Annexation State Development Board LetterJuno 5, 2003 Dubuque City Council 50 West 13th Street' Dubuque, IA 52001-4864 Department of SMART IDEATM RE: City Development Board Case File UA03-35 Attention Dubuque City Council: On May 23, 2003, the City Development Board (CDB) received a proposal for voluntary annexation to the City of Dubuque, CDB Case File No. UA03-35. Upon initial review the proposal appears to be complete and properly filed with two minor exceptions: The copied certified mail receipts do not indicate the date the notice was mailed. The City did not mail notice direct to the county attorney. When county road right-of-way is included Iowa Code requires notification to the county attorney. The City may comply with this requirement by obtaining a letter from the county attorney stating that they were aware of the annexation proposal and allowed opportunity to comment regarding the county road right-of-way prior to council action on May 5, 2003. The Board will consider the proposal submitted at its July 2003 meeting. At that meeting the Board will review the proposal for annexation for compliance with the filing requirements of Iowa Code {}368 and its administrative rules contained in Iowa Administrative Code Chapter 263 and may either approve or deny the request. If approved the board will comply with the apprepdate procedures set-forth in Iowa Code and its administrative rules referenced above for filing the final documents to complete the annexation. A formal notice of meeting will be distributed following the June 12, 2003, meeting announcing the exact time and meeting location for July 2003. Average daily traffic counts from t997 indicate there are 2,270 vehicle trips on Old Highway Road. Access will be off Seippel Road, which is a City street. Public Services: Response time for City police, and fire witl be the same or less than response time for County and volunteer services. The City has identified that an additional relocated fire station may be needed in the future as the community develops to the west. Environment: Storm water management will be required as part of the review and approval of any development on this parcel, q addition, erosion control wilt be required to minimize soil loss associated with development of the property.
