Regular Session, April 6th, 1931.
Council met at 7:45 P. M.
Present —City Manager Evans,
Mayor Meuser, Councilmen Andel-
finger, Jansen, McEvoy, Schuckert.
This being the first meeting of the
fiscal year 1931, the first order of
business was the administering of
the oath of office to Councilmen
McEvoy and Schuckert who were re-
elected at the regular city election
in 1930, to take office on the first
,Monday in April, 1931.
Mayor Meuser administered the
oath of office to the new council-
men, after which the new Council
proceeded with the appointment of
a • Mayor.
Councilman Andelfinger moved
that Mr. Meuser, the present incum-
bent, be appointed as Mayor for the
ensuing year. Seconded by Council-
man Schuckert. Carried by the fol-
lowing vote:
Yeas — Councilmen Andelfinger.
Jansen, McEvoy, Schuckert.
Nays —None.
Not voting —Mayor Meuser.
Resolution No. 39 -31.
Be it Resolved by the City Coun-
cil of the City of Dubuque, that the
following officers be appointed to
serve during the fiscal year, 1931, at
the pleasure of the Council and be
paid the salaries provided for in the
budget adopted by this Council on
March 30, 1931:

tary sewer in Burlington, Stoltz,

conducting a hearing on the issu-
ance of bonds to pay for the same
and acting on any other business
that may come before the meeting.
Proof of publication, certified to
by the publisher, of the City Coun-
cil's intention to levy a special as -,
sessment and issue bonds to pay for
the construction of a sanitary sewer
in Burlington, Stoltz, Davenport and
Muscatine streets, and also proof of
publication of a hearing on the issu-

• WHEREAS, the contract hereto -
fore entered into by the City of Du-
buque for the construction of an
eight inch tile sanitary sewer in
Burlington Street, Davenport Street,
.etc., hereinafter described, has been
completed and said improvement has
b.ten accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $5,730.51.
AND WHEREAS, public notice as
provided by law, has been published
by the City Clerk stating the inten-
tion of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
oojections filed thereto have been
considered and determined:
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque that to provide for
the cost of constructing an eight
inch vitrified tile sanitary sewer, Y
branches, risers and manholes in
Burlington Street from the north line
of Lot 81, McDaniel's Park Hill Ad-
dition to the alley between National
Street and Stoltz Street, and in the
alley between National Street and
Stoltz Street from Burlington Street

Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 6th day of May, 1931: shall
be in the denominations of $500.00
except that there shall be one bond
to the amount of $230.51. They shall

clusive and shall be divided into ten
series of which the bond numbered
2936 shall constitute the first series
and shall be payable the 1st day of
April, A. D. 1932; the bond numbered
2937 shal constitute the second ser-
ies and shall be payable the 1st day
of April, A. D. 1933; the bond num-
bered 2938 shall constitute the third
series and shall be payable the 1st
day of April, A. D. 1934; the bond
numbered 2939 shall constitute the
fourth series and shall be payable
the 1st day of April, A. D. 1936; the
bonds numbered 2940 and 2941 shall
constitute the fifth series and shall
be payable- the 1st day of April, A.
D. 1936; the bonds numbered 2942
snd 2943 shall constitute the sixth
:,cries and shall be payable the 1st
day of April, A. D. 1937; the bond
numbered 2944 shall constitute. the
seventh series and shall be payable
the 1st day of April, A. D. 1938; the
bond numbered 2945 shall constitute
the eighth series and shall be pay-
able the 1st day of April, A .D. 1939;
the bond numbered 2946 shall con-
stitute the ninth series and shall be
payable the 1st day of April, A. D.
1940; the bond numbered 2947 shall
constitute the tenth series and shall
be payable the 1st day of April, A.
D. 1941.
Said bonds shall bear interest at
tho rate of five per cent per annum
- which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach -
e0; and said bonds shall be payable
cut of the proceeds of the special as-
sessment levied for said improve-
ment.
Both principal and interest shall be
payable at the office of the City
Treasurer in the City of Dubuque.

SEWER BOND
The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer hereof,
on the first day of April, A. D. 193
or any time before that date at the
option of the City, the sum of $500.00
hundred dollars with interest there-
on at the rate of five per cent per
annum, payable on the presentation
and surrender of the interest cou-
pons hereto attached, both interest
and principal are payable at the of-
fice of the City Treasurer in the City
of Dubuque in the State of Iowa.
This bond is issued by the City of
Dubuque pursuant to and by virtue
of Chapter 311 of the Code of Iowa,
1927, and in accordance with a reso-
lution of the City Council of said
(ny, duly passed on the 6th day of
April, 1931. This bond is one of a
series of 12 bonds, 11 for $500.00,
numbered from 2936 to 2946 inclu-
sive, and one for $230.51 numbered
%047, off of like tenor and date, and
issued for the purpose of construct-
ing an eight inch vitrified tile sani-
tary sewer, Y branches, risers and
manholes in Burlington Street from

Street, and in the alley between Na-
tional Street and Stoltz Street from
Burlington Street to Davenport

dition, and in Stoltz Street from Dav-
enport Street to the existing man-
hole in Stoltz Street, and in Musca-

Street and described in said resolu-
tion; which cost is assessable to
fund levied along said improvement,
and is made by law a lien on all
abutting or adjacent property, and
payable in ten annual installments,
with interest on all deferred pay-
ments at the rate of five per cent,
per annum, and this bond is payable
erily out of the money derived from
the collection of said special tax, and
said money can be used for no other
purpose. And it is hereby certified
and recited that all the acts and con-
ditions and things required to be
done precedent to and in the issu-
ing of this series of bonds, have been
done, happened and performed in
regular and due form as required
by said law and resolution; and for
the assessments, collections and pay-
ment hereon of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In witness whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 6th day of April, 1931, and
has authorized the use of their fac
simile signature to the interest cou-
p;ns hereto attached.

that the City Treasurer be and he
is hereby instructed to sell said
bends in the manner provided by
Law, the proceeds of said sale to be
kept in a special fund to be known
as Sewer Fund.
BE IT FURTHER RESOLVED,
that the interest coupons attached to
the bonds be signed with the fac-
simile signature of the Mayor and
countersigned with the fac- simile sig
nature of the City Clerk.
BE IT FURTHER RESOLVED,
that as fast as funds allow, begin-
ning with the second year after the

shall be called and retired in the

Gentlemen: This is to advise that
at an informal meeting of the City
Council held at 11:00 A. M., March
31, 1931, at which Councilmen Meu-
ser, Schuckert and McEvoy were
present, they investigated the re-
quest of the Midwest Lumber Com-
pany to construct a lumber shed on
East 7th Street which does not ful-
ly comply with the City Building
Code.
After viewing the proposed site of
said lumber shed, the petition was
granted.

Treasurer, stating that a receipt was
issued (receipt $534) to Mrs. Paul-

437; credit was not entered, a sub-
sequent amount of $15.35 was issued
to Ed. Muntz, who was in possess-

referred to him for investigation.
The assessments for Central Ave-
nue paving, if levied against her
property as was levied against oth-
er property on - Central Avenue,
would have been $320.21. Reductions
granted her were $132.37; she was
also granted a reduction of $12.88
on the sidewalk assessment in front
of her property which was laid in
connection wtih the boulevard light
installation.

City Manager Evans reported on
the drainage of the hill in the rear
of the Holy Ghost Church, which
drains across the sidewalk over a
private driveway owned jointly by
the church and Mr. Wolter on Cen-
tral Avenue. He states that the nuis-
ance can be removed by construct-
ing a 15 -inch storm sewer from the
ditch in the rear at the foot of the
hill across church property, with
permission of the church authorities,
to the existing storm sewer in 30th
Street, a distance of 345 feet. The
estimated cost of said sewer amounts
to $445.00 as itemized on attached
sketch. This method will eliminate
the storm water nuisance and is
cheaper than a new adequate storm
sewer run under paving of Central.

drain to 29th Street.

and schedule have been duly pre -
pared and approved by the City
Council of the City of Dubuque and
are now on file in the office of the
City Clerk showing among other
things the following:
1. The boundaries of the district,
if any.
2. The streets to be improved.
3. The width of such improve-
ment, and the size and kind of sew-
ers.
4. Each lot proposed to be asses-
sed together with a valuation fixed

Be It Therefore Resolved that the
City Council on its own motion or
upon petition of property owners,
deems it advisable and necessary
for the public welfare to make the
herein mentioned improvement, and
unless property owners at the time
of the final consideration of this
proposed resolution have on file
with the City Clerk objection to the
amount of the proposed assessments,
they shall be deemed to have waived
all objections thereto.
Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk. That the cost and expense of
making said improvement will be
assessed upon and against all pri-
vately owned property lying within
assessable distance provided by law
and in an amount not to exceed the
amount provided by law, property
will be assessed whether the same
abuts thereon or is adjacent thereto
according to area and in proportion

thereby, and any deficiency shall be
paid out of the. general fund, im-
provement funds or sewer funds, or

Bonds shall be issued and sold in
anticipation of deferred payments of

the proceeds thereof used to pay the
contractor. The railway portion of
any street or assessment district
shall be assessed to and paid by the
railway company.

Be It Resolved by the City Coun-
cil of the City of Dubuque that pur-
suant to a resolution ,of, necessity
No. 30 -31 which was duly passed
by this Council for the improving of
Central Avenue from the north prop-
erty line of East Twenty- second
Street and Kaufmann Avenue to a
point about fifty (50) feet north of
the north property line of East and
West Thirty- second Street, by grad-
ing said street to the proper sub -
grade where necessary, removing old
creosote wood blocks, bituminous
pavement, brick pavement and sand
cushion from existing concrete base,
cleaning said concrete base and re-
pairing same where necessary, re-
moving old stone curb, trees and
stumps along parking strip, furnish-
ing extra concrete for base, furnish-
ing steel, constructive concrete side-
walks, catch basins and tile connec-
tions to main sewer, concrete curbs,
both high and step curbs, combina-
tion curb and gutter, concrete head-
ers, tile drain and installing two (2)
inch Fibre Conduit where necessary,
and by paving and draining said
street forty -four (44) feet wide from
the north property line of East
Twenty- second Street and Kaufmann
Avenue to the south property line
of East Twenty - fourth Street and
forty (40) feet wide from the south
property line of East Twenty- fourth
Street to a point about fifty (50)

Be It Further Resolved that the
cost and expense of the said im-
provements be paid for by levying
special assessments against the pri-
vately owned property lying within
the assessable distance from the im-
provements, whether such property
abut upon the same or are adjacent
thereto, according to the area there-
of and in proportion to the special
benefits conferred, and any defic-
iency will be paid out of the general
improvement, or sewer funds of the
city, or partly from each of such
funds. Payment will be made to the
contractor out of funds realized
from the sale of bonds to be issued
in anticipation of deferred payments

Be It Further Resolved that the

Whereas, proposed plans, specifi

cations, and form of contract have
been duly prepared and approved by
the City Council of the City of Du-
buque and are now on file in the
office of the City Clerk for the con-
structing and installing of under -
ground connectons do curb lines
from sewer, water and gas mains in
and along Central Avenue from the
north property line of- East 22nd
Street and Kaufman Avenue to a
point about 50 feet north of East
and West 32nd Street. And it is
deemed necessary and advisable by
said Council, that such connections
be made before said street is per-
manently improved, by paving.
Now, therefore, be it resolved by
the City Council of such City that
such connections be and the same
are hereby ordered made and con-
structed and unless the property
owners make such connections with-
in ten days from the serviec of no-
tice upon them bids will be received
for such work and a contract
awarded.
Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk. That the cost and expense
of making said improvement will be
a ssessed upon and against all pri-
vately owned property, and any de-
ficiency shall be paid out of the gen-
eral fund or improvement funds for
which they are made, or partly out
of each of such fund. Certificates
shall be issued in anticipation of de-
ferred payments of assessments
when a contract has been performed
and accepted and the proceeds there-
of used to pay the contractor. The
railway porton of any street or as-
sessment district shall be assessed
to and paid by the railway company.
The above resolution was intro-

case of Frank J. Fosselman vs. The
City of Dubuque.
On October 17th, 1929, a judgment
was had against the City in the case
of Frank J. Fosselman vs. The City
of Dubuque in the sum of $1,500.
Following the entry of the judgment
I took an appeal in the case to the
Supreme Court and the Supreme
Court has now overruled the appeal
and sustained the decision of the
lower court.
The judgment carried with it in-
terest at the rate of 6% and costs.
The amount of the judgment includ-
ing the interest is $1,635.75 and the
costs are $170.46.
Kindly have a warrant drawn in
favor of R. P. Marshall, Clerk of
the District Court in the sum of
$1,806.21, the same to cover the judg-
ment and costs.

Mr. L. C. Bissell, representing The
H. B. Glover Co., addressed the
Council objecting to the installing
of boulevard lights on Iowa Street
between 4th and 6th Streets, stating
that their business is a wholesale
and manufacturing company and
that they close every evening at 5
o'clock and therefore would receive
no benefits from these lights.
Mr Begley addressed the Council
and stated that he resides in the 900
block and that nobody asked him
about the lights, and that he did not
know anything about them until he
read about it in the newspaper, he
did not want to stand in the way of
improvements, but being that he will
be assessed for this improvement,
he should have had a chance to
voice his opinion.
Anthony Rhomberg addressed the
Council and stated that they owned
the largest amount of property along
this line of improvement and will
be the ones to be assessed the heav-
iest, and that they are absolutely in
favor of having the boulevard lights
installed on this street as soon as
they can be installed.

(Necessity for Improvement.)
Whereas, proposed plans, specifi-
cations, form of contract, plat and
schedule have been duly prepared
and approved by the City Council
of the City of Dubuque and are now
on file in the office of the City Clerk
showing among other things the fol-
lowing:
1. The boundaries of the district,
if any.
2. The streets to be improved.
3. Each lot proposed to be assess-
ed together with a valuation by the
Council.
4. An estimate of the cost of the
proposed improvement, stating the
same for each different type of con-
struction and kind of material to be
used.
5. In each case the amount there-
of which is estimated to be assessed
against each lot, for the installation
of fifty -seven (57) single light boule-
vard standards, including cable,
switches and fibre conduit, relaying

Be It Further Resolved that the
City Council on its own motion or

amount' of the proposed assessment,
they shall be deemed to have waived
all objections thereto.

Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk. That the cost and expense
of making said improvement will be

vately owned property lying within
assessable distance provided by law
and in an amount not to exceed the
amount provided by law, property
will be assessed whether the same
abuts thereon or is adjacent thereto
according to area and in proportion
to the special benefits conferred
thereby, and any deficiency shall be
paid out of the general fund, im-
provement funds, or sewer funds, or
partly out of each of such funds.
Bonds shall be issued and sold in
anticipation of deferred payments
when a contract has been perform-
ed and accepted and the proceeds
thereof used to pay the contractor.
The railway portion of any street or
assessment district shall be assess-
ed to and paid by the railway com-
pany.

Louis Barer addressed the Council
relative to a petition objecting to the
improving of Bennett Street from Al-
gona Street to McCormick Street at
this time, stating that the objectors
svere just assessed for the West Du-
buque sewer and to put another as-
sessment on them at this time would
work a hardship on them and some
of thein would probably lose their
.)omes.
The Council decided to view the
grounds, there was no motion made.

An Ordinance prohibiting the stor-
age of dynamite within the City of
Dubuque; prohibiting the keeping
nd storing of gun - powder and dyna-
mite caps, except in limited quanti-
ties, within the City of Dubuque; and
prescribing a penalty for violation
hereof.
Be it Ordained by the City Coun-
cil of the City of Dubuque:
Par. 152, section 1. That no per-

.(n, firm, or corporation shall keep
or store dynamite within the limits
of the City of Dubuque nor shall any
person, firm, or corporation keep or
maintain a magazine or building for
the storage of dynamite within the
City of Dubuque.
Par. 153, section 2. That no per-
son, firm, or corporation shall keep,
store or have in his possession any
dynamite caps or gun powder with -
.n the City of Dubuque in quantities
in excess of 100 dynamite caps and
or five pounds of gun powder and
no person, firm, or corporation shall
maintain a magazine or building
wherein is kept or stored dynamite
caps or gun powder in excess of the
quantities above stated.
Par. 154, section 3. That any per-
son, firm, or corporation violating
the provisions of this Ordinance shall
be deemed guilty of a misdemeanor
and upon conviction, shall be fined
not to exceed $100 or imprisoned
not to exceed thirty days in jail.
Par. 155, section 4. That this Or-
dinance shall be in force and effect
ten days from and after its final
passage, adoption, and approval by
ne City Council and publication as
provided by law.

County Treasurer, stating that Mrs.
Harriett Marlin paid at the Treas-
urer's Office $39.64 covering the
sixth installment for special assess-
ment against Lot 104, Union Add.,

Avenue, and by mistake this was
credited to Lot 103, and the prop-
erty was sold at tax sale to the City
of Dubuque. He hereby asks that
the tax certificate be cancelled as
this was an error.
Councilman Jansen moved that
the City Treasurer be instructed to
return the tax certificate to the
County Auditor for cancellation.

Report of City Treasurer Otto F.
Puls, stating that he has examined
into the matter of Elizabeth Byrne
and finds that she paid an assess-
ment in the amount of $41.69 for the
Curtis Street improvement Decem-
ber 1, 1930, and the County Treas-
urer failed to make the proper cred-
it, and it was erroneously sold to
the City at tax sale, and a refund
should be made to the said Eliza-
beth Byrne in the sum of $41.69,
and he therefore recommends that
the City Council order a warrant
drawn in this amount.
Councilman McEvoy moved that
the recommendation of the City
Treasurer be approved and the cer-
tificate be returned to the County
Auditor for cancellation. Seconded
by Councilman Schuckert. Carried
by the following vote:

The City Solicitor reported that
he has received from J. J. Nagle
twelve hundred dollars ($1,200.00)
for the following property: Lots 25-

1 of 11, South View Heights Add.,
all in the City of Dubuque, as per
instructions from the Council at a
previous meeting, and the Mayor
and the Clerk have executed and
delivered to Mr. Nagle a quit claim
deed to this property on payment
of the above named sum.
On the petition of Mrs. Henry
Williams for cancellation of the 1930
taxes on West 1 /2 of Lot 3 of Min-
eral Lot 149, referred to the Council
by the Board of Supervisors, Coun-
cilman Jansen moved that the 1930
taxes be suspended and the Board
of Supervisors be advised of the
Council's- action. Seconded by Coun-
cilman Schuckert. Carried by the

Mayor Meuser in the Chair.
Mayor Meuser stated that this
meeting is called for the purpose of
adopting a resolution ordering Telser
Bros., 2468 Elm Street, to abandon
out side water closet, privy or privy
vault and install a sanitary toilet
and toilet facilities.
Resolution of the Board of Health
Be it resolved by the Board of
Health of the City of Dubuque, Iowa,
that it is deemed necessary that Lot
2 Bushman's Sub. No. 2, owned by
Telser Brothers, 2468 Elm Street, be
connected with sanitary sewer; that
the outside water closet, privy o]
privy vault upon said premises be
abandoned and removed and said
atilt cleaned and that a sanitary
lnilet and toilet facilities be installed
and connections made with the san-
itary sewer.
Be it further resolved that said
Telser Brothers be notified to re-
move ana abandon the outside water
closet, privy or privy vault located
upon the premises above described
and to clean said vault; that said
property be connected with the san-
itary sewer and that sanitary toilet
end toilet facilities be installed and
connections made with said sewer,
all of which to be done within Thir-
ty (30) days from the data hereof.
Be it further resolved that said
Telser Brothers be notified of the
action of this Board by the service
of a written notice together with a
copy of this resolution. Failure to
comply with the terms hereof with-
in the time stated shall be followed
by prosecution or such other action
as the Council or Board of Health
may determine.
