Present —City Manager Kratz, Mayor Andelfinger, Councilmen Jan- + cen, McEvoy, Meuser, Schuckert. Absent —None. Mayor Andelfinger stated that this is the regular monthly meeting of the Council for the purpose of trans- acting any business that may come before the meeting, and that this date was also fixed for the levying of special assessments for the im- provements of Burch Street from the north property line of Fenelon Place to the South property line of Hill Street, Spruce Street from Julien Avenue to Wilbur Street, Spruce Street from Wilbur Street to Jeffer- son Street, Sanitary Sewer in Wil- bur Street, constructing sewer and water connections in West 17th Street and Clark Street, considering bids for the construction of a sani- tary sewer in Alley between Argyle and Burden Streets, and hearing tax- payers for and against the Tax Bud- get Estimate for 1930. Notice of publication, certified to by the publisher of the City Coun- cil's intention to levy a special as- sessment and issue bonds for the im- provement of Burch Street from the North property line of Fenelon Street to the South property line of Hill Street, amount of assessment $2,296.76, J. Resolution No. 434-29 A RESOLTJTION Providing for the Issuance of Public Improvement Bonds. Whereas, the contract heretofore entered into by the City of Dubuque for the improving of Burch Street, hereinafter described, has been com- pleted and said improvement has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $2,296.76. And whereas, public notice as pro- vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held • pursuant thereto, and all objections filed thereto have been considered and determined: Nov, therefore, be it resolved by the City Council of the City of Du- buque that to provide for the cost of improving Burch Street from the north property line of Fenelon Street to the south property line of Hill Street there be issued improve- ment bonds to the amount of $2,296.76. Said bonds shall be is- sued under the provisions of Chap- ter 311 of the Code of Iowa, 1927, which bear date as of the 5th day of August, 1929; shall be in the de- nomination of $200.00, except that there shall be one bond to the amount of $96.76. They shall be num- bered from 1956 to 1967 inclusive and shall be divided into ten series of which the bond numbered 1956 shall constitute the first series and shall be payable the 1st day of April, A. D. 1930; the bond numbered 1957 shall constitute the second series and shall be payable the 1st day of April, A. D. 1931; the bond number- ed 1958 shall constitute the third series and shall be payable the 1st day of April, A. D. 1932; the bond number 1959 shall constitute the fourth series and shall be payable the 1st day of April, A. D. 1936; the bonds numbered 1960 and 1961 shall constitute the fifth series and shall be payable the lst day of April, A. D. 1934; the bonds numbered 1962 and 1963 shall constitute the sixth series and shall be payable the lst day of April, A. D. 1935; the bond numbered 1964 shall constitute the seventh series and shall be payable the 1st day of April, A. D. 1936; the bond numbered 1965 shall constitute the eighth series and shall be pay- able the 1st day of April, A. D. 1937; the bond numbered 1966 shall con- stitute' the ninth series and shall be payable the 1st day of April, A. D. 1938; the bond numbered 1967 shall constitute the tenth series and shall be payable the 1st day of April, A. D. 1939. • Said bonds shall bear interest at the rate of five per cent per annum which interest shall be payable semi- annually, in accordance with the Regular Session, August 5th, 1929 terms of the coupons thereto attach- ed; and said bonds shall be payable out of the proceeds of the special assessment levied for said improve- ment. Both principal and interest shall be payable at the office of the City Treasurer in the City of Dubuque. Said bonds shall be substantially in the following form: No. Series No. CITY OF DUBUQUE IMPROVEMENT BOND The City of Dubuque in the State of Iowa promises to pay as herein- after mentioned to the bearer here- of, on the first day of April, A. D. 19 , or any time before that date at the option of the City, the sum of $200.00 with interest thereon at the rate of five per cent per annum, pay- able on the presentation and sur- render of the interest coupons here- to attached, both interest and prin- cipal are payable at the office of the City Treasurer in the City of Du- buque i nthe State of Iowa. This bond is issued by the City of Du- buque pursuant to and by virtue of Chapter 311 of the Code of Iowa, 1927, and in accordance with a reso- lution of the City Council of said City, duly passed on the 5th day of August, 1929. This bond is one of a series of twelve bonds, eleven for $200.00, numbered from 1956 to 1966 inclusive, and one for $96.76, num- bered 1967, all of like tenor and date and issued for the purpose of improv- ing Burch St. from the north pro- perty line of Fenelon Place to the south property line of Hill Street, and described in said resolution; which cost is assessable and levied along said improvement, and is made by law a lien on all abutting or ad- jacent property, and payable in ten annual installments, with interest on all deferred payments at the rate of five per cent per annum, and this bond is payable only out of the money derived from the collection of said special tax, and said money can be used for no other purpose. And it is hereby certified and recited that all the acts and condition and things required to be done precedent to and in the issuance of this series of bonds, have been done, happened and performed in regular and due form as required by said law and resolution; and for the assesments, collections and payment hereon of said special tax, the faith and dili- gence of said City of Dubuque are hereby irrevocably pledged. In witness whereof the City of Du- buque by its City Council has caused this bond to be signed by its Mayor and countersigned by its City Clerk, with the seal of said City affixed this 315 5th day of August, 1929, and has authorized the use of their fac- simile signature to the interest coupons thereto attached. Be It Further Resolved that the Mayor and City Clerk be and they are hereby instructed to cause said bonds to be prepared and when so prepared to execute said bonds, and that the City Clerk be and he is hereby instructed to register said bonds in a book to be kept by him for that purpose, and to then deliver them to the City Treasurer who will also register them in a book to be kept by him for that purpose. Be It Further Resolved that the City Treasurer be and he is hereby instructed to sell said bonds in the manner provided by law, the pro- ceeds of said sale to be kept in a special fund to be known as Im- provement Fund. Be It Further Resolved that the interest coupons attached to the bonds be signed with the fac - simile signature of the Mayor and counter- signed with the fac - simile signature of the City Clerk. Be It Further Resolved that as fast as funds allow, beginning with the second year after the payment of interest due, these bonds shall be called and retired in the same order as numbered. Gentlemen: In regard to the pav- ing of Central Avenue, the City Engi- neer's office is doing everything pos- sible to expedite the work on this improvement which is a very diffi- cult and complicated one due to the fact that the curbs are being moved back two feet and various changes are being made by the public utility companies, and in preparing a pro- gram of procedure in order to elim- inate as much confusion as possible, it has occurred to us that it would be almost necessary to use quick - setting cement in all intersections, otherwise the territory east of Cen- tral Avenue will almost be cut off from the territory west during the curbing period and will cause a great veal of confusion of traffic. It is therefore recommended that the ' Council authorize the contractor to use quiek- setting cement which he has agreed to use and charge the City only the additional cost be- tween ordinary cement and the quick - setting cement or approximately $1.30 per barrel, the City Engineer having estimated that the additional cost caused by the use of quick - setting cement will be approximately $2,900.00 and as this cost cannot be assessed to the property owners, it would have to be paid out of the Public Improvement Fund. To the Honorable Mayor and City Council, Dubuque, Iowa. Gentlemen: From May 1st to the present date the City of Dubuque has been collecting garbage within the city limits. At first we were dump- ing the garbage outside the city lim- its and as you know the Board of Trustees of Table Mound Township enjoined the City from dumping gar- bage in their township. We are now dumping our garbage at the foot of 12th Street within the city limits, forming what is known as a sanitary fill, a method being used by a large number of cities throughout the world and with satis- factory results. (For the Council's information I am attaching hereto a copy of an article appearing in the Engineering News- Record of August 8th, 1929, describing the dumping of garbage in . like manner in Seattle, Washington). Within the past few weeks the County Attorney has informed both the Council and myself that in his opinion the City is violating a state law by dumping garbage on ,land which he claims is subject to over- flow. As the Council already knows, im- mediately upon the return of our City Attorney from his vacation, his opinion on the matter was sought. Our City Attorney, after carefully examining the law, has informed both the Council and myself that he is unable to conclude whether or not our method of disposing of gar- bage is in violation of the state laws, as there has never been a ruling of the courts in the state on the mat- ter. He stated, however, that if a literal interpretation of the statute were adhered to the dumping of gar- bage, as we are now doing, would constitute a violation, but if the court should rule that it is necessary to constitute a violation, to show that the garbage will by reason of the overflow pollute the adjacent streams and further finds that the covering being placed on the gar- bage will prevent this, then there would be no violation of the statute, however, he stated this matter could never be decided until action is tak- en by the court. Some agitation has arisen against the City handling the garbage col- lection, a feeling that the work should be done privately and inas- much as the City Attorney is in doubt on the legality, I am recom- mending to the City Council that the City discontinue the collection of garbage and that the Council author- ize and direct me to advertise for bids for a contract covering the col- lection of garbage in the City. Personally I feel that if the dump- ing of garbage at the foot of 12th Street and adjoining lands is not in violation of the laws, that a saving of from four to six thousand dollars a year for the taxpayers can be made. However, I am of the opin- ion that even a saving of six thou- sand dollars a year is not worth while in the face of the hatred and dissension which the collection of garbage by the City has engendered and therefore in the cause of com- plete harmony I am recommending that the City advertise for bids for the collection of garbage. Dear Sir: I wish to call your at- tention to section 2389 of the Iowa Code as amended in chapter 67 of the Forty -third General Assembly, regarding the appointment of the Registrar of Vital Statistics. This Statute as amended follows: Local Registrar— Appointment— Tenure. The Board of Supervisors appoint the registrar in each county, except that such appointment shall be made by the local Board of Health in cit- ies having a population of 35,000 or more. The term of each local regis- trar shall be four years and he shall serve until his successor shall be ap- pointed and qualified. These figures were apparently taken from government sources and it was stat- ted that the birth rate in Dubuque was especially low, the death rate high and the infant mortality seemed much greater than in any other city in the State. The figure as indicated in the editorial stated that our in- fant mortality in Dubuque was 91.3 while records show that it was only 59.9. There is a marked discrep- ency in the figures. At the time I was appointed Di- rector of Health it was indicated that the Vital Statistics would be taken away from the Health Depart- ment and I proceeded to see Mr. Mel- chior, the Mayor about the situation. He interviewed _ Mr. O'Brien, chair- man of the Board of Supervisors, and Mr. O'Brien stated that 110 change would be made, however, notice appeared in the local news- paper the following day the Clerk of the District Court had been ap- pointed Local Registrar and so the records were taken away from this Department. At the present time Mr. Marshall, Local Registrar, has not only Julien Township, which includes the City of Dubuque but also the townships of Center, Dubuque, Mosalem, Wash- ington, Prairie Creek, Vernon, ,and Table Mound. It can therefore, be seen that all of the Vital Statistics which are recorded in the Clerk's office include a number of rural town- ships and have no bearing on the City of Dubuque. Since April, 1928, this department has been attempting to include Vital Statistics in our monthly reports, but these . Vital Statistics necessarily in- clude seven rural townships and we have no way of separating the city statistics from the county statistics. This Department is primarily in- terested in what is actually going on in the City so that we may have some definite knowledge of what our health conditions are at any partic- ular time. It is obviously unfair to have the city's infant mortality rate increased by infant deaths which may occur in any of the seven townships men- tioned above. The Health Department of any City is the logical place for the keep- ing of Vital Statistics pertaining to that particular City. The above mentioned statute went into effect this month and I would appreciate it very much if you would call the attention of the City Coun- cil sitting as a Board of Review to the amended section 2389 in refer- ence to the appointment of the Health Director as the Registrar of Vital Statistics for the City of Du- buque. Rhoades presented a commu- nication and addressed the Council, representing the Automobile Club, relative to improving the boulevard system in Dubuque. Some Suggestions for Improvement of the Boulevard System in Dubuque. —1— The first and most important sug gestion would be the making of the arterial route on 14th Street from Locust to Jackson Street a boule- vard or through street. The reason for this suggestion is that it is the usual custom all over the country for an arterial highway to be a 'stop" Special Session, August 16th, 1929 355 street, and tourists and strangers traveling these numbered routes are so accustomed to consider an arter- ial highway a stop street that there is imminent danger in their taking for granted that they have the right of way over the streets crossing 14th between Jackson and Locust that some serious accidents will occur in the future. —2— The second suggestion is to elim- inate 8th and 11th Streets are boule- vards from Locust Street east. There is no particular reason why these streets should be boulevards. —3 -- The third suggestion is the lower- ing of the stop signs at Jackson Boulevard at the earliest possible moment convenient to the City to a height not exceeding the height rec- ommended by the highway engineers so as to place these signs within easy vision of motorists. —4— The fourth suggestion is the pas- sage of an ordinance prohibiting the parking within twenty -five feet of a boulevard stop sign. The reason of this is because the obscuring of the stop sign may cause somebody to injure someone, even though they are familiar with the fact that a stop sign is there. It might slip their inind and cause a serious accident. We firmly believe this will work no hardship that is not more than com- pensated for by the factor of added safety. •-5— The fifth suggestion is that there be a distinction between a boulevard and a through street or arterial high- way. We 'would suggest the making of Grandview Boulevard and Jackson Boulevard, boulevards in the truest sense of the word by not allowing any commercial traffic on these boulevards. The rest of the present boulevards, following the changes suggested, we vould suggest designating them as either through streets or arterial highways, and allowing commercial traffic on them the same as pleasure car traffic. The "No Left Turn" signs on Stop and Go lights should be lighted. These are just a few of the sug- gestions that ought to be considered for the bettering of the boulevard :system. After considerable debate on the subject, the matter was referred to the City Solicitor to revise the Street Traffic Ordinance. No further action was taken at this time. Dr. Connell, Health Director, ad- dressed the Council relative to the Registrar of Vital Statistics, stating that the office of Vital Statisics in 356 Special Session, August 16th, 1929 the City of Dubuque should be lo- cated in the Health Office in the City Hall. The matter was laid over to the next meeting of the Council. No motion. City Manager Kratz reported on the matter of R. Mathis, stating that when Kaufmann Avenue was im- proved and widened some years ago the City used some of his land to widen the street for which he claims he never received anything. He is willing, however, to deed this ,prop- erty to the City providing the City. - cancel an assessment levied against him for the construction of the sani- tary sewer in Reeder Street amount- ing to $155.44 and $10.00 on the Val- ley Street sewer amounting to $165.44. Whereas, the contract heretofore entered into by the City of Dubuque for the improvement of Ann Street, hereinafter described, has been com- pleted and said improvement has been accepted by the City Council of said City and the City Engineer has computed the cost and expense thereof to be $4,066.25. And Whereas, public notice as pro= vided by law, has been published by the City Clerk stating the intention of the City Council to issue bonds to pay the cost of said improvement and a public hearing has been held pursuant therto, and all objections filed thereto have been considered and determined: Now, therefore, Be It Resolved by the City Council of Dubuque that to provide for the cost of improving Ann Street from the west property line of Garfield Avenue to the east property line of Lincoln Avenue there be issued improvement bonds to the amount of $4,066.25. Said bonds shall be issued under the pro- visions of Chapter 311 of the Code of Iowa, 1927, which bear date as of the 26th day of August, 1929; shall be in the denominations of $300.00, except that there shall be one bond to the amount of $166.25. They shall be numbered from 1999 to 2012 inclu- sive and shall be divided into ten series of which the bond numbered 1999 shall constitute the first series and shall be payable the 1st day of April, A. City Council, Dubuque, Iowa: Gentlemen: We, the Dubuque Automobile Club, representing thir- teen hundred members, petition the removal of the Stop and Go lights at Fourth and Main Streets. Our rea- sons for this petition are these: We do not believe the traffic is heavy enough to necessitate Stop and Go lights at this intersection. The in- cline leading up to the Stop and Go lights from the east is a dangerous incline to stop on and much diffi- culty is experienced by motorists who have to stop here in getting started. We believe that stop signs placed on Main Street, stopping the Main Street traffic will be sufficient and comply with the state law. We also petition the removal of the Stop signs on Locust Street from Delhi and Asbury Streets in north- erly, easterly and southerly direc- tions on St. Ambrose and Locust Streets to Fourteenth Street. The reason for this petition is that stop signs were placed there originally when this was an arterial highway, and as this is not an arterial high- way at present, we do not believe that they serve any reasonable pur- pose and just add an additional cost and expense to the city and create unnecessary restrictions on the mo- torists of the community. Langworthy's Sub., has been com- pleted and the City Manager has examined the work and filed his cer- tificate stating that the same has been completed according to the terms of the contract, plans and specifications and recommends its acceptance, now therefor Be It Resolved by the City Coun- cil of the City of Dubuque, that the recommendation of the City Man- ager be approved and that said im- provement be and the same is here- by accepted and the City Engineer be and he is hereby directed to pre- pare a plat and schedule showing the lots or parcels of real estate subject to assessment for said improvement and file the same in the office of the City Clerk subject to inspection and said Clerk shall upon receipt of such plat and schedule publish the notice of the Council's intention to levy special 'assessments therefor, as re- quired by law.
