Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant said that the request is to rezone 7 acres of the Spiegel Family Realty
Company's property located along the Highway 61 frontage on Dubuque's south end
from County R-2 Single-Family Residential to City R-2 Two-Family Residential zoning
district. The applicant noted that the request was concurrent with an annexation
request. The applicant said that the Spiegel Family Realty had rezoned approximately
100-acres abutting the subject property to the north last year and should probably have
included the 7 acres. The applicant said that the property could potentially provide a
secondary access to the Silver Oaks Subdivision and provide additional residential lots.
There were no public comments.
Staff reviewed the staff report, noting the property's location, current access and
surrounding land use. Staff stated that the property included a .60-acre remnant parcel
owned by the lowa Department of Transportation. Staff said that the request
represented an expansion of the 100-acre City R-2 subdivision to the north of the
subject property. Staff said that the property could be served by City water and sanitary
sewer would be available when the subdivision to the north is developed. Staff said that
the rezoning is concurrent with a request to annex the subject property.
The Zoning Advisory Commission discussed the request, noting that as it represented
an expansion to an existing City R-2 district abutting the subject property, it is
appropriate.

Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property has historically been utilized for agricultural
production. The property was platted in September 2015 as part of a residential county
subdivision.
Physical Characteristics: The subject property is located east of the U.S. Highway 61
right-of-way and northeast of Cycle Club Lane. The Wilderness Heights residential
subdivision abuts the subject property on the east. The property is sloped dropping
approximately 150 feet in elevation over 700 linear feet from the highpoint along the
south property line to the low point to the north. The property is bisected north to south
by a drainage. The property has over 700 feet of frontage along the U.S. Highway
61/Cycle Club Lane frontage. The property includes an approximately .6-acre parcel in
the northeast corner of the lot owned by the lowa Department of Transportation.
Imagine Dubuque Comprehensive Plan Recommendations: The Imagine Dubuque
Comprehensive plan encourages a mix of housing types throughout the city making
some affordable for all segments of the community. This goal includes options for first-
time homeowners.

Impact of Request on:
Utilities: City water is available to the site through the IDOT property to the
northwest corner of the Spiegel Family Realty Company property. The water
capacity is adequate to serve the proposed development. Sanitary Sewer
terminates along the Elmwood Dr right-of-way north of the subject property.
Sanitary sewer will eventually be extended to the residential subdivision planned
for the abutting property to the north and will have adequate capacity to serve the
site.
Traffic Patterns/Counts: IDOT traffic counts indicate over 17,000 vehicle trips per
day along U.S. Highway 61 north of the subject property. The change from a
county subdivision to a city subdivision should generate very little additional traffic.
Public Services: Existing public services, given future extension of sanitary sewer,
are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided that any future development of the property complies with
established City standards for storm water management and erosion control.
Adjacent Properties: The proposed rezoning to R-2 Two-Family residential allows
single-family residences and duplexes. The adjacent property to the north is
cultivated agricultural land and to the west is the 300 foot plus wide IDOT right-of-
way. There is a single-family subdivision located in the county to the east with
eight one-acre plus lots. The one-acre parcel to the south of the subject property is
partially under cultivation and accommodates a 6,000 square foot metal
contractor's building.
The proposed rezoning should have very little impact on the adjacent uses.
CIP Investments: None proposed.
Staff Analysis: The applicant's request is to rezone property that includes 7.05 acres
owned by the Spiegel Family Realty Company lowa LLC and a .6-acre vacant lot
owned by the lowa Department of Transportation from County R-2 (single-family
residential) to City R-2 (two-family residential) in conjunction with annexation. The
property is located on the city's far south side along U.S. Highway 61 approximately '/z
mile north of the north entrance to the Dubuque Regional Airport. The property is
currently partially cultivated and partially vacant.
The property is located in the county and is bordered by vacant or cultivated land, the
IDOT right-of-way and an 8-lot county single-family subdivision. Within the past four

years, the City of Dubuque has installed water and sewer service to the airport. Water
is readily available to the subject property; however, sanitary sewer will eventually be
extended to the residential subdivision planned for the abutting property to the north.
The density and residential type (single- or two-family houses) permitted by the R-2
district standards will generate little additional traffic and will be compatible with the
adjacent county residential development. Although the subject property has frontage
along the U.S. Highway 61 right-of-way and Cycle Club Lane and abuts a future
subdivision to the north, access to the property has yet to be determined. Any future
subdivision of the property will be subject to the standards established by the City
regarding storm water management, street access and design and extension of utilities
through the subdivision process.
Recommendation
Planning staff recommends that the Zoning Advisory Commission review the
information provided with this packet and forward a recommendation regarding the
rezoning to the City Council in accordance with Section 16-9-5 of the Unified
Development Code for zoning reclassification.
