receipts taken
in at such games, plus whatever ex-
pense which may be incident to the
use of such premises, if such games
are played at night. In any event
the lessee shall provide such clubs
with bases for use in such games.
2n4. It is agreed between the
parties hereto that whatever im-
provements, additions or repairs are
Made upon the premises by the
lessee during the term of this lease
shall, upon the expiration or termina-
tion of the same, be and become the
property of the lessor and the Same
shall not be removed from the leased
premises by said lessee.
3rd. In the event that the base-
ball club, owned and operated by the
lessee should be sold or the rights
or interest therein transferred to

Gentlemen:
Mr. F. W. Coates today called at-
tention to the fact that Fischer &
Co., Inc. had furnished a bond on
the sidewalk on both Fourth and Lo-
cust Streets at the present Newkirk
Garage. Mr. Coates advises that the
premium on this bond has not been
paid for since May, 1929. He further
believes that at one time Council
had considered the cancellation of
this bond, but can find no mention
on the official City records of such
cancellation. He now requests that
the bond be cancelled.
Mr. Coates further advised that
Fischer & Co. would be willing to
continue the bond if the same pro-
cedure had been followed toward
similar sloping sidewalks and ap-
proaches to other properties of the
City, but inasmuch as this has not
been required by Council, it is now
desired that bond be cancelled.

quently, a letter was received and

4th organization meeting. The ,City
Manager, remembering the February

110 Special Session,
In order to now fully advise you
of the case of Mr. Apel, who ap-
peared at the office upon request, I
have ascertained the following facts
for your consideration:
Mr. Apel was in service six
months; was not injured, but con-
tracted a severe case of flu at Camp
Shelby which lasted from two to
three weeks. On December 16, 1918,
the set time for his release, the phy-
sicians in charge advised him that
his right lung was bad. This condi-
tion had developed between his en-
listment and this tentative discharge
and the applicant was detained in
camp one week pending , medical
treatment. He was finally dis-
charged December 23, 1918, with
knowledge by the Government physi-
cians that his right lung was in a
weakened condition, but due to his
haste to return home, he has been
unable to receive compensation for
this cause at any time.
Mr. Apel says that his lung still
bothers him at certain periods, espe-
cially when he gets a cold. He is
not able to do hard work. Mr. Apel
was a finisher at the Brunswick
plant.

Be it Ordained by the City Council
of the City of Dubuque:
Par. 240, Section 1. That the right
and privilege be and the same is
hereby granted to the Chicago, Mil-
waukee, St. Paul & Pacific Railroad
Company to lay, construct and main-
tain a sidetrack across the alley first
east of Garfield avenue commencing
at a point on the east side of said
alley opposite the south line of Lot
128, Ham's Addition to the City of
Dubuque, thence running northerly
at an angle to a point about thirty
feet north of the south line of Lot
so the issuance of the bonds was de-
ferred until a more favorable time in
order to save an excessive interest
charge. To add to the difficulty two
banks in the City closed and the
City had deposits in these banks
amounting to approximately $35,000.
The municipal bond market has
now strengthened and I am .satisfied
that our bonds, which have always
had a ready market can be issued
and sold at an interest rate of not
to exceed four and one -half per cent
with a possibility of receiving a sub -
stantial premium on an issue of
$90,000.
I have prepared the proceedings
for the issuance of sewer bonds in
the sum of $90,000 to pay the indebt-
edness created in the construction of
the sewer. This indebtedness should
be paid at once so that, if the 'Coun-
cil should consider any further im-
provement work to relieve unemploy-
ment and provide work for the un-
employed it will not be hampered by
an existing indebtedness for the;
work already done. These proceed-
ings are instituted under the provis-
ions of law governing this subject
and in strict compliance therewith.
In preparing the maturities of
these bonds I have taken into con-
sideration all outstanding bonds and
the years in which they come due
and have so arranged the maturities
of the proposed bonds so that the
payment of these bonds will not in
any manner increase the present tax
levy. In fact by the time these bonds
mature a very large part of the out -
standing bonds will have been re-
tired and the tax levy for the pay-
ment of bonds will be very mater-
ially reduced. As you know our out-
standing bond indebtedness is being
rapidly reduced and our total in-
debtedness existing after 1936 and
1937 will be cut down to such an ex-
tent that it will leave the City in
the' healthiest financial condition that
it has been for a great many years.
The 'date of the proposed bonds
will be 'June 1, 1932. The maturities
nn the' bonds are as fo'l'lows: $10,000
on December 1, 1941; '$25,000 on De-
cember 1 of each of the years, 1942
and 1943; $20j000 on December 1,
1944; and $10,000 on December 1,
1945. The interest payment dates
are June 1st and Deoember 1st of
each year.
I recommend that the Council pro-
ceed at .once with the proceedings
for the issuance of these bonds and
.order that they may be sold while a
favorable bond market exists.

To the Honorable Mayor and Coun-
cil of the City of Dubuque.
Gentlemen: In Ootober;, 1930, the
'Council adopted - proceedings for the
Shiras Avenue, received bids and
awarded a contract, Before the work
was commenced an action was be-
gun in the District Court of Dubuque
County, Iowa, challenging said con-
tract. In 1931 the case was tried
and resulted favorably to the City.
The Plaintiff then took an appeal to
the Supreme Court. In view of such
appeal, the contractor was not war-
ranted in going ahead with the con-
struction of the sewer under his con-
tract and so no work was begun on
the sewer. While this condition ex-
isted unemployment became acute in
the City and finally in the Fall of
1931 the contractor for said sewer
agreed to give up his contract if the
City desired to construct the sewer
by day labor, thereby furnishing em-
ployment to many men. This offer
was accepted and the contract was
surrendered. The City then went for-
ward with the construction of the
said sewer by day labor and hired
unemployed men to do the work.
This was the beginning of a rather
extensive program of sewer con-
struction.
Cities everywhere were trying to
find work for men out of employ-
ment. Dubuque was no different than
other cities, but the Council realized
that it had to provide work for those
unemployed in order to relieve the
unemployment situation. A system
of registering those desiring work
was inaugurated and approximately
two thousand men registered for
work. To provide work became a
serious problem. It was finally de-
cided that the only kind of work that
could be done at that time of the
year was sewer work. A program of
sewer construction was laid out
which was added to from time to
time as the work progressed and as
men demanded employment. The
Council was encouraged in the doing
of the work by all tax payers in the
City, by all civic organizations, labor
organizations and local newspapers.
That something had to be done and
done at once was apparent to every-
one and, naturally, everybody looked
to the City to inaugurate the move-
ment. It was not possible to esti-
mate the extent of the work when
it was begun or what it would cost.
This work had to be 'financed and
the Council authorized the issuance
of Bonds oaf $90,000 for that purpose.
'Conditions, however, were not favor -
able at that time for the sale of
bonds. The municipal bond market
was in a very depressed condition
and bonds could not be issued and
sold which would bear .a lesser rate
of interest than five per cent or 'even
more. iIn .fact it was [doubtful that
any bonds 'could be sold at all and
men Kane, McEvoy, Schuckert, and
Thompson.

Gentlemen: I recommend for set-
tlement the following:
An action now pending in court
entitled Joseph Hedley vs City of
Dubuque. In this action plaintiff
claims the sum of $2,500 on account
of serious personal injuries which
he received by falling upon a de-
fective walk on the corner of East
22nd and Stafford Avenue on De-
cember 5th, 1930. Plaintiff was 011
his way to work and when he ar-
rived at the place complained of he
fell and broke his leg and received
other painful injuries. His injur-
ies necessitated X -Ray examinations,
services of physicians and he suf-
fered great pain as well as loss of
employment for several months. I
investigated the circumstances of
this accident and I am satisfied that
Special Session, May 9th, 1932
a settlement is advisable. Subject
to your approval I have agreed to
pay the sum of $300 in full settle-
ment of these damages. Plaintiff
to pay the cost.
On February 4, 1932, William
Cumpton fell near the corner of 16th
and Elm Streets on a defective side-
walk and sustained serious and pain-
ful injuries to his back and across
his hips. He has been laid up from
work practically ever since his in-
juries and it is doubtful just how
long it will be before he will be
able to return to work. I am fully
acquainted with the circumstances
surrounding this accident and have
agreed to pay the plaintiff, in full
settlement the sum of $250.
In each of these cases I am satis-
fied that these settlements are ad-
vantageous to the City and, if the
same are approved by your Honor-
able Body, kindly have a warrant
drawn in the Hedley case in favor
of Hugh Stuart, attorney, for the
plaintiff in the sum of $300.00 and
in favor of William Cumpton in the
sum of $250.00.

Gentlemen: This is to advise that
on May 16th Councilmen Kane, Mc-
Evoy and Schuckert called a special
Council meeting which was held at
the City Hall about 5:15 P. M. Those
in attendance were Councilmen
Kane, McEvoy, Schuckert, City So-
licitor Czizek and City Manager
Evans. Mayor Andelfinger was out
of the City and could not be reached
prior to the meeting. Councilman
Thompson was working out of the
City and was not present.
The meeting was called to discuss
the necessity of a representative of
the City Council attending the hear-
ings before the Ways and Means
Committee of the House at Washing-
ton, D. C., June 20th and 21st. After
some discussion, it was decided that
the City Manager should attend this
series of hearings and should assist
the representatives of the Upper
Mississippi River toward the promo-
tion of the $500,000,000 bond issue
for improvements of all inland water-
ways.
The meeting adjourned about 6
o'clock.

be paid upon the surrender of the
premises to the City; that said prem-
ises have been surrendered to the
City and demand has been made for
the payment of the balance due; that
there are no available library funds
out of which to pay the same and a
transfer is necessary in order to pro-
tect the investment of the City in

Whereas, proper arrangements
have been made for the return of
this money, same to be returned
within one year from date of trans-
fer, and
Whereas, there is sufficient money
in the Water Works fund to meet all
demands • thereon, until said money
can be returned, and
Whereas, all laws, relating to mu-
nicipalities have been compiled with,

Be it Resolvd by the City Council
of the City of Dubuque of Dubuque
County, Iowa, subject to the approval
of the Director of the Budget that
said sum of $7,500.00 be, and the
same is hereby ordered transferred
from the Water Works fund to the
Library Building fund and the City
Clerk (secretarial officer) is directed
to correct his books accordingly and
to notify the Treasurer of this trans-
fer, accompanying the notification
with a copy of this resolution and
the record of its adoption.

In the District Court of Iowa in and
for Dubuque County.
In the matter of the estate of
Merlin K. Kalloway, minor.
On this 19th day of May, 1932,
on the application of Theodore Kal-
loway, as father of the above named
minor, who is under fourteen years
of age, for his appointment as
guardian for the sole purpose of ef-
fecting an adjustment with the City
of Dubuque under claim filed with
said City for damages incident to
injury sustained by said minor under
circumstances set out in the applica-
tion, and it being found that, under
the facts, the question of liability
of the City is deemed very doubtful,
and that it would be to the interests
of the said minor to accept the pro -
position of adjustment offered by
said City in the sum of $350.00, it
is now ordered that the said Theo-
dore Kalloway be and he is hereby
appointed as guardian for the sole
purpose of executing a full and com-
plete release to said City of Du-
buque covering all claims incident
to said injury in behalf of the said
minor upon payment of the sum of
$350.00 by said City, said amount
to be applied as follows in full re-
lease and discharge of all demands
of the distributees named:
