Gentlemen: The •Interstate Pow-
er Company does hereby accept that
certain Ordinance, and all its terms
and conditions; which Ordinance is
entitled:
ORDINANCE NO. 15 -32
"An ordinance authorizing Inter-
state Power Company, its successors
and assigns, to substitute motor bus
transportation for street railway
transportation in the City of Du-
buque; fixing a time for the removal
of rails, ties, poles and appurten-
ances from the streets and the re-
storation of streets; designating mo-
tor bus routes; prescribing the
places for loading and discharging
of passengers; imposing conditions
upon the rights granted by this or-
dinance; providing for the continu-
ance in effect of all of the provisions
of the franchise ordinance of said
Interstate Power Company not in-
consistent herewith; and requiring
an acceptance of the provisions here-
of."
Which certain Ordinance was
passed by the City Council upon
first and second readings on the 5th
day of July, 1932, and passed, adopt-
ed, and approved upon final reading
on the 12th day of July, 1932, there-
after to be published in the manner
provided by law.
IN WITNESS WHEREOF, the said

caused this acceptance to be duly

ber of Commerce, by O. A. Reynolds,
Secretary, stating that the Board of
Directors of the Chamber upon rec-
ommendation of the Committee on
Taxation, has gone on record as op-
posed to the construction of any ad-
ditional public works not of an ur-
gent and necessary nature, the prin-
cipal purpose of which would be to
furnish work for the unemployed and
recommending that if any given sum

Whereas, the Council of the City
of Dubuque caused to be prepared
- and published, as provided by law,
the Budget Estimate of Expendi-
tures for the fiscal year 1933, and
the hearing upon said budget esti-
mate was fixed for the lst day of
August, 1932, at 7:30 o'clock P. M.,
at the Council Chamber in the City
Hall; and,
Whereas, this being the time and
place set for said hearing, said bud-
get estimate was taken up for final
consideration by the Council and all
taxpayers have been given an oppor-
tunity to be heard for or against
said estimate of expenditures:
It is, Therefore, Resolved by the
City Council of the City of Dubuque,
that the Budget Estimate of Expen-
ditures for 1933 heretofore prepared
and published, be and the same is
hereby finally approved and adopted
and the Mayor and Clerk are direct-
ed to certify the same to the County
Auditor of Dubuque County, Iowa, to-
gether with verified proof of the pub-
lication of the notice of hearing up-
on such budget estimate.
Be it Further Resolved that the
taxes required to be collected in the
year 1933 be and the same are here-
by levied for the various funds in
the amounts shown in said budget
estimate.

A resolution establishing the tax
levy for the year 1932, the taxes to
be collected in the year 1933 and
used for municipal purposes of the
City of Dubuque.
Be it Resolved by the City Coun-
cil of the City of Dubuque, Iowa:
That there be and there is hereby
levied the taxes for municipal pur-
poses for the ensuing year 1933, of
the following number of mills on the
dollar of all taxable property within
the corporate limits of said City:
26.95 mills for Consolidated Fund,
as provided for by Section
8217 of the Code of Iowa, 1931.
10 mills for Fir e Maintenance
Fund.
.24 mills for Fire Equipment Fund.
2 mills for Park Fund.
1.20 mills for Police Pension Fund.
1.19 mills for Fire Pension Fund.

the Council, to the County Auditor
of Dubuque County on or before the
15th day of August, 1932.

greater amount of good could be ac-
complished if the expenditure takes
the form of direct relief as figures
presented by City Officials to the
committee for the construction of
storm sewers during the last 13
months shows that less than 40%
was spent in the form of wages for
workers, presented and read.

the construction of a six (6) inch
vitrified tile sewer in and along
Strauss Street from the manhole in
Burden Avenue to Hedley Court and
in Hedley Court from the manhole in
Strauss Street about 175 feet north-
erly.
I am attaching hereto a tabulation
sheet showing the unit prices and
total prices bid and respectfully
recommend that the contract for. the
construction of said sewer be award-
ed to Anton Zwack, Inc., as their bid
was the lowest one received.
I wish to advise that the bid of
Fred Fichter was not considered due
to the fact that he, did not bid ac-
cording to notice.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: The City Manager
strongly urges the consideration and
approval of Council toward the pur-
chase of a suspended four -way flash-
ing light to be erected at the danger-
ous intersection of West Locust and
14th Streets. It is my belief that a
single light in each direction will be
sufficient warning to traffic at this
intersection. My thought is to have
the north and south lenses facing
Locust Street equipped with a red
lense on which the word "Stop" will
be embossed. On 14th Street the two
lenses would be of amber color and
the word "SLOW" or "CAUTION"
could be embossed on these Lenses.
The beacon could be suspended on
the same general span with the pres-
ent overhead street light at this
intersection and should be 14 feet
above the surface of the street as
clearance for vehicular traffic.
Two prices obtained today are
from $80.00, plus or minus, to $85.00.
It is estimated that the erection
would cost $15.00. The current for
such a lamp would be very low in
comparison to the two light, three
globe, type lamps on Main Street.
It is suggested that if Council ap-
prove this recommendation that
authority be granted for immediate
order and installation.

Council, Dubuque, Iowa.
Gentlemen: I attach a letter from
Mr. J. C. Collier, which together with
a great many personal requests from
Regular Session, August 1st, 1932

people living in the vicinity of Hill
and West Third Streets, together
with the officials of the Interstate
Power Company, pray that Council
will revise the ordinance compelling
a stop on Hill Street before entering
West Third Street.
If Council will recall at the time
of the drafting of the ordinance pro-
viding that West Third from James
to Grandview Avenue be made a
boulevard street with intersecting
traffic to stop at said streets, it was
believed that the real dangers on the
particular highway were Alpine,
Booth and Nevada Streets. However,
to protect traffic going to the hos-
pital, it was deemed wise to also in-
clude Hill and James Streets.
The numerous requests lead me to
present this matter to Council, but
for the general principal of safety, I
do not recommend at this time any
change in the ordinance.

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: In connection with the
informal meeting of Council held at
the City Hall at 5:00 P. M., July
28th, at which time the City Man-
ager was instructed to discuss with
the Park Board the matter of lower
tax request, please be advised that I
attended the meeting scheduled for
11:30 A. M. today by the Park Board
at which time notice to the public
had been given to discuss the Coun-
ty % mill levy.
After considerable discussion by
the entire personnel of the Park
Board it was further agreed and was
the decision of the Park Board and
they acted officially in the capacity
of reducing the contemplated County
levy from 3/4 of a mill to 1 / z of one
mill. This was done upon the condi-
tion that City Council would not fur-
ther cut the 2 mill levy decided upon
July 18th and as advertised in the
paper for the public hearing August
1st. The reason for cutting the
County levy and not the City levy
was due to the fact that the City
levy can be used for operation and
construction whereas the County
levy can be used for only construe-

Sewer Bonds.
Whereas, the City of Dubuque, in
the County of Dubuque and State of
Iowa, has heretofore ordered and
provided' for building and construct-
ing, certain sewers in and. for said
City, the cost thereof to the amount
of Fifty Thousand Dollars ($50,000)
to be borne by said City; and.
Whereas, it is deemed for the best
interest of said City that the cost to
be so paid be realized at this time
and that the Sewer Bonds of said
City be issued therefor, but it is first
necessary to give notice of a hearing,
as required by Section 363 of the
Code of Iowa;
Now, Therefore, Be it Resolved by
the City Council of the City of Du-
buque, as follows:
Section 1. That this City Council
meet at the Council Chamber in the
City Hall within said City on the

Whereas, many of the people of
Dubuque continue to be out of em-
ployment, and as a consequence
hardships and actual suffering are
being endured, and this Council, ful-
ly aware of this condition, deems it
its duty to meet the situation as far
as it is possible to do so and provide
a measure of relief by the furnishing
of employment, and
Whereas, a survey made by the
Manager and Engineer disclosed that
certain storm sewers are needed im-
provements and plans and specifica-
tions have been prepared and ap
proved for the construction of said
sewers, the estimated cost thereof
being approximately Fifty Thousand
Dollars ($50,000), and
Whereas, there are no funds avail-
able out of, which to pay the cost of
the construction of such sewers and
the only means by which such funds
can be secured is by the issuance
and sale of sewer bonds, and ,
Whereas, in order to provide em-
ployment for the greatest number so
that substantial benefit may result
from the expenditure of public funds
to be realized from the sale of such
bonds, it is deemed necessary and
advisable to construct such sewers
by laborers to be directly employed
by the City of Dubuque rather than
by contract, which method of con-
structing public improvements at
this time seems to meet with the
general approval of the citizens of
the City.
Now, Therefore:
Be it Resolved by the Council of
the City of Dubuque:
That said City of Dubuque under-
take the construction of storm sew
ers for which plans and speeificaz
tons have been prepared and that.
the cost thereof be, paidi from the

lishing Grandview Heights Addition
Sewer District which district em-
braces all the lands within the
drainage area of the sewer system
to be constructed within the same,
declaring that all lands within said
district are benefited by the sewers
to be constructed therein and sub-
ject to special assessments for the
payment of the cost of such sewer
and appurtenances thereto and de-
fining all of such lands which are
subject to be furnished with sewer
connections or drainage by said
sewer system to the adjacent prop-
erty.
Be it Ordained by the City Coun-
cil of the City of Dubuque:
Par. 261, Sec. 1. That there be

established a sewer district within
the City of Dubuque, said district to
be known and designated as "Grand-
view Heights Sewer District," and
al lots, lands and parcels of real
estate situated within and bounded

tary sewers and appurtenances

Par. 263. Sec. 3. That the cost of
construction and installation of said
sewer system within said district
shall be distributed upon the lots,
lands and parcels of real estate
benefited thereby and all property
which is subject to be furnished
with connection to said sewer sys-
tem or which may be drained and
served thereby shall be subject to
assessment therefor and shall be
considered as adjacent property.
Par. 264. Sec. 4. That any part of
the cost of construction of said
sewer system which cannot be as-
sessed against the lots, lands and
parcels of real estate within said
district shall be paid by the City of
Dubuque out of the Main Sewer
Fund, the District Sewer Fund or
the General Fund or partly from
each of such funds.
Par. 265. Sec. 5. This Ordinance
Shall be in force and effect ten days
from and after its passage and adop-
tion by the City Council of the City
of Dubuque and publication as pro-
vided by law.

Whereas, the contract heretofore
entered into by the City of Dubuque
tor the construction of a six inch
sanitary sewer in and along the
alley between Lincoln Avenue and
Rhomberg Avenue from the manhole
200 feet south of Shiras Street to a
point about 25 feet north of Shiras
Street, hereinafter described, has
been completed and said improve-
ment has been accepted by the City
Council of said City and the City
Engineer has computed the cost, and
expense thereof to be $324.89.
And Whereas, public notice as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement. and a public hearing has
been held pursuant thereto, and all
objections filed thereto have been
considered and determined:
Nov, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that' to provide for the cost' of
the construction of a six -inch Vit-
rified Tile Sanitary Sewer in and
along the alley between Lincoln
Avenue and Rhomberg Avenue from

is hereby called a special meeting of
the City Council of the City of Du-
buque to be held at the Council
Chamber in the City Hall on Mon-
day, August 29th, 1932, at 7:30 P. M.
At this meeting there will be con-
sidered for final passage and adop-
tion an ordinance entitled: "Ordin-
ance providing for the issuance of
Fifty Thousand Dollars ($50,000)
Sewer Bonds; providing for the levy
of taxes to pay the same and de-
claring an emergency," which has
been on file with the City Clerk for
public inspection since August 22,
1932.
At this meeting there will also be
introduced a resolution entitled,
"Resolution directing the 'advertise-
ment' and sale of Fifty ' Thousand
Dollars, ($50,000) Sewer Bonds,"
which resolution will have the con-
sideration of the Council at that
time.
Any other and further business
that may properly come before a
regular meeting of said Council will
be considered at this meeting.

ber, of Commerce, through its Board
of Directors, requesting the City
Council to take no action favorable
to a movement which was under-
stood is being considered by the
Iowa League of Municipalities to di-
vert a portion of the primary road
funds to the use of cities and towns
through which primary highways
pass, presented and read.

Gentlemen: At the special meet-
ing of the Council on August 22,
1932, the verbal request of Mr.•Nick
- Lombardi was presented at the Coun-
cil, praying that he again be granted
a free license to peddle fruits and
'vegetables within the city. .The' re-
quest was referred to the City Man-
ager for investigation and report.
Mr. Lombardi has interviewed the
'writer this morning; and I - beg to
report the following in the case.

The applicant was not crippled in
service, and is not now crippled. He
states that peddling is his only
means of support of his family, and
that the income from peddling is
very small.
After examination of the cases the
Council has denied this year, it
would seem that Mr. Lombardi's res-
idence outside the city, and the tact
that he is getting soldiers' relief and

tax reduction from the city
prohibit the reasonable granting of
this permit of a free license for an-
other year.

Ordinance No. 17 -32
AN ORDINANCE providing for the
issuance of $50,000 Sewer Bonds,
providing for the levy of taxes to
pay the same and declaring an
emergency.
Whereas, the City of Dubuque, in
the County of Dubuque and State of
Iowa, heretofore, pursuant to and in
strict compliance with all laws ap-
plicable, lawfully ordered and pro-
vided for building and constructing
sewers in and for said City at a
cost of not less than $50,000; and
Whereas, it is necessary and ad-
visable that provisions be made for
the issuance of bonds of said City in
the sum of $50,000 to defray the cost
ugust 29th, 1932
of building and constructing said
sewers; and
Whereas, notice and hearing on
the initiation of proceedings tor the
issuance of said bonds has hereto-
fore been given in manner and form
required by Section 363 of the Code
of Iowa and no petition nor protest
has been tiled:
Now, therefore, be it ordained by
the City Council of the City of Du-
buque, as follows:
Section 1. That pursuant to and
as authorised by Section 6125 of the
Code of Iowa, there shall be and
there is hereby ordered issued the
negotiable Sewer Bonds of said City
of Dubuque in the principal amount
of $50,000; said bonds to be 50 in
number, dated September 1, 1932,
bearing interest at the rate of Four
and One -half Per Cent (4 %) per
annum, from the date of said bonds
until paid, payable March 1, 1933,
and semi - annually thereafter on the
first days of September and March
in each year; that said bonds be
signed. by the Mayor and attested
by the City Clerk and the seal of
said City attached, and be registered
as to issuance by the City Treasurer
and a certificate of such registration
endorsed thereon; that interest upon
said bonds be evidenced by coupons
thereto attached and maturing on the
several days when such interest ma-
tures, which coupons shall be exe-
cuted with the facsimile signatures
of said officials, and said Mayor and
City Clerk, by the execution of said
bonds, shall adopt as and for their
proper signatures, their respective
facsimile signatures appearing on
said coupons; and that both prin-
cipal and interest be payable in law-
ful money of the United States of
America, at the office of the City
Treasurer in and of the City of Du-
buque, Iowa; that said bonds be of
the denomination of $1,000 each, be
numbered consecutively from 1 to
50, both numbers included, become
due and payable in their numerical
order as follows: $15,000 on Septem-
ber 1, 1937, $15,000 on September 1
of each of the years 1938 and 1939,
$5,000 on September 1, 1940.
Sec. 2. That each of said bonds
be subject to registration as to prin-
cipal in the name of the holder on
the books of the City Treasurer,
such registration being noted upon
each bond so registered, and after
such registration payment of the
principal thereof shall be made only
to the registered holder. Any bonds
so registered, upon the request in
writing of such holder, personally or
by attorney in fact, may be trans-
ferred either to a. designated trans-
feree or to bearer, and the principal

of any bonds so transferred and reg-
istered to bearer shall thereupon be
and become payable to bearer in like
manner as if such bond had never
been registered. Registration of any
bonds as to principal shall not re-
strain the negotiability of the cou-
pons thereto attached by delivery
merely.
Sec. 3. That said bonds, coupons
and provisions for registration be in
substantially the following forms:

That the City of Dubuque, in the
County of Dubuque and State of
Iowa, for value received, promises
to pay to bearer, or if this bond be
registered as to principal, to the
registered holder thereof, the sum of
One Thousand Dollars ($1,000) on
the first day of September, 19
with interest on said sum from the
date hereof until paid at the rate of
per cent ( %) per annum,
payable March 1, 1933, and semi-
annually thereafter on the first days
of September and March in each
year, on presentation and surrender
of the interest coupons hereto at-
tached as they severally mature.
Both principal and interest of this
bond are payable in lawful money of
the United States of America at the
office of the City Treasurer in and
of the City of Dubuque, Iowa.
This bond is issued by the City of
Dubuque, pursuant to and in strict
compliance with the provisions of
Section 6125 and Chapter 63 -B1 of
the Code of Iowa, and all laws
amendatory thereof, and supple-
mentary thereto, and in conform
ity with an ordinance of the City
Council of said City duly passed,
approved and published, for the pur-
pose of building and constructing
sewers in and for said City.
And it is hereby certified and re-
cited that all acts, conditions and
things required by the laws and con-
stitution of the State of Iowa to ex-
ist, to be had, to be done, or to be
performed precedent to and in the
issue of this bond, were and have
been properly existent, had, done
and performed in regular and due
form and time; that provision has
been made for the levy if a sufficient
continuing annual tax on all the tax-
able property within said City for
the payment of the principal and in-
terest of this bond as the same will
respectively become due; that the
faith, credit, revenues and resources
and all the real and personal prop-
erty of said City are irrevocably
pledged for the prompt payment
hereof, both principal and interest;
and that the total indebtedness of
said City, including this bond, does
not exceed any constitutional or
statutchy limitations.
This bond is subject to registra-
tion as to principal in the name of
the holder on the books of the City
Treasurer of said City, such registra-
tion to be evidenced by notation of
said Treasurer on the back hereof,
and after such registration no trans-
fer hereof, except upon such books
and similarly noted hereon, shall be
valid unless the last registration
shall have been to bearer. Registra-
tion hereof shall not affect the
negotiability of the coupons hereto
attached, which shall continue negot-
iable by delivery merely.
In Testimony Whereof, said City,
by its City Council, has caused this
bond to be signed by its Mayor and
attested by its City Clerk, with the
seal of said City affixed and the cou-
pons hereto attached to be executed
with the facsimile signatures of said
Mayor and City Clerk, which offic-
ials by the execution of this bond
do adopt as and for their proper sig-

The issue of this bond has been
duly and properly registered in my
office as of the first day of Septem-
ber, 1932.

Sec. 4. That said bonds be exec-
uted as herein provided as soon af-
ter the adoption of this ordinance as
may be and thereupon they shall be
delivered to the Treasurer of said
City, who shall register the fact of
issuance of same in a book pro-
vided for that purpose and shall de-
liver said bonds to the purchasers,
as determined by this Council, upon

value of said bonds with accrued

Sec. 5. That for the purpose of
providing for the levy and collection
of a direct annual tax sufficient to
pay the interest on said bonds as it
falls clue, and also to pay and dis-
charge the principal thereof at ma-
turity, there be and there is hereby
levied upon all the taxable property
in said City in each of the years
while said bonds or any of them are
outstanding, a tax sufficient for that
purpose, and in furtherance of this
provision but not in limitation there-
of that there be and there is hereby
levied on all the taxable property
in said City the following direct an-
nual tax, to -wit:
For the year 1933, a tax sufficient
to produce the sum of $4,500, being
$2,250 to reimburse current funds
for advancements to pay interest
due March 1, 1933, and September 1,
1933, and $2,250 for interest.
For each of the years 1934 and
1935, inclusive, a tax sufficient to
produce the sum of $2,250 each year
for interest.
For the year 1936, a tax sufficient
to produce the sum of $17,250 for
principal and interest.
For the year 1937, a tax sufficient
to produce the sum of $16,575 for
principal and interest.
For the year 1938, a tax sufficient
to produce the sum of $15,900 for
principal and interest.
For the year 1939, a tax sufficient
to produce the sum of $5,225 for
principal and interest.
Said taxes when collected shall be
converted into 'a special fund for the
payment of principal and interest of
the bonds hereby authorized and no
other purpose whatsoever.
Sec. 6. That the principal or in-
terest coming due at any time when
there are insufficient funds on hand
to pay the same, be promptly paid
when due from current funds on
hand, and reimbursement be made
to such current funds in the sums
thus advanced when the taxes here-
in provided shall have been col-
lected.
Sec. 7. That a certified copy of
this Ordinance be filed with the
County Auditor of Dubuque County
and that said Auditor be and he is
hereby instructed in and for each of
the years 1933 to 1939, inclusive, to
enter for collection and assess the
tax hereby authorized.
Sec. 8. That all ordinances and
resolutions or parts thereof in con-
flict herewith be and the same are
hereby repealed.
Sec. 9. That it is hereby found
and declared that an emergency
exists and that it is necessary for
the immediate preservation of the
public peace, health and safety that
this ordinance become effective up-
on its passage, approval and publi-
cation, and it is so ordered.

for sale at this time:
Now, Therefore be It Resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That sewer bonds in
the amount of Fifty Thousand Dol-
lars ($50,000) as proposed. to be is-
sued and as referred to in the pre-
amble of the resolution, dated
September 1, 1932, be offered for
sale pursuant to published adver-
tisement.

Both principal and interest are to
be payable at the office of the City
Treasurer, Dubuque, Iowa. All bids
shall specify the rate of interest
and, all other things being equal,
the bid of par and accrued interest
or better for the lowest interest rate
will be given preference. The suc-
cessful bidder must pay the cost of
printing the bonds. These bonds are
to be issued for the purpose of de-
fraying the cost of building and con-
structing sewers and will constitute
general obligations of said City. The
City will furnish the approving opin-
ion of Messrs. Chapman & Cutler,
Lawyers, Chicago, Illinois, and all
bids must be so conditioned. Bid-
ders must furnish certified check for
$1,500 as guarantee of good faith,
this amount to be forfeited by the
successful bidder should he fail to
take up and pay for the bonds when
ready. The right is reserved to re-

Councilman Schuckert moved to
refer the communication to the City
Council for consideration. Seconded
by Councilman Thompson. Carried

Councilman Schuckert moved that
the City Council be placed on record
as opposed to razing, at this time,
of the old Masonic Temple Building
and double dwelling south thereof,
located at 11th and Locust Streets,
and stating that according to the
Council records of December, 16th,
1929, as expressed by representa-
tives of the Library Board, namely,
Doctors Alderson and Hancock, that
the reason for the purchase of said
Masonic Temple and dwelling was
due to the fact that the Library was
cramped for actual quarters and
needed more room for library oper-
ations, and Council, after viewing
the books piled in certain rooms of
the present quarters of the Library,
determined that the request was
reasonable and they approved of the
plan of purchainsg said Masonic
Temple and dwelling by the Library
Trustees, in accordance with Resolu-
tion No. 629 -29. Seconded by Coun-
cilman Thompson. Carried by the
following vote:

ance amending an ordinance entitled

ance amending Rule 56, Paragraph
89, Section 3, of an ordinance en-

dinance regulating the use of motor
and other vehicles upon the streets
of the City of Dubuque; designating
the provisions hereof as the Traffic
Code of the City of Dubuque; re-
pealing all ordinances heretofore
enacted governing this subject and
all ordinances or parts of ordinances
inconsistent herewith; and provid-
ing a penalty for violation hereof ",
by designating as Boulevards, West
Third Street from the east line of
James Street to the east line of
North Grandview Avenue, and
Dodge Street from Bryant Street to
the East line of North Grandview
Avenue," by repealing Subdivision
"J" thereof and substituting therefor
a provision designating West Third

86 of McCraney's 1st Addition. Sec-
