City Engineer Gus Psihoyos is recommending acceptance of the Hempstead Safety
Improvements — Crosswalks & Geometrics Project Phase 1, as completed by McDermott
Excavating, in the final contract amount of $97,070.52, which is a 16.4% increase from
the original contract amount of $83,403.51. This increase was due to unforeseen storm
sewer relocation work and a requirement for additional drainage tile.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract
for the Hempstead Safety Improvements — Crosswalks & Geometrics Project
Phase I.
The Hempstead Safety Improvements — Crosswalks & Geometrics Project Phase
1 provided for the:
— Installation of fiber optic conduit, handholes and miscellaneous concrete
foundations to accommodate ITS traffic signals.
— Reconstruction of the Hempstead High School bus driveway exit on
Pennsylvania Avenue, east of Rosemont Street.
— Construction /reconstruction of sidewalk, curbing, driveway and access ramp.
The Hempstead Safety Improvements — Crosswalks & Geometrics Project Phase
1 has been completed by McDermott Excavating of Dubuque, Iowa, in the final
contract amount of $97,070.52, which is a 16.4 increase from the original
contract amount of $83,403.51. This increase is due to unforeseen storm sewer
relocation work near the location where the mastarm foundations were located.
Additional drainage tile was also placed along the sidewalk on the North side of
Pennsylvania Avenue.
I recommend that the City Council accept the improvements and establish the
final contract at $97,070.52.

ACCEPTING THE HEMPSTEAD SAFETY IMPROVEMENTS - CROSSWALKS AND
GEOMETRICS PROJECT PHASE 1 AND AUTHORIZING THE PAYMENT OF THE
CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the Hempstead Safety
Improvements - Crosswalks and Geometrics Project Phase 1(the Project) has been
completed and the City Engineer has examined the work and filed a certificate stating
that the Project has been completed according to the terms of the Public Improvement
Contract and that the City Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Hempstead Safety Improvements Capital Improvement Project (101 -2077)
appropriation for the contract amount of $97,070.52 less any retained percentage
provided for therein as provided in Iowa Code chapter 573, and to pay such retainage
only in accordance with the provisions of Iowa Code chapter 573.
