SUBJECT: Corridor Preservation Zone - Proposed U.S. 20 Improvements
Dear Mayor Duggan:
This letter is to advise you that in accordance with section 306.19(5) of the Iowa Code, the Iowa
Department of Transportation (Iowa DOT) has reduced the limits of the corridor preservation zone
(CPZ) along U.S. 20 from the Peosta interchange east to near the intersection w/th the Northwest
Arterial in Dubuque. We have determined upon further review that several areas within the CPZ now
fall outside the area of potential impact of proposed U.S. 20 improvements. For this reason we are
notifying you that a portion of several properties have been removed from CPZ.
Please be advised that each city and county is required to notify the Iowa DOT in writing of receipt of
an application for a building permit for construction valued at $25,000 or more, submission of a
subdivision plat, or prior to a zoning change which falls within the CPZ. Written notification shall
include all pertinent information regarding the proposed permit, plat, or zoning change. The Iowa
DOT has 30 days to review and provide comment upon receipt of the written notification.
Section 3206.19(5) also states that if the Iowa DOT, within the 30-day period, notifies the city or
county in writing that the department is proceeding to acquire all or part of the property or property
rights affecting the area, the city or county shall not issue the building permit, approve the
subdivision plat, or change the zoning. The Iowa DOT will begin the process of acquiring property
or property rights from the affected persons within ten days of the Iowa DOT's written notification of
intent to the city or county.
The city or county notice to the Iowa DOT of receipt of a building permit, subdivision plat, or
proposed zoning change is to be sent to.

It is requested that the revised Corridor Preservation Notice be provided to your appropriate staff
person who is responsible for planning and zoning activities or the issuance of building permits.
Since the limits of the previously established corridor preservation zone are being reduced rather than
extended, notification to only the affected property owners will occur within the next several weeks.
Your cooperation in this matter will be greatly appreciated and will assist us in preserving this
highway corridor, which is of mutual interest and value to both the State of Iowa and your
community.
