Regular Session March 2nd, 1931.
Council met at 7:40 p. m.
Present —City Manager Evans,
Mayor Meuser, Councilmen Jansen,
McEvoy, Schuckert. Absent —Coun-
cilman Andelfinger.
Mayor Meuser stated that this is
the regular monthly meeting of the
City Council for the transaction of
such business as may regularly come
before the meeting.
Petition of Uhlrich, Paley Co.,
stating that owing to the litigation
involving the City of Dubuque in the
matter of the Shiras Avenue storm
sewer contract, it will be impossible
for them to complete this sewer in
the time specified (namely March
1st, 1931) and they hereby ask that
thetime for completion be extended.
Councilman McEvoy moved that
the prayer of the petitioner be grant-
ed and the time for completion be
extended of August 1st, 1931, provid-
ing this is agreeable to the bonding
company. Seconded by Councilman
Schuckert. Carried by the following
vote:

Councilman McEvoy moved that
the rules be suspended to allow any-
one present who wishes to do so, to
address the Council. Seconded by

Mr. Harold Mathey presented a pe-
tition signed by seven out of the
nine property owners on Iowa Street
between Fourth and Sixth Streets,
asking that boulevard lights be in-
stalled in this locality.
W. M. Clemens, Chas. P. Mettel et
a] addressed the Council, requesting
that the boulevard lights be also in-
stalled from Sixth Street north on
Iowa Street to Thirteenth Street.
Councilman McEvoy moved that
the prayer of the petition be granted,
and the City Manager and City Engi-
neer be instructed to prepare the
proper glans and specifications for
the installation of boulevard lights
on Iowa Street from Sixth Street to
Thirteenth Street. Seconded by
Councilman Schuckert. Carried by
the following vote:

Petition of B. H. Becke et al, ask-
ing that a storm sewer be installed
from Putnam Street to Central Ave-
nue, on West 28th Street, stating
that this street is in a deplorable
condition on account of washouts,
which would not be if there was a
storm sewer there.
Councilman , Schuckert moved that
the petition be referred to the Coun-
cil to view the grounds. Seconded
by Councilman Jansen. Carried by
the following vote:

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: Complaint has been
filed in regard to the dangerous con-
dition of West 28th Street westward-
ly from Central Avenue. Upon inves-
tigation it is found that just west
of Central Avenue, 28th Street is
badly rutted and has been made im-
passable by reason of an open ditch
carrying water from Park Hill above
Central Avenue.
It is recommended that authority
be granted to the Street Department
to install approximately 200 feet of
20 -inch vitrified tile in the present
open ditch and that the ditch be
filled in order to make a . greater
width of street accessible for high-
way traffic. In the accomplishment
of this improvement it would be the
intention to use the present stone
curb from Central Avenue along the
south edge of the street and near the
present water course to provide fill-
ing in order not to encroach on the
property immediately south of West
28th. Street. A concrete inlet will
have to be provided at the upper end
of the new 20 -inch tile drain. The
cost of this improvement can be-
charged to the Sewer Bond Fund.

Henry Becker addressed the Coun-
cil and stated that he understands
that the City owns Lots 18 and 19,
Blake's Add., having acquired Treas-
urer's deeds to this property. He of-
fers to purchase these lots from the

City for $300;00 and also offers to
tuy lots No. 25, 26, 27, Blake's Add.,
and asks what price the City will
make on this property.
Councilman McEvoy moved that
the City accept the offer of $300.00
for Lots 18 and 19 and furnish him
with a quit claim deed on receipt of
$300.00, and that the Council view
the Lots 25, 26, 27, before setting a
price on same. Seconded by Council-
man Schuckert. Carried by the fol-
lowing vote:

Petition of the Voeliter Realty Co.
(by Louis Kolfenbach) stating that
the City is holder of a tax sale cer-
tificate on lot the West 45 feet of Lot
10, J. P. Porter's Add., for the im-
provement of Seminary Street,
amount $122.93, and for a subsequent
tax payment of $23.20. They offer
to pay this promptly if the City will
accept one -half of this amount of the
tax sale certificate, upon assignment
of said tax sale certificate to them.
Councilman Schuckert moved that
the petition be referred to the City
Council to view the grounds. Sec-
onded by Councilman McEvoy. Car-
ried by the following vote:

and the Board of Supervisors be no-
tified of the Council's action. Sec-

A communication from the Central
Avenue Business Men's Association,
congratulating the Council for the
action taken in reference to the pav-
ing of Central Avenue from 22nd
Street to 32nd Street, presented and
read.

Petition of D. J. O'Neill, asking
that he be placed on the list of em-
ployees, having injured his right
hand and is unable to do heavy man-

Petition of W. H. Rauch, stating
that he is the owner of Lot 12, Stew-
art's Sub. This lot has been as-
sessed for construction of a sanitary
sewer in Exchange Street for $49.38,
paving of Grandview Avenue for
$375.00, constructing cement side-
walks for $131.00 and for paving
South Hill Street $412.00. He claims
that the assessments are far in ex-
cess of the valuation of the property
and he hereby asks that the Council
reduce the assessments, consistent
v the valuation of the lot. The
Cily holds tax sale certificates to this
property.

Whereas, the contract for the con-

fied tile sanitary sewer, Y branches,

Street from the north line of Lot 81,
McDaniels' Park Hill Addition, to
Alley between National Street and
Stoltz Street, and in the Alley be-
tween National Street and Stoltz
Street from Burlington Street to
Davenport Street and in Davenport
Street from Stoltz Street south to
the south line of Lot 29, McDaniels'
Park Hill Addition and in Stoltz
Street from Davenport Street to the
existing manhole in Stoltz Street ani
in Muscatine Street from Primrose
Street to the Alley first north of Na-
tional Street, has been completed
and the City Manager has examined
the work and filed his certificate
stating that the same has been com-
pleted according to the terms of the -
contract, plans and specifications
and recommends its acceptance, now,
therefore,
Be It Resolved, by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Manager
be approved and that said improve -
i lent be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby directed to prepare a
plat and schedule showing the lots
or parcels of real estate subject to
assessment for said improvement
and file the same in the office of the
City Clerk subject to public inspec-
tion and said •Clerk shall upon re-
ceipt of such plat and schedule pub-
lish the notice of the Council's inten-
tion to levy special assessments
therefor, as required by law.
Be It Further Resolved, that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of sewer bonds issued upon
the above described improvement in
amount equal to the amount of his
contract, less any retained percent-
age provided for therein.

Annual Budget, Year 1931, City of Dubuque, Iowa.
The following budget of expenditures for the fiscal year, April 1, 1931,
to March 31, 1932, on the basis of expenses for the several departments of
the City of Dubuque, Iowa, has been submitted by the City Manager to the
City Council, and such budget has been approved by the City, Council as its
budget for the fiscal year ending March 31, 1932. This budget will be con-
sidered for final adoption by the City Council at a special meeting to be held
in the Council Chamber at the City Hall on the 23rd day of March, 1931, at
7:30 p. m. Any taxpayer objecting thereto or protesting to the same or to
any item thereof or to any omission therefrom shall present his objections
to the City Council on or before that date.

Gentlemen: Mr. 0, E. Winner, 921
Gilliam Street, requests that the
Council consider the furnishing and
installing of about 80 feet of 30 -inch
vitrified sewer pipe to complete
across 14is, lot discharge from the,
storm sewer system of the Mineral
Street district. This storm sewer
provides an outlet for a considerable
area and includes the draining of
lateral sewer from the swimming
pool at the University of Dubuque.
During such time as this pool is,
emptied the water from the storm
sewer flows over a portion of Mr.
Winner's lot to such a, degree as to
b,e a nuisance to him. The reason
that this has become a nuisance is
due to the fact that the storm sew-
ers drain to, this discharge, while
previously they had been allowed to,
run through open ditches to the
same point of discharge.
It is recommended that this im-
provement be authorized and that
the cost of same be charged to the
Storm Sewer Fund.

Gentlemen: In line with the pro-
cedure followed by other water
companies of this district and most
water companies of the country and
also in line with private utility oper-
ation, the writer would respectfully
recommend the amendment of Sec-
tion 277 of the present rules and reg-
ulations of the Dubuque City Water
Works to read as follows:
"That from and after March 14,
1931, all water meters in sizes from
6 / to 1 ", inclusive, be furnished to
the consumer by the Water Depart-
ment at the expense of the Water
Department; further that after
March 14, 1931, the Water Company
shall repair and keep in first class
condition all water meters within the
above mentiond classes. It is ex-
pressly understood that one meter
only is to be furnished by the Water
Department for each building. Met-
ers in excess of one desired for sin-
gle building shall be purchased by
the owner or owners. Meters above
1" in size shall be approved by the
Water Department and purchased by
the owner or consumer."

The Water Department finds that
they have not room to repair the
number of meters they have in ser-
vice, and plans and specifications
are ready to be submitted to the City
Council, at an estimate of $21,000.
The City owns a piece of ground in
the rear of the City Garage, suitable

for this building, and the Water De-
partment is willing to build a meter
room and garage on this property
and finance the cost of the improve-
ment out of the Water Works funds.
They will furnish the City, for a
repair shop, all space not used by
the Water Department.

Whereas, the construction of a
building for use by the Water De-
partment for the storage and repair
of water meters and the housing of
equipment and other purposes inci-
dental to the conduct and operation
of said Water Department is deemed
necessary and advisable by the City
Council of the City of Dubuque, said
building to be built and erected upon
Lot No. W. 65 ft of It 212 and 213,
East Dubuque Add., owned by the
City of Dubuque, and plans and spec-
ifications therefore have been duly
prepared and approved by this
Council, the estimated cost of said
building being approximately Twen-
ty -one Thousand Dollars ($21,000).
Now therefore, Be It Resolved by
the said Council that said building
be and the same is hereby ordered
constructed and built of the mater-
ials and in the manner provided for
in the plans and specifications here-
tofore prepared and approved, which
plans and specifications are now on
file in the office of the City Clerk for
public inspection.
Be It Further Resolved that the
City Clerk be and he is hereby di-
rected to publish all necessary no-
tices in the official newsppaper of
said City preliminary to the awarding
of a contract for such public im-
provement, including a notice of a
public hearing upon the proposed
plans, specifications, form of con-

Whereas, the City of Dubuque, a
municipal corporation of Iowa, is the
owner and holder of tax sale certifi-
cates upon Lot One (1) of the Sub.
of M. L. 21, Lot Two (2) of the Sub.
of M. L. 21, Lot Two (2) of the Sub.
of Lot Two (2) of the Sub of Lot
Five (5) of the Sub. of M. L. 21 and
Lot Three (3) of Rowan's Sub., all
in the City of Dubuque, Iowa, said
lots and parcels of real estate being
assessed to Ross McMahon Estate,
and notices of redemption have 'been
duly published by the City of Du-
buque as provided by law.
Now therefore, It is hereby stipu-
lated and agreed by the City of Du-
buque that, in the event said lots are
not redeemed from said tax sales
within the time prescribed in said
i.otice by the owner or owners there-
of, said City of Dubuque will cause

to be issued to it by the County
Treasurer of Dubuque County, Iowa,
deeds thereon and, thereupon, it will,
in turn, in consideration of the pay-

have heretofore paid to said City of
Dubuque and for which payment re-
ceipt is herein acknowledged.
It is further stipulated and agreed
that, as a part of this transaction and
in consideration of the sum above
stated, said City of Dubuque will
when and if said tax deeds are issued
fo it, caused to be cancelled and dis-
charged an unpaid special assess-
ment heretofore levied by the Coun-
cil of the City of Dubuque upon Lot
Two (2) of the sub of Lot Two (2)
of the Sub. of Lot Five (5) of the
Sub. of M. L. 21 for the improve-
ment of South Grandview Avenue in
the year 1925.
It is further stipulated that this
agreement shall be deposited with

Whereas, a Stipulation and Agree-
ment has been prepared and sub-
mitted to this Council by the City
Solicitor of the City of Dubuque,

the furnishing of all materials requir-
ed by the plans and specifications re-
ferred to, which notice shall be pub-
lished twice in said official newspa-
per, the first of which publications
' shall not be less than fifteen days
prior to the receipt of bids, which
bids shall be received by the City
Manager up to 10 o'clock a. m. on
the 23rd day of March, 1931, and
submitted by him to this Council, the
time fixed for completion of said
structure shall be the 1st day of
July, 1931.
Be It Further Resolved, that the
cost of such improvement be paid to
t.h.: contractor in cash out of funds
of the Water Department available
for such purpose and upon monthly
estimates certified by the architect,
of labor performed and materials fur-
nished, said payments to be made
for not more than 85 per cent of
said estimate and to be so made that
at least ten per cent of the contract
price will remain unpaid to the date
of the completion of the contract.
Be It Further Resolved, that each
contractor submitting a bid shall ac-
company his proposal with a certi-
fied check for at least ten per cent
of his bid as a guarantee that he will
enter into a contract if awarded to
him or forfeit the same in the event
he should refuse to enter into such a
contract. Any contractor to whom
the contract will be awarded shall
be required to furnish a performance
bond up to at least seventy -five per
cent of the contract price.
This Resolution being deemed ur-
gent and of immediate necessity
shall be in force and effect from and
after its passage, adoption, and ap-
proval by the City Council.

OFFICIAL NOTICE
Annual Budget, Year 1931, City of Dubuque, Iowa.
The following budget of expenditures for the fiscal year, April 1, 1 1931,
to March 31, 1932, on the basis of expenses for the several departments of
the City of Dubuque, Iowa, has been submitted by the City Manager to the
City Council, and such budget has been approved by the City, Council as its
budget for the fiscal year ending Marc11 31, 1932. This budget will be con-
sidered for final adoption by the City Council at a special meeting to be held
in the Council Chamber at the City Hall on the 23rd day of March, 1931, at
7:30 p. m. Any taxpayer objecting thereto or protesting to the same or to
any item thereof or to any omission therefrom shall present his objections
to the City Council on or before that date.

Mrs. Kilby addressed the Council
relative to an assessment against
Lot 66 on Oak Street, stating that
the City holds a tax sale certificate
on this lot, assessment was $144.00.
Some time ago her son offered to
settle this by paying the face of the
certificate, plus 5% interest from
('late of sale, but she thinks this is
1. o much and asks that the Council
reduce this amount. She also claims
that she paid for a sewer to this
property on Cleveland Avenue.
Councilman McEvoy moved that
the matter be referred to the Coun-
cil to view the grounds. Seconded
by Councilman Jansen. Carried by
the following vote:

March 11, 1931.
To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: Attention was called
yesterday to the failure of a retain-
ing wall along the east side of
Thomas Street at the projection of
Humboldt Street. The wall that
failed is approximately fifty feet in
length and varies from eight to ten
feet from the top of the wall to the
ground level at the lower side. The
failure occurred partially at the lot
owned by Louis Oberhoffer at 911
High Bluff Street, and Charles Min-
er, his neighbor on the south.
Yesterday it was believed that the
question of whether or not the City
was liable could remain until Coun-
cil decision March 23rd. Today it is
apparent that a hazard exists, both
on the properties of the above men-
tioned owners, and by reason of the
fact that Thomas Street might slide
in on these properties, endangering
the lives of pedestrians and also au-
tomobile traffic.
The writer has also discussed this
with one or two Councilmen infor-
mally and with the City Solicitor,
and this is to advise that steps were
taken today noon to tear out the
badly bowed stone wall and install
an adequate concrete wall along the
easterly line of said Thomas Street.
I ask for your authority and approv-
al in this connection, which was
deemed an emergency case.

City Council of its own motion deem
it advisable and necessary for the

Gentlemen:
At a recent meeting of your Hon-
orable Body you instructed me to in-
vestigate the matter of regulating
the storage of gun powder, dynamite,
etc., within the limits of the City.
For your information I beg to advise
you that the statute on this subject
is as follows:
Section 5764. Cities shall have the
power to regulate the transportation
and keeping of gun powder, inflam-
mable oils and other combustibles,
and to provide and license magazines
for storing the same, and prohibiting
their location or maintainance with-
in a given distance of the corporate
limits of such cities.
At the present time we have no
Ordinance on this subject. However,
I find that there was an earlier Or-
dinance which regulated the storage
of gun powder, etc., and required a
permit therefore. This Ordinance
limited the keeping and storage of
gun powder in excess of fifty pounds
within the City, unless the same be
kept in a warehouse or other build-
ing situated at least three hundred
feet from any other building. Of
course the storage of gun powder al-
ways presents a menace and the
danger from explosion is always
present. In the case of dynamite or
dynamite caps you have a somewhat
different situation. There is not se
much danger from the storage of
these explosives, yet, I think that
there should also be some regulation
with reference to these articles.
In view of the fact that certain

parties are considering the storage
of explosives within the City, the
Council should decide whether or not
they will be permitted within the
limits of the City, and, if so in what
quantities and to what extent and
where storage plants may be located.

the alley west of Main Street.
Upon investigation yesterday and
today the fact is established that the
contractor has changed the grade of
the curb between the alley and Lo-
cust Street in such a way that there
is now an 18 -inch step from the top
of the sidewalk at the curb down to
the gutter grade. From this point of
maximum distance from gutter line
to curb grade the walk is so sloped
that the established curb grade is
met at the intersection of Locust
Street and at the alley.
Today a letter has been sent to
Mr. Roshek and a copy to the archi-
tect advising that this walk is con-
trary to the established curb grade
and is condemned by the 'City Engi-
neer. The reason for the non- appro-
val of this walk is due wholly to the
action of the contractor in rebuilding
the curb to a grade not in conformity
with the Council Ordinance for the
establishment of the 7th Street curb.

pany's Addition to the City of Du-
buque and being the same tract of
land described as Lots 1A and 2A
shown upon a plat appearing in
Book 8 on page 359, filed February
7, 1923, by Pyramid Lumber Com-

Whereas, the petitioners are the
owners of all of the real estate abut-
ting upon and adjacent to said por-
tion of the street herein vacated; and
Whereas said portion of said street
is not used or needed for public
travel or convenience and the re-
maining portion of said street lying
North of the South line of the alley
first North of East Seventh street

having been heretofore vacated to
the South line of East Eighth street,

Whereas, in consideration of the
vacating of said street herein made
and the conveying of the vacated
portion thereof to the Midwest Lum-
ber Company, said Midwest Lumber
Company has agreed to pay to the

Hundred Fifty Dollars ($750.00)

Par. 137, section 1. That Cedar
street from the North line of East
Seventh street to the South line of
the alley first North of East Seventh
street, being all of said street lying
between Lots 1 of 36 and 2 of 36,
Block 14 and Lots 1 of 2 of 34 and
2 of 2 of 34, Block 12, Dubuque Har-
bor Improvement Company's Addi-
tion, be and the sane is hereby va-
cated and annulled, said land being
all of that portion of said street in-
cluded within Lots 14 and 24, Du-.

Par. 138, section 2. That, in con -
sideration of the payment to the city
of Dubuque by the Midwest Lumber
Company of the sum of $750.00 said
City of Dubuque hereby sells and
conveys to said Midwest Lumber
Company the portion of said street
hereby vacated and the Mayor and
Clerk be and they are hereby direct-
ed to execute and deliver, on behalf
of said City, its Quit Claim Deed
thereof to said Midwest Lumber
Company.
Par. 139. Section 3. That the
Clerk be and he is hereby directed to
file for record a duly certified copy
of this Ordinance in the office of the
Recorder of Dubuque County, Iowa.
Par. 140. Section 4. This Ordin-
ance shall be in force and effect ten
days from and after its passage and
final adoption by the City Council of
said City and publication as provided
by law.

Par. 133 — General Fund. Section
2. That for the purpose of conven-
ience the fund which is made up
from moneys received from the Con-
solidated Tax Levy and miscellan-
eous receipts shall be designated
and known as "General Fund."
Par. 134 — Surplus. Section 3. That
any surplus remaining above these
appropriations shall be and the same
are appropriated to meet emergen-
cies that may arise or may be ap-
plied upon such municipal improve-
ments as the Council may determine
upon.
Par. 135. Distribution. Section 4.
That the distribution and division of
the above appropriations shall be
made in accordance with the Budget
of the City Council adopted on March
23, 1931, which Budget is made part
of this Ordinance by reference there-
to and shall be considered in connec-
tion with the expenditures of said
appropriations.
Par. 136. Emergency Clause. Sec-
tion 5. This Ordinance in the inter-
est of the preservation of public
peace, health, safety, and general
welfare of the City of Dubuque and
the inhabitants thereof, being deem-
ed urgent and of immediate neces-
sity shall become effective from its
final passage, adoption, and appro-
val by the City Council and publi-
cation as provided by law and the

Gentlemen: In line with the pro-
cedure followed by other water com-
panies of this district and most wa-
ter companies of the country and
also in line with private utility oper-
ation, the writer would respectfully
recommend the amendment of Sec-
tion 27 of the present rules and reg-
ulations of the Dubuque City Water
Works to read as follows:
"That from and after March 14,
1931, all water meters in sizes from
%" to 1" inclusive, be furnished to
the consumer by the Water Depart-
ment at the expense of the Water
Department; further that after
March 14, 1931, the Water Company ,
shall repair and keep in first -class
condition all water meters within the
above mentioned sizes. It is express -
ly understood that one meter only is
to be furnished by the Water De-
partment for each building. Meters
in excess of one desired for single
building shall be purchased by the
owner or owners. Meters above 1"
in size shall be approved by the Wa-
ter Department and purchased by
the owner or consumer."

regulations for installing water ser-
vice, making connections with water
mains, and fixing rentals and the
collection thereof, repealing other
ordinances in conflict herewith and
proving a penalty for the violation
hereof," by repealing Section 27 and
enacting a substitute in lieu thereof.
Be It Ordained by the City Council
of the City of Dubuque:
Par. 141. Section 1. That an Or-
dinance entitled "Ordinance No.
383A. An Ordinance establishing
rules and regulations for installing
water service, making connections
with water mains, and fixing rentals
and the collection thereof, repealing
other ordinances in conflict here-
with and providing a penalty for the
violation thereof," be and the same
is hereby amended by repealing Sec-
tion 27 and enacting the following in
lieu thereof:

Be It Ordained by the City Council
of the City of Dubuque:
Par. 143. Section 1. Every per-
son, firm, or corporation engaged in
the business of operating taxi cabs,
as herein defined, shall first procure
a license and pay the prescribed fee
therefore, as provided in Ordinance
No. 66 of the Revised Ordinances of
the City of Dubuque, 1919, and, as a
condition precedent to the granting
of such license, shall file in the office
of the City Clerk of the City of Du-
buque an indemnity bond or public
liability insurance policy executed by
a Surety Company authorized to do
business in the State of Iowa, such
bond or policy to be approved by the
City Council of said City.
Par. 144. Section 2. For the pur-
pose of this Ordinance, the term
"taxi cab" shall be defined to be any
motor vehicle, (other than a motor
bus, traveling over prescribed
routes) which is used for the trans-
portation of persons for hire and any
motor vehicle which is used for hire
with or without a driver.
Par. 145. 'Section 3. The mini-
mum liability of such bond or insur-
ance policy shall be as follows:
A. To cover the assured's liability
for personal injury or death of one
person, as a result of one accident or
other cause, $5,000; and for all per-
sons receiving personal injuries or
death as a result of one accident or
other cause, $15,000, said liability to
include injury or death to passengers
being carried upon such vehicle or
persons injured or killed through the
operation of such vehicle.
B. To cover the assured's liabil-
ity for damage to or destruction of
property other than that of or in
charge of the assured, as a result of
any one accident or other cause,
$5,000.
Par. 146. Section 4. Every bond
or insurance policy filed with the
Clerk shall have attached thereto the
following endorsement:
"It is understood and agreed that
before the bond (or insurance pol-
icy) to which this endorsement is at-
tached may be suspended or can-
celled, the .City of Dubuque, Iowa,
will be given ten days prior written
notice of such proposed suspension
or cancellation.
"It is further understood and
agreed that the obligation and prom-
ises of said policy (or bond) shall
not be affected by any act or omis-
sion of the named assured or any
employe of the named assured with
respect to any condition or require-
ment of said policy (or bond), or any
endorsement attached thereto, nor
by any default of the assured in
payment of premium, or in the giv-
ing of any notice required by said
policy, (or bond) or otherwise, nor
by the death, insolvency, bankruptcy,

legal incapacity of inability of the as-
sured."
Par. 147. Section 5. Said bond or
insurance policy shall be issued for a
period covering the life of the license
applied for. Failure to keep such in-
surance policy in full force and ef-
fect shall be cause for revocation of
the license.
'Par. 148. Section 6. Any driver
of a taxi cab operating the same for
hire and any owner thereof permit-
ting the same to be operated upon
the streets, alleys, avenues, and high-
ways of the City of Dubuque, with-
out a bond or insurance policy being
filed as herein provided, shall, upon
conviction, be punished by a fine of
not to exceed $100 or imprisonment
not to exceed thirty days.
Par. 149. Sec, 7. This Ordinance
shall be in force and effect ten days
from and after its final passage and
adoption by the City Council of the
City of Dubuque and publication as
provided by law.

made of the inadequacy of the pres-
ent 100 C. P. lamp on Perry Street
at an agle west of Grandview Ave-
nue. This Light serves five houses
and it is the City Manager's recom-

to install in place of this 100 C. P.
lamp a 250 C. P. lamp.
Complain has also been made on
Shiras Street of very poor lighting
facilities. In order to afford proper
protection between Lincoln Avenue
and the entrance to the park it is my
recommendation that two new 400 C.
P. lamps be installed and that from
a section west of the park entrance
to the. City line two new additional
400 C. P. lamps be installed. In this
last section there is a gap of approx-
imately 2,000 feet between lamps.

Gentlemen: In connection with the
Edward O'Rourke sewer complaint
at 365 West Locust street, which was
presented to the City Council March
23rd and referred to the writer for
investigation, please be advised as
follows:
Mr. Connie Sullivan has known for
some time that the sanitary sewer of
12 -inch diameter terra cotta between
16th and 17th Streets, has been slug-
gish at certain times, but the sewer
has worked without inconvenience to
abutting property owners after the
usual maintenance each year.
To the best of our knowledge, in
the afternoon of November 21, 1930,
Mr. John O'Rourke advised me at the
City Hall that Mr. Edward O'Rourke
at 365 West Locust Street was hav-
ing trouble with the sanitary sewer
system. Mr. Sullivan was advised to
investigate this condition and it was
ascertained Saturday, November
22nd, and by further investigation
Monday, November 24th, that the
main sewer in front of this residence
on West Locust Street was not
clogged, but we found a few roots in
the same. Whereas, Mr. O'Rourke
states that two loads of roots and
sand were removed from this sewer,
it is known definitely by the City
employes that not over one bushel
of roots was taken from the section
in front of the O'Rourke residence.
No sand existed in the main sewer at
the time of the trouble.
By exact measurement we found
that the small number of roots that
we found were located in the sewer
to the north and up -grade from the
O'Rourke connection. The existence
of the roots was at a spot of from 25
to 50 feet up -grade from this loca-
tion. We admit that upon the dig-
ging up of the sewer connection at
the main there were roots also of
small size in the main sewer at the
connection, but not to such an ex-
tent that would cause any stoppage.
We have rodded and scraped this
sewer this week and were able to get
a 9 -inch cutter through the block on
West Locust from 16th to 17 Streets.
It is believed that the elm tree on •
the O'Rourke parking between the
sidewalk and curb may be partly re-
sponsible for the root trouble at this
location.
The O'Rourke sewer lateral con-
sists of two lengths of terra cotta
six -inch pipe adjacent to the sewer
Y and from this location about 5 feet
from the main the balance of the
lateral sewer is 6 -inch cast iron soil
pipe.
As to the recommendation as to
whether or not the City should as-
sume the entire bill of $87.55 which
Mr. O'Rourke claims is entirely the
City's fault, we raise the point that
had the owner notified the City that
sewer trouble existed at this location,
we could have rodded and cut the
few roots above the O'Rourke con-
nection at a probable cost of from
$10.00 to $15.00.
We do not understand why this
stoppage occurred at the O'Rourke
property as practically no roots were
found below the connection. No
other houses were flooded by sewage
backing up from this sewer either
up -grade or down -grade from the
O'Rourke connection.
Inasmuch as no serious trouble in
the sanitary main sewer was found
and the evidence of the slight trou-
ble at the O'Rourke connection was
of such minor nature that it was im-
possible to determine whether the
roots had grown from the lateral
sewer into the main sewer or vice
versa, it would seem reasonable that
the City should not assume more
than a portion of this bill, if any.

showing among other things the fol-
lowing:
1. The boundaries of the district,

2. The streets to be improved.

may appear and make objection to

and proposed form of contract and at
the same time to the boundaries of
the 'proposed district, to the cost of

and to the passage of the proposed
