INTRODUCTION
The attached resolution for the acceptance of the construction contract and the
establishment of the Final Schedule of Assessments for the 17th Street Storm Sewer
Improvements Project (Elm to Heeb).
DISCUSSION
The 17th Street Storm Sewer Improvements Project is one phase of the Bee Branch
Watershed Flood Mitigation Project. The project involved the replacement of the existing
storm sewer with a large box culvert storm sewer and additional storm drains (intakes)
from the Lower Bee Branch Creek along 17th Street from Elm Street to Heeb Street. The
City hopes to continue these improvements up 17th Street to West Locust Street and
then along West Locust Street to Kirkwood Street in future phases as funding allows.
This work involved the relocation and reconstruction of existing underground utilities to
provide the necessary space for the larger storm sewer. It required the complete
removal and subsequent reconstruction of the street,
The improvements were constructed in multiple phases to accommodate access for
residents. Temporary parking was provided near Crescent Community Health Center
along with wayfinding signage to direct motorists to businesses in the area. This project
included construction of 1060 linear feet of 10-foot by 5-foot concrete box culvert with a
temporary connection on the west end of the project. The project also included local
storm sewer and intakes, roadway reconstruction with asphalt surfacing, PCC driveway,
sidewalk, and curb ramp reconstruction, PCC wall, railing, and step construction, water
main replacement, sanitary sewer replacement, temporary storm water management,
dewatering, mobilization, electrical conduits, fiber vaults, traffic signal replacement,
miscellaneous restoration, erosion control, and traffic control.
This project also included the installation of new 8" and 12" water main along Central
Avenue from 17th Street to just north of 18th Street. This work was added to this contract
to minimize disruption to traffic during the future resurfacing of Central Avenue from 9th
to 21 st. Along with the replacement of 425 LF of 8-inch water main and the 85 LF of 12-
inch water main along Central Avenue, was the replacement of 4 lead water services
with copper services.

The improvements will be funded using the $23.1 million in Community Development
Block Grant Program Disaster Recovery - National Disaster Resiliency funds for the
Bee Branch Watershed Flood Mitigation Project.
SPECIAL ASSESSMENTS
Based upon final construction costs, the total amount of private water service
replacements is in the amount of $19,557.00. There were four (4) private lead water
services. One of the three assessed properties had two lead services replaced.
FINANCIAL ASSISTANCE
Low- to moderate -income property owners subject to private lead water service
replacement assessments will be eligible for financial assistance ranging from 20 to 100
percent of the water service assessment for residential property depending on family
size and income level. This financial assistance program is made available through the
Water Service Line Assistance fund.
To allow sufficient administrative time to process financial assistance applications for
low- to moderate -income families, eligible property owners will be given approximately
30 days from the date of mailing the Notice of Filing the Final Schedule of Assessments

to apply for financial assistance that may reduce the amount of the assessment payable
by the property owner.
During this 30-day period, assessments may be paid in full or in part without interest at
the City of Dubuque, Office of the City Treasurer. After approximately 30 days, any
unpaid assessment will be levied against said benefited property with the Dubuque
County Treasurer and any balance over $500 will be payable in 15 annual installments
at the County Treasurer's Office and will draw annual interest at three percent (3%).
Attached is the financial assistance chart that the City uses in determining financial aid
availability for your reference. This chart is updated every year based on the US
Department of Housing and Urban Development (HUD) guidelines.

RESOLUTION NO. 83-20
ACCEPTING THE 17TH STREET STORM SEWER IMPROVEMENTS PROJECT (ELM
TO HEEB) AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO
THE CONTRACTOR
WHEREAS, the Public Improvement Contract for the 17th Street Storm Sewer
Improvements Project (Elm to Heeb) (the Project) has been completed by the contractor,
Langman Construction, Inc. (Contractor), and the City Engineer has examined the work
and recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $3,964,080.11
; and
WHEREAS, the Contractor has previously been paid $3,765,876.10, leaving a balance
of $198,204.01; and
WHEREAS, the City Council finds that the recommendation of the City Engineer should
be accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Director of Finance and Budget is hereby directed to pay the balance
of the retainage of $198,204.01 as provided in Iowa Code chapter 573, and to pay such
retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa chapter
26.13.

ADOPTING THE FINAL ASSESSMENT SCHEDULE FOR THE 17TH STREET STORM
SEWER IMPROVEMENTS PROJECT (ELM TO HEEB)
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. After full consideration, the Final Schedule of Assessments as shown on the
attached sheet(s), Page 1 to Page 1 inclusive is hereby approved for the 17th Street Storm
Sewer Improvements Project (Elm to Heeb).
Section 2. There is hereby assessed and levied as a special tax against and upon each
of the benefited properties, the respective sums indicated. The amounts shown in said Final
Schedule of Assessments as deficiencies are found to be proper and levied conditionally
against the respective properties benefited by the improvements as shown in the Final
Schedule of Assessments, subject to the provisions of Iowa Code § 384.63. Said
assessments against said lots are hereby declared to be in proportion to the special benefits
conferred and not in excess of twenty-five percent of the value of same.
Section 3. The City Clerk be and is hereby directed to certify the Final Schedule of
Assessments to the County Treasurer of Dubuque County, Iowa, and to publish notice of
said certification once each week for two consecutive weeks in the manner provided in Iowa
Code § 362.3, the first publication of which shall be not more than fifteen days from the date
of filing of the Final Schedule of Assessments. On or before the date of the second
publication of the notice, the City Clerk shall also mail a copy of said notice to property
owners whose property is subject to assessment, as provided in Iowa Code § 384.60.
Section 4. The assessments may be paid in full or in part without interest at the office of
the City Treasurer, City Hall, 50 W. 13th Street, Dubuque, Iowa, at any time within 30 days
after the date of the first notice of the Final Schedule of Assessments. Thereafter, unpaid
assessments of $500.00 or more are payable in 15 annual installments at the County
Treasurer's Office, Dubuque County Courthouse, 720 Central Avenue, Dubuque, Iowa, and
will draw annual interest at three percent (3%) computed to December 1 next following the
due dates of the respective installments as provided in Section 384.65 of the Code of Iowa.
