Present —Mayor Meuser, Council- men Andelfinger, Jansen, McEvoy, Schuckert, City Manager Evans. Mayor Meuser stated that this is the regular monthly meeting of the Council for the transaction of such business as may properly come be- fore a regular meeting of the Coun- cil, and that this date was also fixed for the purpose of levying special assessments- and authorizing the is- suance of bonds to pay for the im- proving of East and West 4th Street from the Chicago, Milwaukee, St. .Paul & Pacific Railroad tracks to the East property line of Locust Street; For installing of Boulevard Lights on East and West 4th Street from the Chicago, Milwaukee, St. Paul & Pacific Railroad tracks to the East ,property line of Locust Street; For installing Boulevard Lights on Iowa Street from West 4th Street to West 14th Street; Considering bids for the construction of a sanitary sewer in •Klingenberg Terrace from Kleine .Street to Rosaline Street and in Ro- saline Street to the north line of Lots 11 and 15, Voelker's Addition. Return of Service sworn to by Donald Bandy that he posted the Notices of Levy of Assessments for the above named improvements along the line of the improvements on East and West 4th Street from the Chicago, Milwaukee, St. Paul & Pacific Railroad tracks to the East property line of Locust Street and on Iowa Street from West 4th Street to West 14th Street. Councilman Schuckert moved that the return of service be approved and placed on file. Seconded by Councilman Andelfinger. Carried by the following vote: Yeas —Mayor Meuser, Councilmen Andelfinger, Jansen, McEvoy, and Schuckert. Nays —None. Said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1927, which bear date as of the 2nd day of December, 1931; shall be in the denomination of $200.00 except that there shall be one bond to the amount of $27.53. They shall be numbered from 3141 to 3151 inclusive and shall be di- vided into ten series of which the bond numbered 3141 shall constitute the first series and shall be payable the 1st day of April, A. D. 1932; the bond numbered 3142 shall constitute the second series and shall be pay- able the 1st day of April, A. D. 1933; the bond numbered 3143 shall consti- tute the third series and shall be payable the 1st' day of April, A. D. 1934; the bond numbered 3144 shall constitute the fourth series and shall be payable the 1st day of April, A. D. 1935; the bonds numbered 3145 and 3146 shall constitute the fifth series and shall be payable the 1st day of April, A. D. 1936; the bond number- ed 3147 shall constitute the sixth series and shall be payable the 1st day of April, A. D. 1937; the bond numbered 3148 shall constitute the seventh series and shall be payable the 1st day of April, A. D. 1938; the bond numbered 3149 shall constitute the eighth series and shall be pay- able the 1st day of April, A. D. 1939; the bond numbered 3150 shall con- stitute the ninth series and shall be payable the 1st day of April, A. D. 1940; the bond numbered 3151 shall constitute the tenth series and shall be payable the 1st day of April, A. D. 1941. Said bonds shall bear interest at the rate of five per cent per annum which interest shall be payable semi- annually, in accordance with the terms of the coupons thereto attach- ed; and said bonds shall be payable out of the proceeds of the special assessment levied for said improve- ment. Both principal and interest shall be payable at the office of the City Treasurer in the City of Dubuque. Said bonds shall be substantially in the following form: No Series No CPPY OF DUBUQUE IMPROVEMENT BOND The City of Dubuque in the State of Iowa promises to pay as herein- after mentioned to the bearer here- of, on the first day of April, A. D. 193 ; or any time before that date at the option of the City, the sum of $200.00, with interest thereon at the rate of five per cent per annum, pay- able on the presentation and surren- der of the interest coupons hereto attached, both interest and principal are payable at the office of the City Treasurer in the City of Dubuque in the State of Iowa. This bond is is- sued by the City of Dubuque pur- suant to and by virtue of Chapter 311 of the Code of Iowa, 1927, and in accordance with a resolution of the City Council of said City, duly passed on the 2nd day of November, 1931. This bond is one of a series of 11 bonds, 10 for $200.00, numbered from 3141 to 3150 inclusive, and one for $27.53, numbered 3151, all of like tenor and date, and issued for the purpose of improving of East Fourth Street from the east curb line of Central Avenue to the Chicago, Mil- waukee, St. Paul & Pacific Railroad Company tracks and West Fourth Street from the west curb line of Central Avenue to the east curb line of Locust Street by widening the tra- veled portion thereof to forty -four (44) feet between curbs, and de- scribed in said resolution; which cost is assessable to and levied along said improvement, and is made by law a lien 011 all abutting or adja- cent property, and payable in ten annual installments with interest on all deferred payments at the rate of five per cent per annum, and this bond is payable only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified and recited that all the acts and conditions and things required to be done precedent to and in the issuing of this series of bonds, have been done, happened and performed in regular and due form as required by said law and resolution; and for the assessments. collections and payment hereon of said special tax, the faith and dili- gence of said City of Dubuque are hereby irrevocably pledged. This bond is one of a series of 10 bonds, 9 for $300.00 numbered from 3131 to 3139 inclusive, and one for $215.66 numbered 3140, all of like tenor and date, and issued for the purpose of installation of boulevard lights on East Fourth Street from the east property line of Central Avenue to the Chicago, Milwaukee, St. Paul & Pacific Railroad Company tracks and West Fourth Street from the West property line of Central Avenue to the east property line of Locust Street and described in said resolu- tion; which cost is assessable to and levied along said improvement, and is made by law a lien on all abutting or adjacent property, and payable in ten annual installment, with interest on all deferred pay- ments at the rate of five per cent per annum, and this bond is pay- able only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified and recited that all the acts and conditions and things required to be done precedent to . and in the issuing of this series of bonds, have been done, happened and per - fcrmed in regular and due form as required by said law and resolution; and for the assessments, collections and payment hereon of said special tax, the faith and diligence of said City of Dubuque are hereby irrevoc- ably pledged. Indefinitely it was presumed that the successful bidder would submit proceedings to attorney's Chapman & Cutler, Chicago. In our own case, we knew that the original issue has been approved by them and that there should be no further question regarding the legal- ity and we did not intend to submit to these attorneys except in case of some particular question in regard t-i legality. Shortly after the bidding, the pre- paration of proper forms was begun in our office and forwarded to the city and it was after this had been done, that we were advised that tho city through its Solicitor, had al- ready been submitting proceedings tc Chapman & Cutler and statement was made that we would be expected to take care of the expense of these attorneys to the extent of $115.00. We object to this expense because in the first place, as stated before, we expect to use Chapman & Cutler's opinion only in case some particular questions of legality arise and in the second place, where proceedings are furnished by us and submitted to Chapman and Cutler, the expense of their opinion on an issue of this amount is to us only $75.00. We feel that we have gone far enough ir. agreeing to absorb the expense in the amount of $75.00, and that rt is unfair and unjust to ask us to absorb additional expense in the amount of a further $40.00. We do not want to incur the ill v. of the City officials but 011 the other hand, we feel that it is entire- ly unfair to ask us to take care or additional expense which has been incurred through no fault of ours. Gentlemen: In connection with the request of Mr. Frank Hamel, Jr., dated October 19th and referred to the City Manager by Council, .Oc- tober 26th for report, please be ad- vised as follows: Mr. Hamel requests the use of the sidewalk space on York Street for a terrace from his side lot line to within six or seven feet of the curb line. The lot upon which this house is erected is located at the northwest corner of Curtis and York Streets and is designated as Lot 1 of 1 of Part of Subdivision of Min- eral Lot 149, with a frontage of fifty feet on Curtis Street and a flankage of 100 feet on York Street. The house is set back in line with the other Curtis Street houses and is built approximately live feet from the west lot line. The front of the house is about forty feet iu width, consequently it comes f'•om within possibly five feet from the side lot line. The house is set above Curtis Street, with a first floor elevation of possibly four feet higher than the curb. York Street drops down along the side of the said lot at an approximate rate of 8% so that the side yard along the east side of said yard at the rear of the house is approximately ten feet above street grade of York Street. A considerable fill has been placed out on the sidewalk space along the west side of York Street at the side of this house. When York Street is finally improved and the sidewalks are erected within one foot of the property line, which is the City requirement by ordinance, it is the writer's belief that a wall shall have to be built along the prop- erty line of York Street to protect the house and the walk along the east side of said house. For the time being, it would seem that no objection would be encount- ered by the City in permitting the use of a portion of this terrace to extend on the sidewalk. However, if is not the writer's recommendation that permanent permission be given for this encroachment. It is suggested that consideration be given toward the construction of a 1500 foot monolithic concrete box sewer made from local labor and local materials to be erected on Valley Street from the present new sewer south of Southern Avenue ap- proximately 100 feet up Valley and Quinn Streets for 1500 feet to Rush Street. The size of this sewer would vary from 4 feet by 4 feet down to 3 feet by 3 feet section. The ap- proximate cost is estimated at $4,000. This would provide relief from the present flooding condition on Rush Street and contemplates an addition- al authorization for a smaller sewer on Rush Street in the near future. The other section that has been discussed and authority has been granted on the upper portions of the said drainage system is Rosedale Avenue. It is recommended that authorization be granted to construct en Rosedale Avenue sidewalk from Parker's Lane to, Auburn Street a concrete monolithic structure similar to the above mentioned construction for 1900 feet varying in size from a 4 by 4 foot to a 3 by 3 foot section. The approximate cost is estimated at $5,000. This will prevent the wash cn Rosedale Avenue from the sec- tion immediately east of the asphalt paving which is a badly needed storm sewer relief measure. A petition this summer was re- ceived from residents of 28th and Muscatine Street requesting a sew- er be Constructed along 28th Street. Council authorized and the City in- stalled approximately 200 feet of this sewer. It is suggested also that au- thorization be granted to construct approximately 900 feet more of an 18 inch vitrified tile sewer starting at a point approximately 200 feet west of Central Avenue and extend- ing to Muscatine Street. Resolution Resolved by the City Council of the City of Dubuque: That the shippers of the Upper Mississippi Valley, including the manufacturers and the grain and live stock shippers of Iowa, have learned with surprise and amaze- ment of the action of the Secretary of War in suspending Federal Barge Line rates on cotton from Memphis to New Orleans upon complaint of rail carriers alleging that these rates represented unfair competition with them. We view such action as the sub- ordination of the public welfare to private interest. So it will be re- garded by the people of Iowa and of that potentially great commercial re- gion stretching along the Mississippi River from New Orleans to Minne- apolis. We identfy it as a triumph for those private interests which, with such unceasing vigilance and determined and incessant activity, have sought to defeat the proposed nine -foot channel on the Upper Mis- sissippi by leaving the Government without adequate motive for going forward with this improvement al- ready approved by Congress. On behalf of the people of the Upper Mississippi Valley, we claim from our Government the same pro- tection and care for the free use of our waterways, and for their devel- Special Session, November 9th, 1931 357 opment, as Congress has so gener- ously accorded the Atlantic, Pacific and Gulf regions, now served to our disadvantage in competition by an artificial waterway constructed at the expense of the nation —the Pa- nama Canal —and by other means for which many millions of public funds have been expended. We ask for every member of Iowa's delegation in Congress an earnest and aggressive effort to de- fend against the designs of selfish private interests the great possibil- ities for the future of our state which lie in the adequate improve- ment of the upper Mississippi River and in such regulation only of its navigation as will preserve the su- periority of public to private in- terest. The City Manager is hereby di- rected to forward copies of this reso- lution to the President of the United States, the Secretary of War, the Interstate Commerce Commission, to the appropriate committee of Senate and House of the Congress of the United States, to all members of Iowa's delegation in Congress and to the Governor of Iowa. Resolution No. 201 -31 Resolved by the City Council of the City of Dubnuque That the shippers of the Upper Mississippi Valley, including the manufacturers and the grain and live stock shippers of Iowa, have learned with surprise and amazement of the action of the Secretary 01 War in suspending Federal Barge Line rates on cotton from Memphis to New Orleans upon complaint of rail carriers alleging that these rates rep- resented unfair competition with them. We view such action as the sub- ordination of the public welfare to private interest. So it will be re- garded by the people of Iowa and of that potentially great commercial region ,stretching along the Missis- sippi River from New Orleans to Minneapolis. We identify it as a triumph for those private interest which, with such unceasing vigilance and determined and incessant activ- ity, have sought to defeat the pro- posed nine foot channel on the Up- per Mississippi by leaving the gov- ernment without adequate motive for going forward with this improvement already approved by Congress. On behalf of the people of the Upper Mississippi Valley, we claim from our government the same pro- tection and care for the 'free use of our waterways, and for their devel- opment, as Congress has so gener- ously accorded the Atlantic, Pacific and Gulf regions, now served to our disadvantage in competition by an artificial waterway constructed at the expense of the nation —the Panama Canal- -and by other means for which many millions of public funds have been expended. We ask of every member of Iowa's delegation in Congress an earnest and aggressive effort to defend against the designs of selfish private interests the great possibilities for the future of our state which lie in the adequate improvement of the up- per Mississippi River and in such regulation only of its navigation as g ill preserve the superiority of pub- lic to private interest. For a number of months past this Board has been investigating the feasibility and desirability of provid- ing a Coal Terminal at some point on the water front. After careful and continuous consideration and at- ter months of negotiations we now \'is to say to you that we feel the time has come when, in order to take advantage of our opportunity to further benefit from our location on the Mississippi River, we should move for the establishment of said Coal Terminal. We have had plans drawn for tl�e terminal to be located north of the lower high bridge and south of East Eighth Street fronting a slough through which East Eighth Street rams to the river. We propose to use the land at the t location deeded to the City for park 1purposes, and the City has had it appraised for the purpose of carry- ing out the conditions of the deed. The other land which we propose to use and which is contiguous to the park property above mentioned, is under an option which expires C ctober 29th, 1931. To the north of this property and under water are some lots over which an easement will be necessary. This easement has been promised to us. It is anticipated that the purchase of this land, the building of the sea wall, the filling behind it, the reloca- tion of a street, the building of a railroad track and the necessary su- perstructure consisting of unloading. screening, weighing and other equip- ment and the necessary building can be constructed at this time for not more than $150,000. Special Session, November 16th, 1931 A contract for the leasing of this terminal has been negotiated with officials of the Kanawha Mississippi Coal Company, a Virginia Corpora- tion. Which contract has been be- fore you and has. been subject to discussion, therefore, you are famil- iar with its provisions. In view of the above we hereby recommend the building of a Coal 'terminal at the location named and request that bonds to an amount not to exceed $150,000 be issued as needed and when the said Kanawha Mississippi Coal Company can show that it has not less than $200,000 paid into the company as capital. Moffatt, objecting to the contract about to be entered into with the Kanawha- Mississippi Coal Co., stating that a reasonable time was not allowed between the call for a public hearing and the hearing it- self to give taxpayers an opportunity to properly present the present case, and he therefore recommends that the City Council terminates the pres- ent negotiations and await further developments. They took up the matter with the City Treasurer and that he informed them that a mistake was made and that they received a card for one lot instead of for two lots. The actual assessment is $135.79 for each lot. They object to this assess- ment and, in view of the fact that they were mislead by the first no- tice, they hereby ask that the Coun- cil reduce their assessment. Nagle, referred to the City Solicitor some time ago, wherein he states that he purchased from the City in April of this year (1931) Lots 1 of 7, 1 of 8, 1 of 9, 1 of 10 and 1 of 11, South View Heights Addition, and Lots 25 -26 and 27, Blake's Addition. for $1,200 cash, with the distinct understanding that he was to get a complete title, free from all taxes and assessments, ex- cept interest, if any, of Ed Blake. He finds that the taxes not paid at the date of deed to him from the City amount to $381.69, besides tax sale certificates which have not been surrendered, nor have deeds been issued for them. He therefore peti- tions the Council to give him title to the above described property free from all taxes and assessments (ex- cept any interest that may be held by Blake), and that the City Treas- urer be instructed to surrender of cause to be cancelled the tax sales certificates above enumerated, cov- ering above described property and sales, and further that the taxes ap- pearing unpaid on the tax books of Dubuque County, Iowa, be cancelled. ' And further requests that the Board of Supervisors of Dubuque County, Iowa, cancel the County taxes ap- pearing unpaid against this property. The City Solicitor recommends that this be granted. At a session of the City Council held September 14th, 1931, a com- munication from A. P. Abeln, stating that the City of Dubuque acquired title to Lots 4 -5 -6 in Cushing's Sub- division by Treasurer's tax deed. The City failed to pay the regular tax for 1922 and were purchased by F. D. Thimmesch, paying $7.75 for each lot. He stated that Mr. Thim- mesch would be satisfied to relin- quish his claim to the City for the amount paid plus 6% interest from date of purchase.
