given the opportunity to expand the original project scope. Amendment 1 to the
Professional Services Agreement with V &K reflects the following tasks and associated
fees.

Services Agreement
The purpose of this memorandum is to request authorization for the acceptance of
Amendment No.1 to the Historic Millwork District Streetscape & Utilities Professional
Engineering Services Agreement between the City of Dubuque & Veenstra & Kimm, Inc.
(V &K).
In February, 2009, the Historic Millwork District Master Plan was adopted by the City
Council. The Master Plan is to incorporate the Green Streets and sustainable design
elements for the rebuilding the district streets with high - quality streetscapes, modern
utilities, on- street parking, artistic elements, and stormwater management features.
On July 6, 2009, City Council approved the selection of Veenstra & Kimm /JJR to
provide the design services for streetscape, street and utility improvements in the
Historic Millwork District at a fixed fee of $187,300. Phase I of the Historic Millwork
District Master Plan included the reconstruction of the following streets: Jackson Street,
between 7 and 11 Street; 10 Street, between Jackson Street and Elm Street;
Washington Street, between 9 and 11 Street; and streetscape improvements along
10 Street, from Main Street to Jackson Street.
Due to the recent receipt of the $5.6 million TIGER grant funding, the City has been

To
HISTORIC MILLWORK DISTRICT STREETSCAPE & UTILITIES
PROFESSIONAL ENGINEERING SERVICES
Between the
CITY OF DUBUQUE, IOWA and
VEENSTRA & KIMM, INC.
This Contract amendment is made by and between the City of DUBUQUE, Iowa, a
municipal corporation, and Veenstra & Kimm, Inc., an Iowa Corporation this th day of
, 2010.
Whereas, it is the mutual desire of the parties hereto to amend the CITY'S
PROFESSIONAL ENGINEERING SERVICES AGREEMENT entered into in July of
2009, hereinafter called the Existing Agreement.
Therefore, it is hereby agreed that the Existing Agreement and scope of project with
associated fees be amended as follows:
1. Foundry Square The following work items will be performed for the Alamo block
and are considered conceptual design on the Foundry Square and parking to the south.
a. Bubble drawings for initial input with staff
b. Plaza concepts, 3 maximum.
c. Hold at least one input session with staff
d. Hold at least one input session with public
e. Incorporate storm treatments in plaza (possibly district wide features)
f. Interface of plaza with relocated Elm, 10th and Washington Streets
g. Possible inclusion of public art area (identify areas)
h. Images of final product- Sections as need with 2 perspectives
i. Layout parking concepts with landscaping for south half of Alamo block
j. Interfacing with Plaza, Washington and relocated Elm
k. Cost estimates
Fees for Items in Task 1 above are $45,000 and have been previously authorized.
2. Water Main on 1 l th Street This includes the work effort for the design of the 20
inch water main being extended to feed the district and ultimately extend through the
district. This work was not identified in the request nor included in our fee estimate.
3. Parking lot estimates- Spahn & Rose sites This work included the sketching of
possible parking configurations of numerous sites currently owned and operated by
S &R. These were used to estimate parking stall count and construction and design
costs for each.
4. Parking lot configurations /estimates- Alamo Block This work included the CAD
generation of maximizing stall counts on the current Alamo block as well as alternates
to include partial plaza and full plaza. These were used to estimate construction costs
for each alternate.
5. Estimates of future phases and alternates- district wide This work included the cost
estimating on a block by block basis throughout the district for full master plan and
utility work as well as alternates of brick only streets, PCC streets and HMA with PCC
curb and gutter streets.
6. Fiber optic duct system This work includes the drafting of alignments and inclusion
of specifications and quantities for the system to be included into the City's
construction documents for this spring's letting.
7. Alliant Transformer locations /primary feed This time includes the effort for leading
the coordination effort for locating private transformer locations and the primary
power service for these buildings to be supplied by Alliant Energy.
8. Design effort increase on 4 blocks (streetscape v full design) This time is for the
differential design effort between the four blocks identified in the request as part of the
first phase (1) letting (four blocks of 10th street streetscaping vs the full design of the
four blocks of Jackson St, which was identified as a second phase (2) in the RFP)
These phases are not to be confused with the larger phasing identified in the master
plan as prepared by Cunningham.
9. GPR time to explore /find bids This time was associated with the effort to find,
contact, scope and obtain pricing for the needed ground penetrating radar services to
locate horizontally and vertically the buried tanks near the Wilmac building south of
9th on Jackson. Staff has previously agreed upon the fees for items 2 through 9.
Fees for Items 2 through 9 are $31,420.
10. TIGER grant Additional blocks of concepting and design for streetscaping,
reconstruction and utility work are added to the project due to the award of a TIGER
grant from the US DOT for the Millwork District. Attached to this Amendment is a
map and table indicating the blocks in green and yellow. The services will include a
NEPA clearance at a categorical exclusion level, FHWA design reviews and alternate
bids for the blocks in an order determined by the City. The fees associated with Item
10 are $164,500.
11. Survey The original project's survey was performed by the City of Dubuque.
Given the tight timeframe and the City's other commitments, we are proposing the use
of Buesing and associates for performing 11 additional blocks of survey (4 blocks of
9 2 blocks on lower Jackson, 2 blocks on Elm St, 1 additional block on Jackson,
Washington and 8 These needs are all consistent with the City's priorities as
designated and conveyed to the FHWA and consistent with number 10 above. The
fees associated with Item 11 are $20,000.
The Change in "Total" cost associated with Amendment No. 1 is to increase the authorized
fee by a total of $260,920 to a total of $448,220. The Total cost is the same amount set forth
in the Existing Agreement plus Amendment 1.
This amendment will be deemed a part of, and subject to, all terms and conditions of the
existing Agreement. Except as modified above, the Existing Agreement will remain in full
force and effect.
