Statement of Merrill Crawford to the Dubuque City Council regarding the
proposed Orchard Park subdivision
April 19, 2010
Thank you and good evening, Mr. Mayor and members of the City Council. My name is Merrill
Crawford and I reside at 2110 Jonathan Lane in the Orchard Hills subdivision, adjacent to the
proposed subdivision that is the subject of this plat. I speak to you tonight on behalf of
concerned residents of the greater Eagle Point neighborhood including the existing Orchard
Hills and Eagle Valley subdivisions, who, for a variety of reasons already in the record, oppose
the particular design, configuration and housing density of the proposed subdivision described
in this preliminary plat.
Further, we welcome the opening of a second street access to Orchard Hills and the Shiras
Valley for emergency vehicles or emergency detour purposes; it’s long overdue. However, we
respectfully request that traffic via that Baldwin Drive link be restricted to those emergency
purposes and that two-way general traffic be prohibited by means of signage and a control
device in the nature of a gate, or a retractable or breakaway barrier.
Mr. Mayor, The record shows that numerous concerns were raised by citizens regarding the
potential for noise as well as windblown and waterborne debris flowing from the proposed
subdivision into the adjacent subdivisions and down Shiras Ave, concerns regarding
infrastructure such as street width, water and sewer capacity, stormwater control, etc. ,
concerns regarding the density of 74 nearly identical small houses with no basements or
garages on small lots in tight rows on narrow streets, the absence of covered storage options
for residents’ vehicles, yard tools, toys, refuse and recycling containers, barbecue grills, lawn
furniture, bicycles, pets; their “stuff”, concerns about inadequate refuge from severe weather,
and anticipated traffic problems, both within the new automobile-dependent subdivision as
well as along Roosevelt Road, and concerns about the negative effects of opening up the
proposed shortcut to general two-way traffic via Baldwin through Orchard Hills and on to
Shiras.
It’s been a challenge to make our point clearly understood on this latter issue, the Baldwin
connection; It seems we can’t repeat often enough the distinction: we say “Yes” to emergency
vehicles and to emergency detours, via Baldwin. Firefighters, paramedics, police officers are
our friends; they’re welcome anytime, and in an emergency, we want them to use the quickest
route to reach us.
But we also fear the safety, noise, and related consequences of two-way general traffic via that
route, with its 85-foot vertical descent through the awkward “s” curve intersection at Baldwin
& Jonathan, down to the slightly tighter-than-90-degree intersection of Jonathan and Orchard
Drive, and the dangerous tendency for vehicles to speed downhill on Shiras past Eagle Point
Park, in an area where the streets are frequented by kids and adults on bicycles, or on foot.
Some have wondered why it seems that we residents of Orchard Hills, who have the most to
gain by a new shortcut to the west, are the very ones who most strongly advocate restricting
that shortcut to emergency vehicles or emergency circumstances. Have we temporarily taken
leave of our senses, or is there, as we believe, a justification that is a higher priority than our
own convenience, in guarding against the loss of a standard of safety and quality of life that,
once gone, would be difficult, if not impossible, to recover?
Mr. Mayor, I believe it is no secret that the influence of Eagle Point reaches well beyond the
gateway entrance into the Park. The bluff which embraces our cherished park rests in harmony
with its immediate neighbors along Shiras and Eagle Point Drive, with the Ham House Museum,
the Dubuque McDonald families’ estate farms, with Four Mounds, and across Roosevelt with
the prairieland of the Sisters of St. Francis, and through Eagle Valley to the bluff that is home to
Sunnycrest Manor. In fact, it’s often hard to delineate where parkland ends and private
property begins.
Every time the residents of Shiras and Orchard Hills come home from work or a long trip, and
make that turn from Rhomberg onto Shiras, Eagle Point reaches out and welcomes us home.
We feel its influence all up and down the Shiras and Roosevelt Valleys, as we go about our daily
lives, caring for our individual properties, watching our kids play in our yards, along the streets
and in the Park. We respectfully suggest that there is a kind of extra care demanded for a
community treasure, that goes beyond simple land stewardship, beyond just meeting minimum
requirements, and which carefully balances our legacy against our immediate need. There
must be a way to develop or to use this property that better harmonizes with the surrounding
residential and parkland areas, and does not risk collateral damage to the properties, or to the
quality of life flourishing here in the shadow of Eagle Point.
Mr. Mayor, that’s why we ask that the Council deny this preliminary plat and waiver request,
that you restrict the opening of Baldwin Drive to emergency uses only, and that, going forward,
you be extremely careful and deliberative as you test and decide the best way to complete one
of the last remaining pieces of the residential puzzle that is the greater Eagle Point
neighborhood. And while we disagree with the recommendation of the Zoning Advisory
Commission this time around, I want to say that both the Commission and City staff have been
respectful and attentive to us and to our concerns over the past 6 months. I know you’ll
appreciate that this has been a stressful time for all concerned.

Message: Honorable Council Members, I am emailing to let you know I am against the passing of the Orchard Park
Subdivision Preliminary Plat tonight. The density of this development WILL cause runoff issues for the unfortunate
neighbors on Shiras, just like Eagle Valley subdivision has. A less dense design is in the best interests of all. To adjoin a
development like this to Orchard Hills and even Eagle Valley subdivision is wrong. I realize the need for housing in Dubuque
but I would implore each of you to consider what is actually being approved here. The out -of -town developer, Curtis
McDonald, has no ties to this community and will be an absentee landlord in this lease -to -own set -up he is working on. The
narrow streets in this neighborhood design will not be sufficient in a neighborhood that will serve as a "cut- through" from
Shiras to Roosevelt. Safety issues are obvious. My farm and homestead adjoin this piece of property and I am opposed to this
type of development. Please take the time to study what is actually being placed on this plat. Thank you for your

Further, to the extent permitted by law and by Council policy, I encourage you to familiarize
yourselves firsthand with the site by driving through Eagle Valley and Orchard Hills to observe
the location of the proposed development, the example homes on Bald Eagle Court, and the
proposed traffic shortcut route between the sharp corner of Roosevelt via Baldwin Drive to
Shiras Ave.

Even though the Zoning Commission passed the preliminary plat for the proposed
Orchard Park Subdivision we are asking that you override the vote and reject the plat. We also
would like for all of you, if it is possible, to look at the area get a true feeling of what is being
proposed.
We are not against building on the proposed site but the manner in which it is being
developed. we are not in opposition to opening up Baldwin because we know it is another way
into the Orchard especially in case of an emergency.
We would like to see homes in the area that meet with the design of the homes
currently in the area. we would like to see homes designed and built that are not stacked right
next to one another and have basements and garages. The homes currently being planned
would be all very much similar with very little differences.
We would also like to point out that our area has without decent water pressure
for a number of years even though the city has been aware of the problem. we also are aware
of the fact that there is not adequate sewer and waste -lines currently in the area which has
been pointed out on many occasions that would just add to the problem with this new sub
division.
1 was one of the people who contacted the neighbors seeking signatures to have the
council override and reject the plat. There was not a siggle person who was not supportive or
refused to sign the petition. Most feel it would do nothing to enhance the value of their horse
and many felt it would lower their property value when sold.
Another area of concern is the access point onto Roosevelt. This street is heavily used
by people going to - the west end and also over to John Deere and other businesses currently.
The road is constantly in need of repair and is not very wide. But the comment was made this
will be addressed when the time comes.
In conclusion one of the members of the Zoning Commission made the comment that
they would not like to have this in their backyard. Please override the vote and reject the plat.

I respectfully request that the preliminary plat for the proposed orchard Park subdivision off Roosevelt
Street be denied and that any future access via Baldwin Drive be for emergency vehicles only.
Opening Baldwin Drive to through traffic is a very real safety issue for drivers unfamiliar with the
intersection at Jonathan Lane, Having lived next to this intersection for 32 years, I know how difficult it is
to negotiate the turn from either direction, especially in the winter. Exiting Baldwin onto Jonathan is
equally hazardous due to the sharp "S” curve accompanied by an immediate, steep sloping decline.
The turn is further complicated from November to March due to frost and/or ice from storms and periodic
thawing and freezing.
Even with periodic inspections, I believe erosion control will be a major problem during construction The
retaining wall behind Bald Eagle Ct. in Eagle Valley is already washing out. Denuding vegetation on the
steep hill behind these homeowners will surely cause additional mud and water damage.
I therefore urge the Council to visit both of these areas to better understand the potential problems
associated with the proposed subdivision.

Dear Dubuque City Council Members,
We have several serious concerns about this proposed subdivision. Please be advised that
we are not opposed to the development of the property adjacent to orchard Mills as was
planned for the original subdivision with approximately 30 homes; however, we strongly
feel that the small, prefabricated rental homes that will be placed in this area are not
appropriate due to the large number of homes and the fact that they do not have
basements or garages.
As we spore with many of our neighbors on Shiras Avenue and Roosevelt Street, all were
concerned about increased traffic as well as the speed of the vehicles and noise that is
already an issue in this area.
Before making a fi nal decision to approve the preliminary plat, please give thoughtful
consideration to the concerns of the entire Eagle Point neighborhood.

I Live at 2165 Jonathan Lane, my property is located where Baldwin is
to be opened. The turn on to Jonathan lane will be very dangerous. I am
very concerned about the increased traffic in this area, especially during
the winter season. Not only the increased chance of a vehicle causing
damage to one of my vehicles or properly, but more importantly, the
increased risks of an accident when my grandchildren and dogs are
playing outside. A vehicle could easily slide right into my front yard
where the children like to play! Many other residents on Jonathan Lane
also have children and grandchildren who come to visit and like to play
outside. Traffic and safety have never before been an issue.
The proposed sub division is made up of prefabricated /two part homes
(mobile /movable) set on small crawl spaces. What is going to happen to
all those so called "buildings" when a severe thunderstorm or tornado
comes through on the high ground they will be situated on? Parts of
these "buildings" will be littered throughout our neighborhoods,
hopefully not human parts. This so called Developer that intends to rent
all of these homes will still be living in Fairfield Iowa, with no one on
site to manage what will happen on this new development. Mr.
McDonald's development plans do not mix well with the present
neighborhoods that presently exist in the eagle point area. The City will
have to rebuild Roosevelt Avenue, add a water tower, bus stops, etc. to
make this "out of town developer's" project safe, when Dubuque
residents are paying for this man's profit. He is not a citizen or a voter of
Dubuque. We are accommodating this new development at the expense
of the Dubuque Tax Payer, which is not in the best interest of Dubuque
and the Eagle Point Area. What is this property going to look like in a
few years, will it be an eye sore on the reputation of Dubuque's
Beautiful and Historic land mark The Majestic Eagle Point Park!
Honorable Mayor and City Council Members:
I am writing this letter to express my concern and opposition to Curtis McDonald's plan to develop the land next to
the Eagle Valley Subdivision out on Roosevelt in its current state. I am all for the development of this property as it
brings many exciting opportunities and prospects for the city of Dubuque as well as the surrounding community.
A lot of my points have probably already been addressed by others. Therefore, I will keep this brief. 1 now this;
one or two houses with no garages or basements- -fine. A WHOLE SUBDIVISION full of houses with no
basements and/or garages AND add high density on top of that? A recipe for disaster for adjacent subdivisions as
well as for City Services -this high density housing project in its current state will create safety concerns, economic
and logistical hardships for Dubuque and its citizens. Two of the five zoning board council members personally
opposed this for that very reason. One stated they would not want this in their backyard. The other stated it was a
glorified trailer park. We welcome more housing being brought to Dubuque, but, please, make sure this project is
executed /planned properly. This isn't about Curtis McDonald building whatever he wants on "his land" --even if he
can legally. This will affect the surrounding community as well as tax payers in the City of Dubuque if not
redesigned and addressed properly. As is with the high density setup and no garages and basements, narrow
streets who wants to live in or near a whole subdivision like that? Do the right thing.

A Nat Known Historical Land Mark in Dubuque Iowa
is about to be over populated with housing developments.
This letter is in regards to the new subdivision to be built in the
Orchard Hills/Eagle valley district of Dubuque Iowa.
One of this areas most beautiful places is about to be swallowed up by 2 part
prefab, unsafe and over crowded housing developments. My concerns are also that
of many other people, who not only live in the Eagle Point .Area, but who visit this
beautiful land mark.
The design of this subdivision to be built is first of all, very dangerous! I am very
ashamed that the city of Dubuque would allow something like this to be built here,
not only are these homes nothing more than glorified mobile homes and a mobile
home park, they are very belittling to people.
Who in their right mind would build a home for a family when their only security
during a storm would be to go out into the storm and into a small crawl space
under their home? Crawl spaces are known to be filled with spiders, bugs and
rats. They also harbor dampness up to many inches of water and are highly known
to contribute to mold infestation, which in itself carries many health risks.
And this has been passed by the majority of our Zoning Advisory Commission!
Also Sub pumps do not get rid of dampness, they only pump water to the outside
of the home, what will happen when all these home's sub pumps are pumping
water at the same time, on the sane hill, to those homes sitting below? who pays
for the damages?
Although the threat of a tornado in the Dubuque area is fairly low, the placement
of these homes are in a prime location if a tornado should occur. However, the
threat of straight line winds from a storm in this area are very likely and often do
occur. These winds have been known to be just as dangerous and damaging as a
tornado. These homes are very likely to be badly beaten from the fierce storms
and winds that come with being built on the highest parts of the city. where will
these families be when their homes are gone, and where is their security and cover
then. First of all, the idea of crawl spaces under your home as a storm shelter in

this day and age, is degrading. It draws a picture in my mind of a dog running
under a porch to take cover, these are not animals that will be living *n these
homes, they are human beings. families with children! Also many elderly people
would not be able to crawl into these places.
Codes need to be looked at, even mobile home areas have to abide by more
security codes than this development has to abide by. It seems to me that
someone's pockets are being lined! Only one member on the Advisory Board said
they would crawl under their home in the middle of the night under these
situations. Another member commented that the families who will be residing in
these homes will not care what their storm shelter is, as long as they have a place
to live. Is that saying these families care less about their children and themselves,
that they would be alright with these living situations? I would_ think NOT! These
families are being stereotyped and spoken for without even knowing it, they are
not getting the safety and security they deserve. we are all Human Beings no
matter what our level of income!
This is not an issue of income or who will be living here. it is an issue of safety
and over crowding in this area. Including the addition to the sewers and streets.
Not to mention how the construction of this subdivision will destroy more than
just the ground. All of these factors will take the Historical value from this area.
This is a peaceful and quiet area full of wildlife and history, it should be kept as
such. where will the wildlife take refuge when THEIR homes are taken? Animal
rights also have to be taken into consideration, as they are continually being
pushed farther into our cities, where they are allowed to be killed. Due to our
taking their land. There is nothing prettier than seeing a Majestic Deer running
through this historical area of Dubuque, along with the Majestic Eagles who nest
here!

As Dubu communit members, we reco the need for developin additional housin options for
new communit members (such as those from the new Hormel plant or IIBM). We understand that our
Dubu is an All-American cit and has an obli to provide the t of housin needed to help
our cit continue to g row and thrive in toda times. That said, as members of the Ea Point
Nei we believe the proposed t of housin is wron for our nei for man reasons.
First, we ask that y ou consider the t and st of housin proposed b Mr. McDonald. The densit of
the plat, 74 small, sin famil homes in the proposed confi is an issue of concern for our
communit The st of the homes - small, without basements, g ara g es, etc., in conjunction with other
similar developed properties in the Ea Valle subdivision - su these properties will likel serve
as rental properties. While we reco that Dubu currentl is in. need of rental properties, as a
planful cit we also must reco that ultimatel we want these new communit members from IBM,
Hormel, and other developin businesses to sta in Dubu While a small rental propert in a hi
densit area with no parkin space and no basement for safet and stora ma meet an immediate need
for the cit and for those new to Dubu this t of nei densit and st of housin is not
ideal for the Dubu communit for attractin lon term residents. The t of densit and st of
housin (please see attached photo of properties under development per realtor b Mr. McDonald in the
Ea Valle Subdivision behind our home — all the properties are the same, ri down to the color of
their shutters!) is also not consistent with the existin properties in our nei (see additional
attached photos of the surroundin nei
The proposed subdivision also includes a re to waive certain street width re so that these
properties can be developed. The Zonin Advisor Commission assured concerned nei that on
paper, the street width re were able to accommodate waste and snow removal services as well
as emer vehicles. While we understand that on paper, the proposed street widths ma potentiall
meet the minimum re the realit of livin on a narrow street (somethin we face each da in
the Ea Valle subdivision) demonstrates that sometimes meetin minimurn expectations simpl isn't
g ood enou for communit members.
Alon Stellar Ea in the Ea Valle Subdivision, there are townhouses with one car g ara g es. The
realit of limited off street parkin is apparent — and these houses do have a one car g ara g e. Even in fair
weather, the streets can prove to be difficult for g arba g e trucks to navi T he winter brin more
challen alon these narrow streets. While cit plows work ver hard to efficientl clear streets, snow
further narrows the streets, and there are times when drivin a car down the narrow width of the street
proves next to impossible, sometimes forcin us to turn around and attempt to access our own street from
another entr point. Thankfull however, in Ea Valle we do have the benefit of parkin in g ara g es
or drivewa which somewhat alleviates the issues of narrow street construction. Mr. McDonald is
proposin a subdivision that has no g ara g es or demonstrated off street parkin and as a communit we
have concern for traffic, con and ade parkin areas for residents.
Another area of concern for communit members re the proposed development is that the
properties are bein built without basements. While we understand that the cit currentl does not have
an ordinance or re that properties be built with ade storm protection,, it does not mean that
as a cit we should not hold our developers to a hi standard. Our state asks that all mobile home
parks be built with a safe storm shelter for residents. These homes — small, manufactured, sin famil
with no g ara g e or basement — are not so ver different than mobile homes, and as a communit we should
demand for them the ver same ri for safet as others in similar t of developments where such
safet is called for b our state. The current proposal b Mr. McDonald not onl does not provide a
basement shelter in each unit for storm/wind issues, but also it does not provide for a separate communal
storm shelter in the event of an emer
Finall as a nei there is g reat concern about the impact of this proposed subdivision on our
environment. Selfishl as lon residents of the tri-state area, if we could take Dubu beautiful
north end and preserve it from here forward, we would. The vistas in the Roosevelt and Shiras area are
amazin the wildlife present (deer, fox, ea and other wildlife) make the existin nei a
beautiful place to live. That said, as mentioned above, we all understand that Dubu needs to continue
to g row and develop, and that we need to work to to ensure that we don't do so at the expense of
our environment. There is concern about how buildin such a development will further displace wildlife
in this area. There is also concern about the impact of storm water runoff and debris as a result of further
developin this area. While the Zonin Advisor Commission noted to residents that such concerns "will
be addressed," no plan for how was articulated b Mr. McDonald to nei durin this process.
In one of the earl meetin with. the Zonin Advisor Commission, Mr. McDonald *indicated that he had
made time to talk with nei for feedback about his proposed housin development. We've y et to
meet a, nei that had the opportunit to discuss the proposed development with Mr. McDonald prior
to plans bein submitted to the Zonin Advisor Commission. As a nei we would have
welcomed the opportunit to dialo about the above listed concems. Instead, our interaction with Mr.
McDonald was primaril throu hearin with the Zonin Advisor commission. As nei we
filled the Commission's chambers with residents from the Ea Point Nei and shared with the
Commission wh we so stron and vocall opposed the development of Orchard Park Subdivision. As
y ou will note, the concerns of not onl residents of the north end communit but also the Zonin
Advisor Commission, stopped the development of Orchard Park subdivision twice at the Zonin
Advisor Commission level. Durin our most recent visit with the Zonin Commission, the Commission
itself noted concerns about the development of the subdivision — the densit the narrow streets, the t
of housin proposed, the lack of a storm shelter for residents,, storm water runoff, and other issues
mentioned above — but shared with the man residents present that while concerns were both heard and
shared b the Commission, the subdivision met the minimum re for approval, and therefor tc...
their hands were tied in terms of recommendin approval to the Cit Council. As nei we left the
Commission meetin extremel frustrated — the voice of the people was present, valid concerns were
presented, the Commission shared our concerns and frustrations, but because the proposal met mini-mum
re it was passed.
As members of the Dubu communit we are askin y ou, our dedicated Cit Council, to raise the bar
and sa no to the development of the Orchard Park Subdivision. We did not become an All-American
cit b meetin minimum re We became an All-American cit b listenin to the voices of
communit members and workin to to find a shared vision for the future of our communit That
is what we ask in this process. As members of these nei we aren't sa we oppose all
development in this area because we know our cit needs to g row. We are sa that we oppose this
development in our communit for the reasons we share throu our turnout at Zonin Advisor
Commission meetin our letters, and our petitions. Please let our collective voices be heard, and allow
us, as a communit to work to to find an option that better serves this land and our g reat cit We
respectfull re that y ou please consider suspendin the rules at y our upcomin meetin so that a
sin nei representative can further explain the issues and challen with the proposed
Orchard Park Subdivision from the perspective of those who have built homes and established true
communit in these north end nei
