SUBJECT: Transfer of Jurisdiction
Dear Mayor Duggan:
Pursuant to Section 3 of Senate File 451, jurisdiction and control of certain primary roadways will be
transferred to local jurisdictions effective July 1, 2003. The attachment describes the roadway segments based
on data as of January 1, 2002, which will be transferred to local jurisdictions. On July 1, 2003, by operation of
law, local jurisdictions must assume all further responsibility for these roadways. An implementation meeting
will be held on June 9, 2003, as noted in the attached agenda.
For cities under 500 population, the state highway that is transferring to your jurisdiction on July t, 2003, will
transfer to the county on July 1, 2004, along with any farm-to-market extensions that pass through your city.
The department intends tc~ subsequently transfer by quitclaim deed its title and interest in the right-of-way of
the public road segments described inthe attachment. If the state'has'acquired access rights for the public road
segmems described in the attacinnent, you shall not, within 150 feet of any intersecting primary highway-,
either alter those rights or allow any new access.
As soon as practical, the following items will be forwarded to you:
1. Right-of-way strip map, if available
2. Applicable permits and resolutions
3. Construction plans for roadway, bridges, and culverts, if available
4. Specific bridge information, such as inventory data and safety inspection items
5. Any other correspondence that may pertain to the affected roadway section
All items listed above, and an) Other documents, as appropriate, will be provided by this office. Any further
questions or correspondence regarding the transfers of jurisdiction should be directed to me or Assistant
District Engmeer, Jim Schnoebelen.
