Council met at 7:35 P. M.
Present —City Manager Evans,
Mayor Meuser, Councilmen Andel-
finger, Jansen, McEvoy, Schuckert.
Absent —None.
Mayor Meuser stated that this is
the regular monthly meeting of the
Council for the purpose of transact-
ing such business as may regularly
come before the meeting, and that
this date has also been fixed for the
purpose of adopting of resolution of
necessity for the construction of an
eight (8) inch vitrified tile sanitary
sewer in West 28th Street, Musca-
tine, Burlington, Davenport and Sab-
ula Streets, and conducting a hear-
ing on plans and specifications, form
of contract, and cost of improvement
for said proposed sewer, having been
approved and on file since Dec. 8th,
1930.
Proof of publication, certified to by
the publisher of notice of pendency
of resolution of necessity for public
improvements and hearing upon pro-
posed plans and specifications, form
of contract and cost of improvements
for sanitary sewer in West 28th
Street, Muscatine Street, Burlington
Street, Davenport Street and Sabula
Street, presented and read.
Councilman Schuckert moved that
the proof of publication be received
and filed. Seconded by Councilman
Andelfinger. Carried by the following
vote:

Petition of Henry Kalmen stating
that he is owner of lots 20 and 21
McDaniel's Park Hill Add. and does
not object to the improvement as
it affects lot 20 but he does object
to extending it to lot 21 as this is
inaccessable and entirely unsuited
for building purposes.
Councilman Schuckert moved that
the petition be received and filed.
Seconded by Councilman Andelfinger.
Carried by the following vote:

Petition of Oscar Irmen, owner of
lots 13 and .14 facing Davenport
Street, stating that he will not ob-
ject to the improvement if he can
get the water, when the sewer is
completed. He was assured that the
water would be supplied when the
sewer is completed.
Councilman Schuckert moved that
the petition be received and filed.
Seconded by Councilman Andelfinger.
Carried by the following vote:

Petition of J. V. Schneider, object-
ing to the assessment as proposed
to be levied against his property for
the proposed sewer on West 28th
Street, stating that his property is
located at the corner of West 28th
Street and Central Avenue, and that
he has a sewer on Central Ave.
Councilman Schuckert moved that
the petition be received and filed.
Seconded by Councilman Andelfinger.
Carried by the following vote:

Petition of Nicholas Grandgenet,
2835 Burlington Street, objecting to
the proposed sanitary sewer in West
28th Street, stating that a storm
sewer from Muscatine Street to Cen-
tral Avenue is more necessary. He
is owner of lots No. 78, 79, and 80,
McDaniel's Park Hill Add. He claims
further that the property is not worth
the assessments.
Councilman Schuckert moved to
receive and file the petition. Second-
ed by Councilman Andelfinger. Car-
ried by the following vote:

the contractor out of funds realized
from the sale of bonds or with
to be issued in anticipation of
deferred payments of assessments as
provided by law after the work has
been completed by the City Council.
Be It Further Resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of the
various improvements here in pro-
vided for in the manner provided by
law, the said improvements shall be
completed on or before the 1st day of
May, 1931.
Be It Further Resolved that this
resolution being deemed urgent and
of immediate necessity shall be in
force and effect from and after its
passage .and adoption by the City
Council.

WHEREAS, proposed plans and
specifications and form of contract
for the construction of an eight (8)
inch Vitrified tile sanitary sewer,
manholes, Y branches and risers in
West Twenty- Eighth Street from the
existing manhole in Central Avenue
to Muscatine Street and in Musca-
tine Street from West Twenty -
Eighth Street to Primrose Street and
from West Twenty- Eighth Street
southerly to the north line of Lot 22
South Park Hill addition and in Sab-
ula Street from Muscatine Street to
the end of said street, thence across
Lot 1 of Mineral Lot 346, thence in
Burlington Street to the south line
of Lot 80 McDaniel's Park Hill addi-

the City Council of the City of Du-
buque and public notice given as
provided by Chapter 23 of the Code
of Iowa, 1927, pertaining to public
contracts and bonds, and the time
and place fixed for the hearing of
all objections to said plans, specifi-
cations or contract for or cost of
such improvements, said time being
this 5th day of January, 1931; and
WHEREAS, the City Council met
in Regular session this 5th day of
January, 1931, at 7:35 o'clock P. M.
at the Council Chambers in the City
Hall for the purpose of hearing all in-
terested parties and considering any
and all objections which have been
filed to the proposed plans, specifi-
cations or contract for or cost of the
improvement herein described and
proposed to be made; and
WHEREAS, all interested parties
have been given an opportunity to
be heard and all objections which
have been filed have been duly
weighed and considered; now, there-
fore
BE IT RESOLVED by the City
Council pf the City of Dubuque, that
all objections which have been made
and filed to the plans, specifications,
contract for or cost of said improve-
ment herein described and proposed
to be made, be and the same are
hereby overruled and such plans,
specifications and form of contract
heretofore approved are hereby adop-
ted.
BE IT FURTHER RESOLVED
that this resolution containing the
jections which have been filed to the
plans, specifications and form of con-
tract for or cost of said improvement
be made a matter of 'permanent
record in connection with said im-
provement.

Be it Resolved by the City Council
of the City of Dubuque that pursuant
to a resolution of necessity, No. 373
—30, which was duly passed by this
Council, for the construction of an
(8) inch vitrified tile sanitary sewer,
manholes, Y branches and risers
in West Twenty - eighth street from
the existing manhole in Central ave-
nue to Muscatine street and in Mus-
catine street from West Twenty -
eighth street to Primrose street and
from West Twenty- eighth street
southerly to the north line of Lot 22
South Park Hill addition and in Sa-
bula street from Muscatine street to
the end of said street, thence across
Lot 1 of Mineral Lot 346, thence in
Burlington street to the south line
of Lot 80, McDaniel's Park Hill ad-
dition and in Davenport street from
West Twenty- eighth street to the
south line of Lot 21, McDaniel's Park
Hill addition, be and the same are
hereby ordered and constructed by
this Council upon its own motion and
with or without the petition of prop-
erty owners. All the work shall bg
constructed in accordance with the
plans and specifications heretofore
adopted and now on file in the office
of the City Clerk.
Be It Further Resolved that the
cost and expense of the said im-
provements be paid for by levying
special assessments against the pri-
vately owned property lying within
the assessable distance from the im-
provements, whether such property
abut upon the same or are adjacent
thereto, according to the area there-
of and in proportion to the special
benefits conferred, and any defici-
ency will be paid out of the general,
decision of this Council upon all ob- improvement, or sewer funds of the

stating that the assessment as levied
is too high in comparison to the val-
uation of the property, and they
hereby ask that the Council make
a reduction in the assessment.

the petition (verbal) be referred to
the Council to view the grounds.

A representative of the C., M. St.
P. & P. R. R. Co. addressed the Coun-
cil relative to constructing and in-
stalling Oil tanks at 16th street and
the railroad tracks. The tanks will
be about 100 feet away from the
nearest building. The Ordinance
provides that tanks of this kind must
be at least 300 feet from any build-
ing.
Councilman McEvoy moved that
the petition be referred to the Coun-
cil to view the grounds. Seconded
by Councilman Schuckert. Carried
by the following vote:

Oscar Irmen and Mrs. Senia Liepe
also addressed the Council relative
to Sanitary Sewers in their respec-
tive sewer districts. These petitions
have been taken care of.
Frank Mathis addressed the Coun-
cil relative to the assessment for a
sanitary sewer in the alley between
Lois and Hill Streets constructed
some years ago. The assessment is
in the amount of $175.00 and was
sold to the City at tax sale. He was
allowed to redeem his property by
paying the face of the certificate plus
5 per cent interest from date of sale.
Councilman 'McEvoy made a mo-
tion that Mr. Mathis be allowed to
redeem his porperty by paying the
face value of the tax sale certificate
on lot 1 of Mineral lot 168, plus 5'
per cent interest from date of sale.
Seconded by Councilman Andelfinger.

Plaintiff. vs. City of Dubuque, in the
sum of $2,500 as damages for injur-

paid by the City plus 5 per cent from
date of sale. She is a widow and
has three minor children. Council-

Treasurer be instructed accordingly.

City Council Proceedings for the
month of October, 1930, presented
for approval. Councilman Schuckert
moved that they be approved and

Report of the City Manager on the
petition of Attorney Frank Gilloon,
representing Mrs. P. J. Seippel, Mar-
tin Rabbet et al, in regard to a re-
port to the Council concerning the
Police detaining their boys for sus-
pected of trolley pulling. The City
Manager reported that he had inves-
tigated the matter and since action
was taken immediately by the Chief
of Police toward censure of the ser-
geant for the detention of the boys
in the empty jail; and since instruc-
tions were explicitly given that no
future detention of minors be made
in the jail, it is felt that no further
action, by the Council in this con-
nection, is necessary.
Councilman Schuckert moved that
the report be approved and made a

An Ordinance vacating Bellevue
Street from Blake Street easterly to
the end of said Street and granting
and conveying a portion thereof to
Peter Theobald, owner of abutting
property.
Whereas, Bellevue Street easterly
of Blake Street is unimproved and,
to continue to maintain the same in-
volves a needless expenditure of
public funds as street is of no use
or value for public purposes and is
being used more or less, as a dump -
ing ground and has become a men-
ace to public health; and,
Whereas, P_ eter Theobald, one of
the owners of abutting property
upon said street has petitioned for
its vacation and the transfer of the
title to him of so much thereof as is
herein described:
Now, therefore:
Be it ordained by the City Council
of the City of Dubuque:
Par. 128, section 1. That Bellevue
Street from ,Blake Street easterly to
the end of the said street be and the

Resolution fixing the terms of of-
fice of the members of the City Plan-
ing and Zoning Commission.
Be it Resolved by the City Council
of the City of Dubuque that the
terms of office of the members of the
Planing and Zoning Commission of
the City of Dubuque be and the same
are fixed as follows:
The terms of Rev. J. Wolfe and
P. J. Nelson shall be five years from
May 24, 1929, and will expire on May
24, 1934.
The terms of Fred Bissell and R.
V. McKay shall be four years from
May 24, 1929, and will expire on May
24, 1933.
The terms of Dale Welch and
Lewis Stoffregen shall be three
years from May 24, 1929, and will
expire on May 24, 1932.
The term of R. D. Waller shall be
two years from May 24, 1929, and
will expire on May 24, 1931.
Be it further resolved that upon
the expiration of the terms above
fixed, all appointments to said Com-
mission shall be made for a period
of five years.
Be it further resolved that in case
vacancies occur in said Commission,
the Council shall appoint a compe
tent person or persons to fill such
vacancy and the term of such ap-
pointee shall be for the unexpired
term of the member resigning.

Resolution No. 11 - 31.
Whereas, the Iowa State Legisla-
ture has establshed a Primary Road
System financed from a Primary
Road Fund, which fund is largely
supported by present automobile li-
cense fees and present tax on the-
safe easuone, ant
Whereas, the revenue from such
two sources now exceeds the amount
anticipated and is in excess of the
amounts required for said Primary
Road System, and
Whereas, the present increase, and
the anticipated large future increase,
in vehicular traffic on streets of the •
towns and cities of the State of Iowa
will cause an enormous annual ex-
pense of maintaining said pavements
and semi- pavements and
Whereas, about 60 per cent of the
State income from. Gas Tax and Li-
cense Fees is collected from cities
and towns but now used exclusively
for road purposes outside of corpor-
ate limits, and
Whereas. the present method of
maintaining said streets of the towns
and cities of this State is by taxation
or special assessment which meth-
ods are approaching the stage of
confiscation in many municipalities.
Now, therefore: Be it resolved by
the Council of the City of Dubuque,
Iowa, that the following recommend-
ations he made to Senator and Rep-
resentatives for presentation and
support in the General Assembly:
1. That the State of Iowa should
grant to each City and town an an-
nual sum of money for the mainten-
ance and reconstruction of the
streets of the municipality equivalent
to not less than 50 per cent of the
motor vehicle license fees collected
from said municipality; or grant a
sum of money equivalent to not less
than 25 per cent of the combined
fees collected annually from the tax

on the sale of gasoline and the fees
from motor vehicle licenses; or
grant a sum equal amount of relief
based on some other plan.
2. That the proposed sums appro-
priated by the States to Cities and
Towns for road purposes should be
required by law to replace present
tax levies on property.
3. That the General Assembly
should not increase gasoline tax.
