Snow Removal Assessment
The enclosed resolutions provide for the establishment of the final assessments
for the 2009 -2010 Snow Removal from City Right -Of -Way.
Engineering records show snow accumulations from early December 2009
through the month of February 2010. Iowa State Code Section 364.12b states
the abutting property owner is responsible "for the removal of the natural
accumulations of snow and ice from the sidewalks within a reasonable amount of
time and may be liable for damages caused by the failure of the abutting property
owner to use reasonable care in the removal of the snow or ice." City Code of
Ordinances 10- 1 -3 -C -1 addresses the duties of the abutting owner, removal by
City, and the collection of costs.
Complaints and inspections produced 569 notices being sent to property owners;
82 properties were contracted for cleaning of snow /ice accumulations; 21 of
those properties required sending a crew on two or more separate occasions. Of
the 82 properties billed in the 2009 -2010 season; 48 remain unpaid.
The Final Schedule of Assessments for snow removal from City Sidewalks has
been completed in the amount of $4527.09; this total includes the $25.00 per
incident administrative fee.

BUDGET IMPACT
The Sidewalk Inspection Program — Assessable Capital Improvement Project
(CIP 1001108) is a general fund — liens account, in the amount of $4,527.09. The
General Special Assessment Fund (CIP 25510255) covers the cost of
contracting and the revenue from those assessments.
RECOMMENDATION
I recommend that the City Council approve the resolutions establishing the Final
Assessment Schedule for the 2009 -2010 Snow Removal from City Right -Of -Way
in the amount of $4527.09.
The City Council is requested to approve the attached resolutions establishing
the Final Assessment Schedule for the 2009 -2010 Snow Removal from City
Right -of -Way.
