The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Staff reviewed the submitted Plat of Survey and noted that the plat requires waiving the
lot frontage requirement for Lot 2 -8 Block 3, but that the access easement shown on the
Plat of Survey ensures access between the parcels.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objection.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot frontage requirement for Lot 2 -8 Block 3 of
Westbrook Subdivision.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Lot 1 -8 and Lot 2 -8 of Block 3 of Westbrook Subdivision
subdivides an existing lot into two parcels to facilitate the development of two 12 -unit
multi - family residences. The subject property is located within Westbrook Subdivision
which is on the east side of Seippel Road north of the Dubuque Industrial Center West.
DISCUSSION
The Zoning Advisory Commission reviewed a rezoning request for the same property in
November 2009. It was noted at that time a lot split would be necessary to place each
12 -plex on its own lot. The submitted Plat of Survey subdivides an existing 1.4 acre
parcel into two lots with a 12 -unit multi - family residence on each lot. The Plat of Survey
is before the Zoning Advisory Commission as Lot 2 -8 Block 3 does not have frontage on
a public or private street. A 24 and 30 -foot wide access easement is platted on both Lot
1 -8 and Lot 2 -8 to facilitate future access between the parcels if they are not under
common ownership. The submitted Plat of Survey is in other respects in compliance
with the City of Dubuque Unified Development Code.
RECOMMENDATION
Planning staff recommends that the Plat of Survey of Lot 1 -8 and Lot 2 -8 of Block 3 of
Westbrook Subdivision be approved subject to waiving lot frontage requirements for Lot
2 -8 Block 3.

RESOLUTION APPROVING A PLAT OF SURVEY OF LOT 1 -8 AND LOT 2 -8 BLOCK 3
OF WESTBROOK SUBDIVISION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Of Lot 1 -8 and Lot 2 -8
Block 3 of Westbrook Subdivision in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides no lot frontage for Lot 2 -8, where new lots are
required to front on a public or private street by Section 11 -14(b) of Title 16 of the City or
Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, Said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14(b) of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow Lot 2 -8 to have n� frontage on a
public or private street.
Section 2. That the Plat of Survey of Lot 1 -8 and Lot 2 -8 Block 3 of Westbrook
Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to enclose the approval of the City of Dubuque, Iowa upon said final plat.
