Council met at 7:45 P. M.
Present — City Manager Evans,
Mayor Meuser, Councilmen Andel-
finger, Jansen, McEvoy, Schuckert.
Absent —None.
Mayor Meuser stated that this is
the regular monthly meeting of the
City Countil for the purpose of act-
ing on any business that may prop-
erly come before the meeting, and
that this date was also fixed for the
purpose of considering bids for the
construction of a sanitary sewer in
West 28th St., Muscatine, Sabula,
Burlington and Davenport Streets,
and levying special assessments for
the construction of sewer, water and
gas connections in Viola Street, and
gas connections in Algona, Auburn
and Wood Streets.
Proof of publication certified to by
the publisher of notice to contractors
of receipt of proposals for the con-
struction of a vitrified tile sanitary
sewer in West 28th St., Muscatine,
Sabula, Burlington and Davenport
Streets, presented and read.
Councilman Schuckert moved that
the proof of publication be received
and filed. Seconded by Councilman
McEvoy. Carried by the following
vote:

were received at 10:00 A. M. Mon-
day, February 2, 1931, for the con-
struction of a sanitary sewer in and
along Muscatine, West Twenty -
Eighth, Burlington, Davenport and
Sabula Streets.
I am attaching hereto a tabulation
sheet showing the unit prices and
total prices bid and respectfully re-
commend that the contract for the
construction of this sewer be award-
ed to the Uhlrich -Paley Company as
their bid was the lowest one re-
ceived.

WHEREAS, proposals have been
submitted by contractors for the con-
struction of an eight (8) inch vitri-
fied tile sanitary sewer, manholes, Y
branches and risers in West Twenty -
Eighth Street from the existing man-
hole in Central avenue to Muscatine
Street and in Muscatine Street from
West Twenty- Eighth Street to Prim-
rose Street and from West Twenty -
Eighth Street southerly to the north
line of Lot 22 South Park Hill addi-
tion and in Sabula Street from Mus-
catine Street to the end of said
street, thence across Lot 1 of Min-
eral Lot 346, thence in Burlington
Street to the south line of Lot 80 Mc-
Daniel's Park Hill addition and in
Davenport Street from West Twen-
ty- Eighth Street to, the south line of
Lot 21 McDaniel's Park Hill Addi-
tion, pursuant to Resolution No.
2 -31 and Uhlrich -Paley Co.,. con-
tractor, has submitted the lowest
bid for the furnishing o.f all labor
and materials and performing the
work as provided for in the plans
and specifications; now therefore,
BE IT RESOLVED by the City
Council of the City of Dubuque that
the contract for the above mentioned
improvement be awarded to Uhlrich-
Paley Co., and the Manager be and
he is hereby directed to execute a
contract on behalf of the City of Du-

BE IT FURTHER RESOLVED
that this resolution being deemed
urgent and of immediate necessity
become effective from and after its

To the Honorable Mayor
and City Council,
Dubuque, Iowa.
Gentlemen:
On December 23rd the application
of Mr. Herman Morris of 1824 White
Street, Dubuque, was referred to the
writer for investigation and report.
Mr. Morris has, within the last
four months, moved to Dubuque
from Meadow, South Dakota. He
has presented his discharge from the
World War service, being designated
as No. 3045 of April 21, 1919. Mr.
Morris is slightly crippled at present
as he has had a bad attack :of in-
flamatory rheumatism which has left
his arms partially stiffened. Mr.
Morris is not affiliated with the local
American Legion.
The writer believes that while this
gentleman has had war service and
the Council has in two cases prior to
this application granted certain in- •
dividuals, having war service, per-
mission to peddle fruit and vege-
tables without paying the $50.00
license fee to the City, that to grant
this application would start a pre-
cedent toward favoring unfortunate
individuals from other cities and lo-
cations. I should think it would be
'reasonable to expect persons to re-
side in this City at least one year
prior to granting any favors not
granted to the cordinary individual.
Accordingly the writer would sug-
gest that the application be not
allowed.

ington, D. C., acknowledging the re-

he contemplates purchasing lot 25,
Sister's Add., from Ed. Kuehnle for
$400.00 and the assessment against
this lot for the West Dubuque Sewer
is $434.42. He claims that this is
much too high in comparison to the

At an informal meeting between a
delegation of the Milwaukee Rail-
road Shop employees, the President
and Secretaries of the Dubuque
Chamber of Commerce, Mayor Meu-
ser and the City Manager held at the
Chamber of Commerce January 30,
1931, the following recommendations
were made to the City:
1. Study of the feasibility of es-
tablishing one or more possible com-
fort stations.
2. Increased precautions toward
cleanliness and sanitation of drink-
ing fountains and increase the flow
of water at certain ones.
3. Elimination of several partially
demolished or burned buildings, es-
pecially in business section. Com-
mittee thought some method of
cleaning up debris to accommodate
parking of cars on different sites
could be accomplished.
4. Steps to be taken to prevent
damage to park sod, trees, breaking
of light globes in parks.
5. City should check and replace-
fallen and broken street and traffic
signs throughout City.
6. Street cars on Eighth Street,
east of Main, should not stop so
close to Main Street.
7. City Police Department to en-
courage and assist pedestrain inter-
section crossing at traffic lights.
8. City should establish a City-
wide employment bureau at City
Hall for the benefit of local indus-
tries and local tradesmen and labor.

The Voelker Realty Company and
C. A. Voelker et al have taken ap-
peals from special assessments here-
tofore levied against their respective
properties herein described for the
construction of sewers in Adair
Street, Green Street, and Oak Street.
These appeals are ready for trial at
this term of Court. In preparing
for trial, I discussed with the City
Engineer the various, properties in-
volved in these appeals before taking
the matter up with the interested
parties. d then had a conference with
Mr. Kolfenback, representing the
Voelker Company, and his Attorney.
and we came to an agreement for the
purpose of settlement. I might ad-
vise you further that .practically all
of these lots have been sold for the
delinquent taxes and the City is
the owner of tax certificates thereon
so that, if you approve the sugres '
settlement it will mean the surren-
der of the certificates upon the rny-
ment of the amounts herein sug-
gested.
In Re Green Street Sewer
The Voelker Realty Company is
the owner of Lots 13, 14, 15, 16 and
17, Milts West Dubuque Addition
and each of these lots was assessed
in the sum of $68.78 for the Green
Street sewer. These lots have an
actual value as follows: Lot 13,
$1,400 and Lots 14, 15, 16, and 17,
$100 each. The assessment against
Lot 13 will remain as levied but the
assessments against Lots 14, 15, 16,
and 17, will be reduced to $34.00
each and the balance of the assess-
ments cancelled., This is about fifty
per cent of the original assessment
and I believe is entirely adequate
considering the valuation of the lots.
In Re Adair Street Sewer
The Voelker Realty Company is
the owner of Lot 17, in Pinehurst
Addition which has been assessed
for $78.40, for the Adair Street
sewer. The actual value of this lot
is $360 and no reduction in this as-
sessment is recommended.
'Chris A. Voelker et al are the
owners of Lots 22, 23, 24, 25, 29, 30,
31, 32, and 39, Woodlawn Park Addi-
tion and Lots 42, 43, 44, 45, 46, 47,
and 48, and 49, in Rosedale Addition,
which lots have been assessed for
the construction of the sewer in
Adair Street. The valuation of these
lots range from $40.00 to $100.00 and
the assessments against the same
range from $72.11 to $92.49. The lots
are of little value and the prospect
of development for many years is
very uncertain. The reductions
agreed upon are as follows:

Gentlemen: There has been pend-
ing in the District Court of Dubuque
County, Iowa, a suit by the Jas. F.
Lee Paving Company against the
City, involving something like Four
Thousand Dollars ($4,000) in claims
for work done under a. number of
contracts. This matter has received
your attention for quite a long time
and I have given it considerable con-
sideration.
The City had a bill against the
Jas. F. Lee Paving Company for
damage claimed to have been done
to an electric cable at the time Cen-
tral Avenue was under construction.
I have gone into that matter very
thoroughly and have taken it into
consideration in proposing a settle-
ment with the Jas. F. Lee Paving
Company.
Recently I offered Mr. Lee of that
Company the sum of $1,900 in full
settlement of all claims involved in
said law suit and of all claims for
damages to cable held by the City
against said Company. Mr. Lee has
accepted the offer and has agreed to
dismiss his case and pay the costs.
•I believe this is a satisfactory ad-
justment of this controversy and
therefore recommend that a warrant
be drawn in favor of the Jas. F. Lee
Regular Session, February 2nd, 1931
Sub. which was assessed in the sum
of $89.71 for the sewer in Oak Street.
This lot is being sold under contract
and I find that the purchaser has
paid two installments on this assess-
ment and thereby waived any objec-
tion to the amount of the assess-
ment, Therefore no reduction in
this assessment is recommended.
If the Council approves of these
adjustments I would recommend
that the Treasurer surrender the tax
sale certificates which the City holds
on these lots upon the payment of
the amounts herein stated. The own-
ers of the lots agree to dismiss their
suits and pay the costs.

of Court the case of. Gladys Chapman
vs. City of Dubuque was called for
trial. This was an action for per-
sonal injuries sustained by the
Plaintiff by falling upon an icy side-
walk and suit was brought for Five
Thousand Dollars ($5,000). When
the case was reached for trial I of-
fered $100 and the payment of the
costs as a settlement. The offer was
accepted and, in order not to delay
the settlement, I advised the Treas-
urer to issue a warrant in the sum
of $100 in favor of Walter Koerner.
Attorney for the Plaintiff, to cover
the settlement. The Treasurer has
issued a warrant and the amount is
paid and I request that the settle-
ment be approved.
The costs amount to $12.20, and

the contract for the Sanitary sewer
in - West 28th Street, Sabula, Musca-

Streets, and acting on any other bus-
iness that may come before the
meeting.

Whereas, proposals have been sub-
mitted by contractors for the con-
struction of an eight (8) inch vitri-
fied tile sanitary sewer, manholes, Y
branches and risers in West Twenty -
Eighth street from the existing man-
hole in Central avenue to Muscatine
street and in Muscatine street from
West Twenty- Eighth street to Prim-
rose street and from West Twenty -
Eighth street southerly to the north
line of Lot 22 Squth Park Hill addi-
tion and in Sabula street from Mus-
catine street to the end of said
street, thence across Lot 1 of Min-
eral Lot 346, thence ,in Burlington
street to the south line of Lot 80
McDaniel's Park Hill addition and in
Davenport St. from West 28th to, the
south line of Lot 21 McDaniel's Park
Hill addition, pursuant to Resolution

at an informal meeting of the Coun-
cil held Saturday, February 7th, at
which all members of the Council
were in attendance, the following
properties were viewed and decisions
made as follows:
(1) Request of J. B. Nieman of
December 12th for a 50 per cent re-
duction in the assessments for pav-
ing, water, sewer and gas connec-
tions on Lot 6 and 1 of 5 of Mineral
Lot 178, and also on Lot 10 of Gray's
Subdivision (on which there is a
house located) on Wood Street was
investigated, but not allowed.

Streets, on the 8th Street side, two
of their large plate glass windows
were broken. Although nobody saw
it, they claim that it was done by
pieces of ice being thrown against
the windows by the machine, and
they claim that there is a liability
here on part of the city, stating that
their loss will run in the neighbor-
hood of $37.87 plus lettering the win-
dows.

Gentlemen: The written request
of Mr. J. A. Blichmann, dated Jan-
uary 5, 1931, praying that Council
extend from the end of the present
storm sewer west from Lemon Street
over and through Lot 43, G. R.
West's Dubuque Subdivision an addi-
tional section of storm sewer pipe 90
feet in length up the present ravine
through land owned by J. A. Blich-
mann, was viewed by the Council
February 7th, and the prayer of the
petition was granted with instruc-
tions that the City forces extend this
sewer for the purpose of protecting
Lot 43 from overflow and damage.
The cost of the said additional ex-
tension of sewer is to be charged to

Gentlemen: At a meeting of the
City Council held February 7, 1931,
at which time all members of the
Council and Messrs. George Maddock
and A. H. Smith of the Interstate
Power Company were present, it was
determined that on the Point street
car line and the West Locust street
car line, as operated by the Inter-
state Power Company, that the Tread-
way of street cars would be changed
to the following schedule:
12 minute service from 6:00 a. m.
to 9:00 a. m.
20 minute service from 9:00 a. m.
to 4:00 p. m.
12 minute service from 4:00 p. m.
to 6 :00 p. m.
20 minute service from 6:00 p. m.
to midnight.
The above schedule would be made
with the provision that more fre-
quent service or additional cars
would be provided to take care of all
grade school and high school re-
quirements and curing noon hour if
found desirable and at certain other
rush periods it occasion demanded.
It is further agreed that on all
street car lines the street car service
on Sundays throughout the entire
day would be on the basis of a 20
minute headway.

Whereas, various bills now pend-
ing before both branches of the
Forty-fourth General Assembly of
Iowa provide for the assessment of
real estate by County Assessors un-
der direction of the State Board of
Assessment and Review and for var-
ious forms of new taxation the pro-
ceeds of which are to go wholly into
the treasury of the State and are to
be employed for general State pur-
poses as the Legislature may direct,
the pending bills not requiring that
any portion of the taxes to be col-
lected from new sources shall be ex-
pended in or for the benefit of the
communities providing them.
Therefore, Be it Resolved, that in
the opinion of the City Council of
the City of Dubuque, justice and the
principles of representative govern-
ment require that original jurisdic-
tion of assessments for general prop-
erty tax purposes should remain
with the jurisdiction in which the
taxable property has its situs in all
cases in Which the complete unit to
be taxed is found within a single
local jurisdiction.
It is furthermore the opinion of
this Council that the tax burdens
now borne by real estate in the mu-
nicipalities of Iowa cannot be light-
ened by State taxes on individual or
corporation income or other new
forms of taxation in the proceeds of

ing of the City Council held Feb-
ruary 7th, at which all members
were present, the following requests
were investigated, viewed and grant-
ed by the City Council:
(1) Petition of St. Mary's Or-
phans' Home, as signed by President
and Treasurer, and also Mt. Pleasant
Home, as signed- by President and
Secretary, received February 2, 1931,
for reduction in assessment for sani-
tary sewers in the West Dubuque
District as levied against Lots 21
and 22, Sister's Addition, the orig-
inal assessment in each case of
$221.46 was reduced by 30 per cent.
The revised assessment on Lots 21
and 22 includes $105.02 each to the
owner and $66.44 each to the City.
(2) Petition of J. A. McMahon,
dated February 2, 1931, requesting
reduction in assessment levied
against Lots 1 and 2 of Sub. of Lots
6, 7, 8 and 9, Quigley's Sub. for the
West Dubuque sanitary sewers was
reduced 30 per cent. The revised as-
sessment on Lots 1 and 2 includes
151.02 each to the owner and $21.86
each to the City.

& Glenn, attorneys for Mrs. Margaret
McGivern, dated January 29, 1931,
for reduction in assessment levied
against Lots 31 and 32, Finley,

duced 30 per cent. On the new basis
the owner will assume $68.06 each
for Lots 31 and 32 and the City will
assume $29.17 each.
(4) Petition presented to the
Council January 5, 1931, by Frant-
zen, Gilloon & Glenn, attorneys for
Joseph L. Hird, for reduction in sani-
tary sewer assessment levied against

following basis: Owner to assume
$68.06 each for Lots 47 and 48 and
City to assume $29.17 each.
(6) Petition of Geo. Kampmann,
dated January 6, 1931, for reduction
in sanitary sewer assessments on
Lots 4. 5 and 6, Kampmann's Sub.
was viewed and a 30 per cent reduc-
tion was made on Lot 6. The revis-
ed assessment on Lot 6 includes
$74.16 to the owner and $31.78 to the
City. No reduction was made on

On recommendation of the City So-
licitor, the following motion was
passed, on the matter of Lester
Wiedner. The City Solicitor report-
ed that Lester Wiedner slipped and
fell on the sidewalk back of John T.
Adam's property, severely injuring
himself. Mr. Adams agrees to pay
the doctor and hospital bills, and the
Solicitor recommends that the Conn-
ell pay Mr. Wiedner $50.00 for time
lost from his work.
Councilman McEvoy moved that
the recommendation of the City So-
licitor be approved and a warrant be
drawn in favor of Lester Wiedner in
the sum of $50.00. Seconded by
Councilman Jansen. Carried by the
following vote:

The City Manager and the Engi-
neer were instructed to prepare
plans and specifications for the im-
provement of Central Avenue from

one present who wished to do so, to
address the Council. Seconded by

Be it further resolved that this
Council go on record as opposed to
any tax measures proposed for adop-
tion by the Legislature of this State
which divests municipalities of the
free exercise of taxing powers, or
interfere with such exercise, or pro-
vides that taxes collected in munici-
palities be paid into the State Treas-
ury instead of into the treasury of
the municipalities that exact them.
The City Clerk is hereby directed
to forward copies of this Resolution
to Dubuque County's Representatives
in the Forty - fourth General Assem-
bly of Iowa and the Chairmen of the
appropriate committees of Senate

which amounts to $74.60 (30 per cent

this entire lot which area now lies
within the extended property lines
of West Third Street. The purpose
of this suggestion is to increase the
width of Third Street to a uniform
width of 50' throughout and it is felt
that the increased width of the street
will particularly benefit your lot.
