Present —Mayor Meuser, Council-
men Jansen, McEvoy, Schuckert, and
City Manager Evans.
Absent — Councilman Andelfinger.
Mayor Meuser stated that this is
the regular monthly meeting of the
City Council, for the purpose of act-
ing on any business that may proper-
ly come before a regular meeting of
the Council, and that this date was
also fixed for the purpose of levying
special assessments and authorizing
the issuance of improvement bonds
to provide for the payment for the
improvement of Grace Street from
North Grandview Avenue to McCor-
mick Street and for the widening
of West 12th Street from Locust
Street to Bluff Street.
Return of service sworn and sub-
scribed to by D. L. Sullivan, that
he has posted notice of the assess-
ments for the improvement of Grace
Street from the West property line
of North Grandview Avenue to the
east property line of McCormick
Street, and for the widening of West
12th Street from the West property
line 'of Locust Street to the East
property line of Bluff Street, along
the line of the improvements.
Councilman Schuckert moved that
the report be approved and placed
on file. Seconded by Councilman
Jansen. Carried by the following
vote:

ance of Public Improvement Bonds).
Whereas, the contract heretofore
entered into by the City of Dubuque
for the Improving of Grace Street,
hereinafter described, has been com-
pleted and said improvement has
been accepted by the City Council of
said City and. the City Engineer has
computed the cost and expense
thereof to be $9,238.53;
And Whereas, public notice as pro -.
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds to
pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that to provide for the cost of
Improving Grace Street twenty -nine
(29) feet wide from the west prop-
erty line of North Grandview Avenue
to the east property line of McCor-
mick Street, there be issued Im-
provement bonds to the amount of
$9,238.53. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1927, which
bear date as of the 7th day of Jan-
uary, 1932; shall be in denomina-
tions of $500.00 except that there
shall be one bond to the amount of
$238.53. They shall be numbered
from 3157 to 3175 inclusive and shall
be divided into ten series of which
the bonds numbered 3157 and 3158
shall constitute the first series and
shall be payable the 1st day of April,
A. D. 1932, the bonds numbered 3159
and 3160 shall constitute the second
series and shall be payable the 1st
day of April, A. D. 1933, the bonds
numbered 3161 and 3162 shall con-
stitute the third series and shall be
payable the 1st day of April, A. D.
1934, the bonds numbered 3163 and
3164 shall constitute the fourth se-
ries and shall be payable the 1st day
of April, A. D. 1935, the bonds num-
bered 3165 and 3166 shall constitute
the fifth series and shall be payable
the 1st day of April, A. D. 1936, the
bonds numbered 3167 and 3168 shall
constitute the sixth series and shall
be payable the 1st day of April, A. D.
1937, the bonds numbered 3169 and
3170 shall constitute the seventh se-
ries and shall be payable the 1st day

bered 3171 and 3172 shall constitute
the eighth series and shall be pay-

Said bonds shall bear interest at
the rate of five per cent. per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto attach-
ed; and said bonds shall be payable
out of the proceeds of the special
assessment levied for said improve-
ment.
Both principal and interest shall
'be payable at the office of the City
Treasurer in the City of Dubuque.

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A. D.
193 ; or any time before that date
at the option of the City, the sum of
$500.00 with interest thereon at the
rate of five per cent. per annum, pay-
able on the presentation and surren-
der of the interest coupons attached,
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 7th day of December, 1931. This
bond is one of a series of 19 bonds,
18 for $500.00, numbered from 3157
to 3174 inclusive, and one for $238.53,
numbered 3175, all of like tenor and
date, and issued for the purpose of
improving Grace Street twenty -nine
(29) feet wide from the west prop-
erty line of North Grandview Avenue
to the east property line of McCor-
mick Street and described in said
resolution; which cost is assessable
to and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property,
and payable in ten annual install-
ments, with interest on all deferred
payments at the rate of five per cent.
per annum, and this bond is payable
only out of the money derived from
the collection of said special tax, and
said money can be used for no other
purpose. And it is hereby certified
and recited that all the acts and con-
ditions and things required to be
done precedent to and in the issuing
of this series of bonds, have been
done, happened and performed in
regular and due form as required by
said law and resolution; and for the
assessments, collections and pay-
ment hereon of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In Witness Whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 7th day of December, 1931,
and has authorized the use of their
fac- simile signature to the interest
coupons hereto attached.

liver them to the City Treasurer who
will also register them in a book to
be kept by him for that purpose.
Be It Further Resolved, that the
City Treasurer be and he is hereby
instructed to sell said bonds in the
manner provided by law, the pro-
ceeds of said sale to be kept in a
special fund to be known as Improve-
ment Fund.
Be It Further Resolved, that the
interest coupons attached to the
bonds be signed with the fac- simile
signature of the Mayor and counter-
signed with the fac - simile signature
of the City Clerk.
Be It Further Resolved, that as
fast as funds allow, beginning with
the second year after the payment of
interest due, these bonds shall be
called and retired in the same order
as numbered.

This bond is one of a series of five
bonds, four for $100.00, numbered
from 3152 to 3155 inclusive, and one
for $64.30, numbered 3155, all of like
tenor and date and issued for the
purpose of widening of West Twelfth
Street from the west property line
of Locust Street to the east prop-
erty line of Bluff Street and de-
scribed in said resolution; which
cost is assessable to and levied along
said improvement, and is made by
law a lien on all abutting or adja-
cent property, and payable in ten
annual installments, with interest on
all deferrer} payments at the at of
five per cent. per annum, and this
bond is payable only out of the
money derived from the collection of
said special tax, and said money can
be used for no other. purpose And
it is hereby certified and recited that
all the acts and conditions and
things required to be done precedent
to and in the issuing of this series
of bonds, have been done, happened
and performed in regular and due
form as required by, said law and
resolution; and for the assessment,
collections and payment hereon of
said special tax, the faith and dili-
gence of said City of Dubuque are
hereby irrevocably pledged.

Ordinance No. 24-31
r e J An Ordinance, regulating the con -
struction of storage tanks and the
installation of oil burning devices
and equipment; the storage and use
of fuel oil; and prescribing a pen-
alty for violation thereof.
Be it ordained by the Council of
the City of Dubuque:
Paragraph 195. Application, Ap-
proval, Fee, Permit, Inspection. Sec-
tion 1. (A) Before any person, firm
or coroporation shall be permitted
to erect or install in any residence
or other building, or upon any prem-
ises, any oil burning device or equip-
ment for heating purposes, together
with tanks or containers for storage
of fuel oil, such persons, firm or cor-
poration shall first secure a permit
therefor from the Plumbing Inspect-
or of the City of Dubuque.
(B) No permit shall be issued un-
less and until an application has
been made describing the name of
the burner, name and location of
manufacturer, grade of fuel oil for
which burner is designed, length of
time burner has been on the mar-
ket. No permit shall be issued for
the installation of any oil burner
or equipment unless the same is
listed by the Underwriters Labor-
atory or some other Nationally rec-
ognized inspection board or labora-
tory.
No permit shall be issued until
the applicant has furnished full and
complete specifications of • said ap-
proved oil burner or equipment, in-
cluding size of burner and size and
number of fuel oil tanks, type of
heating systems, and exact location
of the proposed installation.
(C) The schedule of fees charge-
able and collectable, prior to the
inspection and the approval of oil
burning equipment, shall be as fol-
lows:
The cost of the permit fee for
each original oil burner and neces-
sary fuel tank or tanks shall be
$3.75 for the complete installation
and inspection.
The cost of the permit fee for each
additional oil burner, after the first
burner, either as in a battery of
burners or as a replacement of a
burner in an existing system, shall
be $1.00 per burner. The cost of
the permit fee for each tank re-
placement or additional tank install-
ation, shall be $1.00 per tank.
(D) When such application has
been filed with the Plumbing In-
spector, said Plumbing Inspector
shall investigate the piping and tank
features and shall refer all electric-
al details of said installation to the
City Electrical Inspector. When
said application has been ascertained
to be in conformity with this or-
dinance and all City requirements,
said Plumbing Inspector shall issue
such permit.
(E) Tank and pipe installations of
oil burning equipment shall be un-
der the jurisdiction of the Plumbing
'Inspector; all electrical installation
of oil burning equipment shall be
under the jurisdiction of the Elec-
trical Inspector. Each inspector
shall have the authority to enforce
relative tank and pipe and wiring
requirements of this ordinance and
the Electrical code of the City.
(F) The regulations and require-
ments of this Ordinance do not ap-
ply to oil burning devices employing
a wick.
(G) For the purpose. of this Or-
dinance "Oil Burners" shall mean
any device designed and arranged
for the purpose of burning or pre-
paring to burn any liquid fuel and
having a tank or container with a
capacity for more than 20 gallons
connected thereto.
(H) For the purpose of this Or-

dinance "Oil Burning Equipment"
shall consist of "Oil Burners" and all
equipment connected thereto includ-
ing internal and external supply or
storage tanks, piping, wiring, and all
accessories.
Paragraph 196. Fuel Oils. Sec-
tion 2. Oil used for fuel under these
regulations shall be topped or dis-
tilled oil having a flash point of
not less than 100 degrees Fahren-
heit, and such oils shall not be fed
from the tank to the suction pump
as a preheated temperature higher
than forty degrees Fahrenheit below
its flash point.
Paragraph 197. Tank Location and
Setting. Section 3. Storage tanks
shall preferably be located outside,
underground, with top of tank be-
low the level of the burner. Where
conditions are such that top of tank
is above the burner, adequate ap-
proved provisions to prevent siphon-
ing shall be provided.
No storage tank for fuel oil shall
be located within eight feet meas-
ured horizontally, from any fire or
flame or apparatus, capable of pro-
ducing flame.
Inside storage, gravity and auxil-
iary tanks, not inclosed in concrete
or masonry, shall be mounted on
substantial incombustible supports,
and shall be adequately secured to
avoid strains on piping, and shall
consist of units not in excess of 275
gallons for each tank. When locat-
ed inside the building, the aggre-
gate capacity of the tanks shall not
exceed 550 gallons, "and shall con-
sist of units not in excess of 275 gal-
lons in each tank" unless the amount
over and in excess of 550 gallons is
placed in an enclosure, on a firm
foundation, said enclosure to have
dimensions not less than six (6)
inches greater on all sides than the
outside dimensions of the tank. The
wall of said enclosure shall be car-
ried to a height of not less than
one (1) foot above the tank and the
space between the tank and walls
shall be completely filled with sand
or well tamped earth to the top of
the enclosure. The walls of the
enclosure shall be constructed of

inches in thickness, or of masonry
construction of not less than eight

Storage tank or tanks located out-
side of buildings, having an aggre-
gate capacity greater than 550 gal-
lons, shall be buried underground
with the top of the tank net less
than two (2) feet below the ground
surface. Where a tank cannot - be
entirely buried, the same shall be
covered over with earth to a depth
of at least two (2) feet and allow-
ing a slope on all sides of the fill
over the tank, of not less than three
(3) to one (1).
Gravity feed to oil burner from
auxiliary tank, or storage tank of not
over 275 gallons capacity may be
permitted, if suitable automatic safe-
guards are provided to prevent ab-
normal discharge of oil at the burn-
er. When more than one (1) tank
is installed such tanks shall be con-
nected with the main feed pipe line
leading to the burner through a man-
ually operated, approved, three -way
valve so that no more than one tank
can in any way discharge its con-
tents at one time in the event of
breakage of pipe line to burner.
Pressure feed system to burner
may be permitted, if suitable auto-
matic safeguards to prevent abnor-
mal discharge of oil at the burner
are provided, and, if the capacity of
the pressure tank does not exceed
60 gallons.
Auxiliary pressure tanks shall be
designed for six (6) times the max-
imum working pressure and shall be
tested and proven tight at twice the
maximum working pressure; the
working pressure shall not exceed
50 pounds.
Pressure tanks shall be provided
with a reliable pressure gauge and
an automatic relief valve piped to
discharge outside the building.
Paragraph 198. Material and Con-
struction of Tanks. Section 4. Tanks
shall be constructed of galvanized
steel, of open - hearth steel or wrought
iron of minimum gauge (U. S. Stan-
dard) depending upon capacity as
given in the table below:—

For tanks of 1,000 gallons and
more, a tolerance of 10% in capac-
ity may be allowed.
Underground tanks shall be thor-
oughly coated on the outside with
tar, asphaltum or other suitable rust -
resisting materials.
Inside or above ground and aux-
iliary tanks shall be coated with a
good quality of rust- resisting paint.
Paragraph 199. Venting of Tanks.
Section 5. Underground storage
tanks shall be provided with an open
or automatically operated galvanized
iron vent pipe, without trap, and
draining to the tank.
Inside or above ground and aux-
iliary tanks shall be provided with
open vent pipes.
All vent pipes (to tanks) shall be
of ample size to prevent abnormal
pressure in case of fire or when fill-
ing, in no case to be less than 1
inch pipe size.
Such vent pipes shall have the
lower' end extended through the top
into the tank for a distance of not
more than one inch. Outer ends of
vent pipes shall be provided with
a weather -proof hood terminating at
a point outside of building, prefer-
ably not less than three feet from
any window or other building open-
ing.
All vent pipes shall extend from
the tank to outside air. Vent pipes
shall terminate on the outside one
foot above the level of the highest
reservoir from which the tank may
be filled.
Paragraph 200. Filling Pipe. Sec-
tion 6. (A) All filling pipes shall
terminate outside of buildings and
when intalled in the vicinity of any
door or other building opening shall
be as remote therefrom as possible
so as to prevent liability of flow of
oil or vapor through building open-
ings; terminal shall be provided with
a metal cover or cap which may be
locked. Cross connection between
fill pipe and vent pipe is prohibited.
In no case shall the filling pipe be
less than two (2) inch.
(B) Unless auxiliary tanks are
filled in the same manner as storage
tanks they shall be filled by pump-
ing from storage tanks.
(C) Auxiliary tanks shall be pro-
vided with an overflow connection
draining to the storage tank. Over-
flow pipe shall be not less than one
size larger than supply pipe to
pump.
(D) The overflow pipe of an aux-
iliary gravity tank shall not be pro-
vided with valves or obstructions:
but overflow pipe of auxiliary pres-
sure tank shall be provided with in-
ter- connected valves or other means
for automatically venting tank when
filling.
Paragraph 201. Oil Level Indi-
cating Device. Section 7. No oil
tank used in connection with oil
burning equipment shall be equipped
with a glass gauge, or any gauge the
breaking of which will permit oil
to escape from the tank. A test
well, or gauging device shall be in-
stalled on all tanks and shall be
designed to prevent escape of oil
or vapors when closed. Test wells
shall not be located within build-
ings. The top of an outside well
or gauging device shall be kept
tightly closed when not in use.
Paragraph 202. Pumps. Section
8. Oil pumps used in filling auxil-
iary tanks from storage tank shall
be of an approved type, secure
against leaks, with check valves lo-
cated as close to pump as possible
and such pump shall be rigidly fast-
ened in place.
Automatic pumps, not an integral
part of the burner, shall be provided
with automatic means for prevent-
ing the continuous discharge of oil
in case of breakage.
Paragraph 203. Pipes. Section 9.
(A) Standard full- weight wrought
iron steel or brass pipe with sub-
stantial fittings or approved brass
or copper tubing with approved fit-
tings shall be used and shall be care-
fully protected against mechanical
injury in a manner satisfactory to
authorities having jurisdiction. In
all piping systems proper allowance
shall be made for expansion and
contraction, jarring and vibration.
All piping shall be separated from
electric wiring not enclosed in ap-
proved conduit, raceways or armored
cable by some continuous and firmly
fixed non - conductor creating a per-
manent separation, as provided in
the National Electrical Code.
(I3) Approved brass or copper tub-
ing shall have a wall thickness of
not less than .049 inches for small
sizes and correspondingly heavier,
where necessary.
Flexible metallic tubing employed
for the purpose of reducing the ef-
fects of jarring and vibration and
providing swing joints shall be of
an approved type and shall be in-
stalled strictly in accordance with
the limitations of its approval.
(C) Supply pipe shall be not less
than one - fourth inch in diameter iron
pipe size, and when oil is pumped
to burner, return pipe shall be at
least the same size.
(D) Pipe connections to tanks
shall be suitably reinforced and pro-
per allowance made for expansion
and contraction, jarring and vibra-
tion.

(E) Openings for pipes through
masonry walls below the ground
level shall be made oil -tight and se-
curely packed with flexible material.
(F) All connections shall be made
perfectly tight with well fitted
joints. Unions shall be used at
burners to facilitate removal. All
unions shall be of approved type,
having conically faced joint, obviat-
ing the use of packing or gaskets.
(G) Piping shall be run as directly
as possible and in the case of pump-
ing systems, so laid that if practic-
able the pipes are pitched back to-
ward the storage tanks without
traps.
(H) Systems under pressure shall
be designed for six times the work-
ing pressure and installation when
complete shall be tested and proven
tight at twice the maximum pres-
sure. •
Paragraph 204. Valves. Section
10. All valves shall be of an ap-
proved type. Readily accessible
valves shall be provided near each
burner and also close to the aux-
iliary tank in the pipe line to burn-
er. Control valves shall be of ap-
proved type provided with stuffing
box of liberal size, containing a re-
movable cupped gland designed to
compress the packing against the
valve stem and arranged so as to
facilitate removal. All valves shall
be designed to close against the sup-
ply, and to prevent withdrawal of
steam by continued operation of the
hand wheel. The use of packing
affected by the oil or heat is pro-
hibited.
Where strainers and pumps are
not a part of a burner unit shut-
off valves shall be provided on both
sides of any strainer which may be
installed in pipe lines; in discharge
and suction lines to pump; and in
branch lines near burners. In sys-
tems where burner, pump and strain-
ers are assembled as a unit a suit-
able shut -off valve shall be provid-
ed on the inlet side of the strainer.
Paragraph 205. Burners. Section
11. Only oil burners or oil burning
equipment listed by the Underwrit-
ers Laboratory or any other nation-
ally recognized inspection board or
laboratory shall be permitted to be
installed.
Where automatic operation is pro-
vided by means of a room theremo-
stat, the installation shall be equip-
ped with an additional control to
prevent abnormal water temperature,
abnormal steam pressure, or over-
heated hot aid ducts. Such auto-
matic control shall be so arranged
that the same will reset itself auto-
matically.
Paragraph 206. Dampers. Section
12. Dampers which may entirely
close the chimney uptake are pro
hibited. Damper area should be care-
fully determined in each case but
in no case shall it be greater than
80% of the internal cross sectional
area of the uptake.
Paragraph 207. Conflicting Ordi-
nances Repealed. Section 13. All
ordinances or parts of ordinances
in conflict herewith shall be and
the same are hereby repealed.
Paragraph 208. Penalty. Section
14. Any person, firm or corporation
violating any of the provisions of
this ordinance shall be fined not less
than $5.00 nor more than $100.00 for
each offense, or be imprisoned for
not to exceed thirty days.
Paragraph 209. Publication Clause.
Section 15. This ordinance being
deemed- urgent and of immediate im-
portance shall be in force and ef-
fect from and after its final pass-
age and adoption by the City Coun-
cil and publication as provided by
law.

Street, at a point about forty -five
(45) feet South of Ninth Street, in
the City of Dubuque, Iowa, with cer-
tain conditions, obligations and re-
strictions regarding the same.

Par. 210. Section 1. That Farley
& Loetscher Manufacturing Com-

pany, a corporation organized under
the laws of the State of Iowa, with
its principal place of business at Du-
buque, Iowa, its successors and as-
signs, be and are hereby authorized
to erect and maintain an enclosed
bridge approximately eight feet wide
and twenty -five feet five inches long,
extending from the old building on
Ninth and Jackson Streets to the
new building on Ninth and White
Streets, in the City of Dubuque, the
said bridge to be fourteen feet from
the grade level in the alley to the
lowest point of the bridge, and said
bridge shall be covered with galvan-
ized iron roof and siding and shall
be provided with a wooden floor,
and on condition that said Farley &
Loetscher Manufacturing Company,
its successors and assigns shall ever
hereafter hold said City harmless
from all damages that may arise or
be incurred by reason of the grant of
the privileges hereby made.

Whereas doubt has arisen as to
the validity of Ordinance No. 8 -31,
which purported to vacate the alley
first West of Locust Street in the
City of Dubuque commencing at the
South property line of West Sixth
Street and ending approximately
183.5 feet South thereof on account
of the fact that the proposal to va-
cate said alley had not been sub-
mitted to the Planing and Zoneing
Commission of the City of Dubuque
prior to the final passage and adop-
tion of said Ordinance; and:
Whereas it is deemed advisable by
this Council to repeal said Ordinance
and, by the passage and adoption of
Ordinance No. —31, cause said vaca-
tion of said alley to conform to all
legal requirements now existing:

Whereas the Government of the
United States has purchased all of
Lot 101, the North 18 feet of Lot
102, the South middle 38.5 feet of
Lot 102, the South 8 feet of Lot 102,
Regular Session, December 7th, 1931 387
the North 30 feet of Lot 103, the
North 24.5 feet of the South 34.5 feet
of Lot 103, all of Lot 140, the North
59 feet of Lot 139, the South 7.5 feet
of Lot 139, and the North 54.5 feet
of Lot 138, all in the Town (now
City) of Dubuque, Iowa, for the pur-
pose of erecting a post office and
customs building thereon and the
plans for said improvements contem-
al the use portion Locust
alley ley lying first West
Street and extending from West
Sixth Street to West Fifth Street in
said City; and,
Whereas the owners of all of the
real estate abutting upon said alley
have petitioned the City Council of
the City of Dubuque to vacate so
much of said alley as will be used
and needed for said improvements
and there are no other persons or
property which will be effected by
said vacation and the general public
will not suffer any inconvenience
thereby; and,
Whereas this Council is desirous
of aiding and assisting in the promo-
tion of said improvements, deeming
the same advantageous to all of the
citizens of the City of Dubuque; and,
Whereas the proposal to vacate
said alley has been submitted to the
Planing and Zoneing Commission for
its recommendation and approval
and said Commission has filed its
recommendation with the Council
wherein it recommends the granting
of the petition; and,
Whereas the Engineer has caused
to be prepared a plat of the portion
of the alley proposed to be vacated,
which plat is hereto attached and
made a part hereof;
Now Therefore:
Be it Ordained by the City Council
of the City of Dubuque:
Par. 214, Section 1. That the alley
first West of Locust Street com-
mencing at the South property line
of Wet Sixth Street and ending ap-
proximately 183.5 feet South thereof
be and the same is hereby vacated
and annulled and from and after the
adoption of this Ordinance, said por-
tion of said alley shall no longer be
open for public use as a public
thoroughfare.
Par. 215, Section 2. That upon the
final passage and adoption of this
Ordinance, the Clerk shall and he is
hereby directed to cause a certified
copy of the same to be filed in the
office of the Recorder of Dubuque
County, Iowa, together with the plat
attached hereto, the same to be a
part of the permanent records of
said office.
Par. 216, Section 3. This Ordin
ante being deemed urgent and in the
interest of the public peace, safety
and general welfare shall be in force
and effect from and after its final
passage and adoption by the City
Council and publication as provided
by law.

excavating.
Inasmuch as this work has been
completed for some time, it is rec-
ommended that the bond be can-
celled and returned to the Swords
Company.

excerpt from the minutes of the Park
Board meeting held December 31,
1931:—
- "The Park Board recommends to
the City Council that it is desirable
to have Sixth Street between Locust
and Bluff widened approximately
388 Regular Session, December 7th, 1931
from four to five feet on the south
side of said street by setting the
curb back approximately that dis-
tance from its present location, the
exact distance that the curb should
be set back to be determined by the
location of the existing trees which
it is thought desirable to preserve.
It is also thought advisable to pre-
serve the trees on Locust Street and
a part of those which now exist on
Bluff Street."

To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen: Within the last few
days the architect for the new Post
Office Building on Sixth Street has
discussed with the City Manager
questions pertaining to a boulevard
light system and further tree distri-
bution on the sidewalk or parking
space on Locust, Sixth, and Bluff
Streets adjacent to the Post Office
area.
It was mentioned that the pro-
posed sidewalk for this Sixth Street
frontage was to be constructed of
concrete 17 feet in width from prop-
erty line to present curb. The writer
believes that consideration should be
given by City Council in the very
near future toward the authorization
of the widening of Sixth Street from
Locust to Bluff at least along the
south side. The street is 64 feet in
width from property line to property
line and formerly had 12 -foot side-
walks with 40 feet of paving, but the
curb was moved out prior to paving
on the south side to such an extent
that there is a 17 -foot space avail-
able by the present curb on the
south property line of the street. It
is recommended that this street be
widened five feet on the south side
from Locust to Bluff.

Gentlemen: At the meeting of
November 30th two petitions for new
street lights were referred to the
write for investigation and action.
This is to advise that I have in-
vestigated the condition on Ellis
Street between West Locust and Al-
mond Streets and find that the two
600 C.P. lamps on either end of this
block are about 600 feet apart. I
have instructed the Power Company
to install a new 100 C.P. lamp near
the middle of the block to provide
illumination necessary because of
the heavy tree condition on the east
side of said block.
Concerning the Park Hill light re-
quested to be installed at Broadway
and Putnam Streets, I have instruct-
ed the Power Company to install one
new 250 C.P. light at this corner.

Council, Dubuque, Iowa.
Gentlemen: Upon my investigation
of the street light facilities in the
Park Hill district and after instruct-
ing the Power Company to install a
new light at Broadway and Putnam
Streets, I would further recommend
the installation of a light at Musca-
tine and Putnam as Putnam Street
is a dead end at Muscatine and all
traffic coming off the hill must turn
right or left at this intersection.
This is a dark spot in this section
as the closest lights are on Musca-
tine at Sabula and Charles Streets
and will provide some illumination
toward the new West 28th Street
hill.
Another location that seems wor-
thy is a recommended new light at
the intersection of Monroe and Ful-
ton Streets. The lights on Broadway
are a considerable distance from this
intersection and I believe a light is
necessary attached to the present
pole at Monroe and Fulton.

WHEREAS, the contract hereto-
fore entered into by City of Du-
buque for the improving of Locust
and West Locust Streets, hereinafter
described, has been completed and
said improvement has been accepted
by the City Council of said City and
the City Engineer has computed
the cost and expense thereof to be
$34,773.63,
AND WHEREAS, public notice as
provided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto, and all
objections filed hereto have been
considered and determined:
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Dubuque that to provide for
the cost of improving of Locust
Street from the south property line
of West Sixth Street to the . north
property line of West Sixteenth.
Street except the West Eighth Street
intersection and West Locust from
the north property line of West Six-
teenth Street to the north property
line of West Seventeenth Street and
the Bluff and West Locust Street
intersection, there be issued Im-
provement bonds to the amount of
$34,773.63.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 14th. day of January, 1932;
shall be in denominations of $500.00
except that there shall be one bond
to the amount of $273.63. They shall
be nu mbered from 3185 to 3254 inclu-
sive and shall be divided into ten
series of which the bonds numbered
from 3185 to 3191 inclusive shall con-
stitute the first series and shall be
payable the lst. day of April A. D.,
1932; the bonds numbered 3192 to
3198 inclusive shall constitute the

first day of April A. D., 1933; the

Said bonds shall bear interest at
the rate of five per cent; per annum
which interest shall be payable semi-
annually, in accordance with the
terms of the coupons thereto at-

able out of the proceeds of the spe-
cial assessment levied for said im-
provement.
Both principal and interest shall
he payable at the office of the City
Treasurer in the City. of Dubuque.

IMPROVEMENT BOND
The City of Dubuque in the State
of Iowa promises to pay, as herein-
after mentioned to the bearer hereof,
on the first day of April, A. D. 193 —;
or any time before that date at the
option of the City, the sum of
500.00 HUNDRED DOLLARS,
with interest thereon at the rate of
five percent, per annum, payable on
the presentation and surrender of
the interest coupons hereto attached,
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1927, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 14th. day of December, 1931.
This bond is one of a series of 7U
bonds, 69 for $500.00 numbered from
3185 to 3253 inclusive, and one for
$273.63 numbered 3254, all of like
tenor and date, and issued for the
purpose of improving of Locust
Street from the south property line
of West Sixth Street to the north
property line of West Sixteenth
Street except the West Eighth Street
intersection and West Locust from
the north property line of West Six-
teenth Street to the north property
line of West Seventeenth Street and
the Bluff and West Locust Street in-
tersection, and described in said
resolution; which cost is assessable
to and levied along said improve-
ment, and is made by law a lien on
all abutting or adjacent property, and
payable in ten annual installments,
with interest on all deferred pay-
ments at the rate of five per cent.
per annum. and this bond is payable
only out of the money derived from
the collection of said special tax, and
said money can be used for no other
purpose. And it is hereby certified
and recited that all the acts and
conditions and things required to be
done precedent to and in the issuing
of this series of bonds, have been
done, happened and performed in
regular and due form as required by
said law and resolutions; and for the
assessments, collections and pay-
ment hereon of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In Witness Whereof, the City of
Dubuque by its City Council has
caused this bond to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-

Whereas, the contract heretofore
entered into by the City of Dubuque
for Improving the Alley first west of
North Booth Street, hereinafter de-
scribed, has been completed and - said
improvement has been accepted by
the City Council of said City and the
City Engineer has - computed the cost
and expense thereof to be $812.76.
And Whereas, public notice as pro-
vided by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
to pay the cost of said improvement
and a public hearing has been held
pursuant thereto, and all objections
filed thereto have been considered
and determined:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque that to provide for the cost of
improving of the alley first west of
North Booth Street from the north
property line of Langworthy Street
to the south property line of West
Third Street, there be issued Im-
• provement Bonds to the amount of
$812.76. Said bonds shall be issued
under the provisions of Chapter 311
of the Code of Iowa, 1927, which bear
date as of the 14th day of January,
1932; shall be in denominations of
$100.00, except that .there shall be
one bond to the amount of $12.76.
They shall be numbered from 3176
to 3184 inclusive and shall be di-
vided into nine series of which the
bond numbered 3176 shall constitute
the first series and shall be payable
the first day of April, A. D. "1932;
the bond numbered 3177 shall con-
stitute the second series and shall
be payable the first day of April,
A. D. 1933; the bond numbered 3178
shall constitute the third series and
shall be payable the first day of

Gentlemen: With reference to the
petition requesting a street light on
Clark Street between West 17th
Street and West Locust Street,
please be advised that investigation
on the ground discloses the fact that
the present street light at the north-
erly end of Clark Street is about 20
feet north of the north line of West
Locust Street beyond the intersec-
tion of Ellis Street. The distance
from this light to the light at the
intersection of Clark and West 17th
is between 500 and 600 feet.
The writer would recommend the
installation of a small lamp of pos-
sibly 100 C.P. capacity to be install-
ed midway in this block at the pole
in front of 440 Clark Street. This
lamp would be on the opposite side
of the street from the heavy trees
and would undoubtedly safeguard
this block.

Whereas, this Dock Board of the
City of Dubuque, Dubuque County,
Iowa, has caused to be prepared a
general plan for the construction of
harbor and water front improve-
ments and, pursuant to petitions
heretofore filed with the City Coun-
cil of said City, bonds in the aggre-
gate amount of $347,000 have hereto-
fore been issued to defray the cost
thereof; and
Whereas, it is deemed necessary
and advisable that additional bonds
be issued for the purpose of defray-
ing the cost of said works and im-
provements;
Nov, Therefore, Be It Resolved by
the Dock Board of the City of Du-
buque, Iowa, as follows:
Section 1. That it is hereby de-
clared necessary and advisable that
additional bonds of the City of Du-
buque, Dubuque County, Iowa, in the
principal amount of $150,000, be
authorized for issuance from time to
time by the City Council of said City
for the purpose of defraying the
cost of constructing works and im-
provements for the harbor and water
front in said City and the purchase
of property for said purpose.
Sec. 2. That this resolution be
deemed a petition requesting that
said bonds be authorized without de-
lay and that a certified copy of this
resolution be forthwith filed with the
City Council of said City for the pur-
pose of initiating the necessary pro-
ceedings in the manner and form
prescribed by paragraph 11 of Sec-
tion 5902 of the Code of Iowa, to-

SPECIAL ORDER AND NOTICE
FROM BOARD OF HEALTH.
To John Berwanget; Estate, 2509
Roosevelt St.
You are hereby ,notified that on
the 14th day of December, 1931, the
Local Board of Health for the City
of Dubuque adopted a resolution or-
dering you to abandon and remove
the outside water closet, privy'•or
• privy vault located upon the. preen -'
ises described therein and to clean
the same; also to connect said prem-
ises with the sanitary sewer and in-
stall sanitary toilet and toilet facil-
ities and connect the same. with said
•sewer; all of which to be done with -•
in Thirty (30) days from the date of
• said resolution, a copy of which is
llerein set out and is as follows:
RESOLUTION OF THE BOARD
OF HEALTH
• Be it resolved by the Board of
Health of the City of Dubuque, Iowa,
that it is deemed necessary that Min-
eral Lot No. 307A, owned by J. Ber-
wanger Estate, be connected with
sanitary sewer; that the , outside
water closet, privy or privy vault
upon said premises be abandoned
and removed and said vault cleaned
and that a sanitary toilet and toilet
facilities be installed and connec-
tions made with the sanitary sewer.
Be it further resolved that said
John Berwanger's Estate be notified
to remove and abandon. the outside
water closet, privy or privy vault lo-
cated upon the premises above de-
scribed and to clean said vault; that
said property be connected with the
- 'sanitary sewer and that sanitary toi-
let and toilet facilities be installed
and connections made with said
sewer, all of which to be done with-
in Thirty (30) days from the date
hereof.
Be it further resolved that said
John Berwanger's Estate be notified
of the action of this Board by the
service of a written notice together
with a copy of this resolution. Fail-
ure to comply with the terms hereof
within the time stated shall be fol-
lowed by prosecution or such other
action as the Council or Board of
Health may determine.

Absent — Councilman Schuckert.
Meeting called by order of Mayor
Meuser and Councilman Andelfinger.
Mayor Meuser read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of acting up-
on the petition of D. C. Browning,
Assistant United States Attorney for
the Northern. District of Iowa, re-
questing that a permit be granted
for the . erection of Post Office and
Federal Building upon their property
which Is included in the restricted
residence district as embodied in
Ordinance No. 29 -29 and for which
the City Council must grant the issu-
ance of permit for the erection of
certain class of buildings and acting
on any other business that may come
before the meeting.
Petition of D. C. Browning, As-
sistant United States Attorney for
the Northern District of Iowa, re-
questing that a perthit be granted
for the erection of a Post Office and
Federal Building upon the following
described property, City Lot 101,
City Lot 102 and the North Fifty -
four and one -half feet of City Lot
103, the North Fifty -four and one -
half feet of City Lot 138, City Lot
139 and City Lot 140, as this prop-
erty is located in the restricted resi-
dence district as embodied in Ordin-
ance No. 29 -29, presented and read.
Councilman Andelfinger moved
that the prayer of the petitioner be
granted. Seconded by Councilman
McEvoy. Carried by the following
vote:
