SUBJECT: Acceptance of Creekwood Drive Storm Outlet Repair Project
DATE: July 15, 2020
City Engineer Gus Psihoyos is recommending acceptance of the public improvement
contract for the Creekwood Drive Storm Outlet Repair Project, as completed by Top
Grade Excavating, Inc., and authorize payment in the contract amount of$35,882.78.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

RE: Acceptance Creekwood Drive Storm Outlet Repair Project
INTRODUCTION
The enclosed resolution provides for the acceptance of the Public Improvement Contract
for the Creekwood Drive Storm Outlet Repair Project.
DISCUSSION
The Creekwood Drive Storm Outlet Repair Project provided for the repair of the storm
sewer outlet between Lot 8 and Lot 9 in Timber Hyrst Estates #2. The project consisted
of approximately 20-feet of 30-inch pipe between two new manholes and 100-feet of rip
rap to mitigate erosion and facilitate better drainage.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment of
the contract amount of $35,882.78 to Top Grade Excavating, Inc. for the Creekwood
Drive Storm Outlet Repair Project.

The project cost for the Creekwood Drive Storm Outlet Repair Project is summarized

REQUESTED ACTION
I respectfully request adoption of the attached resolution accepting the improvements and
authorizing payment in the contract amount of $35,882.78 to Top Grade Excavating, Inc.
for the Creekwood Drive Storm Outlet Repair Project.

RESOLUTION NO. 213-20
ACCEPTING THE CREEKWOOD DRIVE STORM OUTLET REPAIR PROJECT AND
AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Creekwood Drive Storm Outlet
Repair Project, (the Project) has been completed by the Contractor, Top Grade
Excavating, Inc. (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $35,882.78;
WHEREAS, the Contractor has previously been paid $34,088.64, leaving a balance
of $1,794.14; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $1,794.14 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.
