The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing location of property and his desire to build
two single - family homes.
Staff reviewed the surrounding lot sizes in the neighborhood, noting that many of the lots in this
subdivision are less than 5,000 square feet in area. Staff noted the plat requires waiving the lot
area requirement for both Lot 1 -100 and Lot 2 -100.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the proposed lot split will
be consistent with the existing lot layout in the neighborhood.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request subject to waiving the lot area requirement for both Lots 1 -100 and 2 -100 of Finley,
Waples and Burton's Addition.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION APPROVING A PLAT OF SURVEY OF LOT 1 -100 AND LOT 2 -100 OF
FINLEY, WAPLES AND BURTON'S ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1 -100 and Lot 2-
100 of Finley, Waples and Burton's Addition in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 4,354 square feet and 4,355 square feet of lot
area for Lot 1 -100 and Lot 2 -100 respectively, where 5,000 square feet of lot area is required by
Section 5 -7.7 of Title 16 of the City or Dubuque Code of Ordinances, Unified Development
Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 5 -7.7 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 4,354 square feet and 4,355 square feet of lot
area for Lot 1 -100 and Lots 2 -100 respectively where 5,000 square feet of lot area is required.
Section 2. That the Plat of Survey of Lot 1 -100 and Lot 2 -100 of Finley, Waples and
Burton's Addition is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to enclose the approval of the City of Dubuque, Iowa up »n said final plat.

INTRODUCTION
The submitted Plat of Survey of Lot 1 -100 and Lot 2 -100 of Finley, Waples & Burton's
Addition subdivides an existing 8,709 square foot lot into two parcels. The Plat of
Survey needs to be reviewed by the Zoning Advisory Commission as the two resulting
lots do not meet the City's minimum 5,000 square foot of lot area for the R -1 Single -
Family Residential District.
DISCUSSION
The submitted Plat of Survey is to facilitate the construction of a single - family home on
each lot. The applicant had requested a rezoning of the parcel to the R -2 Two - Family
Residential District in September 2009. The Zoning Advisory Commission
recommended denial on a 4 -0 vote with one abstention and the City Council concurred
with the denial.
Attached to this memorandum is an aerial photo that highlights the subject property as
well as a second aerial photo where properties which are also Tess than 5,000 square
foot are highlighted in red, while the subject property is outlined in bluish green. Staff
would note that a portion of the Finley Waples & Burton's Addition Subdivision between
Mineral and West Streets actually is comprised of 4,200 square foot lots. In addition,
across the street from the subject property there are three single - family residences and
a small church. Thus, if the lot split is approved, staff believes the lot layout would be
similar to that of the surrounding neighborhood.
RECOMMENDATION
Planning staff recommends that the submitted Plat of Survey of Lot 1 -100 and Lot 2 -100
of Finley, Waples & Burton's Addition be approved subject to waiving lot area
requirements for both Lot 1 -100 and Lot 2 -100.
