The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating that the rezoning will facilitate the
development of a 66-1ot subdivision. The properb/is currently served with City water and
sewer.
Staff reviewed surrounding zoning and land use. Staff indicated that the Comprehensive
Plan designated the subject property for single and two-family residential.
There were several public comments regarding the loss of green space and impact of
development on storm water and traffic.
The Zoning Advisory Commission discussed the request, noting that the proposed
rezoning to R-1 Single-Family Residential is consistent with the Comprehensive Plan.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request. ~

Property History: The property has been used for agricultural proposes since its
an annexation into the City.
Physical Characteristics: The subject property lies immediately west of the two
churches along John F. Kennedy Road west of Spring Valley Ddve and Eisenhower
School. The topography is rolling in nature and generally drains towards the
southeast.
Concurrence with Comprehensive Plan: The Comprehensive Plan designates this
area for single and two family residential.
Impact of Request on:
Utilities: Existing utilities are in place to serve the subject property.
Traffic Patterns/Counts: Access to the site will initially be only from John F.
Kennedy Road which is designated as a minor arterial and carries approximately
8,500 vehicle trips a day.
Public Services: Adequate public services are available to serve the property.
Environment: Staff does not anticipate any significant impact to the environment
provided that adequate erosion control is provided during all phases of
development and that adequate storm water control is provided.

Adjacent Properties: The most significant impact to adjacent property will be an
increase in the volume of traffic utilizing John F. Kennedy Road and the loss of
some open space.
CIP Investments: None proposed.
Staff Analysis: The applicants are requesting rezoning of approximately 9.95 acres of
land from AG Agricultural to R-1 Single Family Residential. The applicants intend to
develop the property and two adjacent parcels for single-family homes subdivision.
The applicants are anticipating development of 66 lots.
The subject property has been used for agricultural proposes for many years and
located behind the two churches along John F. Kennedy Road near Spring Valley
Drive. The City's Comprehensive Plan designated the area for single and two-family
residential and the proposed rezoning request is in compliance with that designation.
City utilities are available to the site and are adequate to serve the proposed
development of the parcel. As part of the development, storm water control will be
required and will be provided in the southeast comer of the parcel. In addition, erosion
control will be required dudng all phases of development.
Planning Staff recommends that the Zoning Advisory Commission review the criteria for
reviewing rezoning request containing in Section 6-1.1 of the Zoning Ordinance.

ORDINANCE NO. 43-03
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT WEST OF 2915 KENNEDY ROAD FROM AG
AGRICULTURAL DISTRICT TO R-I SINGLE-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from AG Agricultural District to R-1 Single-Family Residential District to wit:
Lot 1 of I Mineral Lot 455 and Lot 3 Mineral 454 and to the centerline of
the adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
