This is a claim in which claimant alleges that as she was traveling south on Hwy. 52,
one-half mile before the Grandview Exit, claimant ran over a piece of steel, damaging
her tire.
According to the report of John Klostermann, Street/Sewer Maintenance Supervisor, Mr.
Klostermann states that this is a state highway and the City of Dubuque has no
maintenance agreement with the state on this road.
It is therefore the recommendation of John Klostermann to deny this claim, and refer Ms.
Breitbach to Mr. Dave Shanahan with the Iowa Department of Transportation for
information regarding how to file a claim with IDOT. The Legal Department concurs with
this recommendation.

Dear Barry:
In this letter I will respond to the claim filed by Ms. Susan Breitbach.
Ms. Breitbach claims to have damaged her tire while traveling south on Hwy 52, one-
half mile before the Grandview Exit. This section of Hwy 52 is a state highway and the
City of Dubuque has no maintenance agreement with the state on this road.
It is my recommendation to deny this claim because this roadway is not under the
jurisdiction of the city. Ms. Breitbach may want to contact Mr. Dave Shanahan (563-
582~3063) with the Iowa Department of Transportation for information on how to file a
claim with IDOT.
