Council met at 7:30 P. M.
Present —City Manager Kratz,
Mayor Meuser, Councilmen Andel-
finger, Jansen, McEvoy, Schuckert.
Mayor Meuser stated that this is
the regular monthly meeting of the
Council for the transaction of such
business as may properly come be-
fore it, and this date has also been
fixed to conduct a hearing at which
hearing property owners on Central
Avenue from 22nd Street and Kauf-
mann Avenue to 32nd Street will be
heard on the proposed improvement
of said street.
Resolution No. 178 -30.
A resolution awarding contract for
improving of Custer Street, from the
West property line of Auburn Street
to the East curb line of Algona
Street, by grading said street to the
proper sub- grade, constructing con-
crete driveways and sidewalks, con-
crete curb where necessary, remov-
ing existing sidewalk and curb at
Algona Street and paving said street
with a concrete pavement six (6)
inches thick and thirty -one (31) feet
wide, or by paving with a three (3)
inch black or asphalt binder base,
and a two (2) inch Warrenite -Bitu-
lithic wearing surface with combina-
tion curb and gutter, to James Saul
& Son, having been approved and
placed on file for one week for pub-
lic inspection April 28th, 1930.

A resolution awarding contract for
the improving of Viola Street, from
the North property line of Eagle
Street to the North curb line of
Merz Street, by grading said street
to the proper sub - grade, clearing and
grubbing, constructing concrete side-
walks, twelve (12) inch drain across
Viola Street, at the North curb line
of Merz Street, combination curb
and gutter where necessary, catch
basins and by paving said street
with a concrete pavement six (6)
inches thick between the existing
concrete curb and gutter from Eagle
Street to Pleasant Street, and with
integral curb six (6) inches thick
and twenty -five (25) feet wide from
Pleasant Street to Merz Street, to
Uhlrich -Paley Co., having been ap-

hereby established and adopted as
shown by the Profile of said street
and Grade prepared by the City En-

Be it ordained by the City Council
of the City of Dubuque:
Par. 112. Section 1. That the al-
ley first westerly of Althauser Street
from Merz Street to Eagle Street be
and the same is hereby vacated.
Par. 113. Sec. 2. That the alley
hereby vacated be and the same is
hereby granted and conveyed to In-
dependent School District of Du-
buque, Iowa, the same to be used
and held by said district for public
school purposes.
Par. 114 Sec. 3. That the City
Clerk be and he is hereby directed
to certify a copy of this ordinance
to the County Recorder of Dubuque
County, Iowa, to be by him duly re-
corded as a part of the records of
said county.

alley be and the same is hereby es-
tablished from Merz Street to Eagle
Street lying between Althauser
Street and Riverview Street in
the City of Dubuque, Iowa, such
alley being shown upon the plat
hereto attached and made a part
hereof.
Par. 117. Sec. 2. That the City
Clerk be and he is hereby directed
to cause a certified copy of this or-
dinance to be filed with the County
Recorder of Dubuque County, Iowa,
to be by him duly recorded as a part
of the records of said County, to-
gether with a copy of the plat re-
ferred to.

Avenue, Long Beach, Calif., stating
that he did not receive the notice of
assessment for the improvement of
Ashton Street, owing to the fact
that he lives out of the City, there-
fore did not make payments when
due; he hereby asks that he be al-
lowed to pay the amounts past due
to date with interest and balance to
be paid on the installment plan.
Councilman Schuckert moved that
the prayer of the petition be granted
and the City Treasurer be instruct-
ed accordingly. Seconded by Council-

Attorney Herbert Hoffmann ad-
dressed the Council representing
Mrs. Chas. M. Miller stating that
Mrs. Miller purchased a lot on No-
wata Street with the intention of
building a home, and that she has
already had a garage constructed
there and she hereby asks that the
Council reconsider its action taken
at the last meeting whereby it voted
not to have Nowata Street improved
this year.
Councilman McEvoy moved that
the Council reconsider its action ta-
ken at a previous meeting whereby
it decided not to improve Nowata
Street this year. Seconded by Coun-
cilman Andelfinger. Carried by the
following vote:

Councilman McEvoy moved that
the matter of awarding a contract
for the improving of Nowata Street
be referred to the Council. Seconded
by Councilman Jansen. Carried by

Property owners on upper Central
Avenue from 22nd Street to 32nd
Street were then given a hearing.
Julius Sprengelmeyer was the first
one to speak; he stated that he rep-
resented the Specht interests and
that they objected to the improve-
ment of the street,at this time. Dave
Cameron objected to the improve-
ment because the property on the
west side of the street will not stand
the assessment, being hill side prop-
erty and worth very little. Jos. J.
Bertsch was the next speaker; he
stated that the street is in very bad
condition and ought to be improved,
but before. the City does anything in
the way of improving said street,
the water which pours over the
street after each rain should be ta-
ken care of first, which can be done
by constructing storm sewers in
Stoltz and Lemon Streets. Father
Wm. Weirich representing the Holy
Ghost parish also addressed the
Regular Session, May 5th, 1930 145
Council. He coincided with Mr.
Bertsch that the water be taken
care of first, and stated further that
the improving of the street at this
time would work a great hardship
on some of the residents of the north
end, as a great many have been out
of work all winter, and some are
still paying on the White Street im-
provement and advised that for these
reasons the work should not be done
at this time, and if the sewers will
be constructed this year, and with
the Brunswick factory now under a
new management, times will be bet-
ter next year and he thinks there
will not be many objections to the
improvement, because everybody
knows it is badly needed. Geo. Bock,
Adam Mueller et al. also spoke that
they were satisfied to have the street
improved next year and widened if
necessary. Mr. C. E. Dove of the
Interstate Power Co. also made a
short talk and stated that by next
year the power company will prob-
ably remove the rails from the street
and install bus service, but if the
City Council saw fit to improve the
street this year the Interstate Power
Co. will not stand in the way.
Councilman Schuckert moved that
the sewers be constructed to take
care of the water on Stoltz and
Lemon Streets. Seconded by Coun-
cilman McEvoy. Carried by the fol-
lowing vote:

Councilman Jansen moved that
the matter of paving Couler Avenue

stated that service thereof had been
duly made and that this meeting is
called for the purpose of consider-
ing bids for the sanitary and storm
sewers in the West Dubuque Sewer
District and acting on any other
business that may come before the
meeting.
Proof of publication, certified to
by the publisher, of notice to con-
tractors of the receipt of proposals
for the construction of sanitary and
storm sewers in the West Dubuque
Sewer District, presented and read.

Gentlemen:
In accordance with your instruc-
tions and our advertisement, bids
were received at 10 A. M. Friday,
May 9th, 1930, for the construction
of storm and sanitary sewers and
appurtenances in what is known as
the West Dubuque Sewer District as
delimited by Ordinance No. 3 -30.
I am attaching hereto a tabulation
sheet showing the unit prices and
total prices bid, and respectfully
recommend that the contract for the
construction of this sewer, using
Fairbanks -Morse pumps be awarded
to Uhlrich -Paley Company as their
bid is the lowest one received.

tary sewers in what is known as the
West Dubuque Sewer District as de-
limited by Ordinance No. 3 -30, to

Whereas, the Planning and Zon-
ing Commission of the City of Du-
buque, heretofore appointed by this
Council, has recommended the en-
tering into a contract with John
Nolen, City Planner of Cambridge,
Massachusetts, for the sum of
$10,000 covering the professional ser-
vices of himself, associates and as-
sistants in the preparation of a City
Plan and a Report for the City of
Dubuque; and
Whereas, this Council is commit-
ted to the preparation of a compre-
hensive City Plan and Report and
believes that the services of a com-
petent expert planner be engaged
for that purpose and, upon investi-
gation, feels that John Nolen is en-
tirely capable of performing the
work contemplated; and
Whereas, a contract has been duly
prepared providing for the engaging
of the services of said John Nolen:
Now Therefore, Be it resolved by
the City Council of the City of Du-
buque that a contract be entered in-
to by the City of Dubuque, through
its Council and John Nolen, the form
of said contract be hereto attached,
providing for the engaging of the
services of John Nolen, City Plan-
ner of Cambridge, Massachusetts, in
the preparation of a comprehensive
City Plan and Report for the sum of
$10,000 and such other incidental ex-
penses as provided for in said con-
tract.

THIS AGREEMENT, made this
19th day of May, 1930, by and be-
tween the City of Dubuque, Iowa,
party of the first part, and John
Nolen, City Planner, of Cambridge,
Massachusetts, party of the second
part,
Witnesseth :
1. The said John Nolen, party of
the second part, agrees to prepare
in two periods, according to the fol-
lowing schedule, the plans and re-
port constituting the City Plan for
the improvement and development
of Dubuque, Iowa.

First Period (1930)
(a) Field Survey.
(b) Charts •and diagrams of pertin-
ent facts.
(c) Existing conditions maps.
(d) Major streets and highways
plan.
(e) Street sections.
(f) Report of major streets and
highways.
(g) Progress report for 1930.
Second Period (1931)
(a) Public park and recreation sys-
tem plan.
(b) Public buildings and grounds
plan.
(c) Regional plan of area within five
miles of city limit.
(d) Zone plan.
(e) Zone ordinance.
(f) Regulations for land subdivis-
ion.
(g) Master plan.
(h) City plan report and follow -up
program.
2. The City of Dubuque, Iowa, par-
ty of the first part, agrees to pay the
said John Nolen, party of the sec-
ond part, the sum of Ten Thousand
Dollars ($10,000) for the profes-
sional services of himself, his assoc-
iates and his assistants in the pre-
paration of the City Plan and the
Report.
Payments are to be made as fol-
lows:
First Period (1930)
1. Retaining Fee — execution
of contract $1,000.00
2. Eight equal sums of $500
each, due on last day of
each month 4,000.00
$5,000.00
Second Period (1931)
1. Eight equal sums of $500
each, due on last day of
each month $4,000.00
2. Final payment on comple-
tion of work 1,000.00

Total $10,000.00
In addition to the sum for profes-
sional services named above, the
traveling expenses to and from Bos-
ton, hotel and other local expenses

of the said John Nolen, party of the
second part, his associates and as-
sistants, are to be paid by the party
of the first party,, staid expenses
shall not exceed the sum of $1,500
and payments therefore shall be
made monthly upon presentation of
vouchers.
It is understood that following the
approval of the preliminary plans by
the party of the first part, or its
agent, no major changes or revis-
ions shall be made except at the
direction of the party of the first
part and charges therefor shall be
at the regular rates of the office of
John Nolen, as shown by the sched-
ule hereto attached.
In addition to the payments of the
above sums of money, the City of
Dubuque, Iowa, party of the first
part, agrees to print from time to
time the reports and other publicity
matter, and when the schedule of
plans is completed, reproduce the
plans and print the report prepared
for the development of the city by
said John Nolen, party of the sec-
ond part, and to appropriate not to
exceed $1,500 for said purpose.
The existing topographical or ser-
ial surveys, maps, atlasses and other
local data which are necessary as a
basis for the city plans and subse-
quent work are to be at the disposal
of the said party of the second part,
and shall be without expense to said
second party.

Annual Report Civil Servica Com-
mission for Year Ending
March 31, 1930
The Civil Service Commission held
twenty -two meetings during the fis-
cal year ending March 31, 1930.
The first was held on April 1,
1930, and was for the purpose of
conducting entrance and promo-
tional examinations. Twenty -nine
men were examined for the Fire De-
partment and twenty -five for the
Police Department making a total of
fifty -four. Of those examined the
Commission certified to the City
Council an eligible list of ten names
for the Fire Department and six for
the Police Department as required
by law. Twenty -two men were exam-
ined for promotion on the Fire De-
partment and four for the Police De-
partment. Of those examined the
Commission certified to the City
Council an Eligible list of twenty
for promotion on the Fire Depart-
ment and four for the Police Depart-
ment. From these eligible lists, the
City Manager made two permanent
appointments to the Fire Depart-
ment and one to the Police Depart-
ment. There were two permanent
promotions made on the Fire De-
partment and one on the Police De-
partment.
Examinations for entrance to the
Fire and Police Departments con-
sist of mental and physical tests.
The mental tests are written and
comprise the following subjects:
Arithmetic, spelling, an examination
on duties which consists of general
knowledge of the city, questions on
judgment and civil government. Al-
so an intelligence test which pro-
motes alertness and general mental
efficiency. Applicants passing these
tests are then subjected to a phys-
ical examination by the physician
in charge of the Health Department.
Promotional examinations are held
annually in both Fire and Police De-
partments in writing. They com-
prise questions relating to duties
performed within the Departments.
Seniority and efficiency are given
consideration in the ratings.
New Manuals for use by members
of the Fire and Police Departments
were prepared and distributed.

Robinson Street from the west prop-
erty line of Bluff Street westerly
about two hundred and ten (210)
feet, Uhlrich -Paley Company, con-
tractors, has been completed.
I further certify that this work
has been done in accordance with
the plans and specifications and
stipulations of the contract and I
would therefore recommend, its ac-
ceptance by the Council.

cepting improvement and direct-
ing the Clerk to publish notice.
Whereas, the contract for the pav-
ing of Robinson Street from the
west property line of Bluff Street
westerly about two hundred and ten
(210) feet has been completed and
the City Manager has examined the
work and filed his certificate stating
that the same has been completed
according to the terms of the con-
tract, plans and specifications and
recommends its acceptance, now
therefore
Be It Resolved by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Man-
ager be approved and that said im-
provement be and the same is here-
by accepted and the City Engineer
be and he is hereby directed to pre-
pare a plat and schedule showing
the lots or parcels of real estate sub-
ject to assessment for said improve-
ment and file the same in the office
of the City Clerk subject to public
inspection and said Clerk shall up-
on receipt of such plat and sched-
ule publish the notice of the Coun-
cil's intention to levy special assess-
ments therefor, as required by law.
Be It Further Resolved that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is-
sued upon the above described im-
provement an amount equal to the

Dear Sir: At the Council meet-
ing held April 7th, 1930, Attorney
Kerz appeared before the Council
in behalf of Mrs. Ed. Milligan, own-
ers of lot 8 and the west 15 feet of
lot 7 Yates' Subdivision, requesting
that the assessments for the im-
provement of West 17th Street and
Catherine Street and for sewer, wat-
er and gas connections be reduced,
also requesting the Council to view
the grounds.
This is to advise that the Council
did view the grounds on May. 17th
and decided to make no further re-
duction.
The original assessment for the
paving of the above mentioned street
was $249.66 for lot 8 which was lat-
er reduced by the Council to $87.25.
For the west 15 feet of lot 7, the
original assessment was $83.21 which
was later reduced to $37.41 by the
Council. The assessment for lot 8
for sewer and water connections is
$120.76.
It is the Council's opinion that
the total assessments for paving,
sewer and water connections on the
above mentioned property should not
exceed a fatal of $175.00. Will you,
therefore, submit the following re-
ductions to the Council for their final
approval and adoption.

Councilman Jansen moved that
prayers of the petitioners be granted,
and all previous action taken by the
Council on the improvement of Wood
changed in order that their respec-
tive property and the improvements
thereon may be preserved and not
disturbed and the expense of con-
nection with said proposed sewer be
lessened; now therefore:
The undersigned, being the owners
of all of the lots above described
hereby petition the City Council of
the City of Dubuque to change the
location of said sewer to the rear
of said lots for which location the
undersigned have granted a perman-
ent easement to said City of Du-
buque, and, in consideration of the
re- location of said sewer, as hereby
requested, the undersigned hereby
expressly waive any objection which
we may have because said sewer will
be constructed as herein requested
rather than as proposed and shown
upon the plans and specifications and
preliminary proceedings therefore
and we do expressly waive any ob-
jection which we may have because
n o preliminary proceedings were
taken by the Council providing for
the construction of the sewer at the
place herein requested and we con-
sent that the City Council may award
a contract under its advertisement
for bids and we agree to be bound
thereby and will not object to the
entering into of such a contract by
said City for any reason whatsoever.
We further agree, in consideration
of the granting of this petition and
the benefits which will come to our
respecitve property thereby, to pay
the assessments which may be lev-
ied against our property on account
of the construction of said sewer
without objection thereto in the same
manner as if said sewer had been
constructed under proper proceed-
ings taken therefore, the intention
hereby being to request the re -loca-
tion of the sewer heretofore pro-
posed and waive any objection there-
to and to agree to pay our respec-
tive assessments under the same
terms and conditions as if said sew-
er were built in its original location.

of the first part, (hereinafter some-
times called "Company "), and the
City of Dubuque, State of Iowa, party
of the second part hereinafter some-
times called "City ").
WITNESSETH
THAT, WHEREAS, the Company
owns Lot One (1) of Block Fifteen
(15) of Dubuque Harbor Improve-

a properly executed release of said
Lot from the lien of said First Mort-
gage and Deed of Trust and shall
hold the same in safe keeping for
delivery to the City at the closing of
the sale of Lots herein provided for.
4. That when the City has, by its
Governing Body, taken the actions
provided for in Section 2 hereof, it
will furnish to the Company certi-
fied copy of all proceedings evidenc-
ing the taking of such actions by it.
5. That when the documents have
been executed and exhibited and fur-
nished by each of the parties hereto
to the other, respectively, as pro-
vided in Sections 3 and 4 hereof,
the parties hereto shall mutually
agree upon a date and place in the
City of Dubuque, Iowa, for the dos-
ing of the sale hereby contemplated
at which time
(a) The Company will deliver to
the City a Warranty Deed, properly
executed and acknowledged by it,
covering said Lot One (1) of Block
Fifteen (15), in accordance with Sec-
tion 1 hereof; and
(b) The City will deliver to the
Company a properly executed War-
ranty Deed covering the parcel of
land described in Subdivision (c)
of Section 2 hereof, as provided in
Section 2 hereof.
6. That the simultaneous accept-
ance by each of the parties hereto
of the Warranty Deed of the other
party hereto as herein provided, shall
be a full and complete consideration
for the execution and delivery of its
own Warranty Deed.

Gentlemen: There are two appeals
from special assessments pending
the District Court of Dubuque
County, Iowa, in which the Voelker
Investors Corporation are appellants
and these cases are set for trial for
the present term of Court.

I beg to advise your Honorable
Body that, subject to your approval
I have agreed upon a disposition of
these cases.
The first case involves an appeal
from special assessment levied
against lot 22 in High Street Subdi-
vision November 22, 1929, for the
construction of a cement sidewalk
in the sum of $104.28 with reference
to this case I have agreed to accept
in full of payment of said assessment
the sum of $50.00 and to cancel the
remaining portion of said assessment
amounting to $54.28.
With reference to the other suit
the following assessments are in-
volved: (a) the sum of $191.40 for
the improvement of Johnson Avenue
levied on November 5th, 1928; (b)
the construction of a driveway in
the sum of $18.02; (c) the construc-
tion of a down spout drain, amount-
ing to $18.69; (d) an assessment
against lot 23, High Street Subdi-
vision in the sum of $97.34.
With reference to this case I have
agreed to accept the payment of the
assessment of $191.40 against lot No.
22 without interest in full of assess-
ment; to cancel the assessment of
$18.02 levied against said lot 22 for
the construction of a driveway. To
accept $18.69 without interest levied
against lot No. 22 for the construc-
tion of a down spout drain and to
accept the full amount of assessment
for the improvement of Johnson Ave-
nue, against lot No. 21 with accrued
interest thereon.
If this arrangement is satisfactory
to your Honorable Body the appel-
lant will dismiss its appeal and pay
the costs.
I respectfully recommend the ac-
ceptance of the various settlements
herein referred to.

advise that we hereby desire to raise

ment Company's Addition in the City
of Dubuque, Iowa, which lot is ap-
proximately twenty -five feet in a
generally east and west direction
and approximately 113 feet in a gen-
erally north and south direction and
is bounded on the east side there-
of by Pine Street;
AND, WHEREAS, the Company
owns Lot Eighteen (18) of Bloc
Fourteen (14) of Dubuque Harbor
Improvement Company's Addition in
the City of Dubuque on said Pine
Street which lot is immediately op-
posite and is of the same size as
said Lot One (1) of Block Fifteen
(15), and other land adjoining said
Lot Eighteen (18) upon which is
located its electric generating plant
and appurtenances thereof, and de-
sires to sell to the City said Lot One
(1), Block Fifteen (15) in considera-
tion of the City selling to it, the
Company, a tract of land of the same
size and shape as said Lot One (1),
now forming a part of said Pine
Street, abutting on the West side of
said Lot Eighteen (18) of Block
Fourteen (14);
AND, WHEREAS, the City owns
the fee of all of that portion of Pine
Street that the Company desires to
be conveyed to it, :.subject to its use
by the public as a duly dedicated
street, and is willing to convey the
same to the Company as aforesaid.
NOW, THEREFORE, it is hereby
agreed by and between the parties
hereto as follows:
1. That the Company shall take
immediate steps to release said Lot
One (1), Block Fifteen (15) from the
lien of its certain First Mortgage
and Deed of Trust dated January 1,
1927, to The Chase National Bank
of the City of New York and George
A. Kinney, as Trustees, which Mort-
gage was thereafter and on May 4,
1927, duly recorded in the office of
the County Recorder of Dubuque
County, Iowa, in Block 2 of Special
Records, page 1, whereupon the fee
simple title to said Lot One (1)
will vest in the Company free and
clear of all liens and encumbrances.
2. That the City will duly take
the following action by its Governing
Body:
(a) To repeal a recent resolution
or Ordinance adopted by it for the
raving of that portion of Pine Street
lying between the Northerly side of
Seventh Street and the 'Southerly
side of Eighth Street;
(b) To vacate that portion of Pine
Street, described in Subdivision (a)
of this Section 2, so that the same
cannot thereafter be used by the
Public as a street or public highway.
(c) To authorize the execution
and delivery, pursuant to the terms
of this agreement, to the Company
of a proper Warranty Deed cover-
ing parcel of land hereinabove re-
ferred to and herein -after more
specifically described, in considera-
tion of the Company executing and
delivering to the City of a proper
Warranty Deed covering said Lot
Gne (1) of Block Fifteen (15), to-
it:
That certain piece or parcel of
land situate, lying and being in the
City of Dubuque, County of Dubuque
and State of Iowa, more particularly
described as follows:
Commencing at the Northwest cor-
ner of Lot Eighteen (18), Block
Fourteen (14) of said Dubuque Har-
bor Improvement Company's Addi-
tion in the City of Dubuque and run-
ning thence in a straight line, in a
generally Southwest direction, on the
South line of Eighth Street extended
across Pine Street a distance of
twenty -five feet; thence in a straight
line in a generally Southeastern di-
rection parallel with the West side
of said Lot Eighteen (18), Block
Fourteen (14), a distance of one hun-
dred and thirteen (113) feet to a
point on an imaginary straight line
across Pine Street from the South -
west corner of said Lot Eighteen
(18), Block Fourteen (14), to the
the Southeast corner of Lot One (1),
Block Fifteen 15) of Dubuque Har-
bor Improvement Company's Addi-
tion in the City of Dubuque, twenty -
five feet in a generally Southwest
direction from the Southwest corner
of said Lot Eighteen (18), Block
Fourteen (14); thence in a straight
line, in a generally Northeastern di-
r ection, twenty -five feet to the South-
west corner of said Lot Eighteen
(18), Block Fourteen (14); thence in
a generally Northwest direction
along the West boundary line of said
Lot Eighteen (18), Block Fourteen
(14) to the point of beginning. Said
parcel being a strip of land twenty -
five feet wide in Pine Street adjoin-
ing the West line of said Lot Eigh-
teen (18), Block Fourteen (14),
That after the governing body of
the City has taken the actions here -
inabove recited, said City will own
said parcel of land described in Sub-
division (c) of Section 2 hereof, in
fee simple free and clear of all liens,
encumbrances, easements, rights of
user as a street or public highway
and will have due and proper author-
ity for the sale of the same to the
Company as herein provided.
3. That when the Company has
procured the release of said Lot
One (1), Block Fifteen (15) from the
lien of said First Mortgage and Deed
of Trust, as provided in Section 1,
hereof, it shall exhibit to the City

our offer $200 making the sum $500,
the same to be in full, and we would
also agree to let the City use what-
ever may be necessary of the west-
erly portion of lots 4, 5 and 6 in Con -
nolly's Subdivision, for the purpose
of constructing a storm sewer there-
on, which storm sewer would be for
the benefit of this property and also
whatever other property might be
tributary to the same water shed.

Councilman Jansen moved that the
City accept the $500 in settlement, as
offered and recommended by the City
Solicitor. Seconded by Councilman
Schuckert. Carried by the following
vote:

Andelfinger, Jansen, McEvoy, and
Schuckert.
Nays —None.
City Solicitor Czizek reported that
in negotiating with Elizabeth Corp -
stein, Rose Voelker, et al, for a
right of way across lots 138 and 139
in Mechanic's Addition, of the City
of Dubuque, they offered him a quit
claim deed to lot 138 and the easter-
ly forty -four feet of lot 139 in said
addition, for the sum of $50.00 and
that he accepted it.
Councilman Schuckert moved that
the action of the City Solicitor be
approved and the deed be accepted
and recorded and a warrant be
drawn on the Consolidated fund in
the amount of $50.00 to pay for said
lots. Seconded by Councilman Mc-
Evoy. Carried by the following vote:
Yeas —Mayor Meuser, Councilmen
Andelfinger, Jansen, McEvoy, and
Schuckert.
Nays —None.
Councilman Jansen moved that the
Council accept the invitation to take
part in the Memorial Day parade.
Seconded by Councilman McEvoy.
Carried by the following vote:

Schuckert.
