Mayor Mouser stated that this is
the regular monthly meeting of the
Council for the transaction of such
business as may regularly come be-
foi e the meeting and this date has
also been fixed for the purpose of
considering bids for the improving
of McCormick Street from the south
property line of Delhi Street to the
north property line of Grace Street
and also for the final awarding of
contracts for the installing of and
constructing of sewer, water and gas
connections in and along Central
Avenue from the north property

and Kaufman Avenue to a point
about fifty feet north of the north
property line of East and West
Thirty- second Street.

To the Honorable Mayor and City
Council,
Dubuque, Iowa.
Gentlemen: In connection with
the disputed assessment for side-
walks erected on Rhomberg Avenue
and $niest Street in front of hots
9 and 10 and along the side of Lot
10 on the J. H. Rhomberg property,
which dispute arose by reason of the
'lity closing up a cellar entrance
'to the building on Lot 10 on Kniest
Street, please be advised as fol-
lows.
At an informal meeting December
24, 1930, after viewing the ground,
the City Council made the following
proposition to Mr. J A. Rhomberg,
agent:
"(1) The City will remove the
concrete sidewalk around the form-
er stone steps
(2) The City will remove the dirt
or sand that is placed in the cellar -
way opening.
(3) The City will remove the brick
,cork leading from this opening from
sidewalk into the basement.
(4) The City will remove the pen-
alty on 'he original assessment, but
must secure the original assessment
, 5% interest from date of pass-
age.

The City will also exempt fron
the original assessment that portion
of the sidewalk torn out in the side
walk cellar opening
The Rhomberg Estate shall, after
the work has been completed bl
the City, promptly pay the assess
ment plus the 5% and the owner
will furnish a suitable and accept
able covering over the sidewalb
opening."
Mr. Rhomberg accepted the propo
sition on December 30th and the
City has just recently completed
their share of the revised work.
The original assessment on Lot
9 was $19.28, on Lot 10 $144.46, to.
talling $164.74, less the area of the
actual opening into the sidewalk at
the cellar entrance, namely 44 ft,
at 12c, $5.28, or a net revised prin-
cipal of $158.46. Interest is to be
Paid from March 4 1929 to date of
settlement by the Rhomberg Estate
at the rate of 5 %. The City has
}urchased these unpaid assessments
by tax certificate No. 360 on the
$144.46 and by tax certificate No.
359 on the $19.28 unpaid assess-
ments.
This letter is written to you for
your approval and instruction to the
City Treasurer for the complete set-
tlement of this claim.

To the Honorable Mayor and City
Council,
Dubunue, Iowa.
Gentlemen: On April 20th the
petition of Mr. Paul Mangino, store-
keeper at 26th and Jackson Streets,
was presented to the Council and
referred to the writer for investiga-
tion and rep_ ort.
Today, at our request, Mr. Man -
gino nresented to the writer his fall
citizen's paver dated, May 7, 1927.
Mr. Mangino reports also that he
first came to the United States in
1909 and that he lived in Dubuoue
since 1928. In 1913 the petitioner
-, lsited his parents in Italy and en-
listed in the Italian army, serving
in the World War until his ( honor -
able discharge from the Italian army
September 10, 1919. The petitioner
'* *as not injured in service, but was
sick for some time during the war
service.
The petitioner has a store at 26th
and Jackson Streets, is now in fair
health, is not disabled, is the father
of several children and supports his
family.
It is the writer's recommendation
t'iat while this gentlemen has had
war service, that due to the fact
ghat he has a business in which he
can possibly provide for the needs
of his family at present, that he
be not permitted to engage in the
peddling business unless the usual
license fee is paid.

City Manager Evans verbally re-
ported as to arrangements made by
him with the interested parties as
to the permanent repairing of the
alley between Main and Locust Sts.,

as follows:
That Telephone Company .will re-
new base and pay $150.00 for top,
Uhlrich -Paley Company will renew
base and pay $75.00 for top, City
Water Company will renew base and
pay $50.00 for top, Mullen Bros. will
pay $16.00 and Yokom Company will
pay if shown that his portion of the
base has been damaged, this will
leave the City portion between the
sum of $50.00 and $100.00.

that the matter of repairing this al-
ley be left in the hands of the City
Manager to be cared for as suggest-
ed by him in his verbal recommenda-

An Ordinance granting to the Chi-
cago Great Western Railroad Com-
aany the right to construct, main-
tain and operate a switch or spur
track in the City of Dubuque from
the southerly line of East Seventh
Street and extending southerly along
Pine Street across East Cypress
Street and onto the property of Mor-
rison Brothers Plant, as indicated on
the blue print hereto attached, mark-
ed Exhibit A and made a part of
this Ordinance.
Be it ordained by the City Council
of the City of Dubuque:
Par. 163. Section 1. That the
Chicago, Great Western Railroad
Company, its successors and assigns
be and it is hereby granted the right
to construct, operate, and maintain
a switch or spur track in the City
of Dubuque from the southerly line
of East Seventh Street and extend-
ing southerly along Pine Street
across East Cypres, Street and on-
to the property of Morrison Broth-
ers Plant as indicated on the blue
print hereto attached, marked Ex-

Par. 164. Section 2. That when-
ever the City Council of the City

interest to cause the line of said
track to be changed or moved or to

City of Dubuque remove or change
the same, as requested, and no rights
in or to the portions of the streets
occupied by said Railroad Company,
except the right to use the same as
herein slated, shal', accrue to said

Whereas Molo Sand and Gravel
Uompany has petitioned the City
Council of the City of Dubuque for
permission to instali a Howe Scale
at the north line of Third Street
extension and at the easterly ter-
minus of said street, said scale to
be located partly within the side-
walk space at said point and partly
within the street proper, and,
Whereas said Council finds no ob-
. action to the installation and main-
tenance of said scale at the point
stated provided said scale will be
: at any time the Council of
, ne City of Dubuque may deem such
removal necessary or advisable.
Now, therefore,
Be it ordained by the City Council

Molo Sand and Gravel Company be

not extend beyond the curb line to

mission herein granted is subject to

said scale shall be removed by said
Molo Sand and Gravel Company at
any time the removal of the same
Shall be deemed necessary or advis-
able by the City Council and no
fights shall be deemed to accrue to
said Molo Sand and Gravel Company
on account of the permission here-
in granted, except merely to main-
tain, overate and install said scale.
Said Molo Sand and Gravel Com-

to do so, remove said scale and ap-
purtenances thereto belonging and
store the street and sidewalk oc-
cupied by it to as good condition as

Attorney John Cunningham ad-
dressed the Council on behalf of the
Retail Grocers Association, protest-
ing against the granting of licenses
to sandwich cars on the streets of
the city, stating that they object to
a sandwich car parking on the
streets in front of or near a business
house that handles the sandwiches
also.
The matter was refered to the
Chief of Police, to instruct wagons
of this kind to keep on moving. No
motion made.
The City Manager reported that
.he term of D. W. Waller as a mem-
ber of the Planning and Zoning
Commission has expired, and Judge
Nelson having resigned as a member
of the board, leaves two vacancies
to be filled. No action taken.
On the petition for a street light
on Hempstead Street, the City Man-
ager reported that a light is very
necessary on this street and recom-
mends that a light be installed.
Councilman Schuckert moved that
the recommendation of the City
Manager be approved. Seconded by
Councilman Jansen. Carried by the
following vote:
Yeas -Mayor Meuser, Councilmen

Gentlemen: Mr. J. A. Clark, treas-
urer of Dubuque County, made re-
c /uest yesterday that the City Coun-
c.l authorize the purchase of a set
of printed forms for the City of
Dubuque special assessment receipts.
He estimates that the year's supply
will cost from $75.00 to $100.00.
In discussing with him as to why
the City should spend money for
County forms, he advised that on
certain other occasions this expense
nad been split between the County
and City. Last year the City did
not pay anything toward this item.
it seems that the Code does not
specify as to whether the County or
City should stand this expense. Dis-
cussing this question with the State
Examiners, they Ovise that it is op-
tional and not mandatory on the
part of the Council to authorize this
expenditure. I present this question
to you for your decision.

We find that the 4 x 4 posts are

crete sidewalk as is possible. The
rear or inside edge of the sidewalk
- Jackson Street is about 2 ft, 8 in.
from the property line and on 14th
Street the sidewalk is about. 3 feet
from the property line. Accordingly

clear for traffic.
They therefore respectfully re-
quest that this plan be approved so
that construction work on paving at
this point can proceed without delay.
They agree that when they remove
the brick they will pave that portion
of the street with concrete to con-
form with the rest of the street.

Gentlemen: In connection with the
request of June 15th by George B.
Michael of 2608 Broadway, Dubuque,
Iowa, for permission to sell house-
hold products, which application was
referred to the City Manager for in-
vestigation at the meeting of June
15th, please be advised as follows.
Mr. Michael, at our request, has
presented evidence that he enlisted
with the United States Army Feb-
ruary 22, 1918 at Manchester, Dela-
ware County, Iowa. Mr. Michael was
disabled in France in active service
in January, 1919. He was affected
with arthritis and gastritis.
In 1921 the applicant moved to
Dubuque. Since this time he has
worked for short intervals at the
Brunswick Company and the Klauer
Manufacturing Company as a cabinet
maker. He has not worked during the
last two years. At present he is in
bad condition, being subject to
shortness of breath, stomach trouble
and gallbladder trouble. The gentle-
man receives $26.00 per month from
the United States Government under
disability claim 318,755. He is mar-
ried and has one dependent boy to
support.
The applicant requests, for six
months' trial, to be permitted to take
orders and to deliver at a later date
products manufactured by Dr. Blair,
a household agency. of Virginia, con-
sisting of about 300 articles and in-
cluding coffee, tea, spices, extracts
and toilet goods.
We believe that we have authority
to issue a permit for the taking of
orders and delivering at a later date
of such commodities. Accordingly a
permit will be granted to this man.

has interviewed Mr. Waller and he

another term of office. Inasmuch as
his term included March 10, 1930 to
May 24, .1931, and part of the other
members were appointed for a five
year term, I suggest that Mr. Waller
be appointed for a five year term
starting May 24, 1931,
Mr. Wm. A. Smith has consented
to fill the unexpired term of Judge P.
J. Nelson who resigned about a
month ago from the Planning and
Zonning Commission. This term ex-
pires May 24, 1934.
The writer suggests that both the
reappointment of Mr. Waaller and the
appointment of Mr. Smith in place of
Judge Nelson be confirmed by Coun-
cil this evening.

Gentlemen: The writer advised the
Council recently that the terms of
the members of the Recreation Com-
mission will. shortly expire. In check-
ing this morning, I find that on July
10, 1931, this Commission will cease
to exist unless appointment is made
immediately.
In connection with Milton Glenn,
please be advised that this member
from the School Board has asked to
be relieved from the work of the
Recreation Commission and Mr, John
Chalmers was named by the Board of
Education as their suggested mem-
ber to the Recreation Commission in
place of Milton Glenn.
The present personnel of the
Commission includes H. C. Baum -
gartner, Peter K. Karberg, Alois
Hoffmann, George J. Roepsch, John
Knoll, Wm. Clemens, Leo Gregory
and with the additional substitution
of Mr. Chalmers in place of Milton
Glenn, the Commission will include
nine members with the City Man-
ager.
I suggest that these appointments
be considered tonight.

Gentlemen: The Local Board of
Review appointed by your Honorable
Body to equalize the taxes for the
year 1931 beg to advise that that it
has completed its work after having
been in session sixty -seven days. We
commenced the first Monday in
April and have been in continuous
session since. We have had a num-
ber of complaints and made person-
al inspection in each instance.
We had an interview with Mr,
Louis Cook, Chairman of the State
Board of Assessments and Review
and he advised us that a reduction
of 15% must be made on all valua-
tions.
In view of this fact we made our
equalization with this reduction in
mind.
The Board made 250 inspections
and makes report as follows. Hereto
attached you will find all assess-
ments equalized by the Board. There
being nothing further to do, it has
taken final adjournment.
