1932 June Council Proceedings= =. = 128 Regular Session, June lst, 1932 Lively from 1 to 90, both numbers included, become due and payable in their numerical order as follows: $10,000 on December 1, 1941, $25,000 on December 1 of each of the years 1942 and 1943, $20,000 on December 1, 1944, and $10,000 on December 1, 1945. • Section 2. That each of said bonds be subject to registration as to principal in the name of the hold- er on the books of the City Treas- urer, such registration being noted upon each bond so registered, and after such registration payment of the principal thereof shall be made only to the registered holder. Any bonds so registered, upon the re- quest in writing of such holder, per- sonally or by attorney in fact, may be transferred either to a designated transferee or to bearer, and the prin- cipal of any bonds so transferred and registered to bearer shall there- upon be and become payable to bearer in like manner as if such bond had never been registered. Registration of any bonds as to prin- cipal shall not restrain the negotia- bility of the coupons thereto at- tached by delivery merely. Section 3. Both prin- cipal and interest of this bond are payable in lawful money of the Unit- ed States of America at the office of the City Treasurer in and of the City of Dubuque, Iowa. This bond is issued by the City of Dubuque, pursuant to and in strict compliance with the provisions of Section 6125 and Chapter 63 -B1 of the Code of Iowa, and all laws amendatory thereof and supplement- ary thereto, and in conformity with an ordinance of the City Council of said City duly passed, approved and published, for the purpose of build- ing and constructing sewers in and for said City. And it is hereby certified and re- cited that all acts, conditions and things required by the laws and con - constitution of the State of Iowa to exist, to be had, to be done or to he performed precedent to and in the issue of this bond, were and have been properly existent, had, done and performed in regular and due form and time; that provision has been made for the levy of a sufficient continuing annual tax on all the taxable property within said City for the payment of the principal and interest of this bond an the same will respectively become due; that the faith, credit, revenues and resources and all the real and per- sonal property of said City are ir- revocable pledged for the prompt payment hereof, both principal and interest; and that the total indebt- edness of said City, including this bond, does not exceed any constitu- tional or statutory limitations. This bond is subject to registra- tion as to principal in the name of the holder on the books of the City Treasurer of said City, such regis- tration to be evidenced by notation of said Treasurer on the back here- of, and after such registration no transfer hereof, except upon such books similarly noted hereon, shall be valid unless the last registration shall have been to bearer. Regis- tration hereof shall not affect the negotiability of the coupons hereto attached, which shall continue nego- tiable by delivery merely. That said bonds be executed as herein provided as soon after the adoption of this ordinance as may be and thereupon they shall be delivered to the Treasurer of said City, who shall register the fact of the issuance of same in the book provided for that purpose and shall deliver said bonds to the pur- chasers, as determined by this Coun- cil, upon receipt of the purchase price, the same to be not less than the par value of said bonds with ac- crued interest thereon. Section 5. That for the purpose of providing for the levy and col- lection of a direct annual tax suf- ficient to pay the interest on said bonds as it falls due, and also to pay and discharge the principal thereof at maturity, there be and there is hereby levied upon all the taxable property in said City in each of the years while said bonds or any of them are outstanding, a tax sufficient for that purpose, and in furtherance of this provision but not in limitation thereof that there be and there is hereby levied on all the taxable property in said City the following direct annual tax, to -wit: For the year 1932, a tax suf- ficient to produce the sum of $6,075, being - $2,025 to reimburse current funds for advancements to pay interest due December 1, 1932, and $4,050 for interest; For each of the years 1933 and 1939 inclusive a tax suffi- Regular Session, June lst, 1932 cient to produce the sum of $4,050 each year for interest; For the year 1940 a -tax suf- ficient to produce the sum of $14,050 for principal and inter- est; For the year 1941, a tax suf- ficient to pro duce the sum of $28,600 for principal and inter- est For the year 1942, a tax suf- ficient to produce the sum of $27,475 for principal and inter- est; For the year 1943, a tax suf- ficient to produce the sum of $21,350 for principal and inter- est. ' For the year 1944, a tax suffi- cient to produce the sum of $10,450 for principal and interest. Said taxes when collected shall be converted into a special fund for the payment of principal and interest of the bonds hereby authorized and no other purpose whatsoever. Section 6. That the principal or interest coming due at any time when there are insufficient funds on hand to pay the same, be promptly paid when due from current funds on hand, and reimbursement be made to such current funds in the sums thus advanced when the taxes herein provided shall have been col- lected. Section 7. That a certified copy of this ordinance be filed with the County Auditor of Dubuque County and that said Auditor be and he is hereby instructed 111 and for each of the years 1932 to 1944, inclusive, to enter for collection and assess the tax hereby authorized. Section 8. That all ordinances and resolutions or parts thereof in conflict herewith be and the same are hereby repealed. !Section 9. That it is hereby found and declared that an emergency ex- ists and that it is necessary for the immediate preservation of the public peace, health and safety that this ordinance become effective upon its passage, approval and publication, and it is so ordered. Whereas, it is necessary and for the best interest of said City that $90,000 Sewer Bonds contemplated to be issued by the City of Dubuque, Dubuque County, Iowa, be offered for sale at this time; Now, Therefore, Be It Resolved by the City Council of the City of Du- buque, Iowa, as follows: Section 1. That Sewer Bonds in the amount of Ninety Thousand Dol- lars ($90,000) as proposed to be is- sued and as referred to in the pre- amble of this resolution, dated June 1, 1932, be offered for sale pursuant to published advertisement. Sec. 2. That the City Clerk be and he is hereby authorized and di- rected to publish notice of the sale of said bonds for two or more suc- cessive weeks in the Telegraph - Herald & Times - Journal, an official newspaper of Dubuque County, print- ed and published in the City of Du- buque, Iowa, such notice to state that bids will be received and acted upon by this City Council at a meet- ing to be held at 7:30 o'clock P. M., on June 20th, 1932, and such notice to be in substantially the following form: NOTICE OF SALE OF BONDS Sealed bids will be received at the office of the City Clerk in the City Hall, Dubuque, Iowa, until 10 o'clock A. M., June 20th, 1932, for $90,000 Sewer Bonds of the City of Dubuque, Iowa, at which time they will be referred to the City Council of said City at its meeting to be then held in the Council Chamber of said City Hall, and after the receipt of which open bids will be received and the bonds will then be sold to the high- est bidder for cash. Said bonds will be dated June 1, 1932, and mature $10,000 on December 1, 1941, $25,000 on December I of each of the years 1942 and 1943, $20,000 on December 1, 1944, and $10,000 on December 1, 1945. Both principal and interest are to be payable at the office of the City Treasurer, Dubuque, Iowa. All bids shall specify the rate of interest and, all other things being equal, the bid of par and accrued interest or better for the lowest interest rate will be given preference. The successful bid- der must pay the cost of printing the bonds. These bonds are to be issued for the purpose of defraying the cost of building and constructing sewers and will constitute general obliga- tions of said City. The City will fur- nish the approving opinion of Messrs. Chapman and Cutler, lawyers, Chi- cago, Illinois, and all bids must be so conditioned. Bidders must furnish certified check for $1,500.00, as guar- antee of good faith, this amount to be forfeited by the successful bidder should he fail to take up and pay for the bonds when ready. Resolution No. 41 -32 The City Council of Dubuque, as- sembled in regular session, hereby records its earnest approval of that provision of the Garner bill author- izing a federal bond issue to com- plete within five years the internal waterway projects already author- ized by Congress. We regard the bond method of financing the enter- prise as necessary to the construc- tion of a nine -foot channel in the upper Mississippi River at fair cost and within reasonable time. We fur- ther look upon this project as'the best prospect in sight for the return of prosperity to the Upper Missis- sippi Valley and its idle working men - We moreover regard the completion of the proposed work as a necessary means of restoring the industries of Regular Session, June 1st, 1932 131 the middle west to a position in the competition for trade and develop- ment as favorable as they enjoyed prior to the construction of the Pa- nama Canal by means of a band issue. Nays —None. Resolution No. 42 -32. Anthony Schuckert, beloved son of Councilman H. F. Schuckert, met a tragic death on May 25, 1932. The entire community was shocked be- yond expression. Although only a young man he had won numberless friends on account of his pleasing personality and sterling character. It is only fitting that this Council should extend its sympathy to the parent who has suffered so great a loss and assure him that the senti- ment herein contained falls far short of expressing the genuine sorrow which each member of this body has in his heart for him and his family. Be It Therefore, Resolved, that the expression of sympathy, as repre- sented by this Resolution, be spread upon the p6rmanent records of this Council and a copy thereof be sent by the City Clerk to the bereaved parent and his sorrowing family. Gentlemen: Due to defective drain- age above the viaduct on West 8th Street west of the intersection of Hill Street, it seems imperative that certain repairs shall be made to a wing wall on the south side of the tunnel which exists under the via- duct about 400 feet west of Hill Street. It is also our intention to smooth and oil, as a means of preventing further wash, the roadway from the lower end of the viaduct to Air Hill Street. To prevent accidents after this street has been made passable, we intend to erect a large sign at the tap of the hill warning all traffic to use Air Hill Street rather than descending the steep grade. Mayor and City To the Honorable Council, Dubuque, Iowa. Gentlemen: As per the attached notice for the sale of bonds, please be advised that bids were received at 10:00 A. M. June 20, 1932, for the $90,000 4 Sewer Bonds. One sealed bid was received, namely from Glaspell, Vieth & Duncan of Davenport, bidding on the 4 bonds, par, accrued interest, plus a premium of $1,171. A certified check was received from this con- cern for $1,500 attached to their bid. Other bidding firms were repre- sented as follows: Geo. M. Bechtel & Company of Davenport, Harris Trust and Savings Bank of Chicago, and the White - Philips Company of Davenport. Each of the three above named concerns deposited certified checks for $1,500. The oral bidding for said issue of 41/2% bonds at par, accrued interest, and additional pre- mium started by the bid of $1,180 by Geo. M. Bechtel & Company, the oral bidding continuing until Geo. M. Bechtel & Company dropped out at $1,302. Oral bidding continued be- tween the Harris Trust & Savings Bank and the White - Phillips Com- pany until the White - Phillips Com- pany dropped out at their bid of $1,451. The Harris Trust & Savings Bank continued to $1,460 as the high- est oral bid offered on said issue. We attach herewith a copy in du- plicate of the proposition from the Harris Trust & Savings Bank as highest bidder for the sum of par, accrued interest, and premium of $1,460. Agard, together with other taxpayers and property owners of the City of Du- buque,' praying that the Welbes Field lying west of the City Limits, north of Pennsylvania Avenue ex- tended, and in a general way west of Cherry Street and Green Street, be purchased for a City playground. This ground was viewed by City Council June 18th. Council was given information concerning this tract of land, which includes 11.6 acres, together with the proposition made by Mr. Welbes to the City Manager in which the pres- ent owner agreed to sell to the City the entire 11.6 acres for $7,000 cash, making the per acre cost $600.00, or Mr. Welbes agreed to take $2,000 as a down payment with the balance deferred for two years at 6% in- terest. An Ordinance regulating the use of motor and other vehicles up- on the streets of the City of Du- buque; designating the provisions hereof as the "Traffic Code of the City of Dubuque "; repealing all or- dinances heretofore enacted govern- ing this subject and all ordinances or parts of ordinances inconsistent herewith; and providing a penalty for violation hereof," be and the same is hereby amended by adding thereto the following: "J. Gentlemen: We attach the peti- tion dated June 13th from Mrs. Ame- lia Curtis which was presented to Council June 20th. in regard to her desire that certain sidewalks order- ed in on Avoca Street in front of properties owned by herself be elim- inated or at least delayed for the time being. The requst was referred to the City Manager for investiga- tion. I attach herewith a sketch for your information showing the loca- tion of the Curtis property in rela- tion to other lots on Avoca Street and also indicating the present side- walks installed. In accordance with the informa- tion contained in Mrs. Curtis' letter, upon investigation it is found that a bad fill exists on Lots, 320 and 321. The sidewalk space is irregular in front of these lots and will have to be filled in some places and cut in other places. The fill along the prop- erty line of Lots 320 and 321 indi- cates a slippage towards the rear of the lots. This fact is further borne by the conditions of the gutter which has sunken possibly 6 to 8 inches in front of this property. It is the writer's suggestion that prior to the construction of sidewalks, in • front of Lots 320 and 321 on Avoca Street, that the gutter should be raised to its proper height; that the sidewalk should be properly graded and sufficient time should elapse prior to the construction to deter- mine that the fill will not further settle along this sidewalk space. In regard to Mrs. Curtis' conten- tion regarding Lots 328 and 329, we find that a frontage of approximate- ly 160 feet exists on this property facing Avoca Street. The lot front- age is of such very narrow depth, averaging from 10 to 72 feet, that it would seem almost impossible for the. property to stand a sidewalk as- sessment. If her deal can be con- summated whereby she acquires the vacation of an alley immediately west of Avoca Street from Cherry Street to the south line of Lot 329 and can buy a portion of or all of Lot 165 abutting said alley and fronting on Cherry Street, this prop- erty would then have a depth of ap- proximately 100 feet. It is suggested that an extension until October 1st be given Mrs. Cur- tis for this construction. Yours very truly, R. M. Council, Dubuque, Iowa. Gentlemen: Attached is the pro- test filed by Miss J. E. Kemler of 850 Bluff Street dated June 13th, pre- sented to City Council June 20th and referred to the City Manager for in- vestigation. The protest advised that the City had repaired a sidewalk in front of the house and vacant prop- erty at 1520 West Third Street, owned by Miss Kemler, without suf- ficient notice to the owner to repair the same through her own concrete contractor. This is to advise that we have investigated the case and find that notice was served personally by Mr. Sullivan of the City Engineer's force on April 21st to Miss Kemler. The walk was allowed to remain the 15 days in which notice called for re- pairs to be made and another 27 days or in all 42 days from original service until the time the City actu- ally made these repairs. To the best of our knowledge, Miss Kemler nev- er advised the City Engineer in writ- ing or by phone that she would have the work done by her contractor. It seems that Mr. Ed. Carney, a tenant of hers, was to have done this work, but insufficient advice was given us prior to the time our City forces actually did this work for us to know that he was contemplating making the repairs. The original notice called for cer- tain repairs at raised slabs and the actual work performed by the City includes six new slabs 4 x 4 feet each and one new slab 4 x 2 feet, the total cost for this work which will be bill- ed to Miss Kemler is $6.80. Miss Kemler was advised today by the writer of the actual condi- tions in regard to this protest. After this investigation, it is the writer's belief that no reason exists why Miss Kemler should not be billed for this work. • The day that this work was per- formed on West Third Street by Miss Kemler, by accident the City Engineer ran onto the fact that Mr. Ed. Carney was to do certain work on Glen Oak Street in front of prop- erty owned by Miss Kemler. Our sidewalk repair crew was ready to move to en Oak Gl O 1 Street walks when ney intended doing this work and the result was that the City crew was stopped and Mr. Carney imme- diately put in the Glen Oak Street walk.
