1930 December Council Proceedings396 Adjourned Session, November 28th, 1930 A. McClain ,on Dodge Street, states that he was assessed for two gas connections to his property, that one is paid and the other still stands against his property. He asks that this assessment be cancelled. Councilman McEvoy moved that the assessment for this gas connec- tion be cancelled. Seconded by Coun- cilman Jansen. City Solicitor Czizek reported on the tax matters of Frank McGuin- niss on lot 88 Union. Add. Total amount of tax due August 5th, 1930, amounts to $370.20. The City has in- vested on tax sale certificates $279.78 which amount is to be paid with in- terest from date of tax sale at 5% interest. Mr. McGuinness has paid $100.00 on this and promises to pay the balance in a reasonable time. City 'Solicitor Czizek recommends that this property be taken off of the tax sale list. Councilman McEvoy moved that the recommendation of the City Solicitor be approved. Seconded by Councilman Jansen. Report of the City Engineer on the petition of Mrs. John Klecker, referred to him at a previous meet- ing. Mrs. Klecker's property is locat- ed at the corner of Quince and Rush Streets. She was assessed for a san- itary sewer in Rush Street for $95.29, Aug 18, 1925 and for a sanitary sewer in Quince Street for $84.44, Dec. 15, 1925, and asks that the assessment for the sewer in Rush Street be can- celled. He recommends that the assessment for the sewer in Rush Street be reduced. Councilman McEvoy moved that the recommendation of the Engineer be approved and the assessment be reduced 30% leaving a !balance to be paid of $66.71 and the Treasurer be instructed accordingly. CITY OF DUBUQUE, IOWA Resolution No. 368 -30 WHEREAS, the contract hereto- fore entered into by the City of Du- buque for the improving of Auburn Street hereinafter described, has been completed and said improve- ment has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $7,115.07; AND WHEREAS, public notice as provided by law, has been published by the City Clerk stating the inten- tion of the City Council to issue bonds to pay the cost of said im- provement and a public hearing has been held pursuant thereto, and all objections filed thereto have been considered and determined: NOW, THEREFORE, BE IT RE- SOLVED by the City Council of the City of Dubuque that to provide for the cost of improving Auburn Street from the north property line of West 14th Street to the south property line of Dexter Street there be issued im- provement bonds to the amount of $7,115.07. Said bonds shall be issued under the provisions of Chapter 311 of the Code of Iowa, 1927, which bear date as of the 1st day of January, 1931: shall be in the denominations of $500.00 except that there shall be one bond to the amount of $115.07. They shall be numbered from 2744 to 2758 inclusive and shall be divided into ten series of which the bond num- bered 2744 shall constitute the first series and shall be payable the 1st day of April, A. D., 1931; the bond numbered 2745 shall constitute the second series and shall be payable the 1st day of April, A. D., 1932; the bond numbered 2746 shall constitute the third series and shall be payable the 1st day of April, A. D., 1933; the bonds numbered 2747 and 2748 shall constitute the fourth series and shall be payable the 1st day of April, A. D., 1934; the bonds numbered -2749 and 2750 shall constitute the fifth series and shall be payable the 1st day of April, A. D., 1935; the bonds numbered 2751 and 2752 shall con- stitute the sixth series and shall be payable the lst day of April, A. D., 1936; the bonds numbered 2753 and 2754 shall constitute the seventh series and shall be payable the 1st day of April, A. D., 1937; the bonds numbered 2755 and 2756 shall con- stitute the eighth series and shall be payable the 1st day of April, A. D., 1938; the bond numbered 2757 shall constitute the ninth series and shall be payable the lst day of April, A. Said bonds shall bear interest at the rate of five per cent. per annum which interest shall be payable semi- annually, in accordance with the terms of the coupons thereto at- tached; and said bonds shall be pay- able out of the proceeds of the spe- cial assessment levied for said im- provement. Both principal and interest shall be payable at the office of the City Treasurer in the City of Dubuque. Said bonds shall be substantially in the following form: No. Series No. CITY OF DUBUQUE Improvement Bond The City of Dubuque in the State of Iowa promises to pay as herein- after mentioned to the bearer hereof, on the first day of April, A. D., 1930.. ; or any time before that date at the option of the City, the sum of $500.00, FIVE HUNDRED DOLLARS, with interest thereon at the rate of five per cent. per annum, payable on the presentation and surrender of the interest coupons hereto attached, both interest and principal are pay- able at the office of the City Trea- surer in the City of Dubuque in the State of Iowa. This bond is issued by the City of Dubuque pursuant to and by virtue of Chapter 311 of the Coda of Iowa, 1927, and in accord- ance with a resolution of the City Council of said City, duly passed 011 the 1st day of December, 1930. This bond is one of a series of 15 bonds, 14 for $500.00 numbered from 2744 to 2757 inclusive, and one for $115.07 numbered 2758, all of like tenor and date, and issued for the purpose of improving Auburn Street from the north property line of West 14th St. to the south property line of Dexter Street and described in said resolu- tion; which cost is assemble to and levied along said improvement, and is made by law a lien on all abutting or adjacent property, and payable in ten annual installments, with inter- est on all deferred payments at the rate of five per cent. per annum, and this bond is payable only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified and recited that all the acts and conditions and things required to be done precedent to and in the issuing of this series of bonds, have been done, happened and per- formed in regular and due form as required by law and resolution; and for the assessments, collections and payment hereon of said special tax, the faith and diligence of said City of Dubuque are hereby irrevocably pledged. In Witness Whereof, the City of Dubuque by its City Council has caused this 'bond to be signed by its Mayor and countersigned by its City Clerk, with the seal of said City affixed this 1st day of December, 1930, and has authorized the use of their fac- simile signature to the interest coupons hereto attached. Petition and Waiver To the Honorable Mayor and Council of the .City of Dubuque: Gentlemen: The undersigned being the owners of all of the real estate subject to assessment for the construction of the sanitary sewer herein petitioned for, hereby petition your Honorable Body to cause to be constructed a sanitary sewer in Muscatine Street from Primrose Street to the alley 401 first north of National Street, to- gether with manholes and other nec- essary appurtenances. The undersigned further petition that such sewer be constructed in accordhnce with the plans and spe- cifications heretofore adopted by your Honorable Body for the sani- tary sewer in Burlington, Stoltz, Dav- enport Streets and in the alley first north of National Street from Bur- lington to Davenport Streets and ex- pressly waive the adoption of any other plans and specifications for the sewer herein requested. The undersigned . further petition that, with the approval of the con- tractor who may be awarded the contract for the sewer in Burlington, Stoltz, Davenport 'Streets and in the alley first north of National Street from Burlington to Davenport Sts., the contract for the construction of the sewer herein petitioned for be awarded also to said contractor at the same price per lineal foot of sewer and other appurtenances as may be bid by such contractor, and that this sewer be constructed at the same time and under the same contract or under a supplemental contract therefore, at the option of the City Council. The undersigned further agree that, in consideration of the grant- ing of this petition, the City Council of the City of Dubuque need not adopt any proceedings of any kind preliminary to the awarding of the contract, as herein stated, and need not publish any notices or adopt any schedules which are required by law preliminary to the levying of spe- cial assessments for the construction of public improvements. The under- signed expressly agree that this peti- tion shall confer jurisdiction upon the City Council to award a contract for the sewer petitioned for and to levy assessments upon their prop- erty to pay the cost thereof, the in- tention of the foregoing being to waive any and all prior proceedings of every kind and description. He made the proposition to Mr. Rhom- berg that he Pay $125.00 in settle- ment of this assessment, but Mr. Rhomberg would not agree to this, that he wanted the assessment can- celled or that the City open up the stairway to his cellar, which was closed when the City had the side- walk constructed. Section '2 of Ordinance No. 26 -29 reads as follows: "The term of office of said mem- bers shall be five (5) years, ex- cept that the members first named shall hold office for such terms, not exceeding five years, that the terms of not more than one -third of the members will expire hi any one year." We interpret this to mean that not over two expirations shall occur in one year. Accordingly we believe that the first two mentioned names or appointments are for the five year period, the third and fourth are for four year terms and the fifth and sixth are for three year terms and the seventh for a two year term. It includes new construction on vari- ous storm sewers of the City since April 1st. I am told that the bond issue sold in September for storm sewers was to include the items totaling this amount. However, the expenditures were largely made before the pro- ceeds of the bend money were re- ceived. I ask that authority be granted by the Council to transfer from the spe- cial bond fund for storm sewers to the consolidated fund the sum of $3,514.83. An Ordinance providing for the ap- pointment of an Electrical Inspect- or; defining his powers and duties; prescribing rules and regulations for the installation of electric light and power wiring, electrical work i 436 Special Session, December 22nd, 1930 in a northerly direction. In addi- tion to the $875.00 purchase price, the City also has in a sewer assess- ment amounting to $96.69, or a total amount involved in the lot of $971.69. Mr. E. W, Giese has offered a - - maximum of $550.00 for Lot 319 with reservation to the City of the right - of -way for the said sewer. The as- sessed valuation of Lot 319 is $360.00. The lot is a corner lot, having ap- proximately 50 feet frontage on Rhomberg Avenue and 127 foot front- age on Hawthorne Street. Assessed valuation of Lot 318 to the north is $300.00 and Lot 317, $300.00, while the assessed valuations of Lot 320, with a house, is $1620.00, 1pt 321, with a house, $1425.00, a portion of Lot 322, $120.00 and portions of Lots 322, 324 and 325, totaling $160.00. This lot offers a possible future advantage to the Water Department, either for trade for property imme- diately in front of the Water Plant, having a shorter depth, or possibly other uses of undetermined char- acter. It is the writer's recommendation that the offer of E. W. Giese of $550.00 be not accepted and that the authority be granted to deed said lot to the Water Department for the sum of $750.00, which I believe is a fair value for the use that may be applied to said property in the future by this department. We ask that author- ity be granted for the City employees to purchase and install said drains with the expenses being charged to the storm sewer bond issue fund. (1) Extension of terra cotta pipe drain from the west terminus of the present storm culvert in Mt. Carmel Road about 500 feet south of Cannon Street. 30 feet of 24 inch terra cotta pipe furnished and laid, estimated price, $75.00 (2) New pipe culvert at the east side of the 'Cascade Road at the inter- section of Mt. Carmel Road. 100 feet of 18 inch corrugated pipe and one inlet, estimated price, $250.00. (1 have suggested the corrugated pipe rather than terra cotta pipe for the reason that there is a rock cut at this intersection) (3) On Green Street west of As- bury Street about 500 feet, 60 feet of 18 -inch corrugated iron culvert to lead storm water from the south side of Green Street to the gulley at the north side, estimated price, $100.00. (4) On the north side of Semin- ary Street at Keppler Street there is a present 20 -inch iron pipe dis- charging along a bank into Keppler Street hollow that is washing said Keppler Street and is damaging a fill made by the property owner of a four family apartment house along the east side of Keppler Street. It is estimated that 50 feet of 20 -inch iron corrugated pipe and 50 feet of 24 -inch terra cotta pipe from the bottom of said fill to the rear of the apartment house property will avoid a possible future damage case at this intersection, estimated price, $250.00. Gentlemen: In connection with the auditing of the City books every two years by the State Examiners, please be advised that the actual cost for the last two years, as paid for in 1930, was $1,237.08. This charge was paid for in one fiscal year's appro- priation, while it covered the exam- ination of two fiscal periods. It is the writer's belief that an audit of any business the size of the City of Dubuque should occur at least once per year. Accordingly it is my recommendation that authority be granted to negotiate with the Auditor of State towards securing an annual audit which is estimated at approximately $700.00. EVANS, City Manager. 438 Special Session, December 22nd, 1930 and materials; providing for the inspection of such work and the manner of installation and impos- ing a penalty for the violation of the terms hereof; and repealing all ordinances or parts of ordinances in conflict herewith or theretofore enacted governing the same sub- ject. ELECTRICAL INSPECTION, AP- POINTMENT, QUALIFICATIONS, SALARY, BOND. Section 1. There is hereby created and established the office of Elec- trical Inspector. The Electrical In- spector shall be appointed by the City Manager and shall hold office at his pleasure. The person chosen to fill the office of Electrical Inspector shall be a competent electrician of good moral character and shall have had at least four years' experience as a journeyman in the practice of his trade. He shall be well versed in approved methods of electrical construction for safety to life and property, the statutes of the State of Iowa, relating to electrical work, the rules and regulations issued by the City Council of Dubuque, Iowa, un- der authority of the statutes, the Na- tional Electrical Code, as approved by the American Standards Associ- ation, and other installation and safety rules and standards as ap- proved by the American Standards Association. The Inspector shall hold membership in the Association of Electrical Inspectors in which he may be entitled to membership and shall serve on any Electric Commit- tees of this Association to which he may be appointed. The City Mana- ger shall fix the salary of the Elec- trical Inspector and may require him to file a bond as provided by Ordi- nance. RIGHTS OF ACCESS TO BUILD- ING. Section 2. Said Electrical Inspect- or shall have the right during reas- onable hours to enter any building in the discharge of his official duties, or for the purpose of making any in- spection or test of the installation of electric wiring, electric devices and or electric material contained herein, and shall have the authority to cause the turning off of all elec- trical currents and cut or disconnect in cases of emergency any wire where such electrical currents are dangerous to life or property or may interfere with the work of the Fire Department. PERMITS. Section 3. No alterations or addi- tions shall be made in the existing wiring of any building nor shall any building be wired for the placing of any electric light, motors, heating devices, or any apparatus requiring the use of electrical current, nor shall any alterations be made in the wiring in any building after inspec- tion, without first notifying the Elec- trical Inspector and securing a per- mit therefore, except minor repair work such as repairing flush and snap switches, replacing fuses, changing lamp sockets, and recep- tacles, taping bare joints and re- pairing drop cords. Applications for each permit describing such work, shall be made by the person, firm, or corporation installing same and per- mit when issued shall be to such ap- plicant. Section 4. In industrial plants where expert electricians are regu- larly employed and who have charge of the electrical work in such plants, the general provisions of Section 3 shall not apply except as follows: a monthly inspection shall be made by the Electrical Inspector of the in- stallation of electric wiring, fixtures, appliances, work and materials used and one in connection with the op- eration of work in said plant. A record shall be kept at such plants covering the preceding month. This record shall be filed with the Elec- trical Inspector each month prior to the time he makes his regular in- spection. All wiring, fixtures, appli- ances, work done and materials usacl in connection with electrical instal- lation in such plants shall conform -to the provisions, except as the same are hereby limited or exempted. Any falsity contained in the reports re- quired to be filed with the Electrical Inspector shall subject the person, firm, or corporation responsible therefor to the penalties provided for in Section 26, hereof. "Any industrial plant to whom the provision hereof applies shall pay to the City of Dubuque inspection fees of $5.00 per month, which fee shall cover the service to be performed by the Electrical Inspector as herein provided." Section 5. No permit will be re- quired for the installation of wires to operate electric bells, gas light- ing apparatus, call bells, burglar alarms or other similar installations, when a transformer is not used and where the voltage as used is not over fourteen (14) volts. INSPECTION, CERTIFICATE OF INSPECTION. Section 6. Upon completing the installation of any electric work, electric light or power wiring, elec- trical fixtures and appliances or electrical work or materials or the alteration thereof or addition there- to, the Electrical Contractor or per- son in charge of same shall notify the Electrical Inspector who shall as soon as possible inspect such instal- lation, wiring, fixtures, appliances, work and materials. If found to comply with the requirements there- of and upon the payment of the in- spection fee hereinafter provided for, he shall issue a certificate of in- spection and approval. In case the Electrical Inspector finds that such installation, wiring, fixtures, appli- ances, work or materials or any part thereof is not in conformity with the requirements of this Ordinance he shall refuse to issue a certificate of inspection and approval and upon such refusal he shall give notice thereof to the Electrical Contractor or person in charge of the same, giv- ing his reasons therefor together with a written statement as to the changes necessary to comply with the requirements thereof. In no case shall a certificate of inspection and approval be issued on any in- stallation that is concealed in such manner that it cannot be examined. All wires which are to be hidden from view shall be inspected before concealment and any person, firm, or corporation installing such wires shall notify the Electral Inspector, giving him 24 hours in which to make the required inspection before such wires are concealed. Section 7. When fires have dam- aged wiring of any building, and when wiring has been disconnected by Fire department, wiring must not be reconnected until released by the Electrical Inspector. Section 8. No person, firm or cor- poration shall furnish electricity to any person unless the provisions of this Ordinance have been fully com- plied with and until the certificates of inspection and approval has been issued by the Electrical Inspector. Section 9. In cases of controversy arising over the interpretation of any part of this Ordinance, the in- terpretation of the Electrical In- spector shall be final. RECORDS OF PERMITS AND IN- SPECTIONS: Section 10. The Electrical Inspect- or shall keep complete records of all permits issued and inspections made and other official work per- formed under the provisions of this Ordinance. He shall be provided with the necessary clerical help to carry out the provisions of this sec- tion. INSPECTION FEES. Section 11. Before delivering a certificate of inspection and approval the Electrical Inspector shall collect Special Session, December 22nc1, 1930 439 from the person, firm, or corporation procuring the same ,a fee computed in accordance with the following schedule provided, however, that in no case snail such fee be less than fifty cents. W.) 2.00 Reinspections: For each rein - spection made necessary by faulty construction 1.00 APPROVED MATERIALS. Section 12. No electrical mater- ials, devices or appliances shall be used or installed in the City of Du- buque unless they are in conformity with the provisions of this Ordi- nance, the statutes of the State of Iowa, and unless they are in con- formity with approved methods of construction for safety to life and property. Conformity of electrical materials, devices . and appliances with the standards of Underwriter's Laboratories, Inc., as approved by the American Engineering Associa- tion and other standards approved by the American Engineering Stand- ards Association shall be prima facie evidence that such electrical mater- ials, devices and appliances comply with the requirements of this Ordi- nance. The maker's name, trade mark or other identification symbol shall be placed on all electrical ma- terial, devices and appliances used or installed under this Ordinance. CONSTRUCTION REQUIREMENTS. Section 13. All wire carrying a voltage in excess of 250 volts and less than 600 volts shall be inclosed in all metal conduit, metal raceways or a steel armored cable. Section 14. All buildings within the fire limits and all buildings, oc- cupied by three or more families, all hotels, schools, convents, churches, 440 Special Session, December 22nd, 1930 hospitals, sanitariums, institutions for the care of orphans or aged peo- ple, club houses, theatres, dance and amusement halls, all buildings used for public assemblies, all buildings used for commercial purposes, and all buildings used for industrial pur- poses, shall be wired in approved rigid or flexible metal conduit, metal raceways except where additions are to be made to existing approv- ed feeder systems, at which time such additions may be made with wires in rigid or flexible metal con- duit, metal raceways or with steel armored cable. Section 15. Underground services whether in rigid metal conduit, rigid non - metallic conduit, or park cable or other approved underground cable shall be not less than two standard wire sizes larger than the smallest standard wire size allow- able for the load conditions as stated elsewhere in this Ordinance. Section 16. Neither armored cable nor flexible metal conduit shall be installed in any location where ex- perience has shown rapid deteriora- tion of iron or steel or their protec- tive coating. EMERGENCY LIGHTS. Section 17. Emergency Lights shall be installed wherever necessary to illuminate stairways, corridors, fire escapes and all other ways of egress from: A. Theaters; including motion picture houses. B. Assembly halls fitted with or without a stage or platform, used for purposes of general assemblage, lodge halls, for dancing, for skating, for lectures, or for entertainments or exhibitions. C. Public or private hospitals having accommodations for more than ten or ambulatory patients or more than six patients confined to bed and quartered above the first story. D. Hotels and public rooming houses of more than fifteen rooms. Section 18. All meter installations hereafter made shall be equipped with a standard approved blocked steel service cabinet inclosing all service connection parts, including externally operated switch, fuses and meter connections. This standard service outfit shall be used for en- trance as well as customer's meter connections and shall be arranged so as to be sealed by the company supplying the electricity or its auth- orized representative. Circuit or branch fuses shall be installed for all circuits in such a manner a.g to be externally accessible to the con- sumer or owner of the premises. Section 19. Lighting Services, Feeders, Branch Circuits. This section applies only to instal- lations for lighting and other appli- cations of electricity commonly sup- plied from lighting circuits for con- nection to 115 volt or 115 -230 volt distribution systems and does not ap- ply to wiring for the supply of en- ergy to power equipment is supplied from the same feeders supplying lighting systems. The requirements of this section shall be deemed addi- tional to, or amendatory of these prescribed elsewhere in this Ordi- nance. A. Branch circuit panel boards shall contain a minimum of one spare circuit for each five circuits in service or fraction thereof. B. Where branch circuit distribu- tion cabinets are installed in such a way as to prevent wiring to them, to make use of spare circuit posi- tions without injuring the structure or finish of the building, some means shall be provided for such accessi- bility. C. The current - carrying capacity of feeders in an interior wiring sys- tefn shall be not smaller than the smallest allowable wire size per- mitted for existing load conditions plus 7 amperes at 115 volts for each spare circuit position. D. Conductors for services and feeders shall be of such size that the total voltage drop from the point of entrance to the farthest branch cir- cuit distributing panel board shall not exceed three per cent with the load equal to the total capacity as stated in Paragraph 19c. E. In laying out an installation, except for constant current systems, every reasonable effort shall be made to secure distribution centers locat- ed in easily accessible places at which points cut -outs and switches controlling the various branch cir- cuits shall be grouped for conven- ience and safety of operation. The load shall be divided as evenly as possible between branches and all complicated and unecessary wiring shall be avoided. F. Wire sizes for branch circuits in all classes of building, except res- idences, shall be such that the volt- age drop between the branch circuit distribution panel and the farthest outlet does not exceed 3 volts. G. Residences shall be construed to be buildings or parts of buildings designed for occupancy by not more . than two families; and out buildings on the same premises, such as gar- ages, designed to house not more than 2 cars. H. For the purpose of demand Special Session, December 22nd, 1930 calculations, receptacle outlets which are a part of combination lighting and appliance receptacle circuits shall be rated at not less than fifty (50) watts each. 19 -I. There shall be not more than six sockets on any branch cir- cuit supplying display window light- ing. 19 -J. A demand factor of 50 shall be applied to feeders for show win- dow lighting outside the fire limits. Section 20. All motors of one H. P. or larger operating on voltages of more than fifty (50) volts shall be protected from overload by thermal cut -outs or time limit relays. Section 21. When an addition or change in old wiring, in excess of thirty per cent (30 %) of present in- stallation is made all of said instal- lation shall comply with this ordi- nance. Secion 22. Wherever possible, rigid metal conduit and /or rigid non- metallic conduit shall be pitched for drainage. Where conduits are pitch- ed, drainage of condensation or moisture entering the conduit shall be accomplished in such a manner as to effectively dispose of such con- densation or moisture. Section 23. WORMANSHIP. In all wiring special attention shall be paid to the mechanical execution of the work, care to be taken in neatly run- ning, connecting, soldering, taping conductors and securing and attach- ing the fittings and whenever in the opinion of the Electrical Inspector the installation is not so executed, he shall order such changes, alter- ations or reconstruction as he shall deem necessary. Section 24. No certificate of in- spection shall be issued unless the electric light, power, and heating in- stallations are in strict conformity with the provisions of this Ordi- nance, the Statutes of the State of Iowa, the rules and regulations is- sued by the Industrial Commission of Iowa under authority of the State Statues, and unless they are in con- formity with the approved methods of construction for safety to life and property. The regulations as laid down in the National Electrical Code, as approved by the American Safety Code, as approved by the American Standards Association, and in the National Electrical Safety Code, as approved by the American Standards Association, and other installation and safety regulations approved by the American Standards Association shall be prima facie evidence of such approved methods. 441 EXCEPTIONS TO THIS ORDI- NANCE. Section 25. The provisions of this Ordinance shall not apply to the in- stallation of electric light or power wiring, electrical fixtures, appli- ances, work or material in connec- tion with the erection, construction, maintenance or repair of sub- stations, central power stations, power houses or street car barns or public utility companies furnishing electric current for light, or power or street railway companies nor to the trolley wires, line wires, fixtures or other apparatus or appliances be- longing to suck companies and lo- cated on the streets or alleys of the City nor to the installation of the electric wiring, fixtures, appliances, work or material of public service telephone and telegraph companies and necessary for or incident to the transmission of intelligence by such companies. This Ordinance shall not be con- strued to relieve or lessen the re- sponsibility or liability of any party owning, operating, controlling or in- stalling any electrical wiring, elec- tric devices, and /or electrical ma- terials for damages to person or property caused by any defect there- in nor shall the City be held as as- suming any such liability by reason of the inspection authorized herein, or certificate of inspection issued as herein provided. PENALTY. Section 26. Any person, firm or corporation, who shall fail to com- ply with any of the provisions here- of, shall upon conviction thereof, be punished by a fine of net less than five dollars nor more than one hun- dred dollars. together with the cost of persecution, and in default of pay- ment thereof, by imprisonment for not less than five days nor more than sixty days: REPEAL OF CONFLICTING ORDI- NANCES. Section 27. All ordinances or parts of ordinances conflicting with the provisions of this ordinance and all ordinances heretofore adopted re- lating to this same subject, be and the same are hereby repealed. Section 28. This Ordinance shall take effect ten days from and after its final passage by the City Council and publication as provided by law. To the Honorable Mayor and City Council of Dubuque, Iowa. Gentlemen: We herewith offer for your consideration and approval, certain changes in our electric light and power rates as applicable to your City. For some time we have been contemplating a rearrangement of electric rates for Dubuque, and after mature consideration envolviug considerable study, we have arrived at a readjustment of rates which gives our customers a material re- duction in their electric bills. It will be observed that all classes of service (except those hereafter noted) are affected, and that prac- tically all consumers, large and small, are benefitted. Although these changes are not warranted by the present state of our business and that we are mak- ing considerable sacrifice in our an- nual earnings, we hope and feel that such sacrifice may be temporary and will result in greater use of electric service. In making this reduction we also have in mind our obligation to the public in helping to relieve the pres- ent financial condition of the coun- try. Reductions have been made in rates for Domestic lighting, Option- al Domestic Service, Commercial lighting, Small Power Service, Large Power Service and Street Lighting. No reduction has been made in our rate which applies to primary high voltage service, and to special con- tracts for wholesale service in large quantities. Our special electrical cooking rate also remains unchang- ed. These exceptions are now at the lowest rate which we can afford. At present, Residence and Commercial Lighting are served under a common rate, but the proposed changes con- template a segregation of these classes 'of service. The proposed Residence Lighting rate will apply strictly to single homes or single apartments; Com- mercial Lighting rates will apply to commercial businesses of all kinds, including combination business houses and residences. The Option- al Residence Lighting rates shall be available for single residences and apartments only, with the exception that such rates shall apply to re- frigeration and cooking in commer- cial houses where the service is sep- arately metered, but shall not apply to lighting in commercial houses. Special Session, December 22nd, 1930 December 22, 1930. To the Honorable Mayor and City Council. Dubuque, Iowa. Gentlemen: The letter of Decem- ber 17, 1930, and the proposed changes in Light and Power rates attached thereto from the Interstate Pow, er Company are resultant from the discussions and investigations started by the City Council with Mr. Charles•Dove and the further power considerations and comparisons by Council on December 6th and 15th and the tentative approval of the same by Council December 20, 1930, after the conference with Messrs. G. E. Taylor and G. F. Maddock. The proposed rates include reduc- tions to the following service: Resi- dence Lighting, Optional Residence Lighting, Commercial Lighting, Small Power, Large Power and Street Lighting. No reductions have been made in the Cooking Rate, Large Power Rates "C" and "CO"; and no reductions are made to spe- cial rate contracts. No rates have been increased in this proposal of rate changes. The proposed reductions occur at the be- ginning of each class of rates, thus benefiting all customers. Specific changes in the effected rate sched- ules are as following: (A). RESIDENCE LIGHTING, as proposed is separated from present Residence and Commercial Lighting schedule. A reduction of % cent per KWH is effective in each step up to a consumption of 2000 KWH per month. This new rate offers reduc- tion of 5% at 15 KWH and up to 7% at 500 KWH per month. The minimum is and remains at $1.00 per month. (B). OPTIONAL RESIDENCE LIGHTING, as proposed, is based on same steps of KWH as present schedule. The change occurs in the cost to every consumer of the first 50 KWH per month minimum charge. Present rate is $4.45, while the proposed cost will be $4.25, a saving of $.20 per month. No other change is proposed in this schedule so that all optional customers will be reduced a flat $.20 per month. (C). COMMERCIAL LIGHTING, as proposed, is Separated from Resi- flential Lighting. This schedule of- fers reductions in the first 200 KWH per month. The present cost for 200 KWH is $15.30 and the proposed will be $14.00, a saving of $1.30 or 9% At higher consumptions than 200 KWH the flat reduction of $1.30 per month will apply to each. The mini- mum bill per month will be $1.00, as at present. 445 (D) SMALL POWER SERVICE, as proposed, includes a reduction of one cent per KWH for the first 250 KWH per month. The present cost of 250 KWH is $17.50; the proposed cost will be $15.00, a saving of $2.50 or 14% at 250 KWH. Loads higher than 250 KWH will receive a pro- posed flat reduction of $2.50 per month. The minimum bill per month will continue to be $1.00 per H. P. of connected load. (E). LARGE POWER SERVICE, as proposed, is exactly as the present rate structure, except that a flat 5% reduction is made on each hill. The minimum of $1.00 per month per H. P. is the same as present minimum charge. (F). STREET LIGHTING, as pro- posed, includes a reduction in nearly all classes of service of street and boulevard lighting and is calculated to be a 10 %' reduction. 600 C. P. overhead lamps will be reduced from $65.00 to $58.00 each per year; 400 C. P. overhead lamps will be reduced from $57.50 to $50.00 per year; 250 C. P. overhead lamps will -be reduced from $42.50 to $35.00 per year, etc. The annual cost at present basis of charges and lights in service is $66,- 390.87. The proposed cost at the same basis will be $59,817.44, or a saving of $6,573.44 per year or 9.9 %. The proposed change of rates in- cludes the following estimated re- ductions: Per Year. It is earnestly hoped that increases in in- dividual consumption will stimulate the electrical load to such an extent that other rate changes may be ef- fective in the near future. I wish to thank the City Council for the thorough and conscientious Effort made within the last two months toward a comparison and study of light and power rates with other cities and the final culmination of this rate reduction which will ef- fect nearly every customer in Du- buque. It is recommended that acceptance on the part of the City Council be made of the proposed reduction in 446 'Special Session, December 22nd, 1930 Light and Power rates at this time. Wash- ington be communicated with, with the request that they engage local Architects in connection with the construction and supervision of the proposed new Post Office to be con- structed in Dubuque. The boys were •arrested on suspicion of pulling a trolley on a West Du- buque street car, at West Fifth and Hill streets.
