Van Milligen, City Manager SUBJECT: Reset Public Hearing on Fiscal Year 2021 City Budget DATE: March 23, 2020 Director of Finance and Budget Jennifer Larson recommends that the City Council reset the public hearing for April 23, 2020 from March 26, 2020, on the Fiscal Year 2021 City budget, operating and capital improvement program, for the City of Dubuque. The budget public meeting scheduled for Wednesday, March 25, 2020, is being rescheduled to Thursday, April 16, 2020 at 6:30 p.m. to cover: Water Water and Resource Recovery Center Public Works Engineering I concur with the recommendation and respectfully request Mayor and City Council approval. ____________________________________ Michael C. Van Milligen, City Manager FROM: Jennifer Larson, Budget Director SUBJECT: Reset Public Hearing on FY 2021 City Budget DATE: March 19, 2020 INTRODUCTION Due to the COVID-19 pandemic, the purpose of this memorandum is to submit two resolutions resetting the public hearing and authorizing the publication of official notices for the public hearing required in connection with the adoption of the Fiscal Year 2021 City budget. DISCUSSION The City Council adopted Resolution No. 78-20 on March 2, 2020 which set the public hearing date as March 26, 2020. However, on Tuesday, March 17 the State of Iowa declared a State of Public Health Disaster Emergency related to the COVID-19 pandemic. Additionally, the State of Iowa extended the date for certifying municipal budgets to April 30, 2020. As a result, the City of Dubuque is revising the previous public hearing date. The public hearing on the Fiscal Year 2021 City budget will now be conducted at 6:30 p.m. in the City Council Chambers at the Historic Federal Building on Thursday, April 23, 2020. The public hearing will also cover the adoption of the Five-Year Capital Improvement Program for Fiscal Years 2021-2025. The final budget approval cannot exceed the maximum property tax resolution for Fiscal Year 2021 adopted by City Council at the February 9, 2020 public hearing. State law requires a public hearing on the Operating Budget and the Five-Year Capital Improvement Program. ACTION STEP The action step is for City Council to adopt the two resolutions setting the public hearing and authorizing the City Clerk to publish the required notices of the public hearing on the Fiscal Year 2021 City budget, operating and capital improvement program, for the City of Dubuque. 2 JML Attachments cc: Crenna Brumwell, City Attorney Cori Burbach, Assistant City Manager Teri Goodmann, Assistant City Manager RESOLUTION NO. 96-20 RE -SETTING THE DATE FOR THE PUBLIC HEARING ON THE FISCAL YEAR 2021 BUDGET AS AMENDED FOR THE CITY OF DUBUQUE Whereas, Iowa Code Section 384.16 provides that the City Council shall seta time and place for a public hearing on the Fiscal Year 2021 budget before the final budget certification date and shall publish notice before the hearing as provided in Iowa Code Section 362.3; and Whereas, Resolution No. 77-20 adopted by the City Council on March 2, 2020 set the date for the public hearing as March 26, 2020; and Whereas, the State of Iowa has extended the date for certifying municipal budgets to April 30, 2020 as a result of the COVID-19 pandemic. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA THAT: Section 1. Resolution No. 77-20 is hereby rescinded. Section 2, The City Council shall conduct a public hearing on the proposed Fiscal Year 2021 budget as amended for the City of Dubuque in the City Council Chambers at the Historic Federal Building, 350 West 6th Street, Dubuque, Iowa, on Thursday, April 23, 2020, beginning at 6:30 p.m. Section 3. The City Clerk be and is hereby authorized and directed to publish notice of the public hearing, according to law, together with the required budget information. Firnsta'hI, City Clerk RESOLUTION NO. 97-20 RE -SETTING THE DATE FOR THE PUBLIC HEARING ON THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM FOR FISCAL YEARS 2021 THROUGH 2025 FOR THE CITY OF DUBUQUE Whereas, a proposed Five -Year Capital Improvement Program for the City of Dubuque for Fiscal Years 2021 through 2025 has been prepared and submitted to the City Council; and Whereas, the capital projects for the first year of the program are included in the Fiscal Year 2021 budget for the City of Dubuque; and Whereas, it is deemed to be in the best interest of the City of Dubuque to conduct a public hearing and adopt the five-year Capital Improvement Program simultaneously with the public hearing and adoption of the Fiscal Year 2021 budget for the City of Dubuque; and Whereas, Resolution No. 78-20 adopted by the City Council on March 2, 2020 set the date for the public hearing as March 26, 2020; and Whereas, the State of Iowa has extended the date for certifying municipal budgets to April 30, 2020 as a result of the COVID-19 pandemic.
