Council Met At 7:30 P. AA. (C.S.T.) Present--Mayor Pregler, Coun- cil men Ludwig, McCauley, Pfohl, Schul~z. City Manager, Gilbert D. Chavenelle. Mayor Pregler read the cab and stated that service thereof had been duly made and this meeting is called for the purpose of con- ducting a public hearing on the re- zoning of Lot I of Lot 1 of Lot I of Hawkeye Stock Farm in Sections 27 and 28, Dubuque Township, Du- buque County, Iowa, now in the Ci- ty of Dubuque, and owned by Rob- err J. & Wilma A. McNamara and acting on any other business which may properly come before a regu- lar meeting of the City Council. Communication of Otto Waechter stating that he is in favor of the proposed shopping center on the MeNamara property however is net in favor of making Wacker Drive a public street, presented and read. Mayor Pregler moved that the communication be referred to the Engineering and Building Depart- ment. Yiannias) stating that they do not object to the shopping center but request* ing that proper steps be taken, prior to rezoning, of the McNamara property to avoid certain problems that may arise such as drainage of the area, parking lot iignts, lights from cars shining into the theatre etc. presented and read. Mayor Preglm- moved that the communi- cation be referred to the Engin- eering and Building Departments. Seconded by Councilman Pfohl. Carried by the following vote: Yeas -- Mayor Pregier, Council- men Ludwig, McCauiey, PfohI, Schultz. Nays~--None. Councilman Pfoh! moved that the rules be suspended in order to let anyone present address the Council if they so desire. Seconded by Mayor Pregler. Carried by the following vote: Yeas -- Mayor Pregler, Council- men Ludwig, McCau!ey, Pfohl, Seimltz. Nays--None. Mr. Martin Cooney, attorney for the /¢icNamara interest, quoted from the abstract which indicated a covenant at the time the prop- erty was purchased by McNamara which would dispute the idea of objection suggested by Mr. Yian- nias. The contract of purchase ae- tually makes no protest of any kind. Mr. Lyle Kopp of the Midwest Deveinpars Inc. stated that he was not opposed to the shopping cen- ter but suggested a buffer zone be- tween single family residences, which will be built in his subdi- vision, and the shopping center property. A definite line could be set out by a row of evergreen trees rather than an expensive wall. It was suggested by the Council teat the Kopp request be referred to the Engineering Department for consideration.
