and the Auditor be notified to draw
a warrant for this amount on the

Peter Theobold addressed the
Council, stating that he is the own-
er of Lot 1 of Min. Lot 93 -B on
Kirkwood Street. He got possession
of this property by foreclosure on a
mortgage, which was in the amount
of $2,000.00; after getting possession
of same he found that there was a
mechanics lien against the property
of $300.00 which he paid, he also
found that there were back taxes and
street assessments against the pro-
perty. He paid $290.78 and there is
still a balance of $243.60 represent-
ing 5 installments, due. Inasmuch
as the property is not worth more
than $1,000, and the assessments foe
street improvement was much too
high when levied, he asks that the
balance due be cancelled.
Councilman Mouser moved that
the balance due for assessments on
this property be cancelled, the Aud-
itor be instructed to draw a warrant
for the amount on the General Fund
to make up the shortage thus cre-
ated and the Treasurer be instruct-
ed accordingly. Seconded by Coun-
cilman Schuckert. Carried by the
following vote:

City Manager Kratz announced
that the garbage contract between
the E. E. Frith estate and the City
of Dubuque will expire in May and
he hereby asks that he be author-
ized to advertise for bids for the col-
lection of garbage.

the City Manager be authorized to
procure bids for the collection of
garbage in the City. Seconded by
Councilman Meuser. Carried by the
following vote:

Mayor Maclay stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing on any business that may prop-
erly come before the meeting.
Petition of Frank M. Blake asking
for a reduction in assessment as
levied against his property for im-
provement of Windsor Avenue, re-
ferred to the Council at a previous
meeting for investigation.
Councilman Schuckert moved that
the petition be received and filed.
Seconded by Councilman McEvoy.

Petition of Nick Wiehl stating that
on the night of January 7th, 1929, at
about 6 o'clock, his son fell into a
trench which was left unprotected.
This trench was dug for the purpose
of connecting the Juvenile Play-
ground (which is now used as a
skating rink), with water mains. He
• presented a bill for medical services
in the sum of $14.00 and asked that
the City pay this bill.
Councilman Meuser moved that
the Auditor be instructed to draw a
warrant for this amount in favor of
Nick Wiehl, in settlement of said
claim, and the City collect this
amount from Lewis & Co, contract-
ors, as this company had the con-
tract for making these water connec-
tions. Seconded by Councilman
Yount. Carried by the following

Nick Wiehl addressed the Coun-
cil relative to the accident and ex-
plained to the Council how it hap-
pened.
Mr. R. R. Lahey, Graf, Iowa, ad-
dressed the Council relative to the
accident on 8th and Main Streets,
when the Fire apparatus while go-
ing to a fire, ran into his car and
wrecked it, he claims that the siren
at this corner was out of order and
furthermore the green light was in
his favor. He stated that his car
was a second hand car when he pur-
chased it about a year and a half
ago, that it was almost new when he
bought it and that he paid $600.00.
for it. He asks that the City pay
him $600.00 in settlement for his car
which was totally wrecked. The car
was an Oakland 6, 1926 model.
Councilman McEvoy moved that
the matter be referred to the City
Solicitor to effect a settlement. Sec-
onded by Councilman Schuckert.

As stated by the City Solicitor at
the last meeting, another petition for
a refund was presented to the Coun-
cil earlier in the year and it was de-
cided at that time to file the request
without granting the refund and for
that reason I recommend that the
request of Mullen Bros. be handled
in the same way.
The $1.00 inspection fee does
not seem an unreasonable fee for
inspection and, if for no other rea-
son, the City should have a full and
complete record of all oil tank in-
stallations.

City Solicitor Czizek stated that
inasmuch as the City has no ordin-
ance covering the installation and in-
spection of oil burners, the City has
no legal right to collect fees for the
installation of oil burners and that
the fees that were collected should
be returned, and no such fees be
collected until the City adopts an
ordinance covering the installation
of such oil burners.
Councilman Meuser moved that
the fees collected for inspection of
oil burners be refunded. Seconded
by Councilman McEvoy. Carried by

the Retaail Merchants Bureau of the
Chamber of Commerce sponsored a
proposed Ordinance which would
amend the existing ordinance regu-
lating Itinerant Merchants.
The City Council, I am informed,
has not as yet disposed of this mat-
ter. I have been requested by the
officers of the Bureau to again take
up this matter with the City Council
and I am writing you to ask if you
will not bring it up at your next
meeting.

interested in the adoption of legisla-
tion which will give the home mer-
chant more adequate protection than
the present ordinance now provides,

Gentlemen: I beg to call your
attention to the fact that, having
voluntarily and for the purpose of
better safeguarding the safety of the
employees, replaced the old elevator
in the building occupied by the Hea-
ly Hardware Co. at 456 Main Street,
I was ordered by the Building Com-
missioner to enclose the entire elev-
ator shaft with fireproof material.
This I believe is contrary to the
Building Code, inasmuch as this is a
replacement and not a new instal-
lation.
Therefore I wish to request that
your Honorable Body take such ac-
tion as will relieve me of the neces-
sity of incurring additional expense,
agreeable to the orders of the Build-
ing Commissioner, which in my hum-
ble opinion is uncalled for by the
Building Code.

Gentlemen: I am transmitting
herewith a Certificate of Acceptance
for the improvement of Plymouth
Street. However, this improvement
is not fully completed. For instance,
the pole connection of the lighting
system on Grandview Avenue will
,have to be extended approximately
four or five feet further up the pole.
This, however, has been arranged
for by Mr. Lee with the Power Com-
pany and we have a letter stating
that they will do this work as soon
as material which they have order-
ed for the job arrives. Also a few
minor matters in connection with
the grading of the improvement have
not been fully completed and sev-
eral other minor matters will need

ing Company as soon as the snow
goes off the ground in the Spring
and I am therefore recommending
the improvement be accepted and
that sufficient money be retained, ap-

Gentlemen: It has been something
like eight years since our Building
Code was first prepared and printed,
and practically no changes have
been made in same since the first
ordinance was prepared.
All City Building Codes should be
revised and kept up to date at least
once every two years, and with that
in mind I wish to recommend that a
standing committee be appointed by
the Council to sit as a Building Code
Revision Committee and pass on all
proposed changes to the code as the
various matters are proposed and to
recommend proposed changes to the
City Council.
I recommend that the committee
be composed of the representatives
from the various architectural firms
in the City, together with the City
Building Commissioner, the City
Building Commissioner to act as
chairman
I am advised that the following
are all the architects doing business
within the City of Dubuque; N. W.
Fischer, F. Heer, C. I. Krajewski,
K. F. Saam.

Whereas, the improvement of

same has been fully completed and
accepted by the City Council of the
City of Dubuque, and
Whereas, this Council has deter-
mined upon the issuance of bonds
in the manner and form provided by
Chapter 311 of the Code of Iowa,
1927, to defray the cost thereof,
namely in the total sum of $11,998.14.
Now therefor, be it resolved by
the City Council of the City of Du-
buque that in order to pay the cost
of the construction of the public im-

declared the intention of this Coun-

An Ordinance renaming a portion
of 26th Street, some times referred
to as 29th Street, and calling said
street a part of Lawther Street.
Whereas, 26th Street was origin-
ally established running easterly
from Central Avenue to a point east
of Pine Street, and in 1896, by the
adoption of an ordinance, said street
was extended in a southerly and
easterly direction to Burden Street
and such extension was given the
name of 26th Street also; and
Whereas, in 1907 the name of 26th
Street was changed to 29th Street;
and
Whereas, in 1918, a plat of Bel -
mond Addition was placed on record
and approved by the Council and
on said plat that portion of 26th
Street lying between Burden and
Brunswick Streets was designated as
Lawther Street; and
Whereas, 29th Street has been re-
named East 29th Street; and
Whereas, it is deemed necessary
and advisable to rename that por-
tion of 26th Street which ext€pads
southerly and easterly from East
29th Street to Burden Street. Now
therefore,
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That that portion of
26th Street which extends southerly
and easterly from East 29th Street
to Burden Street be and the same is
hereby named and called Lawther
Street, so that hereafter Lawther
Street shall be designated as extend-
ing from the West property line of
Windsor Avenue to the south pro-
perty line of East 29th Street.
Sec. 2. That the City Clerk be
and he is hereby directed to cause
to be filed in the office of the re-
corder of Dubuque County, Iowa, a
certified copy of this ordinance.

Whereas, some doubt has arisen
as to the reappointment of certain
members of the Board of Trustees
of the Carnegie -Stout Free Public
Library, and it is deemed necessary
and advisable to clarify the records
regarding such re- appointments:
Now therefor be it resolved by the
City Council of the City of Dubuque,
that:
The appointments of the present
encumbents on the Board of Trus-
tees of the Carnegie -Stout Free Li-
brary be and the same are hereby
confirmed and the time when their
respective terms of office shall term-
inate be and the same is hereby
fixed and established as follows:
The term of office of Mrs. Richard
McKay, Dr. John Hancock and M.
H. Czizek, shall expire on July 1,
1929.
The term of office of Charles Mc-
Lean and Frank R. Lacy shall ex-
pire on July 1, 1931.
The term of office of Henry Gniff-

City Solicitor Czizek reported as
follows on the delinquent assess-
ments of John Klecner, on lot 116
Union Add. for the improvement of
Quince St. in 1915, stating that the
original assessment was $194.27, this
property was purchased by the City
at tax sale in 1921 for $194.27 with
interest and penalties amounting to
$241.64; the City holds the tax sale
certificate. Mr. Klecner offers to
pay $50.00 in settlement of this as-
sessment. The City Solicitor recom-
mends that the City accept this
amount.
Councilman Schuckert moved that
the recommendation of the City So-
licitor be approved and the Treas-
urer be instructed to accept from
John Klecner $50.00 in full of settle-
ment and upon receipt of same can-
