SUBJECT: Ice Harbor Flood Gate Abutment Repair Project - CIP #7202792
DATE: July 29, 2020
Public Works Director John Klostermann is recommending acceptance of the
construction contract for the Ice Harbor Flood Gate Abutment Repair Project, as
completed by Tricon General Construction, Inc, in the final contract amount of$79,641,
which is a 9.09% increase over the original contract amount of $73,000. The increase
in the project cost is due to the increase of the actual square footage of concrete repair.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The attached resolution provides for the acceptance of the construction contract for the
Ice Harbor Flood Gate Abutment Repair Project CIP# 7202792.
BACKGROUND
The fiscal year 2020 Capital Improvement Project budget provided funds for the repair
of the concrete abutments at the Ice Harbor flood gate control structure.
DISCUSSION
Bid documents and specifications for this project were prepared by I IW Engineers. This
project included the selective demolition of existing damaged concrete and the
installation of galvanized bent plates on abutment corners including grouting and
installation of adhesive anchors.
Tricon General Construction, Inc. of Dubuque has completed the work for a final contract
amount of$79,641.00. This amount is a 9.09% increase over the original contract amount of
$73,000.00. The increase in the project cost is due to the increase of the actual square footage
of concrete repair. The pricing for this type of additional work was established in the bid
documents prior to the start of the project.
BUDGETIMPACT
The cost estimates for the project are as follows:

This project is funded with monies budgeted specifically for the Ice Harbor Flood Gate
Abutment Repair Project in the Public Works Department's FY 2020 Capital
Improvement Project budget: CIP# - 7202792 in the total amount of$190,000.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements and authorizing payment of the final contract amount of$79,641.00 to
Tricon General Construction, Inc. for the Ice Harbor Flood Gate Abutment Repair
Project.

RESOLUTION NO. 232-20
ACCEPTING THE PUBLIC IMPROVEMENT CONTRACT FOR THE ICE HARBOR
FLOOD GATE ABUTMENT REPAIR PROJECT AND AUTHORIZING THE FINAL
PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Ice Harbor Flood Gate Abutment
Repair Project (the Project) has been completed by the Contractor, Tricon General
Construction, Inc.(Contractor), and the Project Engineer, Lauren Ray (Engineer) of IIW
Engineering, has examined the work and signed a certificate stating that the Project has
been completed according to the terms of the Public Improvement Contract and that the
Engineer recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $79,641.00; and
WHEREAS, the Contractor has previously been paid $75,658.95, leaving a balance of
$3,982.05; and
WHEREAS, the City Council finds that the recommendation of the Project Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The recommendation of the Project Engineer is approved, and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Ice Harbor Flood Gate Abutment Repair Project CIP appropriations for the contract
amount of $79,641.00 Tess any retained percentage provided for therein as provided in
Iowa Code.
Section 3. The Finance Director is hereby directed to pay to the Contractor the balance
of the retainage of $3,982.05 as provided in Iowa Code Chapter 573, and to pay such
retainage in accordance with the provisions of Iowa Code Chapter 573 or Iowa Code
Chapter 26.13.

Dear Mr. Klostermann:
An inspection of the Ice Harbor Flood Gate Abutment Repair project has been completed.
Tricon General Construction, Inc. of Dubuque, lowa, has completed construction of the above referenced Project in compliance
with the drawings and specifications. The final project construction cost is$79,641.00.
We recommend that the City of Dubuque approve and accept the Ice Harbor Flood Gate Abutment Repair project work. Retainage
in the amount of$3,982.05 will be held for 30 days after acceptance and paid at that time provided no claims from others are filed.
Approval and acceptance starts the two year warranty period.
