Regular Session, October 6th, 1930.
Council .met at 7:30 P. M.
Present -City Manager Evans,
Mayor Meuser, Councilmen Andel-
finger, Jansen, McEvoy, Schuckert.
Absent -None.
Mayor Meuser stated that this is
the regular monthly meeting of the
City Council, for the purpose of act-
ing on any business that may regu-
larly come before the meeting.
Petition of Mrs. Berthalda Whit -
beck referred to the Council by the
Board of Supervisors, asking that the
1929 and 1930 valuation on the north
11 in. of the north 26.5 feet of City
lot 239 and south 22 feet on City lot
240 be reduced from $4600.00 to
$3000.00.
Councilman Schuckert moved that
the petition be referred back to the
Board of Supervisors as the Council
has no jurisdiction, this is a matter
for the Board of Review. Seconded
by Councilman Jansen. Carried by
the following vote:

Schuckert.
Nays-None.
Petition of Ann Enright referred to
the Council by the Board of Super-
visors, asking that the 1929 regular
tax and all back special tax be can-
celled. Councilman Schuckert moved
that the 1929 regular tax on lot 48
and the west 10 feet of lot 47 Union
Add, be suspended and that part of
the petition asking that all back
special tax on said property be can-
celled, be denied, and the Board of
Supervisors be informed of the Coun-
cil's action. Seconded by Council-
man Jansen. Carried by the fol-
lowing vote:

Communication from the Sisters of
the Good Shepherd, thanking the
Council for the use of the Athletic
Field, free of charge, for the two

a storm water sewer in Shiras Ave-

Resolution No. 3261/2
Be It Resolved By The City Coun-
cil Of The City Of Dubuque that pur-
suant to a resolution of necessity
No. 327 -30 which was duly passed
by this Council, for the construction
of a storm water sewer in and along
Shiras Avenue, Lincoln Avenue and
in the alley between Rhomberg Ave-
nue and Lincoln Avenue, be and the
same are hereby ordered and con-
structed by this Council upon its own
motion and with or without the peti-
tion of property owners. All the
work shall be constructed in accor-
dance with the plans and specifica-
tions heretofore adopted and now on
file in the office of the City Clerk.
Be It Further Resolved that the
Cost and expense of the said im-
provements be paid for by levying
special assessments against the pri-
vately owned property lying within
the assessable distance from the im-
provements, whether such property
abut upon the same or are adjacent
thereto, according to the area thereof
and in proportion to the special ben-
efits conferred, and any deficiency
will be paid out of the general, im-
provement, or sewer funds of the
city, or partly from each of such
funds. Payment will be made to the
contractor out of funds realized from
the sale of bonds or with
to be issued in anticipation
of deferred payments of assessments
as provided by law after the work
has been completed and accepted by
the City Council.
Be It Further Resolved that the
City Clerk be and he is hereby or
dered and directed to advertise for
proposals for the construction of the
various improvements herein proJ-
vided for in the manner provided by
law, and said improvements shall be
completed on or before the 1st day of
March, 1931.
Be It Further Resolved that this
resolution being deemed urgent and
of immediate necessity shall be in
force and effect from and after its
passage and adoption by the City
Council.

Communication from the Healtl•
Department, stating that numerous
complaints have been received by
the Board of Health of the unwhole-
some odors arising from rabbitries in
the city, and they suggest that regu-
lations be drafted by the City to en-
able the Health Department to abate
the nuisance.
Councilman Jansen moved that
the communication be referred to
the City Solicitor and he be instruct-
ed to draft regulations prohibiting

Resolution No. 327 -30
Whereas the construction of a
storm sewer in Shiras Avenue, Lin-
coln Avenue and the alley between
Rhomberg Avenue and Lincoln Ave-
nue is deemed necessary and advis-
able by the City Council of the City
of Dubuque: Now Therefore,
Be it Resolved by said Council
that a storm sewer be and the same
is hereby ordered constructed and
put in place in Shiras Avenue, Lin -
coln Avenue and the alley between
Rhomberg Avenue and Lincoln Ave-
nue, the same to consist of the ma-
terials and to be built in the manner
provided for in the plans and speci-
fications heretofore prepared by the
Manager and Engineer and which
are now on file in the office of the
City Clerk for public inspection.
Be it further Resolved that the
City Clerk be and he is hereby di-
rected to publish all necessary no-
tices in the official newspaper of said
City preliminary to the awarding of a
contract for such public improvement
and to advertise for bids for the do-
ing of all work and the furnishing of
all materials required by the plans
and specifications referred to, all
work to be completed not later than
the 1st day of March, 1931, unless
time for completion be extended by
proper action of this Council.
Be it further Resolved that the
cost of such improvement be paid to
the Contractor in cash upon com-
pletion and final acceptance, from
funds available for such purpose.
This Resolution being deemed ur-
gent and of immediate necessity it
shall be in force and effect from and
after its passage, adoption, and ap-
proval by the City Council.

Gentlemen:
The undersigned hereby certifies_
that the contract for the installation
of twenty -three (23) single light
boulevard standards, including cable,
relaying cement sidewalk, switches
and furnishing all appurtenances
necessary for a complete installation
on Central Avenue from Eighteenth
Street to East Twenty- second Street,
Geo. W. Kennelly Electric Company,
contractors, has been completed.
I further certify that this work has
been done in accordance with the
plans and specifications and stipula-
tions of the contract and I woulu
therefore recommend its acceptance
by the Council.

Whereas, the contract for the in-
stallation of 23 single light boulevard
standards including cable, relaying
cement sidewalks, switches and fur-
nishing all appurtenances necessary
for a complete installation on Cen-
tral Avenue from Eighteenth Street
to East Twenty - Second Street, has
been completed and the City Mana-
ger has examined the work and filed
his certificate stating that the same
has been completed according to the
terms of the contract, plans and spe-
cifications and recommends its ac-
ceptance, now therefore,
Be It Resolved, by the City Coun-
cil of the City of Dubuque, that the
recommendation of the City Mana-
ger be approved and that said im-
provement be and the same is hereby
accepted and the City Engineer be
and he is hereby directed to prepare
a plat and schedule showing the lots
or parcels of real estate subject to
assessment for said improvement
and file the same in the office of the
City Clerk subject to public inspec-
tion and said Clerk shall upon re-
ceipt of such plat and schedule pub-
lish the notice of the Council's inten-

tion to levy special assessments
therefor, as required by law.
Be It Further Resolved, that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of improvement bonds is •
sued upon the above described im-
provement in amount equal to the
amount of his contract, less any re-
tained percentage provided for there-
in.

City Solicitor Czizek reported on
the case of Mrs. Ethel Loper, who
brought suit against the City in the
sum of $10,000 for personal injuries
received in a fall on an icy sidewalk
on West 5th Street back of the A. A.
Cooper property, stating that he
could probably settle this claim for
$1100 or $1.200.
Councilman McEvoy moved that
the claimant be allowed $1250.00 and
a warrant be drawn in this amount
in favor of Attorneys L. E. Taylor
and John Knoll, attorneys for Ethel
Loper, settlement in full of her
claim. Seconded by Councilman Jan-
sen. Carried by the following vote:

the street light at the foot of the
steps leading to Montrose Terrace,
situated between 14th and 15th Sts.,
be removed and the candlepower of
the light situated at the center of the
steps be increased. Seconded by

Petition of property owners refer-
red to the City Manager and Engin-

McCormick Street be improved from

the petition be referred to the Coun-
cil to be placed on the next years
paving program. Seconded by Coun-
cilman Schuckert. Carried by the

Petition of property owners on
Walsh Street asking that the name
of said street be changed to Parkway
Street, referred to City Manager at a

the prayer of the petition be granted
and the proper Ordinance be drafted
making such change. Seconded by
Councilman Jansen. Carried by the
following vote:

City Manager Evans made the fol-
lowing recommendations concerning
lights:
That a light be installed on West
2rd Street at the angle in the street
between James Street and Hill
Street;
A light be installed on Langworthy
Avenue, midway between James and
Hill Streets;
A light be installed at the intersec-
tion of Cottage Place and Woodward
i
Street
A light be installed on South
Grandview Avenue between Ply-
mouth Street and Southern Avenue;
The light on Grandview Avenue at
Cascade Road be moved to the north
to equalize the light;
That the two lights at the exten-
tion of South Locust Street be re-
moved and signs be placed at both
ends of said Street, to read "Danger-
ous, Keep Out."
Councilman Andelfinger moved
that the recommendation of the Man-
ager be approved ajad carried out as

that the matter of the Main Street
Merchants relative to the City plac-
ing four signs, directing tourists on
Highway No. 20 to the Main Street
Business district, be referred back to
the Council. Seconded by Council-
man McEvoy. Carried by the follow-

Petition of L. 0. Hillyard asking
permission to narrow the sidewalk
in front of his place of business on
Jones Street; prayer of petition de-

The State Highway Commission
offered to maintain the Rockdale
Road paving, being Highway No. 61
from Grandview Avenue westerly to
the City limits.
Councilman McEvoy moved that
the offer be accepted. Seconded by
Councilman Schuckert. Carried by
the following vote:

Councilman Andelfinger moved
that the rules be suspended to allow
any one present who wishes to do
so, to address the Council. Mr. Chris.
Riedi addressed the Council rela-
tive to the petition presented to the
C:ouncil at a previous meeting asking
that a Sanitary sewer be installed
in Burlington, Davenport and Musca-
tine Streets, stating that 20 of the
property owners out of 23 have sign -
ea the petition that the residents liv-
ing in this district want the sewer
and if the sewer is constructed there
will be more residences constructed
Councilman Schuckert moved that
the prayer of the petition be granted
and the Engineer be instructed to
prepare plans and specifications for
same. Seconded by Councilman Mc-
Evoy. Carried by the following vote:

the transfer of $15,000 from the Gen-

Gentlemen:'
The writer's attention was called
yesterday to a complaint in street
lighting facilities on Lowell Street
between Main Street and Foye Street.
We find that the distance between
these two streets on Lowell Street
is approximately 1450 feet. There
is at present a 600 C. P. light at the
intersection of Main and Lowell and
Foye and Lowell. There is also one
600 C. P. light about 400 feet north-
westerly from the angle in Lowell
Street which angle is approximately
250 feet west of Main Street. Where
Paul Street and Rosalind Street in-
tersects with Lowell Street there are
no street lights.
The writer would suggest authority
to have the present light 400 feet
from the angle of the street moved
about two pole lengths toward Main
Street which would afford light near
the angle in Lowell Street and would
also recommend the installation of a
new street lamp at or near the inter-
section. of Lowell and Paul Streets.
This would correct the present 700
or 800 foot stretch without lights
from Foye Street eastwardly.

ager be approved and that said im-

seventy (70) feet westerly, by grad-
ing said streets to the proper sub -
grade, constructing concrete side-
walks, roof drains, deep concrete
curb, catch basins, and by paving
Foye Street with a concrete pave-
ment seventeen (17) feet wide and
six (6) inches thick or by resetting
and replacing old stone curb where
necessary if contract is awarded on
this baths, and by paving Napier
Street, seventy (70) feet westerly
with eighteen foot (18) concave sec-
tion six 6) inches thick, has been
completed and the City Manager has

of $1.00 in hand paid by the City
of Dubuque, Iowa, a municipal corp-
oration, the receipt thereof is hereby

Davis Farm Addition in the City of
Dubuque hereby grants and conveys
to said city of Dubuque a perpetual
right of easement in, over and across
said north 1 /2 of lot 256 Davis Farm

sewer with the right to go upon said
premises at all reasonable times for

pairing the same when installed, pro-

Attorney Kretz addressed the
Council representing C. L. , Sheffield
protesting against the assessment as
levied against his property for the
improvement of Plymouth Street,
claiming that the assessment is in
excess of 25% of the valuation of the
property and he hereby asks the
Council to make a reasonable reduc-
tion.

Claim.

the City Manager be hereby instruct-
ed to interview Robert Marshall,

former. Yet, with the city's finances
low, your honorable body proposes
to throw away the difference to use
clay. A concrete sewer is more ad-
visable from an engineering stand-
point. Personal likes or dislike,
should not influence the selection of
a material.
"Concrete construction means a
healthy contribution on the part of
the city to help needy workmen in
larger numbers and at a greatly in-
creased payroll. Dubuque merchants
will sell the lumber, sand, stone,
steel and cement that will go into
the sewer. Use of clay blocks means
that Dubuque merchants will sell no-
thing. The block will be purchased
outside of Dubuque, made by outside
labor and the profits will go to out-
side people. The cost of segment
block alone will be approximately 75
per cent of the entire contract.
"As taxpayers, we feel that the
City of Dubuque should be glad to
give all available help, as other cities
are doing, rather than use a product
that means a minimum of labor and
no local materials. We, therefore,
petition your honorable body to re-
consider your action.
"Before making a final award of
the contract, we further call upon
you to submit the entire matter to
the budget director of the state of
Iowa, who is vested with authority
to regulate the expenditure of pub-
lic authority to regulate the expen-
diture of public funds in the inter-
ests of the taxpayers."

had bid on the Shiras Avenue sewer
project in competition with the Uhl-
rich -Paley Company.
"The City Engineer's estimate for
Special Session, October 27th, 1930

both segment block and concrete
construction of this sewer was $19, -
000," he said. "No distinction was
made between the two materials by
the estimator. Either one was deem-
ed suitable for the project.
"The purpose of competitive bid-
ding is to prevent fraud and collu-
sion. The Dickey Clay Manufacturing
Company had a representative here
to advise bidders on quotations for
segment block. This representative
gave Saul a quotation of $11.31 a
cubic foot; Conlon, $11.31; Lee
$10.84, and also told Lee he was giv-
ing Uhlrich the same quotation.
Whether he did or not, we do not
know, but we do know that he gave
different quotations to two contract-
ors.
"The council asks bidding on com-
petitive basis. Bidding on segment
block was confro,ied by a single
firm, which gave the quotations. A
total of 1,140 feet of sewer is to be
laid. They gave Lee and Uhlrich a
price 47 cents lower a cubic foot
than they gave Saul and Conlon.
Take 1,140 feet at 47 cents and it
amounts to $535.80 on the job in fav-
or of Lee and Uhlrich and gave them
an advantage over the other two bid-
ders, Saul and Conlon. Now, I main-
tain 47 cents a foot is a fair profit.
"Is the price too high? If you had
fair, competitive prices you might
shave down the cost. You ought not
to pass this contract without invest-
igating.
"In this situation, one firm con-
trolling the material to be used, can
put the price of this material so high
on one contractor and so low on an-
other that others can't make a fair
bid.
"The council will be remiss in its
duty if it does not investigate, re-
advertise for bids and give all con-
tractors an even chance to bid for
the work. In all bidding, contract-
ors must display ingenuity to obtain
contracts when the competitive bid-
ding is on an even basis. But, it
one contractor has to pay 47 cents
more a cubic foot for matrials than
others, he is at a disadvantage. If
this practice is permitted, you might
as well throw competitive bids in the
ash can.
"You gentlemen owe the taxpayers
a duty. You should investigate what
kind of a combine clay products
firms may have; you should abandon
all proceedings so far, re- advertise
for bids and give all contractors a
square deal.
"You should not take any action
until you have made a thorough in-
vestigation. If what you find isn't
as clean as a hound's tooth, throw

Mayor Meuser read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of awarding
the contract for the construction of a
storm water sewer in Shiras Avenue,
Lincoln Avenue, and in the alley be-
tween Lincoln Avenue and Rhomberg
Avenue, and acting on any other
business that may come before the
meeting.
Resolution No. 330 -30 awarding
contract for the construction of a
storm water sewer in Shiras Avenue,
Lincoln Avenue and the alley be-
tween Lincoln Avenue and Rhom-
berg Avenue, to Uhlrich Paley Co.,
for segment block construction; hav-
ing been approved and on file for one
week for public inspection, presented
and read.
A remonstrance filed by competi-
tive bidders objecting to the award
of any contract for segment block,
on Shiras Avenue sewer project, for
the reason that and open competitive
bidding has not been obtained. The
only concern quoting prices on seg-
ment block failed to give a uniform
price to all bidders thereby denying
the right to bid on an equal basis.
They therefore wish to go on rec-
ord as opposing the award of this
contract on the present bidding.

awarding the contract for the Shiras

"In these trying days, with na-
tional, state and civic authorities
striving to relieve suffering and
hardships following in the wake of
unemployment, R is incumbent up-
on the City Council of Dubuque to
do its small part. Within the past
few days the press has carried the
announcement that the city must
curtail expenditures to keep within
the budget. There was a difference
of $1,836 between the concrete and
clay product bids in favor of the

the whole matter out and start
anew."
J. D. Cook, salesmanager of the
Dickey Clay Mfg. Co., replied to Mr.
Gilloon:
"This man (Gilloon) accuses us of
discriminating in the matter of quo
tations on segment blocks," he said.
"The fact of the matter is, we gave
Lee as low a price as was made to
anybody else. However, he did not
see fit to use it.
"The Uhlrich -Paley account is a
valuable one with our company. We
sell them much material. Some of
our accounts are better than others
and they justify better quotations.
We believe that it rests with our
own judgement to quote certain
prices to certain contractors. I be-
lieve any fair- minded person will
bear me out in that. Linehan and
Melo have been dealers in our prod-
ucts here for 20 years and we are
giving them a chance to profit on all
materials we sell here.
"As for competitive bidding, we
did not bid on this project. The con-
tractors did the bidding. We did
not make up their figures. Six other
companies are making segment
block all equal in quality to the
Dickey Company's. It is no fault of
ours that they did not come to Du-
buque and quote prices."
"The Uhlrich -Paley Company has
decided to dispense with ditch -dig-
ging machinery on this sewer pro-
ject. It will all be done by hand
labor. They will pay a minimum
price of 40 cents an hour to common
labor and more to skilled labor.
Cook insisted that segment block
is more durable than concrete, es-
pecially well burned, vitrified and
salt glazed block, which, he claims,
is not affected by gases or acids.
Again touching on the subject of
competitive bidding and price quota-
tions, Cook inquired as to why
crushed stone has been quoted at
$1.40 a ton in Dubuque and at 85
cents in East Dubuque.
Mr. Paul Braun, another Dubuque
contractor, addressed the Council in
favor of segment block construction.
In his argument, Braun said that
he is probably more interested in the
sewer than any other person, as it
runs along his property. He said
that if a concrete sewer were built,
an extremely narrow sidewalk would
run along Shiras Avenue and that all
trees would have to be removed from
one side of what he termed as "one
of the most beautiful streets in the
city ", one leading to Eagle Poin:,
Park. With a segment block sewer.
he said, the trees would not be de-
stroyed and there would be a four -
foot sidewalk on Shiras Avenue.
The motion having been made and
seconded, awarding the contract for
the Shiras Avenue storm sewer pro -
ject to Uhlrich -Paley Co., for seg-
ment block construction, the question
was then put and the vote resulted
as follows:

The vote being 3 to 2 in favor of
Uhlrich -Paley Co. and segment block
construction.
"I desire to explain my position,"
Mayor Meuser said. "When we ad-
vertised for bids for this sewer, we
called for them on two materials,
segment block and concrete. No dis-
tinction was made between the two.
The fact that we advertised on bids
for two materials and secured the
lowest bid on concrete, leads me to
l;elieve that the low bidder on con-
crete should have been given the
contract. I believe the City Manager
recommended that the Council award
the contract to the low bidder on
concrete, whose bid was lower than
the low bid on segment block. 1
believe if we would re-advertise for
bids we might get better price on
both materials."
"My position is the same as it was
at last Monday night's Council meet-
ing," Councilman McEvoy said.
"When I voted 'aye' on the third
motion to award the segment block
contract it was to have harmony in
the Council. I could not see why the
Council should pay $1,836 more for
segment block than concrete, espe-
cially at this time, when there is
so much unemployment. I still feel
the same way about it."
Attorney Gilloon addressed the
Council representing Even and Kolb,
asking permission to replace the gas
filling pump between 9th and 10th
Streets on Central Avenue with a
new pump.
Councilman McEvoy moved that
the prayer of the petition be granted.

eight residents of Green Street west
of Asbury and presented to the City
Council October 20th, please be ad-
vised that your officials have viewed
the street and in consideration of the
requests contained in said petition
Lave advised the petitioners that we
will extend the water line down to
the west end of the street which in-
cludes about 500 feet of six inch
water line, serving four possible cus-
tomers, and will also roughly grade
Green Street the entire distance from
Asbury Street. The grading proced-
ure will not be difficult and will in-
clude crowning the roadway and pro -
iding ditches on both sides.
We have decided to immediately
start on tl:e construction of the wa-
ter line in order to safeguard against
freezing weather during construc-
tion.

Gentlemen: The , attached petit-
ion of residents on Wood Street
dated October 18th requesting that
a street light be installed at the in-
tercetion of Fourteenth and Wood
Streets was addressed to the writer
and received October 22nd.
We have made an examination of
the lighting facilities on Fourteenth
Street and find that there is a pres-
ent arc light at Fourteenth and Mt.
Pleasant, also at Fourteenth and
Nowata. On Fourteenth there is a
strip of approximately 700 feet with-
out a light, eastern half being
heavily treed. On Wood Street to-
ward the, north there is a strip about
500 feet before the first street light
and towards the South about 300
feet. Accordingly it would seem ad-
visable to have a street light placed
at the intersection of Fourteenth
and the new paving on Wood Street.

The writer has gone over the
ground with Mr. Sheffield and Mr.
Cullen, the City Engineer, today and
Mr. Sheffield makes the statement
that he does not challenge the en-
gineering calculations or the method
of levying the assessments, which
method is in strict compliance with
the sense of the resolution and in
accordance with the Somer's System
of levying assessments. Mr. Shef-
field claims that for slightly more
frontage on the street than his neigh-
bors, Messrs. Molo and Stampfer,
that he was assessed more in pro-
portion than they were. This dif-
ference was explained to him by Mr.
Cullen in regard to the area basis
for levying assessments.
We find that the total frontage of
property owned by Mr. Sheffield is
144 feet, against which was levied a
total of $1,255.03, while against Mr.
H. E. Molo, with a frontage of 7S
feet, a total of $449.79 was levied and
against Mr. J. F. Stampfer, with a
frontage of 99 feet, a total assess-
ment of $682.57.
While the frontage on Plymouth
Street of these portions of five lots
is 144 feet, the lot lines radiate in
such a way that at the approximate
fifty foot setback line from the prop-
erty line, which is the building line
of said street, it would be possible
to secure three lots at the fifty foot
setback line, each eighty feet in
width and the lot width in the rear
would be considerably in excess of
eighty feet.
With this in mind and also due to
the fact that the lots are up to street
grade and are capable of being de-
veloped for residential use, the writ-
er can see no real reason for recom-
mending any reduction in the assess-
ment.

Gentlemen:
The petition dated October 9th
from the Dubuque Realty Company
that either their assessment of
$128.95 be rebated or a recently con-
structed White Way lamp which was
removed in August 1930 be placed on
Eighth Street near Iowa, has been
investigated.
We find that the assessment for
White Way lighting on Eighth Street
was spread against lots abutting
Eighth Street and for 128 feet either
way. We find that on the first of
August the Council authorized the
removal of the particular light in
question, which was in front of the
Grand Theatre and about 15 feet
westwardly from the property line
between the Bradley & Maclay in-
terests and the Dubuque Realty Com-
pany property. The light was re-
moved because of its confliction
with the new canopy or marquee of
the Grand Theatre. It was explained
to Mr. Ed. G. Imhof that the light
was in confliction with the new can-
opy and that the lighting around the
canopy would practically do away
with the necessity of the light at this
point.
The light in question was a dark
after midnight type, being a two
lamp post. Accordingly if a rebate
is allowed, it could not be made for
$128.95 as requested because this
amount includes the cost of under-
ground cable and the lamp post. The
actual cost of the lamp with glass
and fixtures is $85.00. It was ex-
plained to the Dubuque Realty Com-
pany interests that if a rebate were
made it would not be made to them
as the light was not in front of
their property and in our opinion the
rebate should be made to every per-
son assessed for the improvement on
said lighting procedure.
The writer suggested that inas-
much as the Council had not fully
determined as to whether or not
Eighth Street was to be widened.

that the question of re- installing the
light be dropped for the time being
until such time as a new location
would be definite and accessible to
both the Bradley & Maclay interests
and the Dubuque Realty Company

The writer's attention has been re-
peatedly called by interested citizens
of Dubuque toward condition of un-
sightly, demolished or partly demo-
lished building in the City. I am told
that at the meeting of the Woman's
Club Tuesday, October 21st, a plea
was made to the City Council, espe-
cially on two of these sites, namely
the Cooper Building at Third and
Locust and also a condemned house
at Eleventh Street near Race Street.
I find that on August 5th, 1930, the
Building Inspector made the follow-
ing recommendations:
Demolish present house owned by
C. C. McGregor at 737 -739 West Elev-
enth Street.
Demolish present frame• shed;
owned by J. Doyle Estate at 14 Lo-
cust Street.
Demolish old barn owned by J. E.
Kringle at 1598 Jackson Street.
Remove old rock house on the for-
mer City of Dubuque property al
2417 Queen Street. This house was
. recently sold and the Building In-
spector has been instructed to inter-
view the present owner to hasten the
tearing down of this house.
Demolish the two story frame
building owned by H. Pfotzer at
Windsor Avenue and Ries Street.
I am told that these matters were
referred to the City Council for
Council action at a later date. I
would suggest that haste be made to
clean up the hazards as above men-
tioned.

Whereas, the contract for the in-
stalling of sewer and water connec-
tions in Algona Street from the north
property line of West 14th Street to
the south property line of Delaware
Street has been completed and the
City Manager has examined the work
and filed his certificate stating that
the same has been completed ac-
cording to the terms of the con -
tract, plans and specifications and re-
commends its acceptance, now there-
fore,
Be It Resolved, by the City Council
of the City of Dubuque, that the re-
commendation of the City Manager
be approved and that said improve-
ment be and the same is hereby ac-
cepted and the City Engineer be and
he is hereby directed to prepare a
plat and schedule showing the lots
oz parcels of real estate subject to
assessment for said improvement
and file the same in the office of the
City Clerk subject to public inspec-
tion and said Clerk upon receipt of
such plat and schedule publish the
notice of the Council's intention to
levy special assessments therefor, as
required by law.
Be It Further Resolved, that the
City Treasurer be and he is hereby
directed to pay to the contractor
from the funds to be realized from
the sale of Improvement bonds is-
sued upon the above described im-
provement in amount equal to the
amount of his contract, less any re-
tained percentage provided for there-
in.

The City Manager, to whom was
referred the petition of R. D. Mul-
len at a previous meeting, reported
that he has seen Mr. Mullen relative
to a rock wall constructed by the
City at the entrance to his property
to Madison Street, stating that he
had made arrangements with Mr.
Mullen regarding this wall and that
the City Solicitor be instructed to
draw up a resolution covering this
matter. No motion made.
On recommendation of the City
Solicitor to whom was referred the
petition off Christine Jackson rela-
tive to the assessment against her
property lot 2 Buettell's Sub, for
street improvement, the money paid
by Mrs. Jackson, on said assessment
be returned to her and the balance
of the assessment be cancelled; she
being a widow and the mother of sev-
eral small children.
Councilman McEvoy moved that
the recommendation of the City Soli-

Street. The Manager made no recom-
mendation.

they be allowed to construct said
sewer at their own expense under
the supervision of the City Engineer.

$629.53 plus interest at 5% from date
of tax sale to date, penalties to be
cancelled„ for lots Stewart/s Sub.

$170.24 in full with interest, no re-
duction for lot Stewart's Sub. 24.
