Resolution No. 103 -32 WHEREAS, the contract hereto- fore entered into by the City of Dubuque for the improving of Kleine Street hereinafter described, has been completed and said improve- ment has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $1297.73. AND WHEREAS, public notice as provided by law„ has been published by the City Clerk stating the in- tention of the City Council to issue bonds to pay the cost of said im- provement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: NOW, THEREFORE, BE IT RE- SOLVED by the City Council of the City of Dubuque that to provide for the cost of improving Kleine Street from the south property line of Kaufmann Avenue to the north property line of Klingenberg Ter- race there be issued improvement bonds to the amount of $1297.73. Said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1927, which bear date as of the 3rd day of November, 1932; shall be in denominations of $100.00 except that there shall be one bond to the amount of $97.73. They shall be numbered from 3279 to 3291 inclusive and shall be di- vided into ten series of which the bonds numbered 3279 and 3280 shall constitute the first series and shall be payable the 1st day of April, A. D. 1933, the bonds numbered 3281 and 3282 shall constitute the second series and shall be payable the lst day of April, A. D. 1934, the bonds numbered 3283 and 3284 shall con- stitute the third series and shall be payable the 1st day of April, A. D. 1935, the bond numbered 3285 shall constitute the fourth series and shall be payable the 1st day of April, A. D. 193....._..; or any time before that date at the option of the City, the sum of one hundred dollars ($100.00) with interest thereon at the rate of five per cent per annum, payable on the presentation and surrender of the interest coupons hereto at- tached, both interest and principal are payable at the office of the City Treasurer in the City of Dubuque in the State of Iowa. And it is hereby certified and recited that all the acts and conditions and things required to be done preced- ent to and in the issuing of this series of bonds, have been done, happened and performed in regular and due form as required by said law and resolution; and for the as- sessments, collections and payment hereon of said special tax, the faith and diligence of said City of Du- buque are hereby irrevocably pledged. Since the meeting of October 3rd, at which time the signs were order- ed removed, the Dubuque Auto Club had presented a bond protecting the City in regard to public liability for said signs in the sum of $5,000 and $10,000. It was explained to officials of the Dubuque Auto Club that Council was without power to grant such signs and that since the same were dan- gerous, the Dubuque Auto Club agreed to have the signs removed from the sidewalk and, at their own expense, erect the four signs on the outside wall of the front line of the building.
