Mayor Meuser stated that this is
the regular monthly meeting of the
Council for the transaction of such
business as may regularly come be-
fore the meeting and that this date
has also been fixed for the purpose
of final awarding of the contract for
the improving of Locust Street, West
Locust Street and the Bluff and West
Locust Street intersection, also a
hearing on the resolution of neces-
sity for the widening of East and
'West 'Fourth Streets and for the in-
stalling of Boulevard 'Lights on East
and West Fourth Streets.
Resolution No. 112 -31 awarding

line of West Sixth Street to the

July 6, 1931
To the Honorable Mayor and City
Council,
Dubuque, Iowa.
Gentlemen: On July 2nd our at-
tention was called to the condition
of the bridge across Catfish Creek on
the North Cascade Road southwest
from Wartburg Seminary. At this
time certain repairs were made to
the guard rail of the bridge.
Today, with the Street Superin-
tendent, the writer made an investi-
gation of the entire bridge and found
it to be in such poor condition that
warning signs have been placed this
afternoon at either end of the bridge
warning vehicular traffic of the weak
and unsafe condition of the bridge
and limiting the total gross weight
to two tons.
The columns in this bridge are of
crude and antiquated design, having
become decayed and are absolutely
unsafe at present. We did not have
a chance to examine all the tim-
bers in the bridge, but find that im-
mediate attention should be directed.
I ask for your authority to rebuild
this bridge.

meeting is called for the purpose of
adopting a resolution and application
for approval to levy an emergency
tax and acting on any other business
that may properly come before a
meeting of the City Council.

RESOLUTION AND APPLICATION
FOR APPROVAL TO LEVY AN
EMERGENCY TAX.
That whereas, the revenue in cer-
tain 'funds of the City of Dubuque
as 'set out in the within ;application
is 'inadequate to meet the actual and
nedessary expenses which must be
paid from said funds and any extra-
ordinary or unforseen'expense which
may arise during the ensuing fiscal
year; and,
Whereas, the inadequacy of the
reveuue'referred tots deemed'to con-
stitute an •emergency 'which requires
the levy of an'emergency'tak: NOW
THEREFORE:
Be it resolved by the 'City Coun-
cil of the City Of 'Dubuque, 'Iowa,
that the director of the budget be
and he is hereby petitioned for ap-
proval to levy an emergency 'taX for
the year 1932 in the sum 01130,0'42,

and is necessary for the purpose of
securing additional operating reven-

Roosevelt Street from the westerly
property line of Rhomberg Avenue
to the north line of Lot 6 Peil's Sub-
division and acting on any other
business that may come before the
meeting.
Councilman McEvoy moved to sus-
pend the rules for the purpose of al-
lowing any one present in the Coun-
cil Chamber who wishes to do so

Street purposes, south of the Mt.
Carmel Road, please be advised as
follows.
The area used for street purposes
and a five (5) foot sidewalk toward
the east of the curb includes ap-
proximately 875 square feet, the
width appropriated along Grandview
Avenue is approximately seventy
(70) feet, the widest portion in the
middle of the circle is seventeen
(17) feet.
Your officials have had several
meetings with Mr. Hoffman and to-
day he has given his lowest and
final price for • this portion of his lot,
which has been used for street pur-
poses since 1925, as Five Hundred
Dollars ($500.00). This represents
a per foot price of fifty -seven cents
(57c). Mr. Hoffman advises that,in-
asmuch as no appropriation has been
set up for this purchase in this year's
budget he will be willing to have
Council approve the purchase of this
particular area on condition that it
be paid within approximately six
months to date.

Gentlemen : Attached is a peti-
tion received last week requesting
a new street light to be installed at
the intersection of 11th and Wash-
ington Streets.
The writer has investigated this
and finds that at this one intersec-
tion no light exists. All four corners
are occupied by buildings or dwell-
ings and due to the fact that freight
cars are allowed to stand along a
southeasterly direction from this in-
tersection, I would recommend', es-
pecially for the safety of women and
children, the installation of a new
400 C. P. street light.

Gentlemen: Today Mr. Thomas
Stampfer, representing the Security
Bldg, Co., at the corner of Main and
Eighth Streets, has made formal ap-
plication to the Building Commis-
sioner and the .City Engineer for
permission to rebuild a sidewalk
space next to his building on Eighth.
Street. We have at hand a set of
detailed plans showing all proposed
arrangements which include a new
reinforced concrete sidewalk to, re-
place the present existing sidewalk
on Eighth Street and also a possible
new walk on Main Street. The pro'
posed construction below the side-
walk level is so designed that if
either Eighth or Main Streets are
widened' two feet, no change will
have to be made in the construction
of the walk.
Mr. Stampfer has also requested
that permission be granted to him
by the City for a certain modifica-
tion on Eighth Street to the present
show window ledge on the south ele-
vation of this building which extends
out over the sidewalk space for about
two feet. The desire on the part
of the owner is to construct a bulk-
head from the top of the concrete
sidewalk slab up to the floor of the
show window. The purpose of this
is to brace and further make stable
the weak and unsafe condition and
to improve the appearance of the
show windows that extend out over
the sidewalk space. As we under-
stand it, the line of the bulkhead will
be the line of the present show
window.
The Security Bldg. Co were grant-
ed the right to locate the show win-
dows on the sidewalk space approx-
imately twenty -five years ago for an
indefinite period. We bring this
question to your attention- in the be-
half that only the Council can grant
modification or changes in construc-
tion of a building occupying a por-
tion of the public street.

the fiscal year 1932, as a basis for
the levy of the taxes for 1931, to be
collected in 1932, and said budget
estimate having been duly approved
by it, NOW THEREFORE,
Be it resolved by the City Coun-
cil of the City of Dubuque:
That said budget estimate be and
the same is hereby ordered filed in
the office of the City Clerk for pub-
lic inspection and the date of pub-
lic hearing thereon is hereby fixed
as the 3rd day of August, 1931, at
7:30 o'clock P. M. in the Council
Chamber in the City Hall.
Be it further resolved that said
Clerk be and he is hereby directed
to cause said budget estimate of
expenditures to be published in the
official newspaper of said City and
the official notice to be given of the

Gentlemen: The question has
arisen during the improvement of
Bennett Street, west of Algona
Street, of securing from Mr. Louis
Baier the right -of -way for storm
water across Lot 17 Ann O'Hares
Sub. and Lot 1 of 2 of M. L. 156.
At first Mr. Baier demanded that the
City pipe the water across these lots
and also that the City should pay
him $300.00 for the right -of -way
across this property.
In conference on July 8th the writ-
er explained that this was a natural
waterway and Mr. Baler finally
agreed to permit the City to lay a
sewer across the east side of Lot
17 approximately two feet from the
dividing line of Lot 18 and a slight
distance beyond the end of Lot 17
to a depression without charge.
Inasmuch as the City pipe is esti-
mated for this improvement, I would
recommend the acceptance of a
right -of -way on this basis without
compensation to Mr. Baier.

Whereas a petition • has been filed
with this Council requesting the va-
cation of that portion of the alley
lying first West of Locust Street and
commencing at the South property
line of West Sixth Street and end-
ing approximately 183.5 feet South
thereof, and this Council has exam-
ined the same and, in view of the
fact that the United States Govern-
ment proposes to erect a Post Office
building on the property abutting
said alley and contemplates the use
of the alley in conjunction therewith,
is prepared to adopt the necessary
proceedings for such vacation;
Whereas, the statutes of Iowa as
amended, provide that before such
alley can be vacated the proposal
for the vacation or partial vacation
shall be submitted to the Planning
and Zoning Commission for its rec-
ommendation and approval: NOW
THEREFORE,
Be it Resolved by the City Coun-
cil of the City of Dubuque:
That the proposal to vacate that
portion of the alley lying first West
of Locust Street and commencing at
the South property line of West
Sixth Street and ending approximate-
ly 183.5 feet South thereof be sub-
mitted to the Planning and Zoning
Commission of the City of Dubuque
for its recommendation and approval.
Be it further resolved that the City
Clerk be and he is hereby directed
to file a copy of this resolution with
the Secretary of said Commission
with the request that said Commis-
sion take prompt action thereon.

Czizek recommending that the peti-
tion of Taylor- Yonkers Company, re-
questing a reconsideration and rede-

of-ways for said sewer. Seconded by
Councilman Andelfinger. Carried by
