Iowa Department of Economic Development Notice of Board ActionApril 8, 2010 Mr. Bob Johnson Sustainable Neighborhood Builders, Inc. 1079 Elm Street Dubuque, IA 52001 NOTICE OF BOARD ACTION RE: Iowa Brownfield/Grayfield Tax Credit Program Application Award Date: December 17, 2009 Dear Mr. Johnson: I am pleased to inform you that the Iowa Economic Development Board (Board) has reviewed your application and intends to award Sustainable Neighborhood Builders, Inc. the Brownfield Redevelopment Tax Credit, maximum credit of $100,000 for your project in Dubuque, Iowa. In a few weeks, our office will send you the necessary contract documents to finalize the terms and conditions of your company's participation in this financial assistance award program. The contract documents must be signed by authorized representatives of Sustainable Neighborhood Builders, Inc., and IDED. This Notice of Board Action is subject to execution of a written contract. This Notice does not constitute the formation of a contract between the Iowa Department of Economic Development (IDED) and Sustainable Neighborhood Builders, Inc. You do not acquire any legal or equitable rights until a contract containing the terms and conditions acceptable to IDED has been executed. Incurring costs related to this Project before a contract is signed is a risk analysis decision for Sustainable Neighborhood Builders, Inc. Until a contract is executed, IDED has no obligation to authorize tax benefits for allowable Project costs. If a contract is not signed, those costs will not be reimbursed by IDED. If a contract is executed, IDED's standard contract language permits expenditures as of the Award Date stated in this letter to be eligible Project costs.
